Dickman, C. R., Australian Nature Conservation Agency, University of Sydney, Invasive Species
Program (Australia). (1996). Overview of the impacts of feral cats on Australian native fauna.
Canberra, ACT: Australian Nature Conservation Agency.
Content Summary
In this book the authors review impact of feral cats. Feral cats have major or minor impacts on the
Australian native wildlife some of which are competitive, amensal, and predatory. The Competitive
impact caused by cats is on large predatory species by loss of prey. Amensal impact is most likely
cause by transmission of diseases. And predatory impact on native wildlife has been identified by
historical evidence. Many conclusions can be made from this evidence. Mammals make up a large
part of a feral cats diet. They target mammals weighing up to 2kg, and birds up to 1kg. But they prefer
prey weighing less then approximately 200grams in Mainland Australia. ... Show more content on

Australia has the worlds worst record for extinct mammals, 28 species and sub species mostly
marsupials since European explorers and settlers arrived. Most of these extinctions have been linked
to feral cats and other introduced species. Cats have developed there skills over millions of years and
they a fast and silent killers. The US Fish and Wildlife Service has revealed that feral and domestic
cats kill an estimated 2.4 billion birds and 12.3 billion mammals each year most of which are native.
No such large studies have been performed in Australia. However The Australian Wildlife
Conservancy released a report, which estimated the impact of 5 to 18 million feral cats on native
Australian species, such as the numbat or bilby. Each cat can potentially take from 5 to 30 animals a
night. The extinction of 9 species of bird and the critical state of 33 others has been directly linked to

Examples Of Dystopia In The Hunger Games
The chosen utopia is a political utopia that described in the novel The Hunger Games written by the
American author Suzanne Collins. Utopia means a nowhere land , and its concept alludes to some
imaginary paradisiacal places where human beings are living under a desired environment. This kind
of ideal society with everything perfect can be found in Edward Bellamy s Looking Backward and
William Morris s News from Nowhere . Dystopia, on the other hand, is a world in which nothing is
perfect such as 1984 by George Orwell and We by Yevgeny Zamyatin. The concept of political utopia
was originally developed by Richard Saage. According to him, political utopia provides an ideal
commonwealth that characterised by its distinctive criticism of reality, its rational and comprehensible
design, which is universally applicable. In this essay, I will posit the political utopia in The Hunger
Games as a dystopia and elaborate the universally applicable utopia or dystopia is non existent and
impossible because of the diversity of human beings. ... Show more content on Helpwriting.net ...
At the beginning, the story states the government regards hunger games as the repentance for uprising

is under peace which reflects the sense of political utopia which is an orderly and peaceful society
without turmoil and well governed by an ideal commonwealth. As to Capitol, Panem is desirable place
since what they want is orderliness. For example, they think the issue of disparity in position is
reasonable because it can make citizens strictly obey order and government can easily rule the society

Paul s View On The Law Essay
Paul has used the law in many circumstances throughout his epistles. He also discusses the
implications of the law and its relation to believers. Paul s view on the law has been a conversation
held by many New Testament scholars. Some suggest that Paul s views on the law is inconsistent
throughout the epistles but by a careful analysis will show that his views are complementary rather
than inconsistent. A main issue that Paul argued was that we are justified by faith in Christ and not by
doing the works of the law. Paul view of the law was that nobody can be saved by obedience to the
law but only by faith in Christ can one be saved. Three theological stands that have strong interest
with Paul view of the law are those of Lutheranism, Reformed and The so called New Perspective of
Paul. The Lutheranism believes that it is Paul s belief that Christ abolished the law and that the law is
an argument contrast of the gospel (Crandell 2014). The main role of the law is to display our
hopefulness in efforts of obedience in order to obtain God s acceptance and should cause us to desire
from God a mercy that is only found in Christ. The Reformed view sees salvation as something that is
of grace and not nothing that involves obeying the law but once saved we must only obey the moral
law in order to be pleasing to God (Rosner 2013). Lastly this New Perspective of Paul believers that
Paul s problem with the law was not a matter of salvation being by grace rather

In recent years, airlines build a closer relationship, especially European airlines and Chinese airlines.
Europe is the headstream of airplane, but compared to North America, European aviation is a little bit
weak on the ridership. In late 1990s and early 2000s, Europe had more interactions with American
aviation. In recent years, Europe set China as a new partner. European aviation is trying to expand its
international market through increasing new cooperation.
In recent years, the relationship between Chinese and European Aviation is getting closer. The
strongest evidence is that Chinese government and European Union have signed a 5 year work
agreement for reducing the economic burden in aviation industry, preserving aviation safety and
environmental compatibility. European Union and China emphasized the importance of this project by
preparing over 10 million euro as its budget. The detailed work plan was reviewed and updated in
September 2016. This is the first official cooperation in European and Chinese aviation, which is
managed by the European Aviation Safety Agency (EASA) and Civil Aviation Administration of
China.
In terms to those individual airlines, there is another event that caught the public attention is that the

Food Security Is A Basic Human Right, Essential For Life
Food security is considered as a basic human right, essential for life. It exists when all people, at all
times, have physical and economic access to sufficient, safe and nutritious food to meet their dietary
needs and food preferences for a healthy and active lifestyle [Food Agricultural Organization (FAO),
1996]. Food insecurity can refer to not having sufficient food; experiencing hunger as a result of
running
out of food and being unable to afford more; eating a poor quality diet as a result of limited food
options;
anxiety about acquiring food; or having to rely on food relief (Rychetnik, Webb, Story, Kat, 2003).
Although the United States population is considered food secure as a whole, with 85.7% being food
secure (Coleman Jensen, Gregory Singh, 2014), pockets of food insecurity have been identified
among
sub populations such as single parent households (34.4%), people at social or geographical
disadvantage (26%), the homeless and the young (Rychetnik, Webb, Story, Kat, 2003; Innes Hughes,
Bowers, King, Chapman, Eden, 2010).
According to National Center for Education Statistics (2013), enrollment of students 18 24 years in
degree granting institutions increased from 15.9 million in 2001 to 21 million in 2011. Many students
live
on low incomes and have unique expenses, such as high tuition, cost of textbooks, healthcare cost and
other instructional expenses such as housing that increase their cost of living relative to other young

