• Software is a type of intellectual property (IP), which is governed by copyright laws and, in some
countries, patent laws
• Proprietary software is another name for non-free software

PLAGIARISM
• Plagiarism involves the use of another person’s work without full and clear referencing and
acknowledgement
• In open-source software there is plagiarism when someone deletes the author of something

• COPYRIGHT:
• I have taken some pictures of the scenery.Are they protected by copyright?
• I have thought of a story but have not written it down. Is it protected by copyright?
• EXCLUSIVE RIGHTS OF COPYRIGHT OWNERS:
• I have uploaded my self-composed songs onto my personal webpage so that they can be
downloaded by other people.
• I have composed an opera. I plan to have a public performance of my opera in an opera house.
• PROTECTION PERIOD OF COPYRIGHT:
• I’m a great poet who has written so many poems. My descendents will possess the copyright of my
poems forever.
• Beethoven died more than a hundred years ago. If I perform his composition in public, I will not
infringe any copyright.
DISCUSSIONS
• PHOTOCOPYING IN SCHOOL:
• This book is too expensive and I cannot afford it. I should seek the help of my teachers because
they should have the right to photocopy books.
• This book has been out of print for many years. I think it is okay to copy it and distribute the copies
to my students.
• COMPUTERS AND SOFTWARE:
• The school does not have this learning software. I can install such software (which I have used in my
computer at home) in the school’s computers, so that my classmates can share it.
• There are many pictures and texts over the Internet. I can email them to my classmates for their
reference.
• COPYRIGHT INWORKS CREATED BYTEACHERS AND STUDENTS:
• These works are created by my students.As a teacher, I have the right to copy their work.
• I can photocopy the teaching material given by Miss Chan and distribute the copies to the students
of other schools.

• Using Internet resources research famous cases of property rights violations, such as:
– The Graphical User Interface (Apple Computer, Inc. v. Microsoft Corporation)
– DigitalVideo Recording (TiVo Inc. v. EchoStar Corp.)
– ENIAC (Honeywell v. Sperry Rand)
• Make a short presentation using online presentation making tool such as Prezi

“MY OWN INVENTION”
• Statements for discussion about patents:
– This “smart home” is my invention. I should disclose it to the public via the media prior to patent
registration.
– I have copied the idea of smart vacuum cleaner invented by another inventor. Only the appearance is
slightly different. I think I can register a patent for it.
• What is wrong with above views?
• Draw your new inventions on a sheet of paper. The new invention should meet three
requirements. It must be new, inventive and industrially applicable.

  • 3. WHAT IS INTELLECTUAL PROPERTY? • Intellectual property (IP) refers to creations of the mind, such as – inventions; – literary and artistic works; – designs; and – symbols, names and images used in commerce. • Example: Sport and Intellectual Property

  • 8. PLAGIARISM • Plagiarism involves the use of another person’s work without full and clear referencing and acknowledgement • In open-source software there is plagiarism when someone deletes the author of something
  • 9. DISCUSSIONS • COPYRIGHT: • I have taken some pictures of the scenery.Are they protected by copyright? • I have thought of a story but have not written it down. Is it protected by copyright? • EXCLUSIVE RIGHTS OF COPYRIGHT OWNERS: • I have uploaded my self-composed songs onto my personal webpage so that they can be downloaded by other people. • I have composed an opera. I plan to have a public performance of my opera in an opera house. • PROTECTION PERIOD OF COPYRIGHT: • I’m a great poet who has written so many poems. My descendents will possess the copyright of my poems forever. • Beethoven died more than a hundred years ago. If I perform his composition in public, I will not infringe any copyright.
  • 10. DISCUSSIONS • PHOTOCOPYING IN SCHOOL: • This book is too expensive and I cannot afford it. I should seek the help of my teachers because they should have the right to photocopy books. • This book has been out of print for many years. I think it is okay to copy it and distribute the copies to my students. • COMPUTERS AND SOFTWARE: • The school does not have this learning software. I can install such software (which I have used in my computer at home) in the school’s computers, so that my classmates can share it. • There are many pictures and texts over the Internet. I can email them to my classmates for their reference. • COPYRIGHT INWORKS CREATED BYTEACHERS AND STUDENTS: • These works are created by my students.As a teacher, I have the right to copy their work. • I can photocopy the teaching material given by Miss Chan and distribute the copies to the students of other schools.
  • 11. CASE STUDY “PROPERTY RIGHTS VIOLATIONS” • Using Internet resources research famous cases of property rights violations, such as: – The Graphical User Interface (Apple Computer, Inc. v. Microsoft Corporation) – DigitalVideo Recording (TiVo Inc. v. EchoStar Corp.) – ENIAC (Honeywell v. Sperry Rand) • Make a short presentation using online presentation making tool such as Prezi • Present!
  • 12. “MY OWN INVENTION” • Statements for discussion about patents: – This “smart home” is my invention. I should disclose it to the public via the media prior to patent registration. – I have copied the idea of smart vacuum cleaner invented by another inventor. Only the appearance is slightly different. I think I can register a patent for it. • What is wrong with above views? • Draw your new inventions on a sheet of paper. The new invention should meet three requirements. It must be new, inventive and industrially applicable. • Brainstorm 1.What are the functions of your invention? 2. How does your invention meet the three requirements: new, inventive and industrially applicable? 3. Do you think your invention has any commercial value?Why?
