a. Prior History: Detainee'sparentshadbeenlivingin Miramshah,Pakistan(PK),in a
refugeestatuswhendetaineewasbom. Detaineestayedin Pakistanafterhisfamilyreturned
to Afghanistanto continuehisschooling.Sometimein 2000,detaineereturnedto hisfamily
in Gardez,AF.
b. Recruitment and Travel: Onor aboutFebruary/March2}}2,detaineetraveledto a
villagecalledLaywanto attendthefuneralof aTalibanmembernamedMaulawiYousef,a
martyr(detaineelatercalledhimafriend).(AnalystNote: Detaineelaterdeniedvisitingthis
town.) Whileattendingthefuneral,two Talibanrecruitersapproacheddetaineeand
convincedhimtojoin thejihadagainsttheNorthernAllianceandUSforces.Therecruiters
told detaineeto goto thevillageof Shahi-Kot,Paktiaprovince,AF, andto waitfor further
instructions.Detaineetraveledto thetownof ZormatandmetaTalibancommandernamed
Ali Ghul(possiblyMullahGhulMohammed,aformerTalibancommander;Alim Gul,a
Taliban/Al-QaidaOperativeinZormaqAF; or Ali Gul,anACM operativeandallegedly
commanderof thePaktiaprovinceof Afghanistan).(AnalystNote: Accordingto asenior

detaineedecidedto returnto hisvillage. Detaineepassedthroughthevillageof Babulkhal
andwascapturednearthevillageof MughalkhalduringOperationAnaconda.Detaineewas
capturedon 10March2002.

o A fatwawasissued,signedby 113AfghanMullahs,andfoundin posterformatin
a mosquein thetown of Zormatin April of 2002(possiblya placedetaineeentered
during his travelsthrough Zormat). This documentexplainedto the Afghan public
how the war againstterrorism started;that the authorsblamethe presidentof the US
for not resolvingUsamaBin Laden(UBL) issuepeacefully;thatthe Taliban
govemmentconveyedto the US that they askedUBL to leavethe country on his own,
but this proposalwasnot acceptableto the US; anddespiteall efforts to the contrary
by the Taliban govemment,the US attackedthe Islamic Emirate of Afghanistan,the
only pureIslamicsystemin theworld. (AnalystNote: Detaineeprofessesto teach
the Quranandevenusedthe nameQari Saheb. Detaineehasstatedthat Qari is a title
givento peoplewho memorizetheQuran,andis thenamepeoplein his village use

(AIA) andwarnedthat anyonefound cooperatingwith US or AIA forceswould be
killed.

o Detainee'sveracity is in question. Detaineehasmadea numberof statementsand
thendisputedthosestatementsin a separatedebriefing(i.e.,his family membersare
farmersandthennot farmers;his brotherleft for ShahiKoht, AF, on the 20th day of
Ramadan(6 December2001)andthenhis brotherhaddied4-5 yearsago.) (Analyst

seemsto feelhe is old andexperiencedenoughto leadprayer. On 19October2003,detainee
hascommentedto the guardforcethathe is a Talibancommanderof 150menearning$2,000
amonth andhe was on leaveduring his time of capture.
