2. The Necessity Defense in the Killing of an Innocent Third...
1 Introduction
The general defence of necessity has long been disputed. The South African and English legal
systems are intrinsically opposite, and neither seem to escape controversy. These systems differ
greatly on the legal subject of defence of necessity in the context of killing an innocent third party.
The legal aspects of this defence, as well as accompanying problems which may arise, will be
briefly discussed in terms of the South African as well as the English law. Utilitarianism and
Kantianism will be used to analyse specific case law that made an enormous contribution to the
legal dispute regarding necessity.
2 Necessity
Necessity can be described as the voluntary conscious decision to break the law in order for a lesser

According to this Constitution, every person has the right to life and the right to equality. With a
successful defence of necessity for the murder of an innocent person, these basic human rights
would be infringed upon, which is legally unacceptable. Thus, a case should fail when using the
defence of necessity for the murder of an innocent person.
2 2 English Law
The United Kingdom has no constitution, which is why English law can only be found in the
common law of the United Kingdom. This common law does not regard the general defence of
necessity as a justification, but rather as an excuse to a crime which is then classified as duress,
and it does not recognise the defence of necessity to any murder. The English law, to my opinion,
is still quite unclear as to whether or not the ground of justification of necessity, as to the
unlawfulness of a crime, is accepted or not. The reason for this is because quite a clear position
had been taken up by the courts in the United Kingdom regarding this matter, until the recent case
of the conjoined twins, which led to a dispute in the English law as to the ground of justification of
necessity.
2 3 Case Law
Seen as S v Goliath, R v Dudley and Stephens, and the conjoined twins cases have all set out the
legal precedent to which two countries are to be governed by, they will be briefly discussed by
using the analogy of Utilitarianism as well as Kantianism. The basic premise of utilitarianism is
that the

3. Slavery Race And Ideology Summary
Throughout history, the word race has changed across cultures. It s been used to classify humans
in a variety of ways such as traits and behaviors. There is no gene in our human body that can
define what race we are. But in today s society people categorize individuals
According to Barba Fields, racism is an action, not an attitude, bigotry or prejudice . It s clear that
racism is an action you take to treat the other as a minority and with differences. Individuals
shouldn t be judging others just because of their skin complexion, or because they have longer hair
than the next person. Another point that Field states is, people were being targeted because of their
skin color . For instance, every Country has inhabitants of different skin complexion and maybe
speak different languages, different hair textures, etc. The whiter skin complexion discriminates the
darker skin complexion because they re darker; and will ... Show more content on Helpwriting.net ...
Also, she mentions the error people makes by believing that race is a physical feature rather than
being genetic. In reality, race was created to make people think they re superior to others because
of their background or maybe their skin complexion or their characteristics (how they look
outside). Field states that, when virtually the whole society, including supposedly thoughtful,
educated, intelligent person, commits itself to belief in propositions that collapse into absurdity
upon the slightest examination, the reason is not hallucination or delusion or even simple
hypocrisy; rather it is ideology. And ideology is impossible for anyone to analyse rationally who
remains trapped on its terrain. It s clear that society has taken race to the next level and people
have used it as a description of pressure. People grow into the society with the idea of that the
whiter you are the better your life will

4. Cost Control in Health Maintenance Organizations Essay
An HMO is an organized health care delivery system, which provides health care to its members
through networks of doctors and hospitals. Rather than traditional health plans, HMO s cost less.
Two ways HMO s control costs are: controlling hospital admission and length of stay, and by
providing incentives to physicians. These two cost control methods are further examined by an
article published by The National Bureau of Economic Research (2002). The article examines the
incentives to physician strategy for reducing utilization cost. The Physician Guide to Managed Care
(1994) describes HMOs the case management procedures used to control cost through hospital
length of stay and admissions.
Much of the focus regarding HMO controlling cost is ... Show more content on Helpwriting.net ...
Bonus levels are determined on the basis of performance, as performance improves the bonuses
gradually become higher. HMO s rely on rates and member satisfaction survey results to measure
provider performance. By keeping a certain level of member satisfaction, more revenue can be
brought in through new enrollees.
Financial incentives are generally more influential when it comes to physicians improving quality
of care. According to the National Research Council (2001), research regarding payment and quality
improvement efforts of health care administrators was presented at an Institute of Medicine
Workshop in April of 2004. The research showed ,with the use of physician incentives the total
direct savings in health care cost which include reduce visits and hospital episodes was an
estimated net savings of about 2,000 per patient. For more than 13,000 diabetic patients managed by
a physician group it was projected that the savings had the potential to generate over $10 million in
net saving per year. Aligning financial incentives with physician s networks provides the
achievement of better patient outcomes, but generally provides the HMO cost control over their
equity.
HMO s utilize the process of controlling hospital admission and length of stay as another form of
cost control. According to Nash (1994), in order to minimize hospital length of stay, the HMO
arranges in advance for care to

