Negligence Is An Important Part Of Tort
Study on Negligence
1.0 Introduction
Negligence can be defined as lack of proper care or attention (Ludowyk, Moore, 2006). Negligence is
an important part of tort. A tort is defined as a civil wrong (other than a breach of contract) in the form
of a breach of duty for which the legal remedy is an award of damages. Negligence is that a
reasonable person doing something which may cause damage.
The purpose of this essay is to understand the three essentials of negligence. In order to fully
understand the three essentials, this essay shows some details about the three essentials. In addition,
this essay fully analyses the novus actus interveniens.
2.0 Background
When the plaintiff wants to prove the defendant owed by negligence, he or ... Show more content on

3.1 Reasonable foreseeability
If the plaintiff s injury was not a reasonable foreseeable, the defendant did not have a duty of care. In
the case Tame v New South Wales (2002) 211 CLR 317, the plaintiff had been in a traffic accident.
She was tested and returned a zero blood alcohol level.
However, the police officer recorded as 0.14 by mistake. Later, it was correct. In addition, the plaintiff
s lawyer told her the truth and it would not affect her insurance. Then the plaintiff was obsessed and
had a mental problem. In this case, the plaintiff s mental problem is not a reasonable foreseeable
injury. Therefore, the police officer had not been under a duty of care and the state was not liable.
3.2 Recognised duties of care
The way to recognise duties of care is to find if there is a law regarding relationship between the
plaintiff and the defendant (Pentony, 2013). For example, the teacher is under a general duty of care to
provide students a safe environment to study, or the manufactures need to provide a higher quality
good to customers.
3.3 Neighbourhood factors
If the case is not in an established category, the Court may look at the important characteristics of this
case to establish an existent neighbourhood relationship to justify a duty of care. In order to establish
it, the Court needs to consider the plaintiff s weakness in the matter, whether the plaintiff relays on the

Defining The Divisions At One Time, Our Nation Is Divided...
Classifying the Divisions At one time, our Nation was divided by race and social class. Today, our
Nation is divided by the type of political party one identifies by or even by our stance on particular
issues. There are some, however, that get caught up in their generational past and use this occurrence
to identify by. Even more, some people classify themselves by their moral obligations, setting
standards that they may view as higher or different than their adversaries. Then there are those who
want to create new ideas and give their idea a fighting chance in this ever so active society. Therefore,
historical, modern, and principled issues classify the groups of topics that divide our Nation.
Historically, racism and equality have served to be the basis of issues that have stemmed and grown
from the constitution. Racism was a huge issue and is still seen as an issue even today. Although
equality is at the best point it has ever been, discrimination is still an immense problem. Recently, the
debate regarding the Confederate flag as a symbol for slavery sparked many opinions, demonstrating
the divisive nature of this issue. In her entry on the Huffington Post: Black Voices page, Hilary
Hanson (2015) reported that some people...feel the Dixie flag represents their Southern heritage. On
the contrary, some people feel as though the flag has been used as an explicit symbol of racism
(Hanson 2015). Between these divided groups, an argument has ensued as to whether the

The Troubles Of Ireland Research Paper
The Troubles.
Since the 17th century, Ireland was the scene of a complex and bloody struggle, which has created
martyrs, heroes, and a long legacy of bitterness. Irish nationalists fought the British for independence,
before battling their comrades for its future. The war for Ireland encompassed iconic revolts, guerrilla
struggles and hard urban warfare.
1) From 1969 onwards for almost 30 years, images of armed British soldiers running down seemingly
residential streets, rioting, funerals and dead bodies hastily covered with blankets dominated news
coverage of Northern Ireland. Four hundred years of anger boiled up to become The Troubles , a
period that took over the lives of a generation of Northern Irish. The scars of this event are still ...

Catholics, a minority which for decades had endured political and economic marginalisation. Caught
between them was the British government, desperate to achieve peace in Northern Ireland but unsure
how to enable it. Outside the law, paramilitary groups like the Irish Republican Army (IRA) and
Ulster Volunteer Force (UVF) used violence and terrorism to impose their political will. For three

Affluenza Case Study Psychology
Affluenza: From the Utilitarian Approach and the Moral Brain In society, there are always going to be
different opinions and controversial topics that cannot be avoided. Morality is one of these topics
because there will never be a solid answer to whether or not something is moral due to everyone
having their own perspectives. Morality can be defined in many different ways. The Utilitarian
approach and neuroscience are two of the many ways morality can be thought of. A case study from
the 2015 National Ethics Bowl exemplifies how one situation can be thought of in many different
ways. A case on affluenza is able to be thought of in two different perspectives, by both utilitarianism
and by neuroscience. In case number fourteen from the 2015 National Cases Ethics Bowl, it discusses

The course of conduct [should] promote the greatest amount of happiness for all those who will be
affected (Rachels 93). If Ethan were to be sentenced to jail, it would make the most people happy in

people in this accident and many people in his town are upset by this because their family or friends

more happiness or unhappiness (Rachels 100). For the victims, families, and bystanders involved in
this accident, they would be happier if Couch gave his time and was sentenced to ten years in jail for
his actions since they lost loved ones due to his stupidity and ignorance. Many bystanders and the jury
of the case thought Couch deserved a stricter, harsher punishment than what he received. According to
utilitarianism, Couch should not have gotten the easy way out of this situation with probation and
rehabilitation. The only way Couch would be sentenced to jail was if he failed to obey his

Big data management system:
Author says that conventional data storage systems (databases) work well with structured data, but
crash under heavy workloads. He describes various distributed file systems like GFS (Google file
system), HDFS (Hadoop distributed file system), and amazon S3(Simple Storage service). All these
file systems handle unstructured data and support fault tolerance by data replication. Specially S3
provides good integration with other amazon services and provides big data processing capabilities to
consumers at an affordable cost in a pas as you go fashion. For storing non structured and semi
structured data, the author provides solutions used in various corporates. He gives examples of
BigTable used by Google and PNUTS used by Yahoo. One that caught my eye is the one proposed by
Facebook, which is a hybrid data management system. It is hybrid in a sense that it combines features
of a row based and column based database systems. Upon research I found that this new system
actually enhances the performance of both query processing and load balancing [2]. The author then
moves on to describe various available cloud vendors. All these Infrastructure as a service (IaaS)

purpose of NEPA was to establish a national policy to protect the environment, create a Council on