The Animation Of Life In Frankenstein
The Animation of Life by Stories: Literature and Society Doctor Frankenstein in Mary Shelley s
influential novel never reveals the secrets behind the animation of his monster. Even still, the creature
is suddenly thrust into being; thrust into an amalgamation of ebbing and flowing stories and forced to
carve out a story of his own. It can be reasoned that everything which exhibits what we classify as life
carries with it the capacity to simultaneously create and be shaped by stories. Shelley s intentional
decision to keep the methods of the monster s creation hidden allows for the story of the monster itself
to be what truly gives him life and consequently, the story of Frankenstein and his monster has
breathed life into many modern discussions. ... Show more content on Helpwriting.net ...
The most poignant example being Victor s wedding night, a night which should be shared between
him and his new bride. Ultimately, Victor is so caught up in his own story that he does not even begin
to reason that his new bride could be the target of his monster s wrath and Victor s beloved dies at the
hands of his creation. (Shelley 151) It is interesting to conjecture that getting caught up in one s own
story is the opposite of animating life, rather, the loss of life. When one is caught up in their own story,
all other stories around it cease to be narratable. By figurative reasoning, when someone s story
becomes un narratable, the life which the story sustains can no longer exist. Arthur Frank comments
that stories are symbiotic, Stories and people need each other. (Frank 37) A person cannot live without
stories and stories can be created, or destroyed, by people. Frankenstein teaches us that stories are
dangerous and out of control, but we depend on them to animate life and without them, life ceases to

Specific Heat Lab Report
Have you ever wondered why a fire burns orange, or why a lighter burns blue towards the bottom of
the flame? If we take a quick step back, this is mostly due to a chemical reaction that is known as the
specific heat . This must be achieved (as well as the other two properties that every fire is required to
possess in order to burn) in order for a flame to become present. After this specific heat is reached, a
chemical reaction occurs and turns the fuel source of the fire into a vapor. The aspects that are
required for a flame to be created are a heat source, some sort of fuel, as well as some sort of oxidizing
agent. The only way that a change in flame color can be observed is by manipulating the fuel source.
After we manipulate the source

The Defense Of The Insanity Defense
The insanity defense has been used in several cases in criminal law. This defense basically states that
the accused cannot be held responsible for what he/she did because they had no control over their
actions. Many times the defense attorney will plea for a deal that the defendant be sent to a mental
rehabilitation center for proper treatment. When using this defense the defense attorney will argue that
there may be a chemical imbalance in his brain therefore he had no idea what he was doing at the
time.
In my opinion the insanity defense should not exist because many of the people accused just use to get
out of their justified sentence. Daniel M Naghten was a woodworker who believed he was the target of
a conspiracy involving the pope ... Show more content on Helpwriting.net ...
And this is because so many people were using this defense to get out of being in trouble and later
being sentenced. In many cases involving the insanity defense the defense attorney will raise the point
that there is a chemical imbalance in his head, basically stating that he had no control over himself at
the time that he did the act of violence.
Monte Durham was a 23 year old who had been in and out of prison and mental institutions since he
was 17. He was convicted for housebreaking in 1953, and his attorney appealed. Although the district
court judge had ruled that Durham s attorneys had failed to prove he didn t know the difference
between right and wrong, the federal appellate judge chose to use the case to reform the McNaughton
rule. Citing leading psychiatrists and jurists of the day, the appellate judge stated that the McNaughton
rule was based on an entirely obsolete and misleading conception of the nature of insanity. He
overturned Durham s conviction and established a new rule. The Durham rule states that an accused is
not criminally responsible if his unlawful act was the product of mental disease or mental defect. The
Durham rule was eventually rejected by the federal courts, because it cast too broad a net. Alcoholics,
compulsive gamblers, and drug addicts had successfully used the defense to defeat a wide variety of
crimes. (Legal information institute, Cornell university law school). This is an example of how the
insanity

confidante. She is very loyal to both Telemachus and Odysseus. Upon Telemachus search to find his
father she keeps his journey a secret from his mother Penelope (Homer 2.104 105). She also keeps
Odysseus identity a secret after recognizing a scar on his leg. In book 19 she states that scar as the old

The Freudian Slip Theory
Introduction
Freudian slip theory was originally created by Sigmund Freud. He was an Austrian neurologist and
was better known as the founder of psychoanalysis (1856 1939). Psychoanalysis can be defined as a
set of psychological theories which includes the Freudian slip theory. He believed that everyone
possess an unconscious mind, feelings, desires and memories in their lifetime. It is to be said that
peoples will bring their unconscious content on their mind to their conscious awareness and people
will be able to experience catharsis and gain insight into their current state of mind. (Cherry, What is
Psychoanalysis?, 2016)
Freud s theory of slips of the tongue and pen Sigmund Freud theory is formed based on peoples brings
the unconscious thoughts to conscious self. Freudian slip is the Hint of the Unconscious. (Cherry,
What is a Freudian Slip?, 2015) A Freudian slip also known as a parapraxis, is an error of speech and
memory or physical action which Freud stated was a result of interference of self own
unconsciousness wish, desire, conflict or train of thought. Freud believed errors of all types were

Non Human Research Paper
Humans have been oppressing non human animals for quiet sometime just because they can. Humans
see non humans as less intelligent, insignificant, disposable, and the fact that humans are at the top of
the food chain. Humans haven t just oppressed non humans, they have oppressed other humans and
treated them like non humans today are treated. We are guilty of treating humans and non humans as
slaves to better our own lively hood. I have come up with a few strategies to overcome our power
hunger and denial regarding non humans. We treat dairy cows as slaves like we did to humans. An
example of this is that if they produce more milk than expected they are expected the high of
production every time (Willets, Class Notes 4/25 4/27). However, ... Show more content on

First, is to as a society accept that we have a problem of wanting and needing power. In order to get to
this acceptance we need to bring the slaughterhouses and farms out of hiding and show what is really
going on behind the scenes. There should be a law implemented to make slaughterhouses and farms
have windows for the public to see what is going. I mean it shouldn t be like we can view what s
happening 24/7 because that is there lively hood and some people s homes. We don t want the public
to invade people s privacy or put the workers at risk of being in danger. There could be more tours
available for slaughterhouses. I don t see anyone wanting to go on a tour, but it should be available to
the public maybe on line. Perhaps, a live feed of what is happening at the slaughterhouse. These
strategies are a bit more risky because they can have backlash on the governments invasion of privacy,
works endangerment, and animal cruelty complaints left and right. The public can be overwhelmed
when something like slaughterhouses is put right in front of our face. If we can accept the fact that
slaughterhouses exist and we treat animals like dairy cows as slaves. Then we can overcome this
power hungry society we live in. To get rid of any problem it must be accepted that there is a problem.
Denial is a powerful thing we have in our society and that is quite often over

The Theme Of Tess Of The DUrbervilles
Tess of the d Urbervilles written by Thomas Hardy takes place in the 19th century in high class
England. One fellow by the name of Jack Durbeyfield learned from a local parson that he is actually
descended from the old and forgotten family, the D Urbervilles. Planning to exact his royal name, he
sent his eldest daughter to a nearby town by the name of D Urberville, to see if she can find out
whether or not they are related. Tess came to find out that their name had died off and is no longer
related to the noble name, D Urberville. What Jack and his family do with that information will be
uncovered soon. Birds, one of the most recurring themes throughout this novel. The characters believe
that birds represent higher beings, as if they are spirits from another realm. The main birds that the
characters speak of, mainly Tess, is the Christian dove of peace and the Romantic songbirds of Keats
and Shelley. The author makes you think as if the birds speak for Tess. On many occasions you can
hear birds singing in the background as Tess sits quietly and silent. Her personality and mannerisms
make her seem quiet and calm. The real reason for this is because she was raped by Alec D Urberville,
son of the noble family, when she was younger and feels wronged and disgraced. The incident makes
her silent and submissive to whatever the situation is. The birds also represent more than just Tess s
voice; they also represent images of hope and freedom. One occurrence of this was when Tess