5. Slavery And The American Dream
Slaves they are products of a lost mind and irresponsible love. Now when I say a slave I am not
talking about someone who is the property of someone else that must obey his or her every
command. I am talking about the slavery of the mind that has run like wild fire among the black
community. However sad it may be, our own kind are making their children into slaves. There
are few things that have had such an impact on making slaves as the topics that I am about to
mention. Which all will take place within a child s first five years of life So when the new media
talks about all the mystics about how blacks are thug and criminals what else do they aspect.
You have taught a person to hate every aspect of them and to shun other with like features and to
strive for the American dream, by the way the American dream is white. So there is no place for
a black colored skin person too belong in the American dream. Not allowing someone to have any
place in this world forces them to come crashing into life.
Because at the end of the day it is up to you and you only to make sure you don t die and survive.
So now that theory are not only slave black people in this world there are also educated blacks that
are compared to these and are given no hope by society, because of a person of the same skin type
has all ready ruined the image of their face to be positive. So when you ask a black person where

According to Cornel West and Henry Louis Gates in their book entitled, The African American
Century: How Black Americans Have Shaped Our Lives, in her lifetime she wrote a total of
seven poetry editions, two five autobiographies, four children s books, a screenplay, and two essay
collections (West and Gates 276). Her most acclaimed publication was her introspective novel, I
Know Why The Caged Bird Sings, which was based on her childhood, growing up in a then
segregated Missouri (West and Gates 276). Margalit Fox wrote in an article for the New York
Times, this book was the first time anyone paid attention to a black woman s autobiography
(Fox). The narrative awakened a culture of female self revelation in 1970 (West and Gates 279).
Because Angelou s works examined concepts of race, identity, family, and community, which are
still prevalent today, they have stood the test of time (Fox). She was also gifted in theatre and
film. She acted on Broadway and was nominated for a Tony Award, and she performed on
television in the mini series Roots in 1977 (Fox). Maya Angelou then took her passion for language
and shared it with others. As stated in the article Maya Angelou: Teacher, she found her true calling
as a profressor at Wake Forest University, teaching subjects such as world poetry and Shakespeare.

Passivity and Impotence in Frankenstein
There are many ways to interpret a literary text, especially one as laden with ethical questions and
literary allegory as Mary Shelley s Frankenstein. Shelley s complex family dynamic her conflicted
relationship with her father, her need to please her mentor/husband with literary success, her infants
deaths enhances the intrigue of the novel and suggests multiple themes and layered meanings. One
discernible theme in Frankenstein is illuminated by the bold line that separates male character from
female: The men inevitably fail the women whom they claim to love, but the women are
maddeningly passive, seemingly blind to the men s inadequacies. Here, however, this passivity is a

Elizabeth s lack of force and tepid presence in the book Victor s descriptions of her generous
nature notwithstanding mirror Victor s weaknesses. His follies are the meat of Frankenstein, and
though his initial failure to study the right books can be blamed on Alfonse, the rest of the book s
mayhem lays squarely on his shoulders.
Victor glorifies his own childhood and his parents responsibility for his happiness when he
describes it, With this deep consciousness of what they owed towards the being to which they had
given life...I received a lesson of patience, of charity, and of self control... (33).
Unfortunately, he absorbs none of their parental talent or compassion. When Victor creates the
hideous Monster, he abandons the Monster and essentially abandons the world on which the
Monster is unleashed. Victor s failure as a father to the Monster is the second link in the chain of
death swung by the Monster at William, Clerval, Elizabeth, and by default, Justine.
Like Alfonse, Victor excels at female worship but falls a step beyond Alfonse s well meaning
ineptitude into a deep crag of impotence. Throughout the novel, Victor speaks of Elizabeth in

