Thomas Davitt On Contractual Obligation
The basis on contractual obligation is a promise, a promise from both parties to perform a duty, or
duties in reliance on that promise. This paper will take the stance that Thomas Davitt takes, stating
that though mutual assent and consideration are important to a contract, those factors are not the
essence of a contract. There is a moral obligation to fulfill a contract, one that is much more than
simply words written on paper. The second restatement of contracts defines a contract as: a promise or
a set of promises for the breach of which the law gives a remedy, or the performance of which the law
in some way recognizes as a duty. Restatement (Second) of Contracts § 1 (1979). The restatement
goes on to define what a promise is. A ... Show more content on Helpwriting.net ...
Davitt discusses the difference between consent and assent . Davitt states that the former implies a
positive action and involves submission, while the later involves more passivity or submission, which
does not include consent. Id. at 273. Davitt would rather state that knowledge and consent are more
appropriate, because these two factors can be applied to both natural and legal promissory agreements.
Id. at 274. In Davitt s view, consideration is not the basis for contractual obligation. Davitt uses
consideration to discuss ways in which to distinguish between legally enforceable promises are those
that are not. According to Davitt, a consideration is the price bargained and paid for a promise. Id. at
277. Consideration, as defined in the restatement, is similar, stating that in order [t]o constitute
consideration, a performance or a return promise must be bargained for. Restatement (Second) of
Contracts § 71. Though Davitt uses a similar definition to that of the restatement, he believes that
consideration is not even essential for a contact. Davitt states that bargaining, or a quid pro quo, too
often fosters injustice and frustration of honest claims. The Elements of Law, at 279. Davitt also states
that men have been making agreements for a long time that do not involve a quid pro quo, or anything
else like the later, yet there is still a trust between the two parties. Id. at 282. Davitt argues that

Staying Fat For Sarah Byrnes Quotes Courage
It s scientifically proven that people who live courageously have less regrets in life. Leaders have a lot
of courage, and that s what people like in leaders, but you don t have to be a leader to have courage.
Everyone s born with it in them. There are people with less courage and others with buckets full of
courage, but I know everybody has at least some in them. Courage is important because it s taking a
risk or making a decision to help yourself or others. It s doing something you re scared of doing. In
Staying Fat for Sarah Byrnes there is a lot of courage shown by the characters. We all show courage at
one point or another.
Courage is important for helping others. Sarah is the most courageous character in this book because
she was brave to do things. There were many different parts of the book where she showed courage,
but definitely the most courageous one was when she was three years old and tried to save her mom
while she was being abused by Virgil Byrnes. On page 143 Sarah says to Eric, I ran at him, screaming,
and crashed into his legs. It knocked him off a little, and loosened his grip and my mother got away. I

It builds integrity in people. Even Mark Brittain had courage. Especially near the end of the book.
While Eric was in the hospital, Mark came by to talk with him. The talk later led to Mark announcing
to his whole class that what Jody was saying was the truth and what Mark had been saying was all
lies. When Mark finally decides he has the courage to tell his class the truth, some of what he says is I
m a liar. I think the last words I said to this class were that Jody Mueller was a liar. Not so. Jody got an
abortion just like she said... Then I tricked her into thinking it was her fault... Everything she said
about me is true pg 282. Mark had the courage to tell the truth, and it ended up being the right choice.

Reasons For The Collapse Of The Han And Mayan Empires
A number of complex and enduring empires have dominated large parts of Afro Eurasia, and Meso
America. Among these were the Han Empire in China, the Roman Empire in the Mediterranean Basin,
and the Maya in Meso America. These empires had wealth, power, and they are a vast size, but they
all suffered their unfortunate collapse. There are multiple factors that contribute to the collapse of
these empires such as warfare, taxes, the environment, problems with the government, religion, and
shortage of resources like food and water. The reasons for the collapse of the Han and the Mayan
empires are very similar. However, there are also some striking differences of the reasons why these
empires collapsed. The Han Empire s disintegration happened because of 3 reasons: warfare,
governmental problems, taxes, and shortage of resources like food and water. Warfare had an impact
on the failure of the Han Empire because they needed a lot of strong and efficient armies which led to
the need for manpower, food, horses, and weapons. These needs couldn t be fulfilled because the taxes
were so high (governmental problem) that the peasants had no way of paying their taxes resulting
many joining rich land owning generals lands which means that these peasants are now under their
command. Since these peasants left their land to join those that were rich, their plots of ... Show more