Symptoms Of Cystic Fibrosis
Overview: Cystic Fibrosis, or CF, is a genetic disease that affects children to young adults. It occurs
when a child has two defective copies of the gene that causes cystic fibrosis, one from each parent.
The disease primarily affects the digestive system and it also affects the respiratory system, mainly the
lungs bronchi and bronchioles. Cystic fibrosis affects the cells that produce mucus and digestive
juices, as it changes the protein that regulates the movement of salt in and out of cells. Which leads to
people thick and sticky mucus and digestive juices, such as pancreatic juices. Whereas people who do
not have CF have thin and slippery mucus and digestive juices. The severity of the disease differs
from one person to the next, yet the ... Show more content on Helpwriting.net ...
Symptoms of cystic fibrosis is persistent cough that are full of mucus, shortness of breath, weight loss
and infertility or decreased fertility in both men and women. Also, intestinal blockage can occur,
where a part of the intestines folds in on itself.
Two or more of the symptoms might indicate that you have cystic fibrosis and a doctor might conduct
a sweat test, which tests for how much salt is in your sweat. If the salt levels are high enough, it might
indicate cystic fibrosis. Other tests that can determine if you have cystic fibrosis is genetic testing and
newborn screening.
There is no cure for cystic fibrosis, but medication can be provided to help ease the symptoms that
accompany the disease. Things like antibiotics can treat and prevent lung infections. A person can also
take mucus thinning drugs that help to improve lung functions, by helping you cough out the mucus.
Furthermore, a person can also take in pancreatic enzymes that help to digest food in the small
intestines and stomach. If a person s intestine folds in on itself, then the person would have to have
surgery that removes the part of the intestine. If the blockages in the ducts in the lungs become
resistant to medication, or antibiotics, then the person might need to have a lung transplant. Cystic
fibrosis does not occur in the set of lungs that have been transplanted into

The Growth And Poverty Improvement Of A Country Essay
CHAPTER 1 1.1.1 INTERNSHIP INTRODUCTION Finance is assumed to be one of the most
important tools for the growth and poverty improvement in a country. Financial inclusion is a vision
for every country to achieve so that it can provide quality services to its citizens. Govt. Has introduces
many schemes to achieve the aim of Inclusive growth and abandoned access to Financial services.
Many initiatives, schemes and reforms have been put into the place after independence. Many
Cooperative Banks where introduced to supply credit for farming purpose and for this cooperative

nationalization of many banks and priority sector lending and subsequently. Indian shifted from an
agriculture economy to Industrial economy and later to Services sector Economy, but center of
attention shifted from subsidized credit and to important sector lending to enterprise driven. But in this
journey of economic development poor and disadvantaged people were not ignored in this journey of
economic growth and economic stability. But Post liberalisation India (1991 onwards) saw numerous
changes in the financial area; interest rate free licensing, de regulation, privatization has opened india

On Bruce Springsteen s Song Born In The USA
Born in the U.S.A. The song Born in the U.S.A. was written by Bruce springsteen. Bruce grew up in
New Jersey, and shows it in this song. Bruce is widely known for his americana, working class poetic
lyrics. The song is about the mistreatment of Vietnamese War veterans, but people believe Born in the
U.S.A. is a real patriotic song, when in reality they just misunderstand the deeper connotation .Bruce
himself did not serve in the Vietnam War. He was called upon to serve, but did not meet requirements.
This song was meant to defend the veterans, his use of diction ,repetition , and comparisons
throughout the song to meets that purpose rather than just patriotism. Bruce Springsteen was born in

Literary Analysis Of Young Goodman Brown
Young Goodman Brown In the story of Young Goodman Brown, as a reader we see many
circumstances where Hawthorne uses irony in straightforward situations. I have learned from reading
several of the author s works that it is up to the reader to decide the meaning behind his stories. In this
paper, I will be discussing the significance of the title, Young Goodman Brown and how I believe
there is more to the story than what Hawthorne writes. Young Goodman Browns journey within the
forest revealed truths not only within him, but within human nature and society. On page, 1103
Goodman Brown states there may be a devilish Indian behind every tree. When defining irony, we
think of it as an expression of ones meaning that normally signifies the opposite. This made me think
of the irony behind the good in Goodman Browns name. Hawthorne makes us think that the character
is a good man with only but the best intentions towards God. However, I believe it show cases the
opposite behind the character s name. Throughout the story Goodman Brown shouts his faith and
devotion for God, but behind every man s faith is curiosity.
Faith is all Goodman Brown has known. He had even married a Faith. The double meaning of Faith
within this story shows major Irony for us as the readers. Brown marrying a Faith was almost shown
as he made the biggest devotion towards God. The main character has put every ounce of Faith he has
into his life that would completely give himself to God forever. This is

more effectively the theme of Carpe Diem than the other poem. To the virgins, to make much time, it
talks about that young women should go and get married because time passes fast. They should go and
have fun while they are young. The author uses symbolism, he uses the sun and sunset to show that
people should go fun while they can. It refers to live each day at their fullest. The tone in this poem is

The Developmental History Of Nosql And The Fundamental...
Abstract
The demands on database technology have been ever expanding since its introduction in the 1960 s.
Today traffic on the internet requires that millions upon millions of records be stored and queried each
second. Data must be highly available and quickly retrievable. These requirements put together have
given rise to new forms of database technologies collectively called NoSQL or Not Only SQL .
NoSQL eschews the strict guidelines that govern the creation and function of traditional relational
databases. These guidelines are put aside in order to rise to the new demands of an increasingly
interconnected world. The rigorous standards and data definitions of relational databases give way in
order to provide the ability to rapidly ... Show more content on Helpwriting.net ...
NoSQL is able to address the massive traffic loads experienced by database servers at corporations
that specialize in data processing like Google, Facebook and Amazon. NoSQL technologies can
provide near constant availability, massive user concurrency and lightning fast responses. There are
four primary NoSQL database implementation types being used today: document based, wide column
(or columnar), key value and graph. The different properties of SQL and NoSQL databases will be
examined and an overview of each NoSQL implementation type along with an example will be given.
ACID v. BASE: Eventual consistency Standard SQL databases adhere to what are commonly called
the ACID properties. This means that the database must be atomic, consistent, isolated and durable.
Atomic means that each attribute cannot be broken into sub groups. Consistent means that the
database displays only the latest data; there are no older versions of data present within the database
unless by design. Isolated means that no transactions will interfere with one another; i.e. two
concurrent users changing the same data in the database will not end with incorrect results; the
transactions will be processed separately. Durable means that once changes have been made they will
remain in place and not revert to their prior state (Pritchett, 2008). The ACID properties can be crucial
to certain business models; financial transactions might require