One Christian man who utilized and clearly enjoyed literature both of fiction entertainment and
non fiction as a means of spreading the Christian worldview is C. S. Lewis. Lewis, though the joys
of the sub genre of fantasy, managed to create an entertaining story while also upholding and
spreading the Christian worldview. One of his most famous works, The Chronicles of Narnia, is a
series filled with magic and the impossible, but the entire series is riddled with allusions to the
Bible, allusions that fell into place because of his Christian faith. The creation of Narnia (The

Even when the body goes to sleep, the mind stays up all night, telling itself stories. There is a
feeling of greatness and satisfaction in reading and thinking about different situations, of

fantastical literature, in which I have found both my passion and, as I believe at this time in my

miniscule nutshell, it takes, to various degrees, planning, delving into psychology, and research.
A good story takes imagination, work, prayer, and, of course, a good deal of coffee. It has been
twelve years since I first discovered the joy of writing, and since then, the desire and joy of this
action of creation has only grown, much like a seed of a great oak tree. To me, there are few things
that match the euphoria of writing and completing a story, or even just a chapter in a manuscript. I
have a passion for both writing and reading: indulgences (in the right moderation) which tend to go
hand in hand. After all, what greater teacher for the writer than those who have written and kept
moral standards which they released into

9. Emission Of Radiation
Light Amplification by Stimulated Emission of Radiation (LASER) produces a narrow beam
light, which is used in a multitude to modern technology (NASA, 2017). A LASER is produced
through the using energy to excite atoms trapped within a space surrounded by mirrors. The
atoms will emit photons that will recoil off the mirrors, the more activity in this space the more
photons will be released, as it will increase the excitement of other atoms. In one section of the
codified are area a partial mirror is used allowing a singular been of photons to be released, hence
the LASERbeam. After Theodore Maiman invented the first practical laser people began to see the

The efficiency of the LASER can be seen as the output ranges from 9 to 11 m (Whitehouse, n.d.).
The gas discharge consists of multiple frequencies in the near IR to the mid IR ranges. The Carbon
Dioxide molecule is symmetric and linear, consisting of the carbon atom s balance with the two
oxygen atoms: O C O (Whitehouse, n.d.). Due to this triatomic (n=3) nature of the molecule
under principle it must have 4 vibrational modes, established by the 3n 5 relation of linear
molecules. Figure 1 depicts symmetric stretching mode v1, doubly bending mode v2 and the
asymmetric stretching mode v3 (Polfer, 2016). When each mode is in a ground state the
quantum vibrational is noted as 000, compared to 001, in which the first excited mode is the
asymmetric stretching mode, while the others are at the ground state. Figure 2 depicts the CO2
LASER s energy diagram. The excitation of N2 into its first vibration state is the result of
discharge. The N2 atoms cannot relax back into ground state through spontaneous emission due to
its limited dipole moment (Polfer, 2016). The CO2 molecule enters its first energy level of
asymmetric stretch, 001, by collisions between N2 molecule and CO2 molecules at ground state.
Stimulated emissions are activated from the 001 level to the 100 (symmetric stretching) and 020
(doubly bending mode) (Polfer, 2016). These two energy levels relax to the 010 level, as the result

Government
Rome like Carthage traces it s founding myth back to the Phoneticians of Tyre and shared many of
the same governmental structures as Carthage with a Senate, assemblies, etc (Duncan, 2016).
Undoubtedly it was influence by the Greeks, however it grew beyond the simple city states of
Greece. It was the evolution of Roman government which differentiated themselves and allowed
them to eventually surpass their Greek neighbors.
Military
Early Rome was a warrior people whose success was founded not just based on that of their
military but their ability to adapt and absorb the military strategies and tactics of those they fought.
The navel vessels via the Carthaginians where derived from the Greek triremes, and even the
formations hearken back to the Trojan phalanx. They took what worked, improved it and made

violence of children s television shows (includes violent characters, victims and perpetrators of
violence) are double than that of prime time adult television shows. Back in 1961, Albert
Bandura conducted the Bobo Doll Experiment to study aggression in children. With Bandura s

with two groups of children, one who watched a film of an adult playing with a Bobo doll
violently, and one group that did not. The group that witness the violent behaviour were more
aggressive towards the doll as opposed to the other group of children. When children are young,
they are exposed to many different violent cartoons (The Roadrunner, Teenage Mutant Ninja