They are warfare, shortages of food and water, and governmental problems. Warfare is a problem for
these empires since it is mainly the start of more issues like government problems and riots which will
eventually cause the destruction of the empire. To further explain, in Document 9, it states, With entire
communities engaged in warfare, fields were left fallow and water control systems deteriorated. This
means that war changed everyone s lives and made everyone not care about their community resulting

Guns In Public Places
People should not be allow to carry their guns in public places because there are a lot of people dying
because of shootings. Americans needs more regulations on the gun situation, we don t want more
people under 3 meters of dirt just because some crazy person was able to get a gun and start to shoot
them, that s why guns should be restricted and take them away from everyone. The first reason we
need more regulations on guns is because there are a lot of irresponsible people that have guns at
home. They keep them ready to shoot, and that s no how it supposed to be. They have to put the
bullets apart and the gun with a look according to the The Brookings Essay The promise. The Families

Factors Influencing The International Students
Factors influencing the international students to choose the United States as their higher study
destination
Prejin Kumar Pradeep Kumar Husson University
Abstract
The United States hosts more of the world s 4.5 million global mobile college and university students
than any other country in the world, with almost double the number hosted by the United Kingdom,
the second leading host country. However, little research has done on various components that
influenced a student to choose a country for higher education. In this investigation, I consider a survey
approach on students in selected countries about their preferred study destinations, their reasons for
studying internationally, their main sources of information on overseas study and their opinions of the
U.S. as a potential study destination compared to other key host destinations. Specifically, the quality
of education and research opportunities are the two major factors that students consider before
choosing the United States as their study destination.

The Importance Of Catching A Girl s Lacrosse
Girls lacrosse isn t as easy as it looks. Without the right training and and equipment you can get
seriously injured. Lacrosse is the oldest sport in North America. Lacrosse had started in 1857, girl s
lacrosse started in 1890 and was given its name by french settlers. In 1933, girl s lacrosse was
restricted with rules that limits stick contact, prohibits body contact, and requires protective
equipment. In order to play girl s lacrosse you should know 3 basic techniques, picking up ground
balls, throwing/catching, and cradling. Ground balls are simple to pick up but requires a lot of effort at
all times. Your right hand has to be at the throat of the stick, preferably a little bit above the middle

Catching a lacrosse ball isn t hard as long as whoever is throwing it to you has good aim and doesn t
hit your face. When catching a lacrosse ball you want to make sure that your right and left hand are in
the same position as picking up ground balls. Your lacrosse stick has to be towards your right and the
back of your lacrosse stick has to be facing you so that the opening is facing forward. You want to
have your lacrosse stick bent forward so that the person knows you re ready to catch the ball. Always
be sure that when someone is throwing the ball towards you, your lacrosse stick moves towards
whatever direction the ball is heading towards. For finalization, the ball can be felt when you are
holding your lacrosse stick. You want to get your hands into the same position you were in for
catching, make sure that your right foot is forward and bent, also that the bottom of your lacrosse stick
is in front of your body and the head of the stick is behind your head but to the right. Now you are
able to just throw the ball, but when you do it make sure that the ball is towards the center in your net

John Hart Sacrifice
I think the 3 major signers who made the biggest sacrifice are, John Hart, Richard Stockton and
Francis Lewis. I uprightly believe that John Hart had the worst of all. This man has been through it all,
he tried returning home to see his wife who lay on her death bed to find soldiers ruining his farm and
wrecking his homestead. He had to sleep in caves and woods and was hunted across the countryside.
When in the end embeded by hardship he managed to sneak home to find he wife already buried and
his 13 children removed from his home, he never saw them again and died in 1779 without ever
finding his family. Richard Stockton, Judge. He rushed back to his home in effort to evacuate his wife

Education Reform in American Schools Essay
Education Reform in American Schools
Frederick Douglass was, and still is, a golden example of why education is so important to a human
being s life. Douglass spent the first part of his life in ignorance. However, his life of a seemingly
endless servitude and ignorance was completely shattered by the fact that he learned to read. Once he
learned to read, his life was forever changed. He escaped slavery and tyranny and became an icon
even to this day.
Douglass s story more than adequately shows that a quality education is perhaps the most important
thing a person can receive in their life. Without his education, he would not have realized the shame
and inadequacy his slavery, and unfortunate acceptance of that slavery, held him ... Show more content