Angela s Ashes Modernism Essay
Modernism took place in the late 19th century and early 20th century, more specifically the years
following World War I ( Modernism in literature 1). The novel Angela s Ashes, written in 1996, is
considered a work of modernism. Writers often talked about historical events, due (feeling) that they
were at the end of history. ( Modernism 504).
Writers of this time period were heavily influenced by the war, and the political events going on.
Major writers were; T.S. Eliot, William Faulkner, James Joyce, Ezra Pound, and others. All of their
writings incorporated accurate portrayals of the world through experience and interior monologue (
Modernism 504) and did not write about the new technology developing around them ( Modernism

laws is the Bagley Keene Act it applies at the state government level; it includes state boards, state
commissions and any other state offices that have to hold public meetings. Bagley Keene Act defines
meetings as a congregation of the members of a state body at the same time to hear, discuss or

The employees of the government offices are paid by the government hence the reason that I do not
believe they are considered a business at the government level.
The cities receive their revenue from companies, state and federal accounts. But, a lot is paid by the
residents of the state, for example; property taxes, permits, parks and recreation, homeowners taxes,
taxes from businesses, court fees and fines, utility companies and other outside franchises. City
revenue can also take fees for some services like, amusement taxes, and hotel occupancy.
Yes, a city can file bankruptcy. The city of Stockton in California filed bankruptcy, the question was
can they go bankrupt without having to reduce the pensions of public workers. It is the largest city that
filled and Detroit followed. When a municipality files bankruptcy the federal government has to
approve or deny it. Municipalities file under Chapter 9 of the Bankruptcy code. This is not a common
occurrence. The process varies from state to state. In some states, the city goes into state receivership
rather than actually filing. The most common reason is unaffordable union

MAPK And The Regulation Of The Isolation Of Eukaryotic Cells
Introduction Isolation of DNA along with transcriptional material in the nucleus, by the nuclear
envelope, from the cytoplasm and the translational material held there gives the opportunity for exact
regulation (Lange et al, 2006). The nuclear envelope provides the ability for regulation of gene
expression and signal transduction. With this regulation cells can, if exposed to an extracellular signal,
perceive and create an intracellular response to withstand or react to such a signal, for example, by
signalling cascades with the use of mitogen activated protein kinases (MAPKs) (Brown and Sacks,
2009). A protein kinase can phosphorylate a protein at serine, threonine or tyrosine residues which can

The many isoforms of JNK could have varying catalytic activity on their substrates such as the means
to phosphorylate a transcription factor (c Jun) in JNK1 and JNK2 (Liu et al, 2004). JNK
phosphorylate either serine or threonine residues when there is a proline after it (Hibi et al, 1993).
JNK can also be phosphorylated by autophosphorylation most notable in the JNK2 isoforms where it
still allows initiation of substrates with the strongest occurrence in JNK22 (Tsuiki et al, 2003). There
are three kinases involved in the MAPK phosphorelay system which act in series: MAPK kinase
kinase (MKKK), MAP kinase (MKK) and MAPK (JNK), which respond to external stimuli, shown in
Figure 1 (Johnson et al, 2005). There are a wide range of stimuli that can activate regulation of JNK
including ultraviolet irradiation, growth factors (tumour necrosis factor ), cytokines and even protein
synthesis inhibitors (anisomycin) activates MKKK and using phosphorylation to activate the next
kinase in the process, MKK, which in turn phosphorylates MAPK (Dérijard et al, 1994; Kallunki et al,
1994; Lange Carter et al, 1993). There are 13 different MKKK including MEKK1 4, MLK2/3 and
DLK that can act in the JNK pathway which provides the ability to responds these different external
signals (Brown and Sacks, 2009; Dérijard et al, 1994; Johnson and Lapadat, 2002; Kallunki et al,
1994). In the sequence of MEKK there are specific motifs

Racing Flat Research Paper
The Preferred Choice
Fast times are the key to success in the world of running. When it comes to race day attire you have
two real options that will give you an advantage over someone wearing a normal training shoe. These
are a racing flat and a spike. A racing flat has the ability to support an athlete on uneven terrain and
provide them cushioning on hard surfaces making them incredibly versatile. Also a racing flat is more
than capable of being worn for races as long as a marathon while being light enough to give you great
increases in performance. Finally The available cushion and natural range of motion that a racing flat
provides tends to cause less injury in athletes than in a spike. Because of the reasons listed, a racing

This can be supported by, A study published in a 2012 issue of the Journal of the American College of
Sports notes that people who run in barefoot or with minimalist shoes such as racing flats instinctively
land toward the ball of the foot. This reduces the risk of injury, which is more prevalent for those who
land on the heel (Yemi 1). This is a clear fact that has been supported by numerous studies. The nature
of a racing flat allows your foot to go through a more natural motion while running. This reduces
injury. Another factor that makes a racing flat good at reducing injury is that it still has sufficient
cushioning. Also in the study conducted by the Journal of Sports Science and Medicine they say that
In this study, the amplified loading rate, stiffness, and peak vertical impact force demonstrate that
running spikes and flats produced a greater external force on the body. The initial impact force
between the foot and the ground is directly transmitted to the leg and can potentially be an influential
factor in injury risk (logan, Hunter, and Hopkins 6). The cushioning as mentioned previously is light
enough to give an athlete better performance while still substantial enough to protect the runner from
some of this initial shock of running on a hard surface such as a track. A spike on the other hand has
little to none resulting in more force being exhibited on the joints and