Nature has always played an important role in human history. Increase in international trade,
globalization and creation of big corporations caused negative impact on the environment. The new
economic framework established after the end of the World War II benefited the interests of the
multinational corporations. The Bretton Woods systemwas aimed to boost the production and
consumption of commodities. The World Bank and the IMF, led by the US, financed corporations
and exploitation of resources. The Bretton Woods system was supposed to make use of the world s
natural riches. The fall of Communism in the world gave more power to the corporations and led to
the creation of the free market system. The US government tried to help underdeveloped nations to
export wood, livestock and other commodities to industrialized countries.
The establishment of new financial institutions helped the public works projects to rise. One of
the examples of these projects was the Tennessee River Valley in 1933. The government
constructed 20 dams and coal fired power plants with a purpose to provide electricity to poor
areas. Although the project provided many benefits, it also created a quite few ecological
concerns. Construction of dams flooded to many areas. Mining of coal caused pollution and
erosion. The same situation was evident across the globe. Thailand has built 26 irrigation and
hydroelectric projects since 1957. Most of them were financed by the World Bank. The country

benefits for bilingual students in the future. For example, it is acknowledged that English language

with monolingual candidates, who are competent to perform their duties only in native language

Imaging technology is the visual representation of a body part, such as an organ, for the purpose
of a medical diagnosis. Nowadays, technologies such as X Rays, Magnetic Resonance Imaging
(MRI) and ultrasound are used everyday for medical analysis. X Rays are very useful because
they can penetrate through different materials to give an image of the interior of the body. MRI
use strong magnets to create an image of a body part, while ultrasound imaging uses sound waves.
Bone, muscle and fat absorb x rays at different levels, so the screen lets see different structures of
the body because the different levels of exposure are in different shades of gray. The main
component of an x ray machine is a vacuum tube with a cathode or filaments and an anode, which
is usually made of tungsten, a hard steel gray metal used to make electric light filaments. Electric
current passes through the filament, raising its temperature. Once it reaches a certain level of
energy, the filament starts emitting negatively charged electrons. These electrons are attracted with
great force from the positively tungsten anode, taking them through the vacuum tube at very high
speed. In one of the atom s lower orbital an electron gets knocked away when the anode collides
with electrons. An electron from the higher orbital takes place of the removed electron, releasing
energy as an X ray photon. (HowStuffWorks X Rays) Called bremsstrahlung , the reaction contains

21. Theme Of To My Dear And Loving Husband By Anne Bradstreet
Poetry Analysis
Poetry is a form of literature that can be both artistic and meaningful, with many similarities and
differences between the poetry pieces created by the millions of famous poets throughout history.
The poems To My Dear and Loving Husband by Anne Bradstreet and Shall I compare thee to a
summer s day __ _______ ___________ are two examples of poetry masterpieces that not only
have many things in common, but that also have things that make them unique and singular pieces
of literature. When writing, poets like Shakespeare and Bradstreet try to convey a theme or
meaning that they want their readers to comprehend and understand.
Often, poems from different writers can have a common theme shared between them. In the case of
... Show more content on Helpwriting.net ...
A third similarity between the two poems is the use of a first person narrator. In poem 1, the
writer uses the word I when directly speaking about the narrator s feelings. In poem 2, the writer
also uses the word I , but instead uses it in an indirect, roundabout way that has the same
intended meaning as its use in poem 1. There is, however, a definitive difference between
narrator one and narrator 2. This definitive difference, as alluded to earlier, is the gender of the 2
narrators. The narrator of poem 1, for example, is a female writing to her husband. However, in
today s realistic society it could just as very well be a guy writing to his husband if some of the
minor word details were changed. In poem 2, the narrator is semi obviously a man talking about a
girl. As stated before, this could also be taken into the context of a girl talking about another girl in
today s realistic society.
There is yet another way in which the poems are different. The writing style used by the two
writers is entirely different. For example, Shakespeare normally writes all of his poems and/or
sonnets in iambic pentameter. This means that the poem ends in a rhyming couplet, while the other
preceding lines of the poem follow another rhyme pattern, which in this case is what is known as
the a b rhyme scheme. In the case of Shall I compare thee to a summer s day , the poet uses So