Interest groups, who are more interested in preserving their values as opposed to maintaining an
exceptional education (Christian fundamentalists, for instance), that control some communities, can
completely destroy any opportunity for a young mind to learn. The politics of racial injustice are
hopefully completely gone, but we re still living through a state where the races feel as though they
are still there. Of course, from my perspective (the perceived subjugator), it is easy to claim the
politics are not there. From the perspective of those who believe they are being subjugated, it is even
easier to say it is there. They feel it.
The second problem, and possibly the most important, is a question of interest.
Are schools really condusive to American youth to learn in a stumulating way? I don t believe so.
Pubescent students are almost incapable of true learning because their minds are clouded by a
hormonal fog for an enormous part of their lives. They walk around the schools nearly humming and
buzzing with new and exciting thoughts they are just beginning to understand. Once those hormones
have calmed and the student feels they can control them a little, there is still no difference in the way
they are taught. Nearly every school is the same (Wood 9). The students go to class around eight in the
morning and come home around three in the afternoon. If a student is old enough, that student will

Essay on Henry Ford
INTRODUCTION
When you think about Ford, an automobile will usually come to mind. Most people don t think about
the man behind that name, Henry Ford. Henry Ford was the man responsible for the Ford Motor
Company (FMC). He was also the creator of the invention that changed the mass production industry,
the assembly line. As you read on you will learn about Henry Ford s life, the FMC, and the assembly
line.
FORD S LIFE
In Wayne County, Michigan on July 30, 1863, a pair of Irish immigrants, William and Mary Ford,
gave birth to a boy who they named Henry. They owned a farm in Dearborn, Michigan where Henry
helped his parents and attended a one room schoolhouse. ... Show more content on Helpwriting.net ...
The automobile didn t look like much with a carriage body and a lever for steering. This car was what
got Ford started on the way toward the automotive industry.1
Ford only had one son, who was president for the Ford Company from 1819 to 1943 when Edsel, died.
Henry had to take over presidency for two years until he gave his position to his grandson, Henry Ford
the II. After living for 83 years Henry Ford passed away on April 7, 1947, at his home in Dearborn,
Michigan.3
FORD MOTOR COMPANY
In 1903 the Ford Motor Company was incorporated after two unsuccessful attempts. Henry Ford was
the vice president and the chief engineer. The company started out only making a few cars a day at the
Ford factory, with two or three men working on a car at a time and having to use parts made to order
from other companies.2
Ford s dream was to produce a moderate priced, reliable, and efficient automobile, which came with
the Model T in 1908.3 A company that started out small, now had over half of the car owners in
America driving the Model T.1 It was easy to operate and maintain, it also handled good on rough
roads. It was the most popular automobile in history, and over fifteen million were sold. With the
Model T, Ford achieved his goal to make reasonable priced cars for the average person. 2
The reason he could make cars for decent prices was that the FMC owned its own steel mill and iron
mine, and could make its own parts.

Respiratory Chains
All living cells that are able to divide and receive the parental genetic material, are depending on
permanent delivery of energy which is stored in reusable forms. Being separated from the outside
environment, within this cells, endo and exothermal reactions are present, allowing them to provide
their own vital processes and to synthetize their own components (Lodish et al., 2000). Photosynthesis
and respiration, the most important energetic processes occurring in the cellular membranes, are
transforming one form of energy into another. Photosystems are able to transform the energy of
photons into chemical energy which is stored in molecules like ATP or NADPH. Furthermore, the
chemical energy of reduced compounds by oxidation processes is transformed, by the respiratory
chains, also into molecules like ATP (Lodish et al., 2000, Hohmann Marriott et al., 2011). ... Show

The direction of electrons through the respiratory chain is driven by the redox potential of each of the
elements the measure of affinity to electrons which moves from the negative redox potential to the
positive redox potential (Lenaz et al., 2010). Respiratory chains are mainly composed of large multi
subunit protein complexes containing several cofactors. The biogenesis of respiratory chain is a highly
ordered and sophisticated process. This process includes: translation, protein insertion into the
membrane cofactor insertion and the assembly of the subunits into multi subunit protein complexes.
Any defect in one of this steps can terminate the biogenesis and can result in severe impairments of
respiratory chains, which is why these processes are very important for all living organisms (Diaz et