Comparing The Income Statements Accounts And Categories Essay
Profitability These ratios are comparing the income statements accounts and categories to reflect and
to present the company s ability of generating profit from their operations. They can be used by
investors and as well by creditors to judge the company returns on investment based on its relative
level of assets and resources. Operating profit margin This ratio reflects the ability to distinguish
products, ability to control their expenses, also the degree of competitiveness in the actual economic
market. The higher the ratio the better is for the company. It shows the percentage of sales left over
after all expenses are being paid by the business. CFT Ltd, after calculating the ratio, shows us that
from 2014, where we had a 8,15% operating profit margin, they had an increase to 9,25% in 2015,
telling us that the company is doing better. Returns on capital employed (ROCE) This is another
profitability ratio that help us to measure how a company can generate profits from its capital
employed by comparing net operating profit to capital employed. Investors are looking at this ratio to
reflect on how efficiently a company uses its capital employed as well as its long term financing
strategies. CTF s ROCE in 2014 was 16,46% while in 2015 they reported an ROCE that is 18,22%

The Equalizer Film Analysis
In the film The Equalizer , a thriller/action directed by Antoine Fuqua, there are several key scenes
that build the storyline for the movie, however there was one scene that engaged my attention and I
found had great relevance as I studied this film. It is the first fight scene where Robert McCall fights a
Russian group holed up in a hotel room. Significant aspects that I noticed Fuqua use in this scene were
the characters actions, camera techniques and lighting. I feel as though these 3 techniques were the
most important and the most effective. Fuqua cleverly utilised these techniques in this scene which
helped the audience to understand the characters emotion and to help build tension leading up to the
fight.
I feel that the director s purpose of this scene is to expose and shed a little light upon Robert and how
he approaches tasks as well as the way he thinks and acts in these situations. One example Fuqua has
attempted to portray in this scene is how Robert s mind works differently to most other people and this
is shown when we see Robert opening and closing the door 3 times before finally locking it behind
him. This shows myself and the audience that Robert is some sort of perfectionist and may have some
kind of O.C.D. Locking it behind him tells me that he is extremely confident in his own abilities. I
definitely wouldn t enter the room let alone go in and lock the door. Robert, throughout the whole
scene, is very calm and patient. As he is standing at the door

Tolkien s Female Characters in the Lord of the Rings Trilogy
In Tolkien s Middle Earth, women are generally expected to submit to patriarchal authority. To what
extent does Tolkien present women who succeed in subverting this norm?
J.R.R. Tolkien s works have been analysed for decades and have often been criticised for the lack of
female characters. Arguably his most cherished publications, The Lord of the Rings trilogy, in
particular has been condemned for the passivity of his relatively few female characters. Having said
that however, throughout the three books, there are a number of female characters who combat the
stereotypical role of women and subvert the norm of submission to a patriarchal authority. Arwen,

Elrond expects Arwen to fulfill her role as Elven royalty by traveling with the people of Rivendell to
Grey Havens, to find peace and everlasting life in Valinor. However, she wishes to remain in Middle
Earth to be Aragorn s partner thereby giving up her immortality. Although at first Arwen honours her
father s wishes and embarks on the journey with the Elven people to the Havens, she returns to
Rivendell after she has a vision of what she believes to be her future, and confronts her father with it.
The vision was of her son and Aragorn, a vision which brings her hope and strengthens her will to
remain in Middle Earth. This strength is different to what was expected of women at that time. It
allows Arwen to rebel against her father s will and follow the destiny she chooses for herself. Her
choice, however, is ironic because she longs to fulfill the duties of a housewife, which other female
characters in the Lord of the Rings rebel against, such as Ɖowyn.
Arwen s most prominent significant relationship is with Aragorn, which in itself is a conflicted one.
While Arwen s desire is to be with him, she puts her duties to her people and her father before him.
However, in Peter Jackson s film adaptation, she validates the significance of her relationship with
Aragorn by gifting him the Evenstar in the form of a pendant, the object representation of herself

Of course, after the proposal came out college athletics directors and conference commissioners began
protesting the new stipend by claiming of all things they could not afford it . Within a month, 125 of
them had signed an override request. So the NCAA decided to cave on the idea. Some of the students
who had already signed that deal got to keep the $2000 stipend yet others who take money for a
different type of deal, say with an overzealous booster for selling some of their team paraphernalia, as
a few Ohio State players did violated the NCAA s rules regarding amateurism and were hit with multi

El NiƱo In Spanish
El NiƱo implies The Little Boy, or Christ Child in Spanish. El NiƱo was initially perceived by anglers
off the shore of South America in the 1600s, with the presence of curiously warm water in the Pacific
Ocean. The name was picked taking into account the season of year (around December) amid which
these warm waters occasions had a tendency to happen. Meteorologists utilize the term El NiƱo

Being A Wallflower Banned
Published in 1999, The Perks of Being a Wallflower has won several literary awards from the
American Library Association the ALA Best Books for Young Adults award in 2000, the ALA Popular

A study concerned with the possible connections between children s behavior and reading banned
books focused on the potential influence that such books have on civic behaviors, mental health
problems, students grade point averages, and violent and non violent crime. Findings suggest that
consumption of banned books promoted civic behavior and had no effect on grade point averages and
criminal activity, but increased the internalizing and externalizing mental health symptoms. The
potential correlation between increased symptoms of mental health issues and banned book reading
existed within a small subset of the subjects and cannot be proven to be substantial. Overall, banned
books seem to have little to no negative effect on the majority of children and foster increased civic
behaviors (Ferguson). While the motivation behind banning books seems logical and justified, in
reality, books have no substantial negative effects on most children. In all actuality, banned books
foster increased positive, civic behaviors, likely because they teach children tolerance by exposing
them to diverse characters and humanizes groups whose lifestyle choices they may be unfamiliar and
innately uncomfortable with. The Perks of Being a Wallflower exposes students to multiple
incarnations of homosexual characters Patrick, a strong and proud gay teen who is loved by friends
and family regardless of his sexual preference, as well as Brad Patrick s partner who is uncomfortable
with his sexual preference, does not come out to friends or family, and is ashamed when his father

stories and characters that they can possibly identify with and see themselves reflected in (Thomas,

