among Justices over the very existence of the legal concept makes it challenging for states to
determine whether they are crafting Constitutional legislation and difficult for district and appeals
judges to decide cases.
The main criticisms of the dormant Commerce Clause include that the doctrine forces judicial
activism, leads to unpredictable results, and lacks a theoretical basis in the Constitution. Justice
Thomas stated that the doctrine requires the court to function more as legislator than as judges because
of the policy judgements that judges must do when weighing competing interests at stake. Justice
Scalia criticized the doctrine, stating that it has been inherently unpredictable unpredictable not just
because we have applied its standards poorly or inconsistently, but because it requires us and the lower
courts to accommodate, like a legislature, the inevitably shifting variables of a national economy.

Empire predominantly because they weakened the empire and thus made it vulnerable to other
problems such as a poor economic situation and political weaknesses within the empire. Barbarian

the sack of Rome in 410 AD by Alaric and the Visigoths because this was the first time Rome was
defeated in 800 years therefore signalling the beginning of the end of the Western Roman Empire. The

empire and so Alaric decided to besiege Rome until the senate paid him to leave. This resulted in

Visigoths looted places of aristocracy and killed Romans who resisted and women were raped. This