Art Therapy in Metal Health Vocation
Art therapy is a common mental health vocation that utilizes the ingenious practice of art making to
ameliorate and improve the mental, emotional, and physical healthfulness of people of all age groups.
It is predicated on the credence that the creative operation involved in imaginative self expression
avails people to undertake conflicts and quandaries, develop interpersonal skills, manage
comportment, reduce stress, increment self esteem and self cognizance, and accomplish understanding
of themselves. Art therapy incorporates the fields of visual arts, human development, and the
ingenious process with models of psychotherapy and counseling.
This is utilized with children, teenagers, adults, elderly people, families, and groups to evaluate and
treat apprehensiveness, despondence, and other mental/emotional quandaries, abuse and domestic
violence, mental illnesses, family and relationship problems, gregarious/emotional difficulties cognate
to incapacitation or illness, personal trauma, loss and post traumatic stress disorder, physical,
cognitive, and neurological quandaries, psychosocial difficulties cognate to medical illness, substance
abuse and other addictions. Throughout the healing procedure, an art therapist will utilize an array of
ingenious art processes to address the issues a patient wants to find a solution too. Painting, drawing,
and sculpting are principal methods.

How Does A Clockwork Orange Relate To Psychology
A Clockwork Orange Analysis Paper In the movie A Clockwork Orange, the main character Alex is a
deviant adolescent who commits many violent and sexual atrocities and is eventually jailed for them.
While in jail, Alex is given the opportunity to shorten his sentence if he would participate in an
experiment. This experiment actually involved the Ludovico Technique, a form of aversion therapy
where the participator watches film of his antisocial behavior and presumably enjoys it, but afterwards
is given a drug to make him feel sick while he watches the same film. This leads the participant to
associate the film with the negative feeling in the stomach, and presumably would lead to him
associating the antisocial behavior with the bad feeling. In the movie, Alex goes through this
procedure, watching video of violence and rape, and is later shown to be incapable of assaulting a man

The film provides a good example for how classical conditioning is used in the world. Skinner s
theories of behaviorism are introduced in many of the scenes throughout the movie. According to
Skinner, acquisition and retention of new behaviors would elicit rewards. Pavlov s theory of classical
conditioning involves a stimulus and a response that are connected (Myers, 2013). Using the injection,
classical conditioning was used to make Alex feel ill every time he watched the films. Thus, every
time Alex felt the urge to be violent he would associate those feelings with physical illness and
respond by not responding and lashing out. According to Thorndike s Law of Effect, we only repeat
behaviors that provide us with a desired effect. Since violence was no longer a behavior that gave him
pleasure, he could no longer obtain the same gratification as before. Alex extinguished his behaviors

Gymnopedie No 1 Analysis
When you listen to Erik Satie s Gymnopedie No. 1 you are struck with a sullen, dreamy chord
progression striking the root on the one of the measure and the 3rd, 5th, and 7th of the chord on the
2nd and 3nd of the measure with its waltz like ž timing. You hear this song and it almost immediately
hits you with a feeling of sadness but there is a sort of beauty to it. But why? Why is it that this song
makes you feel sad? Many people who are untrained in music will have a simple explanation such as
it s because it s slow or because it s in a minor key . While yes it is at a slow 78 bpm but anybody with
a trained ear can tell that it s in the key of D Major. So there must be more to it than just its tempo or
what key it s in. As you move further along in this endeavour of understanding music you learn that
instead of it being just one or two things that make a song happy or sad it s a combination of many
different attributes. Such as key signature, tempo, meter, chord extensions, intervals, and etc.Music in
it many forms makes us all feel different emotions. Music can evoke so many different types of
emotions some will make you want to dance and some will make you want to cry. Some will make
you remember the best times of your life and some will remind you of the worst. To understand the
invisible connection that so many of us feel towards music one must first understand at least the basics

Flame Test

To determine the cation in each of the unknown substance X, Y and Z by observing the flame colour
of different metal compounds.
Introduction:
A distinctive feature of many s block metals is their ability to produce flame colours.
At temperature of a Bunsen flame, a compound will decompose to give gaseous atoms of its
constituent elements. When an electron in the gaseous atom absorbs energy from the flame, it will
move from an orbital with lower energy to an orbital with higher energy. When such an electron
returns from an orbital of higher energy to an orbital of lower energy, a photon with energy equal to
the difference in energy of the two orbitals will be emitted. An emission line ... Show more content on

