23. Earnest Money
• It shall be a condition of this tender that the Contractor shall submit an
Earnest Money of RM 5,000.00 together with his tender submission,
failing which his tender will be disqualified.
• Earnest Money shall be in the approved form of Banker's Guarantee
attached herein or Bank Draft from approved Banks operating in Malaysia.
Company cheque and Insurance Guarantee will not be accepted.
• If the Contractor shall:-
• 1. withdraw his offer after he has been awarded the tender, and/or
2. withdraw his tender before the expiry of the Tender Validity Period
then in any of such event(s), the Employer shall without prejudice to his
any other rights that he may possess, forfeit the Earnest Money.
• The Earnest Money shall be returned to all unsuccessful Contractors upon
award of the tender. The Earnest Money of the successful Contractor shall
only be returned after the submission of the Performance Bond.
24. Performance Bond
• The Contractor shall provide Performance Bond Guarantee from a
bank operating in Malaysia, to the Employer in a sum equal to five
(5%) percent of the Contract Sum, for the due observance and due
performance of the Contract under the terms of the Bond. The
bank and the terms of the Bond shall be such as shall be approved
by the Employer, and the cost of obtaining the Bond shall be at the
expense of the Contractor and shall be included in the Contract
Sum. The original of the Bond shall be deposited with the Employer
as a condition precedent to the commencement of the Works, and
shall remain with the Employer and be valid for the full duration of
the Contract or the last delivery/shipment/consignment of the
Goods whichever is the later, and in the case of the Contract being
determined, one calendar year after the date of the determination.
25. • Defects Liability Period : 24 months
• Insurances cover for accidental bodily injury : Refer to insurance policies that has been taken up by
to or illness of third parties (whether fatal the Employer
or not), accidental loss of or damage to
property belonging to third parties (the
aggregate liability of the insurers shall be
limited by twice the limit of indemnity caused
by any one occurrence
• Insurance deductible amount : Refer to insurance policies that has been taken up by
the Employer
• Percentage to Cover Professional fees : Refer to insurance policies for reinstatement that has
been taken up by the Employer
• Amount for removal of Debris : Refer to insurance policies that has been taken up by
the Employer
• Value of existing structure together with : Not applicable

• Liquidated and Ascertained Damages : At the rate of RM 700.00 per day

• Interim Claim Interval : One (1) month
• Period of Honouring of Certificates : Thirty (30) days from the date of the Certificate
