Ora siamo più europei e lo conferma il rigido clima dell'isola. In più abbiamo un "bacino aerologico padano" e "piste ciclabili lungo gli argini dei fiummi e dei canali" presenti nei centri storici dei comuni siciliani. A leggere il piano in questione si può fare a meno anche dell'autonomia, dato che anche il Parlamento , l'Assemblea Regionale, è diventato un normale Consiglio regionale come quello del Veneto.

Il Piano regionale per la qualità dell'aria presentato dalla regione Sicilia nel 2007 somiglia stranamente a quello del Veneto. Semplice coincidenza?
E' da un pò che in Sicilia non si respira più la stessa aria. Da Palermo a Gela, da Catania a Caltanisetta ci sono segnali di cambiamento che vengono dalla società civile, dai commercianti, dagli industriali che si ribellano contro la mafia e il pizzo. Anche la burocrazia regionale se n'è accorta. Per questo nel "Piano Regionale di Coordinamento per la tutela della qualità dell'aria", pubblicato sulla Gazzetta Ufficiale della Regione Siciliana, sono state introdotte importanti novità. Ora siamo più europei e lo conferma il rigido clima dell'isola. In più abbiamo un "bacino aerologico padano" e "piste ciclabili lungo gli argini dei fiummi e dei canali" presenti nei centri storici dei comuni siciliani. A leggere il piano in questione si può fare a meno anche dell'autonomia, dato che anche il Parlamento , l'Assemblea Regionale, è diventato un normale Consiglio regionale come quello del Veneto.
Lo Bello e Capilli nelle due audizioni a giustificazione del Piano copiato? Che ha prodotto "effetti" (amministrativi). Purtroppo, devo darvi la brutta notizia che avevano ragione. Il Piano copiato ha prodotto "effetti", e... che "effetti": ECCOLI !!!

c) per quanto riguarda l'ozono, leggerete nelle conclusioni l'ammissione che lo studio è carente e che si rimanda alla...previsione di un altro studio per identificare -
le correlazioni tra danno fogliare e le concentrazioni di ozono (come dire, altro giro, altra corsa).

Sarà celebrata il prossimo 17 gennaio l’udienza preliminare del procedimento penale a carica del sindaco di Isola delle Femmine Gaspare Portobello e dell’Assessore alla Pubblica Istruzione Napoleone Riso. Per il primo cittadino è stato chiesto il rinvio a giudizio per il reato di abuso d’ufficio, mentre all’assessore Riso, all’epoca dei fatti Presidente Presidente del Consiglio Comunale di Isola delle Femmine, viene contestata l’omissione di atti d’ufficio e la minaccia grave ai danni dell’allora capogruppo di opposizione Antonino Rubino. La vicenda finita in Procura ruota attorno ad una concessione edilizia rilasciata dall’Ufficio Tecnico Comunale il 6 giugno del 2006, in favore di un costruttore locale che avrebbe poi volturato il progetto al genero Napoleone Riso, cugino del sindaco Portobello; quest’ultimo, nonostante i legami di parentela, non si sarebbe astenuto dal partecipare alla Commissione Edilizia, e avrebbe approvato il provvedimento di concessione.

,Il giudice per le indagini preliminari Fiorenza Giorgi ha deciso il sì alla richiesta della Procura. La richiesta è stata decisa in seguito alle verifiche che sono state effettuate dai consulenti del Ministero dell'Ambiente e della Procura. Dagli accertamenti svolti sarebbe emerso, in particolare, il mancato rispetto di alcuni limiti imposti dall'Autorizzazione integrata ambientale. Oltre al superamento di alcuni limiti imposti dall'Aia, il sequestro sarebbe scattato anche per l'assenza del "sistema di monitoraggio a camino", che avrebbe dovuto essere realizzato entro il 14 settembre dell'anno scorso.
Il gip Fiorenza Giorgi spiega nell'ordinanza che la centrale potrà ripartire dopo che si sarà messa in regola introducendo tecnologie adeguate.
L'ordinanza. L'ordinanza con cui il gip ha disposto il sequestro della centrale a carbone Tirreno Power di Vado Ligure parla di nesso di causalità tra le emissioni, le morti e le patologie. E la prova del disastro ambientale doloso con conseguenza sulla salute dei cittadini starebbe nella rarefazione dei licheni e nell'aumento delle malattie.
L'inchiesta. Sull'attività di Tirreno Power - nella cui proprietà è presente anche il Gruppo Sorgenia - sono aperti due filoni d'inchiesta, una per disastro ambientale e una per omicidio colposo. Risultano indagati per disastro ambientale Giovanni Gosio ex direttore generale, dimessosi alcune settimane fa, e il direttore dello stabilimento Pasquale D'Elia. Ci sarebbe anche un terzo indagato di cui non si conosce il nome.