History of the Ponzi Scheme Essay
History of the Ponzi Scheme Is named after con man Charles Ponzi, a Ponzi scheme is an investment
fraud that involves the payment of purported returns to existing investors from funds contributed by
new investors.(SEC, 2013) . Typically Ponzi Schemes entice investors with ensuring higher returns
rather than alternative investments, in the form of short term returns that are either abnormally high or
remarkably consistent. Top broker, Bernie Madoff, was found guilty of this scheme, which will further
be discussed below The essential elements of a Ponzi scheme. These types of schemes are better
understood by using an example, for instance say you collect $100 from each investor and promise
you will double it in a month. But, you do not ... Show more content on Helpwriting.net ...
Early on, Madoff started his scheme with family and friends and he eventually expanded his circle
larger. He was able to extend his fraud for so long due to the marketing of his investment business
being by word of mouth rather than publicized. Whenever his business leaked, he would use his charm
and reputation built up in the past to take back control of the situation. The SEC s actions and role in
the case As long ago as 1999, an independent investigator, Harry Markopolos, concluded that Madoff
s success could not be legitimate. In 1995, he sent the US Securities and Exchange Commission a 17
page document titled: The World s Largest Hedge Fund Is a Fraud . Two years later the SEC found no
evidence of fraud after an investigation that seems to only involve just a little more effort than simply
asking Madoff if he was a criminal or not, and then excepting his answer. Red Flags of a Ponzi

characteristics and their relation to this case specifically include: high investment returns with little or
no risk Madoff s scheme was constantly generating high returns which appealed to many investors
interested in enhancing their wealth. They did not see the risk involved because there appeared to be
none in the hands of Madoff as he was well respected and trusted financially. overly consistent returns

Major League Baseball Playoffs Alds And Alcs
Major League Baseball Playoffs ALDS and ALCS Baseball starts in the spring and ends in the fall
with a total of 162 games that every team must play. The playoffs start about a week after the regular
season ends, and is composed of eight teams in total, four from both the National and American
league. The Playoffs are divided into 3 series, the first one being the ALDS or the NLDS in which two
teams face off in a best of five game series. The American and National League are each divided in a

my evaluation consists of achieving in all aspects of the game. The road to the actual playoffs began in
a single game in which the Houston Astros defeated the Yankees in an effort to win the last playoff
spot. Two days later after their win the Astros faced the Kansas City Royals and this series lasted the 5
games. Sadly for the Astros, the Royals won the series and advanced to the ALCS. The Royals did
everything right but they wouldn t have done it without the help of Alcides Escobar who got on base
almost every single game and Eric Hosmer who hit a couple of home runs and managed to get an RBI
in almost every game. This series was really intense because all the games were played; meaning that
there was a tie between the teams and games 5 was the last shot for both of them. Both of these teams
played really good and players from both teams made a lot of sensational plays that led their teams to
a win. Alex Gordon a former gold glove award winner who is always diving for impossible fly balls

Skin Moles Research Paper
Moles are, in essence, clusters of skin pigment cells which should be spread throughout the body.
Instead of locating themselves across the skin itself they group together and form what we see as a
mole. These are often harmless and may never cause you problems in the long run. When they begin
to form too often you may feel there is a reason why they are continuously popping up and you might
want to have a professional see to them just in case they are harmful to your health. There are a variety
of causes that could lead to moles appearing on the body and while some of these can be prevented at
other times the causes are more complex and you may need to look at a range of probabilities that may
be contributing to the problem. At different

Educating Students For A Global Society
The twenty first century seemed light years away when I was in high school. It feels like we blinked
and suddenly we have arrived. With the dawn of this new century, the face of education is changing.
We have to prepare students for a global society. Our test scores show that American education reform
is not just a want but also a necessity. The diverse communities within our classrooms have forced us
to reevaluate best practices to meet the needs of our students. Collaborative teaching is one way to
meet the needs of students of all skill levels. Co teaching allows for differentiated instruction that will
meet the needs of ELL students, students of low income families, students with identified learning
disabilities, etc. The ... Show more content on Helpwriting.net ...
Instructional collaborative activities allow teachers to align teaching objectives, materials, learning
strategies, and assessment so that students can be supported academically in a cohesive manner. Team
teaching provides all students access to the general education curriculum and general education. All
students need to have access to the mainstream curriculum and assistance through teaching and
learning strategies that make concepts understandable. When teachers plan together, they can ensure
that the needs of all lessons are presented in a way that will reach students. Today s classrooms have
many different challenges, and working with a colleague to meet those challenges is far superior to
working in isolation, as teachers frequently do (Dove). Planning together is key to ensuring that all
students will have access to the curriculum. That old saying, two heads are better than one rings true
in collaborative teaching. Teachers will learn from each other s expertise and expand the scope of their
teaching capacity (Ferry, 2013). When teachers come together to provide instruction, they have the
opportunity to observe good teaching practices. Teachers are often very isolated. They don t get the
opportunity to see other good teachers in action. It is difficult to learn new teaching practices when
you are never allowed to observe other classrooms. Team teaching allows us to be able to learn from

Sexual Harassment of Women in the Military; It is a Dirty Secret
I would like to bring awareness, give insight about the actual victims, and possibly educate you about
sexual harassment of women in the military. Sexual harassment can be connected to sexual assault,
beginning in one form and escalating to another level. The definition of sexual harassment is:
unwelcome sexual harassment behavior of a sexual nature that is related to one s job or work
surroundings. Harassers can be male or female. In the military, the soldier can be a supervisor,
coworkers, or a third party. But, why have we not heard anything about this issue? As a ... Show more

This number was statistically higher in 2012 than in 2010, this number was at 4.4 percent. The 6.1
percent of women who were subjected to the unwanted sexual contact indicated the maximum
behavior they encountered was unwanted sexual touching, this was at 32 percent, and attempted sex
was at 26 percent, but 31 percent said that they experienced completed sex.
So the question is where would these crimes take place? The majority of the unwanted sexual contact
happened at the military installations, and during work day or duty hours. 94 percent of the offender(s)
were men and 1 percent indicated the offender(s) were female only, and 5 percent indicated the
offenders were both males and female The WGRA report shows that some of the offenders drugged
their victims or the victim admitted to drinking alcohol and the others reported that some form of
physical force was used (U.S. Military Gender Relations Survey).
The proper procedure for reporting and or filing a claim for a female solider in the Army would be to
report this issue to their supervisor, the Chain of Command, the Equal Opportunity Advisor and
SHARP (Sexual Harassment/Assault Response Prevention). This is after the victim has tried to resolve
the issue by letting the perpetrator or perpetrators know that this type of behavior is not warranted, not
appreciated or welcomed. If the unwanted behavior continues, then is the next step would be to file an

