a. (S//NF) Summary: JTF GTMO previouslyassesseddetaineeasTransferto the Control
of AnotherCountryfor ContinuedDetention(TRCD) on22 November2003.
For this updaterecommendation,detaineeis assessedasa low-levelmemberof Al-Qaida's
TerroristNetwork. Detaineeis assessedto be a memberof theAnti-CoalitionMilitia (ACM)
who plannedto conductinsurgentoperationsagainstU.S. SpecialForces(USSF)andCoalition
membersbasedin the Jalalabad,AF area. Detaineewas oneof two individuals capturedwith
improvisedexplosivedevices(IEDs) during the raid on an Afghan National Army (ANA)
compoundon29 January2003. The IEDs wereto be attachedto bicyclesandmotorcycles,
parkednearUSSFiCoalition targets,andthenremotely detonated.It hasbeendeterminedthis
detaineeis a MEDIUM risk, ashemay posea threatto theUS, its interestsandallies.
4. (S//NF) Detainee Background Summary: Unlessotherwisenoted,thefollowing
paragraphsarebasedsolelyon the detainee'sstatements.
a. (S) Prior History: Detaineeis a24-yearold AfghanNationalArmy military officer.
Detaineeis a memberof the Sayedtribe (partof thePACHA religioustribe). He hasbeen
marriedfor sevenyearsandhastwo children. Detaineepossessesa tenth gradeeducation
andleamedto readandwrite at the MadrassaMalackyar Hotack Lecyee,Jalalabad,AF.
According to detainee,he thenmovedto Peshawarto fight againstthe Taliban.
b. (S) Recruitment and Travel: Detaineeworkedasa soldierfor Haji Qadir,(governor
of Jalalabadandbrotherof Haji Daoud). Haji QadiropposedtheTalibanandAl-Qaida
regimes. Detaineestatedthat he hadno rank, but wasconsidereda "small commander"for
Qadir. Detaineedirectly supervised15men. Detaineestatedthathe andhis soldierstraveled
to Shenwar,AF, (nearJalalabad,AF) wherethey fought the Taliban andAl-Qaida soldiers.
The Taliban capturedthem and 120other soldiersduring the first week of fighting. He was
eventuallytakento the Sarpoozaprison in Kandahar,AF. While imprisonedat Sarpooza,he
statedhe wasbeatenandtorturedby the Taliban. Detaineeclaimedthat his two front teeth
wereknockedout asa result of a beating. Detaineestatedthat he was in the Sarpoozaprison
for "no lessthanfive (5) years". He claimshe wasreleasedwhenthe Talibanfell from
power, andthat United StatesandAllied forcesfreedhim from prison.
c. (S) Training and Activities: After his releasefrom the Sarpoozaprison,detainee
receivedinformation that Haji Qadir was offering his soldiersfive hundred(500) Pakistani
rupeesto acceptajob in the future. Insteadof going home,detaineestatedthat Qadir invited
him to the Govemor's housein Jalalabad.According to detainee,this meetingoccurred
during the holy month of Ramadan. Qadir thankedthe soldiersfor their serviceandprovided
eachman with 20,000Pakistanirupees. Qadir thentold the mento retum to their homesand
spendtime with their families. When the soldiersreturnedto Jalalabad,Qadir wasto assign

eachman ajob. Detaineestatedthat he did not spendmuch time at homebecausehe wanted
to retum to the Provinceof Jalalabadto find out whatjob Qadir was going to give him.
When he returnedto Jalalabad,detaineeleamedthat Qadir createdfour Afghan National
Army divisions,which he referredto as"bodyguard"divisions. Onedivisionwas
responsiblefor protectingQadir andhis home. The seconddivision was createdto patrol and
protectinsidethe city of Jalalabad.The remainingtwo divisions were setup to protectthe
largerdistrict area. Detaineestatedthat he was assignedasan officer to the seconddivision
within the city of Jalalabad.His division wasresponsiblefor fighting weaponsandopium
smugglers. Detaineethen receivednewsthat unknown individuals had assassinatedQadir.
As a result,BrigadierGeneralSaidAgha Sakibtook overthe commandof the divisions.
Detaineestatedthat Sakib sharedthe samebeliefs asQadir. Detaineethen cameunderthe
supervisionof Sakib.
d. (S) Capture Information: Detaineeadvisedhe spenttwo monthsin the SharShahid
compoundoutsideof Jalalabad,AF. He wasthen given ordersto takehis mento military
baseat Kandaki Toupchi. Detaineestatedthat the Americansarrived oneday after he arrived
at Kandaki Toupchi and searchedthe compound. The Americansfound severalimprovised
explosivedevices(IEDs) in a storageroom andarrestedeveryone. Detaineewastakento
Bagram,AF andwas subsequentlytransportedto GuantanamoBay Naval Base,Cuba,on27
February2003.