Discussion: 1. Why do certain metal ions give flame colours in this way?
The elements have their outer electrons loosely bound so that they can be easily excited to higher
energy levels on heating. As these electrons return to their ground states, radiations are emitted. It
happens that for many Group I and II metals, these emitted radiations fall into the visible range of the
spectrum, so that they can be seen by eyes, i.e., visible. 2. What is the

Oklahoma City Bombing Research Paper
In 1995, it all started as a peaceful Wednesday morning. People were starting work or just waking up
in Oklahoma City. While all these peoples days were starting, a young male parked a yellow truck
outside of the Alfred P. Murrah Federal Building. That day, everyone s life in that building changed
forever. The effects of the April 19,1995 bombing were more than just physical to the survivors of this
horrific event. The incident was planned a year before the bombing, in an old trailer in Kingman
Arizona between an ex military man named Timothy McVeigh, and some of his military friends
(Casey). McVeigh was just like any other boy growing up. He was into toys and sports, but he was
very into guns. When he was older, he joined the army and was the top of his squadron. After given
the opportunity to join the Green Berets but not meeting up to their standards, he left the army and
tried to become a worker. During this time, he followed his hobby for guns and joined many militias.

understanding of Theran culture through artefacts such as pottery, art, architecture and trade. Thera, or

According to a Annual Report to Congress on Foreign Economic Collection and Industrial Espionage
(2008), a wide variety of foreign entities have attempted to illegally acquire trade secrets and US
technology a problem attributed to outsourcing research and development. Most companies in the
United States have been encouraging outsourcing research and development as a means improving
themselves in terms of products being universally usable. This has led such companies setting up
bases in foreign countries where such research is carried out. These bases have well been used as a
gateway for economical espionage since foreign entities can easily access such bases and access
information on the said companies or U.S in general. This may be through employees in such bases,
spies or even hacking information systems that are connected the ones in the U.S. Acquisition of
information and technology from such companies has well been used to either disable operations of
such bases or setting up rival companies. It is worth noting that espionage from such bases is hard

measures of such activities due to the nation s sovereignty. Legal cases in such incidents are left
pending for fear of bad international relations and investigations are hardly finished. Economic

One hairstyle, known simply as the bob, would be at the center of this great debate. First introduced
during the Great War, the bob haircut would eventually cause a revolution in the way women would
wear the bob forevermore. It all started in 1915 with the introduction of the Castle Bob, named after
the acclaimed ballroom dancer Irene Castle. While cutting her hair for convenience, little would she
know that she would forever be linked with triggering a revolution in 20th century hair fashion. The
Castle Bob would be the first indication of the rage of short hair. The bob haircut was simply a hair cut
leveling with the bottom of the ears all around the head. It was worn either with bangs or with the hair
brushed off the side of the forehead. It was a simple look but an oppressive departure from the long
feminine looks created by Gibson and Marcel. http://www.hairarchives.com/private/1920s.htm

latest powders, vanishing creams, pan sticks, lipsticks and mascaras (or mascaros as they were known
in the 1920s).

Comparison Of Count Dracula In Bram Stoker s Dracula And...
Dracula is the infamous vampire, that readers were rst introduced to by Irish author Bram Stoker in
1897 when they read his novel Dracula (Stoker). The author conveys the story of Count Dracula, a
mysterious being that is half man, half vampire that sucks blood from the neck of his victims to stay
alive (Stoker). This novel is an outstanding masterpiece of work, which is why it has been a prototype
for various movie releases over the decades, such as Nosferatu, Horror of Dracula, Dracula A Love
Story, and Bram Stoker s Dracula ( Dracula (Universal Classics) ). The hope is when a movie is based
on a novel that the characters coincide from one to the other, which leads to the exploration of the

He cannot come into a house unless invited or walk in water and his favorite meal is human blood
(Stoker). While these traits are consistent in both the novel and the movie there are differences
(Stoker). Starting with the novel, it describes Count Dracula s shadow coordinates with his body, yet
in the movie, his shadow works separately from his body movements ( Dracula (Universal Classics) ).
The next modification of Count Dracula s character in the novel is, he cannot be in or near the sunlight
or it will kill him, however, in the movie, he meets Mina in the daytime and it does not harm him
(Bram Stoker s). Then, in the novel, Dracula is a purely evil, terrifying blood hungry monster that
wreaks havoc on anyone he meets and feels the need to take life or end life with his arch nemesis
being with anyone who wants to preserve life (Stoker). But in the movie when he meets Mina on the
streets of London, he pursues a courtship with her and he begins to develop feelings for Mina (Bram
Stoker s). When he proclaims his love for her and refuses to condemn her to the life of a vampire, he
is no longer a vile, evil monster (Bram Stoker s). These modifications to Count Dracula s character in
the movie make the audience see him as a vulnerable, loving man with feelings for a woman who
reminds him of his dead wife Elisabeta (Bram