Using Signing Statements
Ramification of Using Signing Statements
According to Strauss (2006), the presidential signing statements have come out of obscurity and into
the headlines. Along with salutary attention to an interesting issue, the new public visibility of signing
statements have generated much overblown commentary. The desire to make these little known
documents interesting to the public and to score points in the inevitable political battles over any
practice engaged in by a sitting President has produced a lot of discussion that misleads the public.
Signing statements constitute a striking official power that has recently caught insightful and political
consideration. Earlier writing recommends that presidents utilization signing statements to increase
extra strategy concessions from Congress. Confirmation of approach inspirations are, nonetheless,
hard to exhibit and arrangement thought processes neglect to clarify a wide range of existing
statements.
Evans (2007) infers that the affluent antiquity of the U.S. presidency is confused with illustrations of
presidents endeavoring to practice their influence through this apparatus. The initially archived
utilization of the signing statement is when President Monroe issued an announcement to ensure his
presidential privilege. Be that as it may, the instrument did not turn into a generally utilized vital
weapon until the Reagan organization had the capacity to get it included into the administrative
history (Kelley 2007). Kelley

Occupy Wall Street Equality
Three years after the 2008 financial crisis, the U.S. economy remained a mess, leaving millions
unemployed. The housing market was struggling to recover three years after the financial crisis,
increasing foreclosures. Occupy Wall Street arose in response to the middle class people who are
getting battered by economic forces beyond their control, while elites in the private and public sector
prospered. In this paper, I will examine Occupy Wall Street s confrontation on the U.S. wealth
inequality and its protest in New York, participants and its attempt to encourage equality. Occupy Wall
Street (OWS) is a leaderless resistance movement. People had joined the movement and participated,
no matter what the gender, ethnicity, age, politics, income, occupation and education degree they had.
The majority of the protesters are young people under 30 and many of them are unemployed or
underemployed. They are frustrated that the hard working middle class is getting poor, yet Wall Street
stays wealthy. In response to the frustration, Occupy Wall Street was initiated on September 17, 2011
in Zuccotti Park. The blog post that sparked the movement was by the Canadian magazine Adbusters,
Kalle Lasn and Micah White, Canadian anti consumerist. In a blog post on July 13, 2011, Adbusters

Betrayal in Maus Essay
During World War II and the Holocaust, there was not only mistrust for the government but there was
also plenty of mistrust for prior friends and neighbors. In the graphic novel, Maus (Volume I and II)
Vladek Spiegelman makes it very clear to his son, Artie, that one cannot count on their friends. He
makes the point that in time of hardship, friends will abandon you quite quickly. Vladek says, Friends?
Your friends...if you lock them together in a room with no food for a week...then you could see what it
is, friends! (Maus, VI. 5 6). Throughout the novel, we see examples of this gloomy point proven
repeatedly. In the first volume of the novel, Haskel, a cousin of the family and a chief of the Jewish
police is guarding the ghetto that ... Show more content on Helpwriting.net ...
The Spiegelman family and their comrades were trying to be compassionate and help someone that
they identified with, someone who, through a shared desperate situation (or so they thought) they tried
to befriend. Unfortunately, he was so quick to turn his back on the people who had treated him so
kindly. Yet again, it becomes evident that no one can be trusted when the prisoners are being marched
from the concentration camp due to the Nazis fear that the United States and allies soon would
discover their operation. The Jewish prisoners arrange a plan with some of the German guards
marching alongside them. The prisoners pay the guards with the agreement that when they try to run
the German soldiers will fire over their heads and not kill them. When the time came to run, the
prisoners break away from the pack and start towards the woods, however, the same soldiers that
promised not to shoot them shot them in the back as they ran (Maus V II 82 83). The Germans that
were supposed to be the friends of the Jews and help them escape took their gold and did not hesitate
to shoot them in the back as they ran. Fortunately, for everyone s sake, not everyone was only out to
save himself or herself. In contrast to the many examples where betrayal was the norm there are
several examples of friends who were genuine and helped to make the situation better for someone
even they could not make it better

Modern Day Approach To Negligence
The modern day approach to negligence has developed significantly across the twentieth and twenty
first century. The stance now taken upon an action for negligence is that it must be established that a
duty of care is owed by the defender to the pursuer in order for liability to arise. This came about
following the decision made by Lord Atkin in the case of Donoghue v Stevenson, and has been further
developed in a number of other common law examples. Prior to this revolutionary judgement, there
was a quantitative restriction as to where a duty of care would arise, primarily only in relationships of
a particular nature i.e. a doctor and their patient. Where a wrongdoer carried out an act outside a
recognised relationship, there was no general ... Show more content on Helpwriting.net ...
The neighbour principle, introducing the foreseeability and proximity factors, has been critiqued as it
can be debated that the decision extended the scope far too much. The approach itself was a way
which would be able to unify the court and aid their decision, whilst also offering an element of
predictivity in relation to future cases. It is however worth noting that it can become too predictable at
times, as in many cases the neighbour principle will be somewhat perfectly fitting. Is it just as simple
as establishing that there is even just an ounce of proximity there and hence creating that duty of care?
There has been some degree of scepticism and so this brings us to Lord Wilberforce as he attempted to
re formulate the neighbour principle in the case of Anns v Merton London Borough

The Social Security Act Of Franklin Delano Roosevelt
After getting my first part time, minimum wage job and working for several months, I was given what
is called a W 2 form. A W 2 form broke down my entire income including the income that never even
touched my hand and showed how much of it was withheld for taxes. Social Security was the largest
hunk missing, but I knew that although it pained me to see so much gone I would get it back one day.
However, that money removed went straight into the pockets of recipients, not a trust fund I would
eventually draw from, and the future of the Social Security program (and its ability to pay me back)
was in jeopardy.
After its passage on August 14, 1935, Franklin Delano Roosevelt regarded the Social Security Act as a
cornerstone in a structure which is being built but is by no means completed but whose purpose is to
take care of human needs and at the same time provide for the United States an economic structure of
vastly greater soundness. The very opposite of soundness, however, was achieved. Today, looming
deficits and abuse of the program have left it the focus of many debates. At their conclusion, the
discussions generally only point toward making it more difficult to receive the money you put in,
back, and raising taxes drastically on those still working to provide benefits for the disproportionate
amount of retirees. Its problems are vast, but a permanent solution has yet to be decided. Far less
discussed, however, is if the program itself is worth saving. Because of

Probable Cause

Criminal Procedures
Mid Term Probable cause does not rise to the level of proof beyond a reasonable doubt but must be
beyond a mere hunch or guess. The legal standard to a probable cause arrest is when an officer finds
evidence during a valid stop and frisk search that confirms the reasonable suspicion of an officer that a
crime has been or is being committed and would lead to the arrest of and offender. There are a variety
of sources to establish probable cause and they are personally observed facts by an officer,
information received from an informant. When information supplied by informant the courts and