The Causes Of Veteran Homelessness
The United States of America rests on the shoulders of our brave men and women. It is unfortunate
that once a soldier returns home, he or she has the strong likelihood that a roof, four walls, and a job
will not be waiting. It is the responsibility of the people of this great nation to provide the support that
these veterans need to survive in this world; they would help us survive in theirs. If goals are put in
place and there is enough effort and power backing up the motor of these goals, then accomplishing an
end to veteran homelessness will occur. This paper will examine the causes of veteran homelessness
and how to cease and prevent veteran homelessness from happening and reoccurring. According to the
National Student Campaign Against Hunger and Homelessness, as of 2014, 13.2% of the American
population was homeless. Additionally, it was found that another 3.5 million people were strained to
finding shelter in parks, under bridges, or sleeping in cars. Of this 13.2%, 23% of those suffering were
United States veterans. The reason as to why veterans become homeless is due to war related
disabilities, such as physical disabilities, mental detriment, posttraumatic stress disorder, and an
inability to reorganize themselves back into civilian life, noted in Homeless Veterans: Perspectives on
Social Services Use. In April of 2008, the U.S. Department of Labor released the unemployment rates

Personal Note On Social Skills
I try very hard to teach my children that social skills are very important in the world. You have to be
able to communicate and speak your mind. Those who hide in the background and don t say anything
are the people that don t get very far in real life situations. My oldest daughter has this down to a
science in the fact that she deals with customers on a daily basis and has to be able to be people
friendly at her job. My second daughter is all bundled up and shy and won t speak out for the things
that she thinks is right. This causes me and her to have conflict on a daily basis, especially through the
things she deals with at school from the other students and teachers. My youngest daughter let me tell

Hopefully I have tried to keep the social skills to a professional level in the jobs that I have had. Social
skills are very important all around the world; if you don t have good social skills your
professionalism could take a big hit for the rest of your working days. This is very important with the
learning of the job, if you have bad posture, your arms are crossed, you re not looking at the person
talking to you, and these are not the social skills you want to put out there for everyone to see.
Principles of good social skills can take you to the top of the ladder. You could make better money and
have a better work environment. When social skills are learned they can be easily taught. If we had a
social skills class to take I would make the world take it, so we could be better communicators and
better listeners. This would make a big difference in the work place and the outside world. Would the
world be war free if we knew better social skills? I think it would be a better place to live and a safer
place for our kids to live. So why don t we all learn social skills, and make our world the place we
want to live in. Life is how you make it and if you have social skills then you can compete on any
level you want to compete on. Make social skills somewhat a priority in your everyday living so that
you are confident and know how to be polite and responsive to other people and their interest. Social
skills are like M M s they make the world go round and round.

Life As A Contest With Fate By Heinrich Von Kleist
When is the proper moment to think? Is it better to think before, during, or after an action? The writer,
Heinrich von Kleist, argues that one should think after an act. He uses the example of a wrestler, The
athlete, at that moment when he is holding his opponent in his grip, simply has no recourse but to act
spontaneously, on inspiration; and if he begins to calculate which muscles to contract and which limbs
to move in order to throw him, he will always draw the short straw and be thrown himself (Kleist,
1810). In this example Kleist is correct that it is more appropriate to reflect on your actions rather, but
is this logic acceptable in all occasions? Or when an individual should think be dependent on the
situation at hand? In the same essay, Kleist states life itself is a contest with fate , however should the
entirety of life be treated as a contest (Kleist, 1810)?
To begin with, is it better to think while you act? In the example stated previously, when the wrestler
thought during he s match, he resulted as the loser. In the film Fearless, Huo Yuannjia s father faced a
similar scenario. During a match to determine the better of two Wushu styles, Hou s father meets
defeat when he became lost in thought. In these situations, the individuals would have a higher chance
of success if they acted on intuition rather than critical thinking. On the other hand, would acting on
inspiration would be best during a test or homework assignment? While working on school

American Healthcare System
This study has also covered the weaker aspects of the prevailing American healthcare system. The
financial basis of healthcare improvement lay in enhanced business savvy on the part of the
administrators and providers of healthcare. It is the lack of healthcare and business savvy that is
impeding the American citizens from accessing adequate health. The American healthcare system
involves socialized and privatized healthcare. The socialized healthcare system is inefficient due to
lack of financial balance to support adequate care for every American.
The healthcare providers and administrators lack adequate management skills to ensure efficient
continuity of the business. The currency fluctuation has led to escalating healthcare cost that requires

During the crisis, the primary concern of the organization is to influence the key public s attitudes
favorably. The way the public perceive the information regarding the organization may profoundly
affect their attitudes. According to this theory, the information will affect an individual s attitude
system based on its weight and valence. Valence reflects the perception of an individual of how bad or
good the information is. On the other hand, weight is the function of reliability. Here, the focus is on
the process and the way target audiences incorporate information and the way their attitudes are
affected by it. Practically, the information integration theory needs health care institutions to consider
both weight and valence when arranging for the information to be given to the public during the crisis.
It is critical to contextualize the information and enlighten the members of the target audience the
degree of the danger or risk presented by the risk to allow them (the target audience) to judge the
impact of risk accurately (Goodman, 2012, p.

Play, By Marc Leblanc
When describing the characteristics of play, Huizinga (1995) pointed out that engaging in the activity
of play is not essential, yet engaging in the act of play is a voluntary activity. It is an activity that can
start and stop at any time and often carried out during leisure time. He also mentioned that play only
gets urgent when the enjoyment of play becomes a need. Thus, playing is enjoyable.
Games are compelling because it provides players several uses such as allowing players to pass time,
to procrastinate, to cheer oneself up or to play just for enjoyment (Phillips et al. 1995). As an
entertainment source, games allow people to enter a world of fantasy and escape the boredom of
reality (Sherry 2004).