Machiavelli The Prince
Political theorist Niccolò Machiavelli s, The Prince , exemplifies an early depiction of several modern
ideological principles that would sustain and preserve nations (especially after the separation of the
church and state) in the sixteenth century. In this critically acclaimed work, Machiavelli satirically
bequeaths a map of qualities that princes should steadfastly uphold and advance. Expressly, the
qualities mapped out are frequently criticized as, crafty, cunning and unscrupulous methods by which
a prince can acquire and maintain political power . One of the most prominent principles that almost

In fact, he believes it would benefit princes much more to appear virtuous but not to genuinely be
virtuous considering that one who is not too concerned with being convicted by their moral compass

call princes to be able to dissemble and hide their true motives as the individuals/common people of a
state do concern themselves on how governmental officials appear but not necessarily how they really
are (and will still appreciate them greatly despite their deviousness/cruelty especially if the official
seems virtuous and if the people and state are benefitting from the outcomes of the governments

Responsibilities for Offering of Securities Essay
The federal law requires disclosure of material information in order to ensure the quality and fairness
of an offering. I believe this responsibility should be shared responsibility between all parties
including the investment bankers, the securities lawyers, and most importantly the managers and the
directors of the issuing company have the duty to ensure the quality and fairness of an offering.
Investment banker s have the duty to advise their clients on high level issues of financial organization.

According to the information on the SEC website, all investors, whether large institutions or private
individuals, should have access to certain basic facts about an investment prior to buying it, and so
long as they hold it. The SEC requires public companies to disclose meaningful financial and other
information to the public. This provides a common pool of knowledge for all investors to use to judge
for themselves whether to buy, sell, or hold a particular security. Only through the steady flow of
timely, comprehensive, and accurate information can people make sound investment decisions.
According to The Securities Act of 1933, the law requires full disclosure of information relevant to the
securities been offered to the public. The Securities Act of 1933 provides that the investors must be
provided with the registration statement and the prospectus that describes the security being offered,
the issuing corporation, and the investment or risks related to the security to promote sufficient info to
enable sophisticated investors to evaluate the financial risk involved. It is through such disclosure and
openness on the part of the directors of the issuing company that there can be an existence of quality
and fairness of the offering to the investors. I believe that appointing an independent agency to
oversee such offerings will be a further leap in the attempt to

Battleship Pottemkin Essay
The movie Battleship Potemkin, directed by Sergei Eisenstein, was released in 1925. The film is based
on the historic event where a group of sailors mutinied against the repressive officers of the Russian
Imperial Navy in 1905. Eisenstein s goal with this film was to use it as propaganda to get people to not
only join the Communist revolution, but also to understand that the revolution started already then.
How does Eisenstein, through associative and intellectual editing, use montage and juxtaposition to
create not only meaning to this sequence, but also an emotional response in the viewer to achieve his
goal? And how does he combine close ups and long shots in this sequence, and what effect does that
create? Associative and intellectual ... Show more content on Helpwriting.net ...
There is no use of long shots in this sequence and we are not shown what environment they are in
except from the medium group shot in the beginning and at the end. This doesn t mean that we can t
imagine the environment they are in, on the other hand, Eisenstein s montage of close ups makes the
audience create the environment in their mind. We know what they are doing by seeing the the
gestures linked; washing, drying, and placing spoons. We imagine the space their in; the enclosed
space in the frame, the closeness of the workers, and the humidity. And we think about how it must
feel; the facial expressions and the dishwashing rhythm. Eisenstein creates, through montage and
juxtaposition, a concept in the viewer s mind that he can refer to later. By using similar close up
montages earlier and later in the film, he can link events or concepts. When we see the close up of the
dishes, we might think of the earlier close ups of the maggot infested meat. By using montage of
attractions, Eisenstein has created a deeper meaning and emotional responses in the

