SUMMARY
Staff seeks Council’s authorization in accepting a Competitive Sealed Proposal submitted for the
2021 Street Maintenance Program (SMP).
BACKGROUND INFORMATION
On May 26, 2021 City Manager Buddy Kuhn authorized Freese and Nichols Inc. to provide
engineering services in the amount of $53,505.00 in securing “Competitive Sealed Proposals” for
the 2021 SMP. Contract cost estimates were $1,000,000.00 which includes a five percent
contingency. This contract cost estimate was based on last year’s low bid quantity for similar
repairs performed.
The City requested proposals thru advertisements in the San Antonio Express-News on August 18th
and August 25th
2021. A pre-proposal submittal meeting was held September 2, 2021.
On September 17, 2021 the City received five (5) proposals:
Austin Bridge and Road in the amount of $884,212.53
Texas Materials Group in the amount of $884,576.30
Clark Construction in the amount of $947,565.41
J&P Paving Co. in the amount of $1,230,065.04
Green Dream International LLC in the amount of $1,245,232.06
This project consists of approximately 51,160 Square Yards of roadway improvements, utilizing
both milling and overlay of existing surfaces, and full-depth pavement repair. Streets identified
for improvements are:
1. Ciruela W. Castano to Corona
2. Westover Encino to Patterson
3. Viesca Argo to Imlay
4. W. Fair Oaks, W. Elmview, W. Edgewood, and W. Oakview between Nacogdoches and
Broadway
5. Harrigan Crt. N. N. Braunfels to Broadway

7. W. Castano, from Ciruela east to the dead end and
8. All of Retama, Halcyon, Torcido, Rockridge, and Penny Lane
POLICY ANALYSIS
“Competitive sealed proposal” allows the City flexibility in selection of a qualified contractor.
Public Works staff and two engineers from Freese and Nichols Inc. evaluated all bids. Staff
coordinated with the City Attorney and City Manager to review proposals. Clark Construction was
selected as the best value for this year’s SMP. Below is the evaluation criteria and scoring results.

FISCAL IMPACT

A RESOLUTION ACCEPTING THE SEALED COMPETITIVE
PROPOSALS AND AWARDING A CONTRACT TO CLARK
CONSTRUCTION FOR THE 2021 STREET MAINTENANCE PROGRAM
AND AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE THE CONTRACT; AND SETTING AN EFFECTIVE DATE.
WHEREAS, the City of Alamo Heights desires to engage a contractor for the 2021 Street
Maintenance Program (“SMP”) which consists of approximately 51,160 Square Yards of roadway
improvements, utilizing both milling and overlay of existing surfaces, and full-depth pavement
repair; and
WHEREAS, the Public Works Department with the assistance of Freese and Nichols
sought and obtained competitive sealed proposals for SMP because this procurement process
allows the City flexibility in selection of a qualified contractor; and
WHEREAS, on September 17, 2021 the City received five (5) proposals and City staff
recommended and City Council has determined that the best competitive sealed proposal was
submitted by Clark Construction for such public works project;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF ALAMO HEIGHTS, TEXAS
SECTION 1. That the sealed proposal of Clark Construction in the amount of $947,565.41
is determined to be the best competitive sealed proposal for the street improvements in the Street
Maintenance Program, and such proposal is hereby accepted.
SECTION 2. The City Manager is authorized to negotiate and execute a contract for such
public works project. The contract may include a 5% contingency amount of $47,378.00 to cover
additional street work, a fee of $53,505 to Freese and Nichols Inc. to provide engineering services
so that the total cost of construction shall not exceed $1,048,448.68 which is currently available
under the Capital Expense for the SMP.
SECTION 3. This Resolution shall take effect upon passage by the City Council.