The defense case in chief must mount a defense that either demolishes the prosecutor s case or, at a
bare minimum, creates reasonable doubt in the minds of the jury. A defendant has no burden of proofs
in any criminal case and can still prevail without introducing any evidence with the exception of
affirmative defenses. Based on the Fifth Amendment the defendant may choose not to testify to avoid
self incrimination. The defense counsel also calls defense witnesses for direct examination. Defense
testimony may also include expert witnesses who have special training and qualifications and are
permitted to offer opinions. The prosecution is permitted to cross examine each defense witness.
Reasonable Suspicion is a crime has or about to occur. If an officer has some suspicion of criminality
of a person they are allowed to do a limited stop and frisk of the individual just for the safety of the
officer. The Terry, courts have adapted the stop and frisk rationale to situations involving automobiles
and airport detentions. A reasonable level of force may be used to effectuate the stop if the individual
proves resistance. The subject may be briefly questioned about the unusual conduct; if the explanation
proves unreasonable, and the officer reasonably believes the person is armed and dangerous, he or she
may conduct a limited search of the outer clothing. The facts that generate an officer s reasonable
basis to suspect criminal activity may be derived from the

  • 2. Feral Cats Annotated Bibliography Brendan Bray/325 3950 Annotated Bibliography Citation Dickman, C. R., Australian Nature Conservation Agency, University of Sydney, Invasive Species Program (Australia). (1996). Overview of the impacts of feral cats on Australian native fauna. Canberra, ACT: Australian Nature Conservation Agency. Content Summary In this book the authors review impact of feral cats. Feral cats have major or minor impacts on the Australian native wildlife some of which are competitive, amensal, and predatory. The Competitive impact caused by cats is on large predatory species by loss of prey. Amensal impact is most likely cause by transmission of diseases. And predatory impact on native wildlife has been identified by historical evidence. Many conclusions can be made from this evidence. Mammals make up a large part of a feral cats diet. They target mammals weighing up to 2kg, and birds up to 1kg. But they prefer prey weighing less then approximately 200grams in Mainland Australia. ... Show more content on Helpwriting.net ... Australia has the worlds worst record for extinct mammals, 28 species and sub species mostly marsupials since European explorers and settlers arrived. Most of these extinctions have been linked to feral cats and other introduced species. Cats have developed there skills over millions of years and they a fast and silent killers. The US Fish and Wildlife Service has revealed that feral and domestic cats kill an estimated 2.4 billion birds and 12.3 billion mammals each year most of which are native. No such large studies have been performed in Australia. However The Australian Wildlife Conservancy released a report, which estimated the impact of 5 to 18 million feral cats on native Australian species, such as the numbat or bilby. • 3. Examples Of Dystopia In The Hunger Games The chosen utopia is a political utopia that described in the novel The Hunger Games written by the American author Suzanne Collins. Utopia means a nowhere land , and its concept alludes to some imaginary paradisiacal places where human beings are living under a desired environment. This kind of ideal society with everything perfect can be found in Edward Bellamy s Looking Backward and William Morris s News from Nowhere . Dystopia, on the other hand, is a world in which nothing is perfect such as 1984 by George Orwell and We by Yevgeny Zamyatin. The concept of political utopia was originally developed by Richard Saage. According to him, political utopia provides an ideal commonwealth that characterised by its distinctive criticism of reality, its rational and comprehensible design, which is universally applicable. In this essay, I will posit the political utopia in The Hunger Games as a dystopia and elaborate the universally applicable utopia or dystopia is non existent and impossible because of the diversity of human beings. ... With organising the hunger game, no uprising happens anymore and the country is under peace which reflects the sense of political utopia which is an orderly and peaceful society without turmoil and well governed by an ideal commonwealth. • 4. Paul s View On The Law Essay Paul has used the law in many circumstances throughout his epistles. He also discusses the implications of the law and its relation to believers. Paul s view on the law has been a conversation held by many New Testament scholars. Some suggest that Paul s views on the law is inconsistent throughout the epistles but by a careful analysis will show that his views are complementary rather than inconsistent. A main issue that Paul argued was that we are justified by faith in Christ and not by doing the works of the law. Paul view of the law was that nobody can be saved by obedience to the law but only by faith in Christ can one be saved. Three theological stands that have strong interest with Paul view of the law are those of Lutheranism, Reformed and The so called New Perspective of Paul. The Lutheranism believes that it is Paul s belief that Christ abolished the law and that the law is an argument contrast of the gospel (Crandell 2014). The main role of the law is to display our hopefulness in efforts of obedience in order to obtain God s acceptance and should cause us to desire from God a mercy that is only found in Christ. The Reformed view sees salvation as something that is of grace and not nothing that involves obeying the law but once saved we must only obey the moral law in order to be pleasing to God (Rosner 2013). Lastly this New Perspective of Paul believers that Paul s problem with the law was not a matter of salvation being by grace rather ... Get more on HelpWriting.net ...
  • 5. A New Era Of Deep Cooperation A New Era of Deep Cooperation Economic 2166F November 29, 2016 Jingwen Guo 250811379 In recent years, airlines build a closer relationship, especially European airlines and Chinese airlines. Europe is the headstream of airplane, but compared to North America, European aviation is a little bit weak on the ridership. In late 1990s and early 2000s, Europe had more interactions with American aviation. In recent years, Europe set China as a new partner. European aviation is trying to expand its international market through increasing new cooperation. In recent years, the relationship between Chinese and European Aviation is getting closer. The strongest evidence is that Chinese government and European Union have signed a 5 year work agreement for reducing the economic burden in aviation industry, preserving aviation safety and environmental compatibility. European Union and China emphasized the importance of this project by preparing over 10 million euro as its budget. The detailed work plan was reviewed and updated in September 2016. This is the first official cooperation in European and Chinese aviation, which is managed by the European Aviation Safety Agency (EASA) and Civil Aviation Administration of China. In terms to those individual airlines, there is another event that caught the public attention is that the chairman of the Executive Board and CEO of Deutsche Lufthansa AG, Carsten Spohr and Mr. Song Zhiyong, President and Executive Director of Air China ... • 6. Food Security Is A Basic Human Right, Essential For Life Food security is considered as a basic human right, essential for life. It exists when all people, at all times, have physical and economic access to sufficient, safe and nutritious food to meet their dietary needs and food preferences for a healthy and active lifestyle [Food Agricultural Organization (FAO), 1996]. Food insecurity can refer to not having sufficient food; experiencing hunger as a result of running out of food and being unable to afford more; eating a poor quality diet as a result of limited food options; anxiety about acquiring food; or having to rely on food relief (Rychetnik, Webb, Story, Kat, 2003). Although the United States population is considered food secure as a whole, with 85.7% being food secure (Coleman Jensen, Gregory Singh, 2014), pockets of food insecurity have been identified among sub populations such as single parent households (34.4%), people at social or geographical disadvantage (26%), the homeless and the young (Rychetnik, Webb, Story, Kat, 2003; Innes Hughes, Bowers, King, Chapman, Eden, 2010). According to National Center for Education Statistics (2013), enrollment of students 18 24 years in degree granting institutions increased from 15.9 million in 2001 to 21 million in 2011. Many students live on low incomes and have unique expenses, such as high tuition, cost of textbooks, healthcare cost and other instructional expenses such as housing that increase their cost of living relative to other young ... • 7. The Animation Of Life In Frankenstein The Animation of Life by Stories: Literature and Society Doctor Frankenstein in Mary Shelley s influential novel never reveals the secrets behind the animation of his monster. Even still, the creature is suddenly thrust into being; thrust into an amalgamation of ebbing and flowing stories and forced to carve out a story of his own. It can be reasoned that everything which exhibits what we classify as life carries with it the capacity to simultaneously create and be shaped by stories. Shelley s intentional decision to keep the methods of the monster s creation hidden allows for the story of the monster itself to be what truly gives him life and consequently, the story of Frankenstein and his monster has breathed life into many modern discussions. ... Show more content on Helpwriting.net ... The most poignant example being Victor s wedding night, a night which should be shared between him and his new bride. Ultimately, Victor is so caught up in his own story that he does not even begin to reason that his new bride could be the target of his monster s wrath and Victor s beloved dies at the hands of his creation. (Shelley 151) It is interesting to conjecture that getting caught up in one s own story is the opposite of animating life, rather, the loss of life. When one is caught up in their own story, all other stories around it cease to be narratable. By figurative reasoning, when someone s story becomes un narratable, the life which the story sustains can no longer exist. Arthur Frank comments that stories are symbiotic, Stories and people need each other. (Frank 37) A person cannot live without stories and stories can be created, or destroyed, by people. Frankenstein teaches us that stories are dangerous and out of control, but we depend on them to animate life and without them, life ceases to ... Get more on HelpWriting.net ...
  • 8. Specific Heat Lab Report Have you ever wondered why a fire burns orange, or why a lighter burns blue towards the bottom of the flame? If we take a quick step back, this is mostly due to a chemical reaction that is known as the specific heat . This must be achieved (as well as the other two properties that every fire is required to possess in order to burn) in order for a flame to become present. After this specific heat is reached, a chemical reaction occurs and turns the fuel source of the fire into a vapor. The aspects that are required for a flame to be created are a heat source, some sort of fuel, as well as some sort of oxidizing agent. The only way that a change in flame color can be observed is by manipulating the fuel source. After we manipulate the source ... Get more on HelpWriting.net ...
  • 9. The Defense Of The Insanity Defense The insanity defense has been used in several cases in criminal law. This defense basically states that the accused cannot be held responsible for what he/she did because they had no control over their actions. Many times the defense attorney will plea for a deal that the defendant be sent to a mental rehabilitation center for proper treatment. When using this defense the defense attorney will argue that there may be a chemical imbalance in his brain therefore he had no idea what he was doing at the time. In my opinion the insanity defense should not exist because many of the people accused just use to get out of their justified sentence. Daniel M Naghten was a woodworker who believed he was the target of a conspiracy involving the pope ... Show more content on Helpwriting.net ... And this is because so many people were using this defense to get out of being in trouble and later being sentenced. In many cases involving the insanity defense the defense attorney will raise the point that there is a chemical imbalance in his head, basically stating that he had no control over himself at the time that he did the act of violence. Monte Durham was a 23 year old who had been in and out of prison and mental institutions since he was 17. He was convicted for housebreaking in 1953, and his attorney appealed. Although the district court judge had ruled that Durham s attorneys had failed to prove he didn t know the difference between right and wrong, the federal appellate judge chose to use the case to reform the McNaughton rule. Citing leading psychiatrists and jurists of the day, the appellate judge stated that the McNaughton rule was based on an entirely obsolete and misleading conception of the nature of insanity. He overturned Durham s conviction and established a new rule. The Durham rule states that an accused is not criminally responsible if his unlawful act was the product of mental disease or mental defect. The Durham rule was eventually rejected by the federal courts, because it cast too broad a net. Alcoholics, compulsive gamblers, and drug addicts had successfully used the defense to defeat a wide variety of crimes. (Legal information institute, Cornell university law school). This is an example of how the insanity ... Get more on HelpWriting.net ...