  • 2. Thomas Davitt On Contractual Obligation The basis on contractual obligation is a promise, a promise from both parties to perform a duty, or duties in reliance on that promise. This paper will take the stance that Thomas Davitt takes, stating that though mutual assent and consideration are important to a contract, those factors are not the essence of a contract. There is a moral obligation to fulfill a contract, one that is much more than simply words written on paper. The second restatement of contracts defines a contract as: a promise or a set of promises for the breach of which the law gives a remedy, or the performance of which the law in some way recognizes as a duty. Restatement (Second) of Contracts § 1 (1979). The restatement goes on to define what a promise is. A ... Show more content on Helpwriting.net ... Davitt discusses the difference between consent and assent . Davitt states that the former implies a positive action and involves submission, while the later involves more passivity or submission, which does not include consent. Id. at 273. Davitt would rather state that knowledge and consent are more appropriate, because these two factors can be applied to both natural and legal promissory agreements. Id. at 274. In Davitt s view, consideration is not the basis for contractual obligation. Davitt uses consideration to discuss ways in which to distinguish between legally enforceable promises are those that are not. According to Davitt, a consideration is the price bargained and paid for a promise. Id. at 277. Consideration, as defined in the restatement, is similar, stating that in order [t]o constitute consideration, a performance or a return promise must be bargained for. Restatement (Second) of Contracts § 71. Though Davitt uses a similar definition to that of the restatement, he believes that consideration is not even essential for a contact. Davitt states that bargaining, or a quid pro quo, too often fosters injustice and frustration of honest claims. The Elements of Law, at 279. Davitt also states that men have been making agreements for a long time that do not involve a quid pro quo, or anything else like the later, yet there is still a trust between the two parties. • 3. Staying Fat For Sarah Byrnes Quotes Courage It s scientifically proven that people who live courageously have less regrets in life. Leaders have a lot of courage, and that s what people like in leaders, but you don t have to be a leader to have courage. Everyone s born with it in them. There are people with less courage and others with buckets full of courage, but I know everybody has at least some in them. Courage is important because it s taking a risk or making a decision to help yourself or others. It s doing something you re scared of doing. In Staying Fat for Sarah Byrnes there is a lot of courage shown by the characters. We all show courage at one point or another. Courage is important for helping others. Sarah is the most courageous character in this book because she was brave to do things. There were many different parts of the book where she showed courage, but definitely the most courageous one was when she was three years old and tried to save her mom while she was being abused by Virgil Byrnes. On page 143 Sarah says to Eric, I ran at him, screaming, and crashed into his legs. It knocked him off a little, and loosened his grip and my mother got away. While Eric was in the hospital, Mark came by to talk with him. The talk later led to Mark announcing to his whole class that what Jody was saying was the truth and what Mark had been saying was all lies. When Mark finally decides he has the courage to tell his class the truth, some of what he says is I m a liar. I think the last words I said to this class were that Jody Mueller was a liar. Not so. • 4. Reasons For The Collapse Of The Han And Mayan Empires A number of complex and enduring empires have dominated large parts of Afro Eurasia, and Meso America. Among these were the Han Empire in China, the Roman Empire in the Mediterranean Basin, and the Maya in Meso America. These empires had wealth, power, and they are a vast size, but they all suffered their unfortunate collapse. There are multiple factors that contribute to the collapse of these empires such as warfare, taxes, the environment, problems with the government, religion, and shortage of resources like food and water. The reasons for the collapse of the Han and the Mayan empires are very similar. However, there are also some striking differences of the reasons why these empires collapsed. The Han Empire s disintegration happened because of 3 reasons: warfare, governmental problems, taxes, and shortage of resources like food and water. Warfare had an impact on the failure of the Han Empire because they needed a lot of strong and efficient armies which led to the need for manpower, food, horses, and weapons. These needs couldn t be fulfilled because the taxes were so high (governmental problem) that the peasants had no way of paying their taxes resulting many joining rich land owning generals lands which means that these peasants are now under their command. Americans needs more regulations on the gun situation, we don t want more people under 3 meters of dirt just because some crazy person was able to get a gun and start to shoot them, that s why guns should be restricted and take them away from everyone. The first reason we need more regulations on guns is because there are a lot of irresponsible people that have guns at home. They keep them ready to shoot, and that s no how it supposed to be. They have to put the bullets apart and the gun with a look according to the The Brookings Essay The promise. • 6. Factors Influencing The International Students Factors influencing the international students to choose the United States as their higher study destination Prejin Kumar Pradeep Kumar Husson University Abstract The United States hosts more of the world s 4.5 million global mobile college and university students than any other country in the world, with almost double the number hosted by