engineering services for lower Broadway project.
• Authorized the city manager to try and negotiate a
contract and fees for services
• March 12, 2021, the City Manager, PW Director and
Councilman Jesse met with WGI

• Project timeline likely five years
• Difficult to negotiate into one lump sum
agreement – not equitable for the city
• Decided to negotiate in phases in conjunction
with fiscal budget years
• Some work more equitable for actual hours
worked
4. BACKGROUND
• Other components can be lump sum such as water and sewer
design and structural evaluation of existing underground storm
culverts
• Current proposal (if approved) would run April 12, 2021 –
September 30, 2021
• Allows City Council to budget annual expenses
• Early phases will have higher fees due to workload and
coordination with all funding partners

• Project will be spread out over several years and an SAP item
annually
• Fees will likely be paid out a different amounts dependent on
workload with some years higher and some lower
• First and second year fees likely higher due to extensive design
work and coordination with all other utility engineers and
project engineer of record who will ultimately manage the
project for TxDOT
6. POLICY ANALYSIS
• Consistent with city practices to negotiate fees for
professional services
• Under the Professional Services Act, the selection on
the Engineer must be based on the basis of
demonstrated competence and qualifications
• City Attorney has reviewed and approved the
documents
7. FISCAL IMPACT
• $75,000 earmarked in FY 21 budget for engineering services for this
project
• Phase one is projected to be $85,000 through September 30, 2021
• Council will need to authorize a $10,000 budget amendment in current
year – As a “not to exceed” for phase 1
• Additional work authorizations will be forthcoming for other phases of
the project
8. COUNCIL ACTION
• “I make a motion authorizing the City Manager to execute a
professional services agreement for the Austin Highway/lower
Broadway road improvement project with the engineering firm
of WGI and issue Work Authorization # 1 not to exceed
amount of $85,000 and authorizing a budget amendment of
$10,000 to the current FY 21 budget for work authorization
#1 for engineering services”