These hormones can cause a wide range of symptoms. Most the time, mothers with postpartum
psychosis do not have control of their own emotions, making them very harmful to themselves
and to others. Psychology Today writer Mark Levy explains that though PPD is serious, the
severity of this type of psychosis has a predominant symptom which is a break with reality a loss
of the ability to discern what is real from what is not (Levy, 2002). Mothers with psychosis may
hear voices, have hallucinations or delusions. The Journal of Behavioral Health Services
Research have determined that Postpartum women with obsessional thoughts have been noted to
have aggressive obsessions to harm their infants (Coates, 2004). Osvaldo Mejia, who had a
personal experience with this illness involving his wife, explains his encounter: She complained
that she was tired but could not sleep and ate little. She told him she was scared but could not
explain why (Black, 2013). Soon after, Mejia realized that his wife must have been suffering from
postpartum psychosis when he found his nine month old baby boy stabbed in his crib. Many
people think that psychosis and bipolar disorder are connected in some ways. Many research has
proven that there might be a relationship between the two disorders, and even some misdiagnoses.

23. Egalitarianism In The 1700s
Starting in the late 1700s there has been an adjustment in the various countries of the Middle East
and North Africa. It is a known fact that in these areas there is a hierarchy of tribal, ethnic, familial;
despite the weakening of the traditional social framework and the erosion of the status of the
traditional tribal, ethnic, and religious notables. While this is still true to this day there have been
many changes from the 1700s to the second colonial areas that have brought about new political
identities particularly the idea of nationalism and egalitarian ideology.

College where young intellectual elites would be studying and benefited from the exposure to
Western ideas. Bashir Sfar believed that the French could benefit the lives of the Tunisians through
rural colonization. However, this idea did not get implemented and the official colonization left
Sfar bitter and angry. Sfar wrote about how France is a wealthy nation and can finance the
installation of its citizens without having to condemn anyone to starvation or flight. (Perkins, 60)

25. History of the West Nile Virus Essay
History of the West Nile Virus
Abstract
West Nile virus (WNV) is a virus that is transmitted by mosquitoes. It has been found in humans,
birds, and other animals, typically in Africa, Eastern Europe, and the Middle East. In 1999, WNV
was detected in the United States for the first time, and since then it has spread across the U.S.
According to the U.S. Centers for Disease Control and Prevention (CDC), over 15,000 people in
the U.S. have tested positive for the WNV infection since 1999, including over 500 deaths. Many
more people have likely been infected with WNV, but have experienced mild or no symptoms.

Because New York City is such a huge port of entry into this country, it was suggested that WNV
came from a bird smuggled into the US from Africa or Asia. Since then, WNV has spread to 48
states, and to Canada and Mexico. Ever since the outbreak in New York till now there where
15,000 people in the U.S. that tested positive for WNV infection. The virus has probably spread to
the east through the west by migrating birds that have the virus.
West Nile virus exists in nature through a transmission cycle involving mosquitoes and birds.
Mosquitoes become infected with West Nile virus when they feed on infected birds, which may
carry the virus in their blood for a few days. Infected mosquitoes can then transmit West Nile virus
to humans and animals when biting to take a blood meal. In rare instances, West Nile virus may be
transmitted from human to human through organ donation or blood transfusion or from pregnant
mother to fetus. These new modes or transmission are still under investigation.
People typically develop symptoms 3 to 15 days after they are bitten by an infected mosquito. WNV
affects the central nervous system in the body, however, symptoms vary. Less than one percent
(about one in 150 people) of individuals infected with WNV will develop severe illness. The severe
symptoms can include high fever, headache, neck stiffness, stupor, disorientation, coma, tremors,

First of all, it is important to distinguish that the appellate and discretionary powers belonging to
the Supreme Court are two separate powers. The appellate power is the power of a higher court to
reverse or uphold the ruling of a lower court. The Supreme court is the highest court and thus takes
more appeals cases than trial cases. This is due to the limited original jurisdiction of The Supreme
Court. Unless the case is between two states, involves the United Statesas a party, or involves a
representative of a foreign nation the U.S. Supreme Court lacks original jurisdiction. The Supreme
Court also has limited appellate jurisdiction. The Court can only hear a case if a federal question is

