Province,Afghanistan. He is suspectedof smugglinglandminesinto Afghanistanvia
Pakistan. Detainee'sassurancesthat he supportsthe new Afghanistan govemmentand
admiresAmericansarecontradictedby his firing on US SpecialForces(USSF) andAfghani
Military Forceswhenthey approachedhis compound.It is assesseddetaineeposesa
MEDIUM risk, ashemay posea threatto theUS, its interestsandallies.
4. (S//NF) Detainee Background Summary: Unlessotherwisenoted,the following
paragraphsarebasedsolelyon thedetainee'sstatements.
a. (S) Prior History: Detaineewasborn in the Aburdahvillage,Tarin Kowt District, in
the Oruzganprovince of Afghanistan. He continuedto live therewith his mother andfather,
wife, son,four youngerbrothersandsister. Aburdah, a town of about 70-90houses/families,
is approximatelytwo hours(walking) west of Tarin Kowt. Detaineehasbeento Khandahar,
AF, once. Detaineeis a Muslim andattendedthe localmosque,but hasno formal Islamic
education. At the time he residedin Aburdah, therewasno schoolin the area,thoughthere
is now. Detainee'swife of four to five years,Zarwoti, gavebirth to the couple'sfirst son
approximatelyonemonth prior to his capture.
b. (S) Capture Information: Detainee'swife woke detaineein the middle of thenight
andtold him sheheardgunshots. He alsohearda lot of gunfire, and sawbullets coming from
thehouseof his neighbor,Haji Gul Mohammed. He thoughtthe attackersmight bethieves.
He went outside,stoodin the middle of his courtyard,surroundedby high walls. Detainee
claimedhe couldnot seeoutsidethe compound.Thenhe sawredlights andheard
helicopters. He rcalizedthat the attackerswere Americans,andhe neededto get his family
out of thehouse.Detaineeraninsideandtold his family to getoutsidethe compound
becausethe Americansweregoingto bombthe house.Detaineetold his family he would
staythere,sohe could identify his opium andhis gunswhen the Americanscameto search
thehouse. Detainee'sfamily left thecompound,anda bombwasdropped,injuring detainee.
Detainee'sfather,brotherandwife cameback into the compoundanddraggedhim insidethe
house.US Forcescameto the villase the dav afterthe firefieht andtook detaineeinto
custody.

5. (S//NF) Detainee Threat:
a. (S) Assessment: It is assessedthedetaineeposesa MEDIUM risk, ashe may posea
threatto the US, its interestsandallies.
b. (S//NF) Reasons for Continued Detention:
. (S) Detaineewasreportedto supportAnti-CoalitionMilitia (ACM) activity. He and
five otherunidentifiedindividualsengagedin a firefight with US SpecialForces(USSF)
andAfghan Military Forces(AMF) at the detainee'scompound. The ensuingfirefight
resultedin detaineesustainingseriousinjury while two othersin the compoundwere
killed. Reportingindicatesthat the men in the compoundinitiated the firefight.
o (S) Detainee'scompoundwasunderinvestigationafteranunidentifiedsource
went to KandaharAirfield firebaseandreportedthat oneof his neighborshadbrought
four landminesfrom Pakistanandwaskeepingthem in thedetainee'scompound.
o (S) WhenUSSF/AMF forces(to includeOruzganProvincegovernorJan
Mohammed)approachedthe compound,they found the doorslocked andbarricaded.
Shortly after their arrival, the USSF/AMF forcescameundersmall armsfire from
variouspoints within the compound.
o (S) USSF/AMF took immediateaction,retumedfire andafter determiningthe
enemy'sposition,calledin closeair support(CAS). As a result,two enemy
personnelwere killed-in-action andthe detaineewaswounded-in-action. The report
specifically statesthat the "detaineewaspart of the firefight. He wasprepositioned
andhid out of sight. He fired with the intent to kill or harm."
o (S) AMF investigatedthe incident andreportedthat during the eventtherewere 5-
6 men in the compound. Two were killed andtwo werewoundedandcarried away.
. (S) Detaineeadmitted,after many denials,he actually fired at USSFandAfghan
Military Forcesduring the frrefight. He initially claimed he was not carrying a weapon
during the firefight.
o (S) During interviews at BagramAirfield, AF, detaineestatedthat his wife woke
him up becausesheheardsomething. He went outside,stoodin his courtyardfor 10-
15minutesandheardno gunfire. He thenhearda shortwhistle right beforethe bomb
hit. He did not mention carrying a weaponduring this interview.
o (S) In a l0 April2003 interview,detaineestatedhe did not bring a weaponinto
the courtyard. Later, during the sameinterview, he admittedthat he brought an AK-
47 into the courtyard. He initially statedthat he "fired threeshotsinto the air", but
when the interviewer claimed he did not believethat, detaineeadmittedto o'firing
bulletsin the samedirectionthatHaji Gul Mohammedshothis bullets." (Analyst
note: Detaineeandhis fellow fightersmay havebeenin a preparedstateof readiness

c. . (S//NF) Detainee's Conduct: Detaineeis assessedasa LOW threatfrom a detention
perspective.Detainee'soverallbehavioris compliantandnon-hostile/aggressivein nature.
Detaineeis not a self-harmthreat,but hasbeennotedin the pastto threatenhis own healthif
depressed,which stemmedfrom a lack of other Pashtospeakingdetainees.Detainee
currently hasfour Reportsof Disciplinary Infractions,two being failure to follow guard
instruction,onedamageto property/failureto return property,andoneunauthorized
communications,the lastreportoccurredon02l0ll04. Thedetaineeis currentlyinZulu
block, in Camp4, is at a Low Risk, andhasbeenat RewardLevel onefor four hundredand
eighty-twodays,which indicatesa very compliant,stable,andnon-hostile/aggressive
behaviorpattern. Detainee'shistoryof compliancyindicateshis happinesswhenwith other
Afghanis.
6. (S/NF)DetaineeIntelligenceValueAssessment:
a. (S)Assessment: JTFGTMOdeterminedthisdetaineeisofLOWintelligencevalue.
. (S) Detaineeshouldbe ableto provideinformationregardingthe smugglingof
explosivesfrom Pakistaninto Afghanistan. He was an opium farmer andprobably used
the samesmugglingrouteshe usedfor transportingopium to smuggleweaponsand
explosives.He shouldbe ableto provideinformationon otherpersonnelwho support
ACM operationsin the OruzganProvince.