Because of the number of suitors involved if he makes a hasty decision to fight the suitors along he would be outnumbered. Therefore his disguise will give him the upper hand by devising a plan with those individuals who are loyal and he can trust. They will be able to join forces and initiate a surprise raid on the suitors and ultimately remove them out of his palace. 4. She nursed Odysseus and Telemachus when they were babies. She also served as the master s confidante. She is very loyal to both Telemachus and Odysseus. Upon Telemachus search to find his father she keeps his journey a secret from his mother Penelope (Homer 2.104 105). She also keeps Odysseus identity a secret after recognizing a scar on his leg. In book 19 she states that scar as the old nurse cradle his leg and her hand passed down she felt it. She said to him you are Odysseus, oh dear boy I didn t know you before, not until I touched the body of my king (Homer 19.405). Eurycleia also reveals to Odysseus what female servants was unfaithful to Penelope while he was away thus working and sleeping with the suitors. Eurycleia treatment with Telemachus in book one and with her encounter with Odysseus as beggar was almost identical. She was very emotional when she saw Telemachus was leaving in search of his father and vowed to him that she would not tell his mother. The treatment with Odysseus as beggar was similar when she found out the beggar was Odysseus she was emotional and she also made a promise to him not to tell Penelope just as she did with Telemachus. One fellow by the name of Jack Durbeyfield learned from a local parson that he is actually descended from the old and forgotten family, the D Urbervilles. Planning to exact his royal name, he sent his eldest daughter to a nearby town by the name of D Urberville, to see if she can find out whether or not they are related. Tess came to find out that their name had died off and is no longer related to the noble name, D Urberville. What Jack and his family do with that information will be uncovered soon. Birds, one of the most recurring themes throughout this novel. The characters believe that birds represent higher beings, as if they are spirits from another realm. The main birds that the characters speak of, mainly Tess, is the Christian dove of peace and the Romantic songbirds of Keats and Shelley. The author makes you think as if the birds speak for Tess. On many occasions you can hear birds singing in the background as Tess sits quietly and silent. Her personality and mannerisms make her seem quiet and calm. The real reason for this is because she was raped by Alec D Urberville, son of the noble family, when she was younger and feels wronged and disgraced. The incident makes her silent and submissive to whatever the situation is. The birds also represent more than just Tess s voice; they also represent images of hope and freedom. The Equalizer Film Analysis In the film The Equalizer , a thriller/action directed by Antoine Fuqua, there are several key scenes that build the storyline for the movie, however there was one scene that engaged my attention and I found had great relevance as I studied this film. It is the first fight scene where Robert McCall fights a Russian group holed up in a hotel room. Significant aspects that I noticed Fuqua use in this scene were the characters actions, camera techniques and lighting. I feel as though these 3 techniques were the most important and the most effective. Fuqua cleverly utilised these techniques in this scene which helped the audience to understand the characters emotion and to help build tension leading up to the fight. I feel that the director s purpose of this scene is to expose and shed a little light upon Robert and how he approaches tasks as well as the way he thinks and acts in these situations. One example Fuqua has attempted to portray in this scene is how Robert s mind works differently to most other people and this is shown when we see Robert opening and closing the door 3 times before finally locking it behind him. This shows myself and the audience that Robert is some sort of perfectionist and may have some kind of O.C.D. Locking it behind him tells me that he is extremely confident in his own abilities. Although at first Arwen honours her father s wishes and embarks on the journey with the Elven people to the Havens, she returns to Rivendell after she has a vision of what she believes to be her future, and confronts her father with it. The vision was of her son and Aragorn, a vision which brings her hope and strengthens her will to remain in Middle Earth. This strength is different to what was expected of women at that time. • 31. Betrayal in Maus Essay During World War II and the Holocaust, there was not only mistrust for the government but there was also plenty of mistrust for prior friends and neighbors. In the graphic novel, Maus (Volume I and II) Vladek Spiegelman makes it very clear to his son, Artie, that one cannot count on their friends. He makes the point that in time of hardship, friends will abandon you quite quickly. Vladek says, Friends? Your friends...if you lock them together in a room with no food for a week...then you could see what it is, friends! (Maus, VI. 5 6). Throughout the novel, we see examples of this gloomy point proven repeatedly. In the first volume of the novel, Haskel, a cousin of the family and a chief of the Jewish police is guarding the ghetto that ... Show more content on Helpwriting.net ... The Spiegelman family and their comrades were trying to be compassionate and help someone that they identified with, someone who, through a shared desperate situation (or so they thought) they tried to befriend. Unfortunately, he was so quick to turn his back on the people who had treated him so kindly. Yet again, it becomes evident that no one can be trusted when the prisoners are being marched from the concentration camp due to the Nazis fear that the United States and allies soon would discover their operation. The Jewish prisoners arrange a plan with some of the German guards marching alongside them. The prisoners pay the guards with the agreement that when they try to run the German soldiers will fire over their heads and not kill them. When the time came to run, the prisoners break away from the pack and start towards the woods, however, the same soldiers that promised not to shoot them shot them in the back as they ran (Maus V II 82 83). The Germans that were supposed to be the friends of the Jews and help them escape took their gold and did not hesitate to shoot them in the back as they ran. Fortunately, for everyone s sake, not everyone was only out to save himself or herself. In contrast to the many examples where betrayal was the norm there are several examples of friends who were genuine and helped to make the situation better for someone even they could not make it better ... • 32. Modern Day Approach To Negligence The modern day approach to negligence has developed significantly across the twentieth and twenty first century. The stance now taken upon an action for negligence is that it must be established that a duty of care is owed by the defender to the pursuer in order for liability to arise. This came about following the decision made by Lord Atkin in the case of Donoghue v Stevenson, and has been further developed in a number of other common law examples. Prior to this revolutionary judgement, there was a quantitative restriction as to where a duty of care would arise, primarily only in relationships of a particular nature i.e. a doctor and their patient. Where a wrongdoer carried out an act outside a recognised relationship, there was no general ... Show more content on Helpwriting.net ... The neighbour principle, introducing the foreseeability and proximity factors, has been critiqued as it can be debated that the decision extended the scope far too much. The approach itself was a way which would be able to unify the court and aid their decision, whilst also offering an element of predictivity in relation to future cases. It is however worth noting that it can become too predictable at times, as in many cases the neighbour principle will be somewhat perfectly fitting. Is it just as simple as establishing that there is even just an ounce of proximity there and hence creating that duty of care? There has been some degree of scepticism and so this brings us to Lord Wilberforce as he attempted to re formulate the neighbour principle in the case of Anns v Merton London Borough ... • 33. The Social Security Act Of Franklin Delano Roosevelt After getting my first part time, minimum wage job and working for several months, I was given what is called a W 2 form. A W 2 form broke down my entire income including the income that never even touched my hand and showed how much of it was withheld for taxes. Social Security was the largest hunk missing, but I knew that although it pained me to see so much gone I would get it back one day. However, that money removed went straight into the pockets of recipients, not a trust fund I would eventually draw from, and the future of the Social Security program (and its ability to pay me back) was in jeopardy. After its passage on August 14, 1935, Franklin Delano Roosevelt regarded the Social Security Act as a cornerstone in a structure which is being built but is by no means completed but whose purpose is to take care of human needs and at the same time provide for the United States an economic structure of vastly greater soundness. The very opposite of soundness, however, was achieved. Today, looming deficits and abuse of the program have left it the focus of many debates. At their conclusion, the discussions generally only point toward making it more difficult to receive the money you put in, back, and raising taxes drastically on those still working to provide benefits for the disproportionate amount of retirees. Its problems are vast, but a permanent solution has yet to be decided. Far less discussed, however, is if the program itself is worth saving. Because of ... Get more on HelpWriting.net ...

