European Court of Justice
Introduction:
We have chosen to write this assignment on the European Court of Justice (ECJ), looking into its role
in the European integration process, and how its rulings and judgments have affected the business
framework. We will also be looking into the effects of its rulings on state sovereignty, and how in
some cases its rulings have limited states power over certain policy areas and handed them to the
European Union. We will start by looking at the radical jurisprudence of the European court of justice,
and what political reactions have arisen to that, and how that has changed/affected the integration
process. To get a better understanding, we will incorporate the use of neo functionalism and rational
choice new ... Show more content on Helpwriting.net ...
The main reason behind the spillover effect is increased effectiveness. Two important spillovers here
are functional and political. This allows institutions to expand their activities to areas not under their
jurisdiction/mandate so they can function more effectively. In cases regarding free trade there is bound
to be an increasing amount of spillover, due to the wide ranging nature of the economic issues,
especially on issues such as trade barriers and tariffs. This has been evident from the verdict in the
case of Cassis de Dijon which we will return to later on. Based on various rulings the ECJ could be
seen as an active promoter of the spillover effect.
In the Maastricht treaty the principle of subsidiarity was incorporated into the treaty, which the British
government pushed for. The reason for this was to limit the transfer of power from the member states
to the EU institutions. The decisions should be taken at the lowest possible level, closest to the citizen.
However, the concept of subsidiarity remains to be defined clearly, and thus holds immense ambiguity.
As a consequence, subsidiarity can be used as an argument both by those who desire greater autonomy
for member states and by those who want the EU to become a federation.
Neofunctionalism argues that actors, whether

Should People Be Allowed To Keep Animals In Captivity
Animals in Captivity
Everyday people go to zoos with intentions of having a good time without realizing they are paying
for animals to be held in captivity for the rest of their lives. In recent discussion, the decision to keep
animals in captivity is a very controversial topic. Many people are towards the decision that
zookeepers should keep the wild animals captive for the entertainment of others, while on the contrary
many are against it. However nobody has done anything to get the animals out. The people who are
against setting them free believe that the animals are living a much better life than they would outside
and that they are better for keeping entertainment for the public but what they do not see is what
happens when the zoo is closed and how they are treated outside of the public s eye, which is what the
people who are against it tend to see. Not only do animals not like being held in captivity but also it

Many animals never see life outside of cages because they are taken in from when they are babies and
kept until they die. With zoos existing for hundreds of years people have never noticed how wrong it
is to keep animals in cages. Animals all over the world are affected because they get taken away and
never know what it is really like to live in the wild. Zoos are not a perfect place to keep animals, more
animals are abused and hurt inside of zoos. One day a wallaby was suppose to be getting taken care of
by its zookeeper but the zookeeper was not paying attention because the wallaby drowned in a bucket
of water. In another case a spider monkey had frost bite but was not treated soon enough so
zookeepers were forced to euthanize the spider monkey (Jouvenal). More accidents take place inside
of zoos than they would if animals were released to the wild. Everyday animals die in captivity due to

Homeschooling And Traditional Classroom Education
Compare and Contrast Homeschooling and Traditional Classroom Education
People can choose to get homeschooling or not in the 1970s, some famous writer started write relative
innovation at the same time ( Homeschooling 101 , 2012). There are now more than two million
children being homeschooled in the U.S., with the percentage rapidly increasing by 7 percent to 15
percent each year, according to the National Home Education Research Institute ( Homeschooling
101, 2012). Maybe we can find that homeschooling is becoming more popular than traditional school,
but the truth is, most children still choose to study in traditional school. We could not ignore that it is
hard and laborious for parents to teach their own child at home, although the child could learn a great
deal under the homeschooling. If they send their child to traditional school, more time could be saved
and the parent could improve themselves and be an example for their child. For instance, participating
in the activities with other kids and learning from them for comparison. Furthermore, attending
traditional school could save a ton of money for kids to use it on other skill learning. Whatever the
parent decides to do either the homeschooling or send their children to the traditional school, there is
no denying that children can learn things. From textbook knowledge, on average, home schoolers
score at or above the national average on standardized measurement. (Distefano,

Pros And Cons Of Repealing Obamacare
A somewhat impertinent question to the GOP: Were you lying the whole time about repealing
Obamacare? History has taught us that sometimes it s inflection points are difficult to discern in the
moment. Often it takes events around these points to provide context. Examining the past is through
the objective lens of hindsight makes it easy to determine these points, but not so for those in the
midst of them. However, one can use past events and the immutable laws of human nature to look
ahead and see if present events meet the standard of an historic turning point. In the case of present
events one can make an educated guess as to the consequences of the two choices before you. At
present the GOP has a choice to make with regard to the fiscal abomination of Obamacare. It can
either chose the path laid out for it by the Socialists on the nation s Left and set a course towards
historic oblivion. Or it can return to it s principled roots of preserving liberty. ... Show more content on