However, it is goals which bestow these interactions its purpose (Costikyan 2002). Goals are a
stimulus in games which motivates players to interact with the game system further and furthermore.
These goals could be an explicit win state, a set of victory conditions or smaller goals that adds up to
the bigger objective in the game. Goals could be in numerical form such as getting the highest score or
in status form such as the development of a city. On the other hand, there are games that have no
explicit winning conditions. These are usually sand box games like Grand Theft Auto V or simulation
games like The Sims series, whereby players have a wide variety of goals to choose from or a wide
variety of possibilities to play with. Therefore, games are goal directed interactions that involves
decision making (Costikyan 2002), that are up to the player s discretion and the system of the game.
Games are compelling this way because each gameplay of the same game will be dfferent....
To make achieving goals in games a little more challenging for the players, games have the element of
struggle to make things interesting. Games would have a form of conflict, competition, challenge,
oppositions or even puzzles to make players to struggle interactively towards a goal (Costikyan 2002)

Behavior Modification Plan For Ourselves
When I first learned that we were doing a behavior modification plan for ourselves I did not know
what to think. After having it explained to me I knew that it had to be something related to my stress
and anxiety levels. My entire life it has been something that has hindered me from getting outside of
my comfort zone to better myself. So I started from there and had to figure out a way to measure my
stresses in numbers. I wasn t sure how I was supposed to mathematically lay out what gives me stress.
Our awesome teacher then asked me what it was that I did to relieve stress. I told her that I like guns
and going to the shooting range. From there I was off and running. My goal was to go to the shooting
range to help manage my stress levels. My first sub goal was to schedule times twice a week to go to
the range. I decided that I would go on Tuesdays and Fridays after work. I researched local shooting
ranges in my area and determined that Fletcher Arms in Waukesha was the best bet for me based on
price and location. Another sub goal that I gave myself was to find all my information by September
10, 2015 which I was able to accomplish. That was easy to accomplish but not all of my planning paid
off for me at first. There were a couple of issues that I ran into during the semester that were not
significant; but they were things that I needed to figure out in order to be successful. When road
blocks get in the way it is sometimes difficult to want to continue. I

The Health And Social Care
Person Centred Values is an approach that respects and values the uniqueness of the individual, and
seeks to maintain or if required, restore their individuality. It means the person whom one supports is
able to be involved and included in every aspect of their care and support; and that the care provided
should be centred on and around the person, and not just their health or care needs. This is done by
creating an environment that promotes the personal worth, uniqueness, and social confidence of the
individual, as well as respect, independence and hope. I.e. Person centred values covers the total care
of the person.
There is no doubt that person centred care values must influence all aspects of health and social care
work, and should be ... Show more content on Helpwriting.net ...
It is important to ensure that all individuals are treated as such, and person centred care should ensure
this.
To work in a person centred way, one must develop a clear understanding about the individuals one is
supporting. This includes their needs, culture, means of communication, likes and dislikes, their
family, colleagues and other professionals one may be working with; so one can promote and provide
person centred care and support.
There are 8 person centred values that support person centred care and support. These are:
Individuality
Assumptions should never be made about a person. The person should never have to fit in with you or
your organisation/employer. People should be allowed and supported to make their own choices.
Care and support needs should be tailored to suit each individual, by checking their care plan, to learn
more about them and their likes and dislikes, such as; what food do they like and want to eat, how
they want to be addressed (as one should not assume they can call someone by their first name), etc.
This shows respect by preserving the individual s dignity and individuality. Their personal beliefs
should always be respected.
Rights
Individuals in one s care should continue to enjoy the same rights as when they were living
independently. They have the right to say no, the right to have a relationship, the right to have a say in
their care and how they are supported, the right to choose what they eat and when, how they

means for members of the public to express their opinions and concerns with a greater chance of being

The Partition Of India By Bapsi Sidhwa
Before the Partition of India, in 1947, India was considered a country with a reasonably peaceful
history. However, during and after the Partition, sexual violence, both towards men and women,
escalated, resulting in the rape and abduction of over 80,000 women. Cracking India, by Bapsi
Sidhwa, tells a story that highlights these violent acts by both Muslims and Hindus, through the eyes
of a disabled young Parsi girl named Lenny, who witnesses first hand the violence of Partition when
she mistakenly participates in the abduction of her ayah, Shanta. Throughout Cracking India, Lenny
observes as the religions involved in Partition become increasingly violent towards both men and
women, within their own religions and against others. Lenny, who begins the novel as a very naïve
young Parsi girl, comes to understand that the foundations of violence in her surroundings are largely
gendered and that the experience of this violence is differentiated along gender lines (Rastegar 27).
Lenny witnesses the evolution of Ayah s suitors, (who are Parsi, Hindu and Muslim), from men
interested in being with Ayah to men who are desperate to control Ayah. As Partition gets more
violent, Ice Candy Man, one of Ayah s suitors who is Muslim, takes on the role of a minor nationalist
leader in their area and eventually coordinates a mob of Muslims to come to the Sethi house an abduct
Lenny, who is Hindu (Rastegar 27). When Lenny witnesses the change in behavior of Ayah s suitors

Machiavelli s Influence On Political Philosophy
After reading about some of the different philosophers in our text book this week, the philosopher that
I chose to research is Niccolo Machiavelli. Machiavelli was born on May 3, 1469 in Florence, Italy
and he lived until July 21, 1527. Machiavelli lived in Italy at the time that the government was at odds
and under the mercy of stronger government. Machiavelli served as a diplomat for fourteen years and
was known to be devious. After his involvement in an unsuccessful attempt to organize a Florentine
militia against the return of the Medici family to power in 1512, Machiavelli was tortured, jailed and
banished from an active role in political life. (Editors, 2016)
During Machiavelli s time away from politics he wrote the book, The Prince; which is what he is most
famous for. In the book he explains his political philosophy and describes the way he feels is the most
effective way to rule. Machiavelli is considered by many to be one of the most ... Show more content

Principle Of Pigeonhole Principle
Pigeonhole Principle
Introduction:
In 1834, the mathematician Peter Gustav Dirichlet (1805 1859), developed the idea of what we know
today as the Pigeonhole Principle (2009). It is also commonly called Dirichlet s box principle or
Dirichlet s drawer principle in dissimilar parts of the world. The Pigeonhole Principle is an extremely
essential and easy concept to comprehend, yet when applied to higher level problem solving can very
complicated to detect and use (2009). This powerful Pigeonhole Principle may be presented in a few
different ways:
1.) If m pigeons are put into m pigeonholes, there is an unfilled hole if and only if there s a hole with
more than one pigeon, 2.) If n pigeons are put into m pigeonholes where n m, there s a hole with more
than one pigeon, 3.) Let |A| denote the number of elements in a finite ... Show more content on