  • 35. Probable Cause Tillian Stokeling November 10, 2010 Criminal Procedures Mid Term Probable cause does not rise to the level of proof beyond a reasonable doubt but must be beyond a mere hunch or guess. The legal standard to a probable cause arrest is when an officer finds evidence during a valid stop and frisk search that confirms the reasonable suspicion of an officer that a crime has been or is being committed and would lead to the arrest of and offender. There are a variety of sources to establish probable cause and they are personally observed facts by an officer, information received from an informant. When information supplied by informant the courts and police need to know what facts was observed by them and why should their information be ... Show more content on Helpwriting.net ... The defense case in chief must mount a defense that either demolishes the prosecutor s case or, at a bare minimum, creates reasonable doubt in the minds of the jury. A defendant has no burden of proofs in any criminal case and can still prevail without introducing any evidence with the exception of affirmative defenses. Based on the Fifth Amendment the defendant may choose not to testify to avoid self incrimination. The defense counsel also calls defense witnesses for direct examination. Defense testimony may also include expert witnesses who have special training and qualifications and are permitted to offer opinions. The prosecution is permitted to cross examine each defense witness. Reasonable Suspicion is a crime has or about to occur. If an officer has some suspicion of criminality of a person they are allowed to do a limited stop and frisk of the individual just for the safety of the officer. The Terry, courts have adapted the stop and frisk rationale to situations involving automobiles and airport detentions. A reasonable level of force may be used to effectuate the stop if the individual proves resistance. The subject may be briefly questioned about the unusual conduct; if the explanation proves unreasonable, and the officer reasonably believes the person is armed and dangerous, he or she may conduct a limited search of the outer clothing.