Allowing for appeals to the highest court allows for important decisions to be made that set
precedent for the rest of the courts. It also allows for errors made in the lower court to be
corrected. The appellate jurisdiction that The Supreme Court holds is granted by The
Constitution. In Article III of the preamble The Supreme Court is only limited by the discretion
of Congress. In a way this power has more checks in place than the discretionary powers. One
major critic of the appellate power of The Supreme Court is that it allows for lower courts to be
invalidated. This can lead to less faith in the lower courts and thus undermines the power of the
overall judicial system. Another problem with the appeals process is the amount of useless
litigation that results from the ability to appeal. The Supreme Court does not often overturn
decisions made by the lower courts and thus most of the cases brought to The Court take up time
and resources that might be better used. The process of appeals for the Supreme Court solves
some of this problem, but does not completely mitigate it. The review process used by The
Supreme Court is highly effective and ensures only cases that need the decision of The Supreme
Court reach the justices. As such, the appellate powers of The Supreme Court have few issues and
serve an important function in the Judicial

Comparing the Desktop with other computer systems
Advantages
Top of the range desktops have more power than laptops, micro computers, mobile devices and all

To start off, desktops can contain much more hardware than a mobile device or microcomputer and
AIO PCs, the outcome of being able to store so many components is the result of fitting high
quality parts that are more power immense in the computing industry so desktops beat small
devices on meeting possibilities.
The desktop has the extra benefit of being extremely customisable to adapt to the user and
environmental challenges
Extending from previous points, the desktop can surpass other systems in terms of using
components that can be located swiftly whilst being changeable in order for a client to upgrade,
this is ideal in the industry for those that want to commission their system for a preferable
experience.
Disadvantages
Highly bulky compared with the other mobile, all in one and micro systems
On the other hand, due to the occupation of desktops for retention of more dynamic components
that are heavy, the weight builds up to create a computer device that is forced to be in one space
involuntary for usage on the go in comparison to mobile devices.
Need a big space
Furthermore, the last disadvantage is users have an insufficient device for versatility, clients would

Challenges Facing Sports Facility Managers Planning and managing a sport venue during any

that a facility manager must consider in order to ensure the event is a success. Success of an

both can lead to a fun and safe environment for all parties involved with any event.
Crowd Management Ammon and Southhall (2004) define crowd management as an organization
tool used to assist facility managers in providing a safe and enjoyable environment for their guests
by implementing facility/event policies and procedures (p. 145). Part of the process for ensuring a
safe event is to identify any foreseeable duties and to develop a plan.
Duties
One of the main responsibilities of a facility manager to control a crowd is to account for every
spectator that has entered into the facility. Facility managers should be able to anticipate and
recognize and potential crowd management problems. Movement throughout the facility is a
major safety concern and is just as important as the ingress and egress of patrons (Ammon et al,
2004, p. 145). It is the facility manager s role to ensure vendors are not blocking emergency
evacuation routes as well as ensuring spectators are not loitering in aisles or thoroughfares. Prior

Abstract
Genetic mutations have been linked to disorders for many years thanks to the advancement of
science. Because of multiple studies, scientists have been able to isolate the exact places in the DNA
sequence where these alterations have occurred and characterized the physical manifestations as a
result of such variations. Although the incidence of some of these disorders are one in a million,
their distinctive physical or mental representations have been well catalogued and documented.

The disease is a result of a mutation in the gene that directs protein formation (specifically fibrillin

have long and thin arms and legs as it causes the bones to overgrow and also affects the joints.
Because of how it elongates the chest bone, spinal curvature is also a characteristic.
Proteus Syndrome Known as the elephant man syndrome, is expressed as overgrowth of the
individual s tissues, bones and skin. This disorder is caused by a mutation in the AKT1 gene which
is responsible for regulating cell growth. Because of normal cell growth and division, only some
cells in the body will exhibit the mutation, which explains the combination of normal and abnormal
characteristics.
Over the years, and thanks to the progress of science, the myths that surround these characteristics
caused by genetic malformations have been demystified. Other alterations on the other hand, have
been caused as side effects of advances of this same science. It is imperative to have control and to