Pigeonhole Principle is essentially used, below are a few examples of the application of this valuable
idea. With each example, however, connections stuck between the pigeons and the pigeonholes will be

How Did Religion Influence Ancient Egypt
The geographical location and the surrounding environment of Egypt heavily influenced the people of
Ancient Egypt s spiritual life and their religious belief in a multitude of ways. A central part of the
environment that contributed to Egyptian spiritual life and religious beliefs is the Nile River, a
foundation of their cosmology. Their religious belief stems from the myth of Ra, the sun god. The
belief is at the beginning of time the Nile brought a mound of silt where Ra, the highest deity among
the Egyptian gods. From Ra, the other gods emerged. The Nile River, to the Ancient Egyptians,
symbolized rebirth and renewal. The Nile also represented the belief in life after death. The story of
Osiris is directly connected to the Nile River, and the resurrection after death. Osiris, the god of the
underworld, was killed by his brother Set and his body was cut into small pieces and thrown into the
Nile. Osiris wife, Isis, collected the pieces of his body and put him back together. This myth
contributed to the belief in life after death, which in turn would influence many more aspects of their

A Brief Look at DNA Profiling
DNA profiling has several advantages in helping solve crimes, however, there are still disadvantages
to this technique. DNA profiling can be beneficial, as well as detrimental to the society we live in.
DNA profiling has become the most widely used tool in the field of forensics because of the
advantages it has to offer, although there are some drawbacks when it comes to utilizing this
technique. DNA profiling has greatly enhanced law enforcement investigation by helping determine
the suspect in a criminal investigation, minimizing the amount of unjustified arrests, and by
overturning wrongful guilty sentencing. While DNA profiling has advantages in the field of forensics,
it also has disadvantages. A few of the key disadvantages of DNA profiling are easy contamination,
wrongful convictions, and access to and use of data. One of the foundations in the field of forensics is
the examination of DNA. DNA is the digenetic element which exists in each and every cell. Every
human being has an exclusive analysis of DNA. In fact, there are even a small amount of variations
among the deoxyribonucleic acid (DNA) of identical twins. DNA profiling was established in the
1980 s by Sir Alec Jeffreys, a scientist from Britain. Investigators can obtain DNA for profiling from
various evidence from a crime scene. DNA can be obtained from vital fluid, semen, epidermis, saliva,
mucus, sweat and roots of hair. Additionally, profiling can be performed on old, as well as dried out
specimens. One

Analysis Of The Odissi Dance From Dominican Republic

Indian Dance
Due : 6 January 2017
Differences Bring You Closer
For centuries upon centuries, dance has been used as a form as expression. Whether it be religiously to
please and entertain the gods, or as a form of entertainment for the townspeople, dance has brought
joy to countless people. Because dance doesn t leave a written history trail it is assumed, but not
proven, to have originated over 2500 years ago. However, dance continues to evolve even today. Take
for example the odissi dance from India that is almost two thousand years old versus the bachata
dance from Dominican Republic that is only about 50 years old. Both of these dances originated in
complete separate parts of the world at very ... Show more content on Helpwriting.net ...
Odissi dance was held to a very high esteem not only by commoners, for even royalty were expected
to be great dancers of this kind. However, as a sensual dance of great passion, love, and joy, it doesn t
come to be a great surprise that after the 17th century odissi dance took a turn for the worse. The
dancers went from being admired to being known as prostitutes and whores; it was a dark time for
odissi dance as it came very close to being extinct. Nevertheless, India Independence Day marked an
enormous change due the recognition that culture and dance was essential to unifying India once
again. Many individuals then set out to revive odissi dance for the better (Nirmal). Odissi dance has
since then taken on many different forms and has even split into three different schools: mahari,
nartaki, and gotipua. Mahari dance is the traditional form of odissi used in rituals; narthaki dance was
developed in the royal courts; and gotipua dance is the form of odissi where males wear female
costumes and assume those roles (Courtney).
One of the main differences between these dances is the purpose and symbolism. While odissi dance
has been used for entertainment it is a classical temple dance. It is used in rituals and has originally
been created for the Divine, bachata on the other hand is the complete opposite. It symbolizes freedom
from one of the worst dictatorships Dominican Republic has ever seen and a freedom of speech they

  • 2. Negligence Is An Important Part Of Tort Study on Negligence 1.0 Introduction Negligence can be defined as lack of proper care or attention (Ludowyk, Moore, 2006). Negligence is an important part of tort. A tort is defined as a civil wrong (other than a breach of contract) in the form of a breach of duty for which the legal remedy is an award of damages. Negligence is that a reasonable person doing something which may cause damage. The purpose of this essay is to understand the three essentials of negligence. In order to fully understand the three essentials, this essay shows some details about the three essentials. In addition, this essay fully analyses the novus actus interveniens. 2.0 Background When the plaintiff wants to prove the defendant owed by negligence, he or ... Show more content on Helpwriting.net ... 3.1 Reasonable foreseeability If the plaintiff s injury was not a reasonable foreseeable, the defendant did not have a duty of care. In the case Tame v New South Wales (2002) 211 CLR 317, the plaintiff had been in a traffic accident. She was tested and returned a zero blood alcohol level. However, the police officer recorded as 0.14 by mistake. Later, it was correct. In addition, the plaintiff s lawyer told her the truth and it would not affect her insurance. Then the plaintiff was obsessed and had a mental problem. In this case, the plaintiff s mental problem is not a reasonable foreseeable injury. Therefore, the police officer had not been under a duty of care and the state was not liable. 3.2 Recognised duties of care The way to recognise duties of care is to find if there is a law regarding relationship between the plaintiff and the defendant (Pentony, 2013). For example, the teacher is under a general duty of care to provide students a safe environment to study, or the manufactures need to provide a higher quality good to customers. 3.3 Neighbourhood factors If the case is not in an established category, the Court may look at the important characteristics of this case to establish an existent neighbourhood relationship to justify a duty of care. In order to establish it, the Court needs to consider the plaintiff s weakness in the matter, whether the plaintiff relays on the