. (S) Basedon the circumstancessurroundinghis capture,it is assesseddetaineeis a
memberof the Anti-Coalition Militia (ACM) that plannedto useimprovised explosive
devices(IEDs)to conductinsurgentoperationsagainstU.S. SpecialForces(USSF)and
Coalition membersbasedin the Jalalabad,AF area.
o (S) Detaineeis assessedto havebeena memberof a four-mancell madeup of
detainee,ISN 944,Sharifullah,QariNaqibullah(ISN 944'sbrother),andSaid
Raheem.The cell usedimprovisedexplosivedevices(IEDs) againstUSSFin the
Jalalabad,AF, area.
. (S) The four-man-celloperatedfrom a compoundbelongingto Haji Zahir.
AfghanMilitary Forces(AMF). U.S. SpecialForces(USSF)recoveredsix
bombs, 15mortar rounds,ignitersandfusesfrom Haji Zahir's compound.
Informationobtainedidentifiedthe intendedtargetsof thesebombsto beUSSF,
United Nations American personnel,United Nations foreign personnel,andnon-
govemmental orgarization (ltlGO) non-Afghan personnel.
. (S) This cell was operationallyconnectedto Qari Mohadin, deputyto
Maulawi Kabir.
a (S) Mullah Kabir is the former Taliban EasternZone Governor/Financial
DeputyChairman- TalibanCouncilof Ministers.
o (S) Kabir andhis assistant,Agha Ghul, areresponsiblefor facilitating IED
androcket attacksin Paktia,Paktika,andLogar Provincesof Afghanistan.
o (S) Detaineewas capturedat Haji Zahir'scompound. Zahir wasthe 100th
Brigade Commanderandthe sonof Haji Qadir, former govemor of Nangarhar.
During a searchof the compound,detaineewould not comply with instructions. The
IEDs were found in a bathroom/supplyclosetconnectedto the room wherethe
detaineeslept.
. (S) USSFfoundthe following itemsinsidethebuilding: two bombsin
propanetanks,two bombsin woodenboxesinside"Nice Sweet"candyboxes,
two bombslocatedin a wax box, onebox of ignitersandfuses,two Nokia cell
phoneswired asan igniter, oneportablecellular basestation,onemotorcycle,two
bicycles,and 15-2082mmmortarrounds.
. (S) In addition to Zahir's personnelandthe aboveitems,therewere soldiers
from anotherbrigadein the compound.
o (S) Two personnel(assessedto be referring to detaineeandISN 944) were
capturedpreparingbomb targetsin andaroundJalalabad.After questioning,suspects
admittedthey were going to placethe bombsthe night before,but were convincedto
wait until morning.
. (S) While detainedin Bagram,AF andat GuantanamoBay, both detaineeandISN
945deniedanyknowledgeof thebombs/explosivesrecoveredatZahir'scompoundon
themorningof 29 January2003.

o (S) AnalystNote: It is quitepossiblethatISN 944'sbrotherNaqib Ullah andSaid
Raheemwereresponsibleof the IEDs andthat detaineeand ISN 944 weresupport
personnel.Ullah andRaheemwerenowhereto be foundwhenthe AMF/USSF's
arrived at the compoundandmay havebeentipped off aboutthe raid. Both detainee
andISN 944 continueto claim to that they werenot awareof the IEDs. However,the
following factsindicatedetaineeknew aboutthe IEDs; ISN 944 andNaqib Ullah are
brothers,the IEDs were locatedin a room usedasa bathroom/supplyclosetandthe
closetwasconnectedto the detainee'sroom. It would be impossiblefor detaineenot
to haveknowledgeof the IEDs sincehe would havehadto usethe restroomat some
point during his stay.
b. (S//NF) Detainee's Gonduct: Detaineeis assessedto be a LOW threatfrom a
detentionstandpoint. Detaineesoverall behaviorpatternwhile at CampDelta hasbeenone
of compliancewith the occasionalnuisanceactivity. Detaineehasbeendisciplined14times;
the lastReportof DisciplinaryInfractionwason llll9l}4.appointment. SinceMarch 2005
detaineehasmostlybeennotedfor refusinghis medication.His lasthostileactwason