the United Kingdom, the second leading host country. However, little research has done on various components that influenced a student to choose a country for higher education. In this investigation, I consider a survey approach on students in selected countries about their preferred study destinations, their reasons for studying internationally, their main sources of information on overseas study and their opinions of the U.S. as a potential study destination compared to other key host destinations. Specifically, the quality of education and research opportunities are the two major factors that students consider before choosing the United States as their study destination. This man has been through it all, he tried returning home to see his wife who lay on her death bed to find soldiers ruining his farm and wrecking his homestead. He had to sleep in caves and woods and was hunted across the countryside. When in the end embeded by hardship he managed to sneak home to find he wife already buried and his 13 children removed from his home, he never saw them again and died in 1779 without ever finding his family. Education Reform in American Schools Essay Education Reform in American Schools Frederick Douglass was, and still is, a golden example of why education is so important to a human being s life. Douglass spent the first part of his life in ignorance. However, his life of a seemingly endless servitude and ignorance was completely shattered by the fact that he learned to read. Once he learned to read, his life was forever changed. He escaped slavery and tyranny and became an icon even to this day. Douglass s story more than adequately shows that a quality education is perhaps the most important thing a person can receive in their life. Interest groups, who are more interested in preserving their values as opposed to maintaining an exceptional education (Christian fundamentalists, for instance), that control some communities, can completely destroy any opportunity for a young mind to learn. The politics of racial injustice are hopefully completely gone, but we re still living through a state where the races feel as though they are still there. Of course, from my perspective (the perceived subjugator), it is easy to claim the politics are not there. From the perspective of those who believe they are being subjugated, it is even easier to say it is there. They feel it. The second problem, and possibly the most important, is a question of interest. Are schools really condusive to American youth to learn in a stumulating way? I don t believe so. Pubescent students are almost incapable of true learning because their minds are clouded by a hormonal fog for an enormous part of their lives. They walk around the schools nearly humming and buzzing with new and exciting thoughts they are just beginning to understand. Once those hormones have calmed and the student feels they can control them a little, there is still no difference in the way they are taught. Nearly every school is the same (Wood 9). Being separated from the outside environment, within this cells, endo and exothermal reactions are present, allowing them to provide their own vital processes and to synthetize their own components (Lodish et al., 2000). Photosynthesis and respiration, the most important energetic processes occurring in the cellular membranes, are transforming one form of energy into another. Photosystems are able to transform the energy of photons into chemical energy which is stored in molecules like ATP or NADPH. Introduction: A distinctive feature of many s block metals is their ability to produce flame colours. When an electron in the gaseous atom absorbs energy from the flame, it will move from an orbital with lower energy to an orbital with higher energy. I believe this responsibility should be shared responsibility between all parties including the investment bankers, the securities lawyers, and most importantly the managers and the directors of the issuing company have the duty to ensure the quality and fairness of an offering. Investment banker s have the duty to advise their clients on high level issues of financial organization. • 32. Battleship Pottemkin Essay The movie Battleship Potemkin, directed by Sergei Eisenstein, was released in 1925. The film is based on the historic event where a group of sailors mutinied against the repressive officers of the Russian Imperial Navy in 1905. Eisenstein s goal with this film was to use it as propaganda to get people to not only join the Communist revolution, but also to understand that the revolution started already then. How does Eisenstein, through associative and intellectual editing, use montage and juxtaposition to create not only meaning to this sequence, but also an emotional response in the viewer to achieve his goal? And how does he combine close ups and long shots in this sequence, and what effect does that create? Associative and intellectual ... Show more content on Helpwriting.net ... There is no use of long shots in this sequence and we are not shown what environment they are in except from the medium group shot in the beginning and at the end. This doesn t mean that we can t imagine the environment they are in, on the other hand, Eisenstein s montage of close ups makes the audience create the environment in their mind. We know what they are doing by seeing the the gestures linked; washing, drying, and placing spoons. We imagine the space their in; the enclosed space in the frame, the closeness of the workers, and the humidity. And we think about how it must feel; the facial expressions and the dishwashing rhythm. Eisenstein creates, through montage and juxtaposition, a concept in the viewer s mind that he can refer to later. By using similar close up montages earlier and later in the film, he can link events or concepts. When we see the close up of the dishes, we might think of the earlier close ups of the maggot infested meat. By using montage of attractions, Eisenstein has created a deeper meaning and emotional responses in the ... Get more on HelpWriting.net ...