  • 4. Defining The Divisions At One Time, Our Nation Is Divided... Classifying the Divisions At one time, our Nation was divided by race and social class. Today, our Nation is divided by the type of political party one identifies by or even by our stance on particular issues. There are some, however, that get caught up in their generational past and use this occurrence to identify by. Even more, some people classify themselves by their moral obligations, setting standards that they may view as higher or different than their adversaries. Then there are those who want to create new ideas and give their idea a fighting chance in this ever so active society. Therefore, historical, modern, and principled issues classify the groups of topics that divide our Nation. Historically, racism and equality have served to be the basis of issues that have stemmed and grown from the constitution. Racism was a huge issue and is still seen as an issue even today. Although equality is at the best point it has ever been, discrimination is still an immense problem. Recently, the debate regarding the Confederate flag as a symbol for slavery sparked many opinions, demonstrating the divisive nature of this issue. In her entry on the Huffington Post: Black Voices page, Hilary Hanson (2015) reported that some people...feel the Dixie flag represents their Southern heritage. On the contrary, some people feel as though the flag has been used as an explicit symbol of racism (Hanson 2015). Between these divided groups, an argument has ensued as to whether the ... • 5. The Troubles Of Ireland Research Paper The Troubles. Since the 17th century, Ireland was the scene of a complex and bloody struggle, which has created martyrs, heroes, and a long legacy of bitterness. Irish nationalists fought the British for independence, before battling their comrades for its future. The war for Ireland encompassed iconic revolts, guerrilla struggles and hard urban warfare. 1) From 1969 onwards for almost 30 years, images of armed British soldiers running down seemingly residential streets, rioting, funerals and dead bodies hastily covered with blankets dominated news coverage of Northern Ireland. Four hundred years of anger boiled up to become The Troubles , a period that took over the lives of a generation of Northern Irish. The scars of this event are still ... • 6. Affluenza Case Study Psychology Affluenza: From the Utilitarian Approach and the Moral Brain In society, there are always going to be different opinions and controversial topics that cannot be avoided. Morality is one of these topics because there will never be a solid answer to whether or not something is moral due to everyone having their own perspectives. Morality can be defined in many different ways. The Utilitarian approach and neuroscience are two of the many ways morality can be thought of. A case study from the 2015 National Ethics Bowl exemplifies how one situation can be thought of in many different ways. A case on affluenza is able to be thought of in two different perspectives, by both utilitarianism and by neuroscience. Utilitarianism judge[s] actions right or wrong depending on whether they cause more happiness or unhappiness (Rachels 100). For the victims, families, and bystanders involved in this accident, they would be happier if Couch gave his time and was sentenced to ten years in jail for his actions since they lost loved ones due to his stupidity and ignorance. Many bystanders and the jury of the case thought Couch deserved a stricter, harsher punishment than what he received. According to utilitarianism, Couch should not have gotten the easy way out of this situation with probation and rehabilitation. All these file systems handle unstructured data and support fault tolerance by data replication. Specially S3 provides good integration with other amazon services and provides big data processing capabilities to consumers at an affordable cost in a pas as you go fashion. For storing non structured and semi structured data, the author provides solutions used in various corporates. He gives examples of BigTable used by Google and PNUTS used by Yahoo. One that caught my eye is the one proposed by Facebook, which is a hybrid data management system. It is hybrid in a sense that it combines features of a row based and column based database systems. Cystic fibrosis affects the cells that produce mucus and digestive juices, as it changes the protein that regulates the movement of salt in and out of cells. • 12. Literary Analysis Of Young Goodman Brown Young Goodman Brown In the story of Young Goodman Brown, as a reader we see many circumstances where Hawthorne uses irony in straightforward situations. I have learned from reading several of the author s works that it is up to the reader to decide the meaning behind his stories. In this paper, I will be discussing the significance of the title, Young Goodman Brown and how I believe there is more to the story than what Hawthorne writes. Young Goodman Browns journey within the forest revealed truths not only within him, but within human nature and society. On page, 1103 Goodman Brown states there may be a devilish Indian behind every tree. When defining irony, we think of it as an expression of ones meaning that normally signifies the opposite. This made me think of the irony behind the good in Goodman Browns name. Hawthorne makes us think that the character is a good man with only but the best intentions towards God. However, I believe it show cases the opposite behind the character s name. Throughout the story Goodman Brown shouts his faith and devotion for God, but behind every man s faith is curiosity. Faith is all Goodman Brown has known. He had even married a Faith. The double meaning of Faith within this story shows major Irony for us as the readers. Brown marrying a Faith was almost shown as he made the biggest devotion towards God. The main character has put every ounce of Faith he has into his life that would completely give himself to God forever. This is ... Get more on HelpWriting.net ...