Il convenuto Giuseppe Ciampolillo con gli scritti (blog) a lui riferibili non ha prodotto alcuna lesione alla reputazione ed all’ immagine del ricorrente Anzà Salvatore.
Egli ha esercitato il diritto di critica riconosciuto dall’ ordinamento giuridico e pertanto non deve alcun risarcimento per l’ obbligazione extracontrattuale da illecito civile come chiede il ricorrente le cui domande vanno per ciò rigettate mentre lo stesso Anzà va condannato al rimborso delle spese giudiziali a favore del Ciampolillo.
La condotta di questi non integra il delitto di diffamazione (art. 595 cod. pen.), sol perché i suoi scritti contengono dubbi e perplessità sulla correttezza professionale del dr. Anzà. Sovviene in ogni caso la generale causa di giustificazione di cui all'art. 51 cod. pen., sub specie di esercizio del diritto di critica, preordinato ad ottenere il controllo di eventuali violazioni delle regole deontologiche. [Cass. pen., Sez. V, 05/07/2010, n. 33994]-
L'esimente, che nell’ elaborazione costante di dottrina e giurisprudenza, si realizza relativamente all'esercizio di un diritto (ovvero all'adempimento di un dovere), quando il diritto di cronaca o quello di critica sia conforme ai seguenti limiti:
- verità del fatto narrato;
- pertinenza (intesa quale obbiettivo interesse del fatto per la pubblica opinione)
- e continenza, ovvero correttezza del suo riferimento.
Anche se l'esercizio del diritto di critica trova un limite preciso nell'inammissibilità degli attacchi puramente personali, intesi esclusivamente a colpire la sfera privata dell'offeso e che possono sfociare, quindi, nell'ingiuria, la contumelia e la lesione della reputazione, dal concetto di critica esula, comunque, il requisito dell'obbiettività e della serenità (confacenti invece al diritto di cronaca, come meglio innanzi) in quanto attività essenzialmente valutativa, frutto, quindi, di una lettura personale degli eventi e molto spesso indirizzata a manifestare, con passione e coinvolgimento, un dissenso. Nell'esercizio del diritto di critica, pertanto, è logicamente ammissibile un'intrinseca valenza aggressiva nei confronti del destinatario che dia luogo anche ad una compressione del diritto alla reputazione dello stesso.

Ma Enea Vincenzo, dopo i reiterati atti di danneggiamento subiti, non si piega alla richiesta di Bruno Francesco di costituire con lui una società di fatto impegnata nell’edilizia e questo gli costerà la vita.
IN altri termini Enea Vincenzo rimane vittima dei contrasti con “un’impresa ad infiltrazione mafiosa”, ossia la B.B.P., un soggetto economico che instaura con il sodalizio mafioso, cappeggiato da Riccobono Rosario e da personaggi come Bruno Francesco e Lo Piccolo Salvatore rapporti stabili di connivenza, accettandone i servizi offerti e ricambiandoli con altri servizi ed attività complementari.

Perché dunque meravigliarsi se Ciampolillo parla di “probabili ipotesi truffa” e gridare allo “scandalo”, come fa il ricorrente.
Non ci si meravigli che la verità delle cose venga chiamata per quello che è!
E’, infatti, documentalmente provato (documento prodotto n. 16)che il Piano Regionale di Coordinamento per la Tutela della Qualità dell' Aria della Regione Siciliana è da pag. 9 a pag. 238 frutto di un “collage” di capitoli, paragrafi, ecc., integralmente trascritti, o più esattamente copiati, da pubblicazioni già edite da altri Enti ed Amministrazioni. Nel caso in oggetto gli autori hanno presentato il Piano nella forma di un documento originale, corredato, sì, della consueta sezione di riferimenti bibliografici, ma come se il contenuto fosse il frutto ex novo del proprio personale contributo elaborativo, quando invece si tratta di un mero “assemblaggio”, operato con la tecnica del “copia e incolla”, di porzioni di documenti di varia estrazione e provenienza, alcuni dei quali persino di scarsa attinenza e molti altri anche temporalmente superati.
Gli autori hanno utilizzato come “mirror” il Piano Regionale di Tutela e Risanamento della Regione Veneto, datato anno 2000 e cioè “vecchio” di 7 anni, con ovvie e disastrose conseguenze derivanti principalmente dal divario temporale tra i due documenti, dalle differenti caratteristiche ambientali e dal diverso assetto amministrativo delle due Regioni, nonché dalla non conoscenza, giusto il caso, che il Piano del Veneto era stato già bocciato dalla Comunità Europea (documento prodotto n. 16).

