Legal framework
Between 2006 and 2008 the European Commission issued a series of regulations aimed at
governing the use of fluorinated greenhouse gases referred to in the Kyoto protocol and
listed in the Annex I attached to Regulation (EC) No 842/06, which are gases with a
global warming potential (GWP) that is, on average, over 1000 times more powerful than
CO2.
► Regulation (EC) 842/2006 and then : Regulation (EC) 303/2008, Regulation (EC) 304/2008,
Regulation (EC) 305/2008, Regulation (EC) 306/2008, Regulation (EC) 307/2008
Not until 2012 did Italy transpose the requirements of these regulations with DPR* 43/2012.
These regulations establish the need for a compulsory certification for individuals and
companies working with some fluorinated greenhouse gases .
All regulations confirm that, without such certification, personnel and companies will
no longer be authorised to carry out their activities.

Personnel certification is divided into 4 categories, from I to IV, depending on the types of
activities the person will be authorised to perform on equipment.

The National e-Register
The italian laws have put in place a dedicated Register.
The National e-Register is a web portal – www.fgas.it
Its objective is to take a census of all personnel and companies affected by this new
certification, since they handle fluorinated gases during the execution of their job. It was
set up by the Ministry for the Environment and it is managed by relevant chambers of
commerce.
Following the registration, chambers of commerce release the registration certificates

Italian certification system – Personnel
► Pursuant to ISO 17024, («Certification of persons») only certification bodies accredited
by Accredia and approved by the Ministry for the Environment can provide
examinations.
► The CB can either perform the exam directly or qualify an evaluation body possessing
classrooms and equipment needed to take the theory and the practice tests.
► Laws do not require any training obligation for personnel.
After passing the exam, the CB releases a 10-year certificate to the candidate and this
person will be registered as a qualified operator in the National e-Register.

Pursuant to Accredia technical regulation – RT28 the exam shall be performed according to
the following criteria:
•A theoretical part consisting of 30-10 questions depending on the category.
•A practical part where the candidates shall perform the tests referred to in the annex
attached to the reference regulation.

The requirement for certification shall not apply to manufacturing and repairing activities
undertaken at manufacturers’ sites for stationary refrigeration, air conditionig and heat pump
equipment containing fluorinated greenhouse gases.

Which companies have to register?
Definitions:
Installation: means joining two or more pieces of equipment or circuits containing or
designed to contain fluorinated greenhouse gas refrigerant, with a view to assembling a
system in the location where it will be operated, including the action by which refrigerant
conductors of a system are joined together to complete a refrigerant circuit irrespective of the
need to charge the system after assembly
Maintenance or servicing : means all activities, excluding recovery and checks for leakage
(…), that entail breaking into the circuits containing or designed to contain fluorinated
greenhouse gases, in particular supplying the system with fluorinated greenhouse gases,
removing one or more pieces of circuit or equipment, reassembling two or more pieces of
circuit or equipment, as well as repairing leakages.

► Only certification bodies accredited by Accredia in accordance with EN 45011
(product/service certification) and approved by the Ministry for the Environment can
perform the audit.
► Accredia has developed a special Technical Regulation – RT29
► If the audit has a positive result, the CB releases a 5-year certification and validates the
registration of the company as a certificated organisation in the National e-Register.
Without a valid certificate companies cannot handle fluorinated gases
► If the company passess the annual surveillance audit, that are both documentation and
onsite audits, the certificate will remain valid
► The requirement for certification shall not apply to manufacturing and repairing activities
undertaken at manufacturers’ sites for the above mentioned equipment.

► How to meet the first requirement of the regulation:
• Ensuring sufficient number of certified staff for activities falling within the requirement for certification
in order to cover the expected volume of work
Accredia has developed the following guidelines which have been revised by BV:
The following table contains the minimum number of certified persons, which is
determined by the turnover connected to installation, maintenance and repairing of
refrigeration, air conditioning and heat pumps equipment.
Note : EC regulation states that all persons carrying out certain activities have to be certified. This
means that the above table defines the minimum number of persons in a company that have to be
certified.

• Possessing and making available to personnel all procedures and equipment needed to properly
carry out the activities falling within the requirement for certification
Necessary procedures include: control and qualification of personnel, control of
equipment, procedure for managing complaints and nonconformities.

• A specific Quality Plan regarding the provision of service subject to certification
A «Quality Plan» is a document that specifies applicable procedures (personnel qualification
and training, control, maintenance, calibration of tools, management of complaints and
NCs) as well as resources that shall be used, irrespective of roles and responsibilities for
the conduction of such activities.
Companies of this sector often use dedicated reports to register each activity that was
performed.

Regulation 517/2014
► Until the Ministry for the Environment and Accredia do not provide any specific instruction,
things in Italy will remain unchanged.
► Section 10 states that member states shall ensure that people working on installation,
maintenance, repair and recovery of gas from the already mentioned equipment + people
working with cold rooms, refrigerated trailers, switchgears and Rankine cycles get
certified.
► As regards certification and training programmes, regulation 517 refers to regulations 303-
307, and so it confirms what has been done so far.
► All certificates/attestations issued according to regulation EC 842/2006 remain valid.
► Member states shall ensure that training is available for those who wish to keep up-to-
date.