Today traffic on the internet requires that millions upon millions of records be stored and queried each second. Data must be highly available and quickly retrievable. These requirements put together have given rise to new forms of database technologies collectively called NoSQL or Not Only SQL . NoSQL eschews the strict guidelines that govern the creation and function of traditional relational databases. These guidelines are put aside in order to rise to the new demands of an increasingly interconnected world. The rigorous standards and data definitions of relational databases give way in order to provide the ability to rapidly ... Show more content on Helpwriting.net ... NoSQL is able to address the massive traffic loads experienced by database servers at corporations that specialize in data processing like Google, Facebook and Amazon. NoSQL technologies can provide near constant availability, massive user concurrency and lightning fast responses. There are four primary NoSQL database implementation types being used today: document based, wide column (or columnar), key value and graph. The different properties of SQL and NoSQL databases will be examined and an overview of each NoSQL implementation type along with an example will be given. ACID v. BASE: Eventual consistency Standard SQL databases adhere to what are commonly called the ACID properties. This means that the database must be atomic, consistent, isolated and durable. Atomic means that each attribute cannot be broken into sub groups. Consistent means that the database displays only the latest data; there are no older versions of data present within the database unless by design. Isolated means that no transactions will interfere with one another; i.e. two concurrent users changing the same data in the database will not end with incorrect results; the transactions will be processed separately. Durable means that once changes have been made they will remain in place and not revert to their prior state (Pritchett, 2008). MAPK And The Regulation Of The Isolation Of Eukaryotic Cells Introduction Isolation of DNA along with transcriptional material in the nucleus, by the nuclear envelope, from the cytoplasm and the translational material held there gives the opportunity for exact regulation (Lange et al, 2006). The nuclear envelope provides the ability for regulation of gene expression and signal transduction. With this regulation cells can, if exposed to an extracellular signal, perceive and create an intracellular response to withstand or react to such a signal, for example, by signalling cascades with the use of mitogen activated protein kinases (MAPKs) (Brown and Sacks, 2009). A protein kinase can phosphorylate a protein at serine, threonine or tyrosine residues which can affect its position within the cell ... Show more content on Helpwriting.net ... The many isoforms of JNK could have varying catalytic activity on their substrates such as the means to phosphorylate a transcription factor (c Jun) in JNK1 and JNK2 (Liu et al, 2004). JNK phosphorylate either serine or threonine residues when there is a proline after it (Hibi et al, 1993). JNK can also be phosphorylated by autophosphorylation most notable in the JNK2 isoforms where it still allows initiation of substrates with the strongest occurrence in JNK22 (Tsuiki et al, 2003). There are three kinases involved in the MAPK phosphorelay system which act in series: MAPK kinase kinase (MKKK), MAP kinase (MKK) and MAPK (JNK), which respond to external stimuli, shown in Figure 1 (Johnson et al, 2005). There are a wide range of stimuli that can activate regulation of JNK including ultraviolet irradiation, growth factors (tumour necrosis factor ), cytokines and even protein synthesis inhibitors (anisomycin) activates MKKK and using phosphorylation to activate the next kinase in the process, MKK, which in turn phosphorylates MAPK (Dérijard et al, 1994; Kallunki et al, 1994; Lange Carter et al, 1993). There are 13 different MKKK including MEKK1 4, MLK2/3 and DLK that can act in the JNK pathway which provides the ability to responds these different external signals (Brown and Sacks, 2009; Dérijard et al, 1994; Johnson and Lapadat, 2002; Kallunki et al, 1994). • 19. Racing Flat Research Paper The Preferred Choice Fast times are the key to success in the world of running. When it comes to race day attire you have two real options that will give you an advantage over someone wearing a normal training shoe. These are a racing flat and a spike. A racing flat has the ability to support an athlete on uneven terrain and provide them cushioning on hard surfaces making them incredibly versatile. Also a racing flat is more than capable of being worn for races as long as a marathon while being light enough to give you great increases in performance. Finally The available cushion and natural range of motion that a racing flat provides tends to cause less injury in athletes than in a spike. Because of the reasons listed, a racing flat ... This can be supported by, A study published in a 2012 issue of the Journal of the American College of Sports notes that people who run in barefoot or with minimalist shoes such as racing flats instinctively land toward the ball of the foot. This reduces the risk of injury, which is more prevalent for those who land on the heel (Yemi 1). This is a clear fact that has been supported by numerous studies. The nature of a racing flat allows your foot to go through a more natural motion while running. This reduces injury. Another factor that makes a racing flat good at reducing injury is that it still has sufficient cushioning. Also in the study conducted by the Journal of Sports Science and Medicine they say that In this study, the amplified loading rate, stiffness, and peak vertical impact force demonstrate that running spikes and flats produced a greater external force on the body. The initial impact force between the foot and the ground is directly transmitted to the leg and can potentially be an influential factor in injury risk (logan, Hunter, and Hopkins 6). The cushioning as mentioned previously is light enough to give an athlete better performance while still substantial enough to protect the runner from some of this initial shock of running on a hard surface such as a track. • 20. The Causes Of Veteran Homelessness The United States of America rests on the shoulders of our brave men and women. It is unfortunate that once a soldier returns home, he or she has the strong likelihood that a roof, four walls, and a job will not be waiting. It is the responsibility of the people of this great nation to provide the support that these veterans need to survive in this world; they would help us survive in theirs. If goals are put in place and there is enough effort and power backing up the motor of these goals, then accomplishing an end to veteran homelessness will occur. This paper will examine the causes of veteran homelessness and how to cease and prevent veteran homelessness from happening and reoccurring. According to the National Student Campaign Against Hunger and Homelessness, as of 2014, 13.2% of the American population was homeless. Additionally, it was found that another 3.5 million people were strained to finding shelter in parks, under bridges, or sleeping in cars. Of this 13.2%, 23% of those suffering were United States veterans. The reason as to why veterans become homeless is due to war related disabilities, such as physical disabilities, mental detriment, posttraumatic stress disorder, and an inability to reorganize themselves back into civilian life, noted in Homeless Veterans: Perspectives on Social Services Use. In April of 2008, the U.S. Department of Labor released the unemployment rates of those who served in Iraq and Afghanistan since 2001 and the percentage of ... Get more on HelpWriting.net ...

  • 22. Life As A Contest With Fate By Heinrich Von Kleist When is the proper moment to think? Is it better to think before, during, or after an action? The writer, Heinrich von Kleist, argues that one should think after an act. He uses the example of a wrestler, The athlete, at that moment when he is holding his opponent in his grip, simply has no recourse but to act spontaneously, on inspiration; and if he begins to calculate which muscles to contract and which limbs to move in order to throw him, he will always draw the short straw and be thrown himself (Kleist, 1810). In this example Kleist is correct that it is more appropriate to reflect on your actions rather, but is this logic acceptable in all occasions? Or when an individual should think be dependent on the situation at hand? In the same essay, Kleist states life itself is a contest with fate , however should the entirety of life be treated as a contest (Kleist, 1810)? To begin with, is it better to think while you act? In the example stated previously, when the wrestler thought during he s match, he resulted as the loser. In the film Fearless, Huo Yuannjia s father faced a similar scenario. During a match to determine the better of two Wushu styles, Hou s father meets defeat when he became lost in thought. DNA profiling can be beneficial, as well as detrimental to the society we live in. DNA profiling has become the most widely used tool in the field of forensics because of the advantages it has to offer, although there are some drawbacks when it comes to utilizing this technique. DNA profiling has greatly enhanced law enforcement investigation by helping determine the suspect in a criminal investigation, minimizing the amount of unjustified arrests, and by overturning wrongful guilty sentencing. While DNA profiling has advantages in the field of forensics, it also has disadvantages. A few of the key disadvantages of DNA profiling are easy contamination, wrongful convictions, and access to and use of data. One of the foundations in the field of forensics is the examination of DNA. DNA is the digenetic element which exists in each and every cell. Every human being has an exclusive analysis of DNA.