Juvenile Crime And Crime Rates
Juvenile crime is one of the nation s most serious problems. Concerns about it are generally
broadcasted by federal, state, and local government officials and by the public. In years prior, the
burden developed beginning with the dramatic rise in juvenile violence in the eighties reaching an all
time peak in the first part of the nineties. Even though juvenile crime rates seem to have lowered since
the mid nineties, the reduction has not eased the concern. Many states began taking strict statutory
stances toward juveniles in the late seventies and early eighties. This was an era in which juvenile
crime rates were steady or dropping slightly, while federal reformers were commending prevention
and less disciplinary actions. Some of the conflict between the federal program and what was
happening in the states at that time may have been initiated by substantial changes in legal measures
that made juvenile court procedures more similar, however not equal to those in adult (criminal) court.
The reaction to the most recent spike in vicious juvenile crime has been a portrayal of laws that
uphold blurred differences between juvenile courts and adult courts. Some states continued to
strengthen their juvenile crime laws over the years first by making sentencing more severe, two by
increasing allowable transfers to criminal court, or doing away with some of the discretion protections
of juvenile court. Many such changes were enacted after the juvenile violent crime rate had already

Essay about My Personal Praxis Statement
My Personal Praxis Statement
As a college student, I often find myself inundated with work. To make it worse, these assignments
usually are uninteresting and irrelevant. It is in the midst of these tedious exercises that I begin to
wonder whether all of this work is worth it. When this issue creeps into my mind, I think back to my
reasons for choosing to pursue this profession. When I started college, I knew that I could not function
in a typical nine to five job. The banality and predictability of such a career simply did not appeal to
me. So that essentially ruled out any course of study which would lead to such an occupation. I also
knew that I wanted a job that would allow me to make a difference in people s lives. ... Show more

I believe that I can pass along my own wisdom while simultaneously helping them to develop a

interesting and enlightening. What follows is my interpretation of the teaching profession. It details
the methodological and ideological frameworks that I would use to construct a learning experience
that is meaningful for students.
When looking back on high school, I realize that I typically learned more from teachers who made
their classes interesting. By doing so, these educators utilized student interest as method of building a
desire to learn. They camouflaged learning in the colors of discussion, making it seem as though we
simply were carrying on a normal discourse. But each class inevitably resulted in the acquisition of a
better understanding of the subject material. As a student, I found myself wanting to go to these
classes. The teachers who conducted these courses made education seem enjoyable and thus created in
students a desire to engage in further learning. As a future educator, I would like my class to operate in
a similar manner. I want my class to be one that students look forward to attending. Mine will be an
intellectually open classroom environment one in which

Analysis Of The Midsummer Eve
As Cassandra matures, she begins to change or question her worldview. When she begins writing, the
tone is matter of fact. She is writing as events are happening: I write this sitting in the kitchen sink (1).
After meeting the Cottons, her outlook on life changes drastically. Because of this, her writing
changes again to reflect a more hopeful attitude. Her writing methods also change from writing events
as they happened, to reflecting on events and writing them much later. Midsummer Eve is where this
elated mood reaches a climax. After this section, she becomes extremely depressed, changing her
character and writing methods once more. This change in tone throughout the book, especially in the
Midsummer Eve and church sections, signifies Cassandra s coming of age. Midsummer Eve is an
extremely important day to Cassandra When Cassandra opens the section on page 199 she says, Is it
wrong of me to feel so happy? The entire tone sets the scene for a serene, wonderful day full of
delight. The word choice is light and airy: My lovely day began when the sun rose (199). The reader
has no doubt that Cassandra feels at one with herself while reciting these familiar pagan rituals. She
even says the feeling was thrilling (205.) The tone on page 236 is extremely different from this
beautiful, sunny Midsummer Eve. Because Cassandra is distraught, the entire tone of the book
changes. This tone only wavers slightly when Simon comes out of the fog, paralleling him with the