Le parti che si sono evidenziate in giallo risultano testualmente comuni nei due Piani, laddove gli “autori” siciliani si sono limitati alla semplice sostituzione di parole del tipo “Veneto” , “ARPAV” , ecc., con “Sicilia”, “ARPA”, ecc.;
Le parti che si sono evidenziate in rosso, oltre ad essere in comune, segnalano anche macroscopiche incongruenze determinatesi con la trasposizione testuale dal Piano Veneto a quello Siciliano. Per brevità, qui di seguito si citano solo alcune tra le più eclatanti, mentre per le altre si rimanda alla lettura del testo:
a) parecchie Direttive Comunitarie e normative nazionali, all’epoca della redazione del Piano Veneto (anno 2000) riportate in via di emanazione o vigenti, sono riferite come tali pure al 2007, nonostante esse siano state nel frattempo emanate, recepite e persino abrogate da altre successivamente intervenute;
b) documenti (p.e. il bollettino COP, il DOCUP, ecc.) che si riferiscono a strutture, attività ed atti di programmazione della Regione Veneto sono inseriti come se in realtà fossero e facessero parte del contesto siciliano;
c) caratteristiche e condizioni ambientali proprie del Veneto, (p.e. “il bacino aerologico padano”, ”limitazione degli orari di riscaldamento degli impianti termici civili”, “l’intero territorio pianeggiante”, le “comunità montane”, queste ultime, per inciso, abolite in Sicilia da quasi 20 anni, ecc.) figurano nella descrizione di quelle siciliane;
d) tra le misure da adottare per il decongestionamento del traffico urbano da e verso i centri storici è prevista la realizzazione di “percorsi ciclabili protetti…utilizzando gli argini di fiumi e canali” (salvo a creare prima i fiumi ed i canali da immettere nei centri storici dei Comuni siciliani !);
e) l’assetto amministrativo di regione a statuto ordinario del Veneto appare avere sostituito le prerogative dello statuto speciale della Regione Siciliana (p.e. si fa riferimento al Consiglio Regionale al posto dell’Assemblea Regionale, a competenze della Giunta Regionale al posto di quelle dell’Assessore al ramo, ecc.);
Gli “autori” non si sono astenuti neppure dal copiare la “Bibliografia” (presa pressoché per intero dall’Annuario Arpa del 2005) ed il “Glossario”, tanto che in quest’ultimo vengono riportati acronimi e sigle di organismi, strutture e documenti inesistenti in Sicilia (CIS-Comitato di Indirizzo e Sorveglianza, DOCUP- Documento Unico di Programmazione 2000-2006 della Regione Veneto, SFMR-Sistema Ferroviario Metropolitano Regionale, TTZ-Tavoli Tecnici Zonali) e, di contro, non vengono inclusi acronimi e sigle citati nel testo siciliano (TOFP-Tropospheric Ozone Forming Potentials, PGTL-Piano Generale dei Trasporti e della Logistica, ecc.);

Perché dunque meravigliarsi se Ciampolillo parla di “probabili ipotesi truffa” e gridare allo “scandalo”, come fa il ricorrente.
Non ci si meravigli che la verità delle cose venga chiamata per quello che è!
E’, infatti, documentalmente provato (documento prodotto n. 16)che il Piano Regionale di Coordinamento per la Tutela della Qualità dell' Aria della Regione Siciliana è da pag. 9 a pag. 238 frutto di un “collage” di capitoli, paragrafi, ecc., integralmente trascritti, o più esattamente copiati, da pubblicazioni già edite da altri Enti ed Amministrazioni. Nel caso in oggetto gli autori hanno presentato il Piano nella forma di un documento originale, corredato, sì, della consueta sezione di riferimenti bibliografici, ma come se il contenuto fosse il frutto ex novo del proprio personale contributo elaborativo, quando invece si tratta di un mero “assemblaggio”, operato con la tecnica del “copia e incolla”, di porzioni di documenti di varia estrazione e provenienza, alcuni dei quali persino di scarsa attinenza e molti altri anche temporalmente superati.
Gli autori hanno utilizzato come “mirror” il Piano Regionale di Tutela e Risanamento della Regione Veneto, datato anno 2000 e cioè “vecchio” di 7 anni, con ovvie e disastrose conseguenze derivanti principalmente dal divario temporale tra i due documenti, dalle differenti caratteristiche ambientali e dal diverso assetto amministrativo delle due Regioni, nonché dalla non conoscenza, giusto il caso, che il Piano del Veneto era stato già bocciato dalla Comunità Europea (documento prodotto n. 16).