Marriage is not about a piece of paper, a ring, or sexual preference. It has never been about any of
these matters, and should not be considered so. Marriage is the commitment between two people who
love each other unconditionally. According to Psychology Today, marriage is the process by which
two people who love each other make their relationship public, official, and permanent (Psychology
Today, 2002) . Anyone can get married, but it takes dedication and work to make a marriage last and
be successful. This paper will specifically discuss an article written by Jan LaRue, Why Homosexual
Marriage Is Wrong and what ... Show more content on Helpwriting.net ...
In saying this she is being selective to support her argument, and in doing so is being confirmation
biased. Who is to say that homosexuality is more unholy, or wrong, than divorce, adultery, and lying?
Logical Fallacies
The fallacy that was used in this article is false attribution because of the biased attributes in the
argument. For example, saying that marriage has to be limited to only a man and a woman is not
discriminating, yet it clearly is because of the biased feelings of homosexual relationships. Another
type of fallacy that was used is the fallacy of ambiguity; when an abstract belief is treated as if it were
concrete evidence. Religion is not based on scientific concrete evidence, but merely a belief in
something. The Bible has been written and rewritten by man, and has lack of evidence supporting that
there is a God.
Conclusion
Many base their idea of right and wrong on biased conclusions and/or religion. This makes the issue
hard to decipher between who is right and wrong. Biased conclusions do not make the idea correct.
The idea that only a man and a woman can fall in love with each other, and not a man and a man or a
woman and a woman, is based on favoritisms in how someone feels about the issue. Articles, such as
the one above, have the intentions of sharing their beliefs in the hope of others adopting that particular
belief. The question that should be presented is,

Description Of A Database Management System

Final Research Paper to Pass
A database is an organized collection of data. It is the collection of tables, queries, reports, viewings,
and other objects. The data are typically organized to model aspects of reality in a way that supports
processes requiring information, such as modelling the structure of a major business such as Walmart,
and all of its data including things like their inventory, customers, and their employees. A database
management system is a computer software application that interacts with the user, other applications,
and the database itself to capture and analyze data. A general purpose database management system is
designed to allow the definition, creation, querying, update, and administration of databases. The
Database uses terms that are key for anyone to sift through the collection of data that any company or
business collects. terminology consists of keywords that will help users select desired pieces of data.
The primary key is a special relational database table column of a collection of columns appointed to
individually identify all table records. The primary key s main features include: it cannot contain a
unique value for each row of data, and it cannot contain null values. The primary key is either an
existing table column or a column that is explicitly initiated by the database according to a defined
sequence. The foreign key is a column or group of columns in a relational database table that

Precambrian Era Essay
The Precambrian is the name given for the first super eon of Earth s history (Mary Bagley, Accessed:
20th Aug 2016). This era itself has been recorded to be about seven eighths of the entire earth s
history. This era stretches across from 4 Billion years ago up until only 543 Million years ago (Mya)
which shows how large and substantial this era was.
Precambrian itself refers to the time before the Cambrian period. It also refers to the entire period of
time before the formation of the oldest rocks with recognisable fossils. Lately, however, it has been
seen that some hard to distinguish fossils from in the Precambrian times have been found. The
Precambrian Era can be split into three eras: The Hadean, the Archean and also the Proterozoic. ...

Life on earth began in the early Archean and fossilized organisms became far more abundant through
the entirety of the Precambrian time.
Three billion years ago there was no traces of oxygen in the atmosphere, this caused no life to be able
to live on earth. At around 2.4 billion years, oxygen was beginning to be released in the oceans as
photosynthesis began in cyanobacteria. This process caused the gas levels to slowly grow and
eventually made up 1% of the earth s atmosphere at around 2 Bya. By 800 Mya, oxygen levels
reached around 20% which let organisms to slowly breathe to life. This spike in oxygen also caused
the earth s surface to be shielded from solar radiation. This was the start of the first unicellular
organisms.
The first multicelled animals started appearing in the records of fossils around 600 million years ago.
Fossils found at this time were known as Ediacarans and showed a very important time of evolution
for earth. Ediacara fauna was specifically named after the Ediacara hills in South Australia in which
they were discovered in the early 1900 s. These organisms even predate the explosion of life forms at

Analysis Of Still Alice And The Notebook
Socioeconomic status is a defining factor in nearly every society around the world. Therefore, it is
unsurprising that the issues of class and stratification are manifest in many types of media, including
films. Like many nations, the United States operates under the class system. The sociologist Dalton
Conley defined the class system as, an economically based hierarchical system characterized by
cohesive, oppositional groups and somewhat loose social mobility (Conley 249). Still Alice and The
Notebook depict social stratification and the struggles between different socioeconomic classes. Still
Alice follows the life of Alice Howland, a linguistics professor at Columbia University, as she is
diagnosed with early onset Alzheimer s and fights to retain her memories and relationships. The film
is set in modern day America, in which there is a stigma associated with dementia, there is a large
degree of gender inequality, and some careers are viewed as prestigious (e.g. doctors and lawyers)
while others are condemned by society (e.g. starving artists). The Notebook shares the story of Noah
Calhoun as he tries to revive the memories of his wife Allie, who suffers from dementia, by reading
her the story of their undying love. While Noah reads to Allie, the movie displays their life in the
1940s. During this time, America was facing World War II, segregation, and a highly stratified society
(U.S. Timeline, 1940 1949). When the movie shows elderly Noah and Allie, it takes place in

economy is slow, the rest of the world usually follows. At the start of the 2016 year, China s stock

Unpaved Roads In Ancient Rome
The importance of the paved and unpaved roads leading out of the heart of Rome was crucial to the
spread, advancement, and growth of the Empire from where the roads came from (Beers, World
history: patterns of civilization, 1993, pp.115). These roads were built from about 300 BC through the
expansion and consolidation of the Roman Republic and the Roman Empire (Forbes, Robert J. Studies
in Ancient Technology. Leiden: Brill, 1993. Print). Roman roads were a part of the development of the
Roman state. Roads were also a visible indicator of the might of Rome, and they helped unify what
was a vast melting pot of cultures, races, and institutions. The Roman road system spanned more than
400,000 km of roads, including over 80,500 km of paved roads. When Rome reached the height of its
power, no fewer than 29 great military highways radiated from the city. ( Roads in Ancient Rome

A Comparison Of John F. Kennedy And Donald Trump
I m going to make America great again. This is the plan that President Trump had come up with to get
him elected, and could possibly help America big time. Ask not what your country can do for you ask

Introduction
Negotiating is something that has been around since the beginning of mankind. We all start off
negotiating as little kids, even for little things such as candy and toys. When we grow up, negotiating
becomes sort of the norm. We negotiate consciously and subconsciously every single day. When you
think about it, negotiation takes up most of our lives. We are always trying to see what we can get as a
benefit without giving up much. It always comes down to the pie, how big is the pie and who can get
the biggest slice. As we become adults with careers, there are ever some that become flat our
Negotiators . This means that all they do for a living is negotiate. They are master negotiators and are
praised for being so. When it comes to negotiation, persuasion is also within that talent. You have to
be able to get what you want from people without them feeling like they are being taken advantage of
and that they are also getting just as big a piece of the pie as you are getting, although in reality they
are not. Negotiation Negotiation is all about a strategy. The end result is usually to end a problem that
someone is having, whether it is personally or

The Prime Of Miss Jean Brodie Summary
In The Prime of Miss Jean Brodie narration is a key element in the appeal of the story. The book starts
off in medias res and continues to make use of both analepses and prolepses. Many believe that an
omniscient narrator, in part because of the anachrony, recounts the book but in this essay I will argue
that the book has an unreliable narrator through examination of the narration of character of Mary. On
many occasions Muriel Spark uses narration to endorse the treatment of Mary by the other characters,
meaning that the story s narration contains the opinions of the narrator. If the narrator is unreliable in
the account of Mary, then that brings into question the entire narrative discourse since the reader no
longer has a way of distinguishing ... Show more content on Helpwriting.net ...
By doing all this she makes the narrator unreliable. She consciously or unconsciously endorses the
treatment of Mary by Miss Brody and her set. This endorsement of the treatment of Mary result in a
narration with biased details which brings into question the entire narrative discourse because if she is
unreliable toward Mary, then we can presume that she might be unreliable towards other characters or
events as

The Ambivalent Nature Of The Uncanny
The notion of the uncanny is the key term for psychoanalysis and the psychoanalytical approach for
interpretation of the art. The uncanny effect is ingrained not by something unfamiliar or something
frightening but because it conveys something that has been lived through and exuded to the sphere of
an unconscious. Freud s 1919 essay of the same name The Uncanny has been written for literary,
psychoanalytic, critical, however not art purpose at all. It has erupted into aesthetics discourse (Walsh
21). The notion of the uncanny constitutes an inevitable part of Freudian theory of repression. This
notion exemplifies eruption of the retrospect events in the actual time, whereas mnemonic
representation has been perplexed by fragments. Thus, ... Show more content on Helpwriting.net ...
An important insight is the understanding of the background, of the era at the beginning of the 20th
century. Freud s thought evolves on a specific background around it, during the process of
industrialization, development of the technologies from photo cinematic inventions to the mechanisms
applied in war. Visual arts such as painting, motion pictures, photography were aimed at mirroring an
uncovered epoch and life in it, together with the military conflict and further militarization which
aligned a human being to a machine, an automaton (Freud 227), as a result these aspects threaten an
ordinary, habitual way of life and trigger the inceptives of the uncanny sensations. Regardless the
above mentioned foray of cutting edge machinery, Freud, nevertheless, derives the instances of sensus
numinis from literary studies, namely Romantic and Gothic literature. These are the instances such as
the opposition between being animate or inanimate which evokes intellectual uncertainty (Freud 221)
whether the events or the objects that are presented to the intended reader by the writer are legitimate
or fictitious, in other words, whether the situation is real or imaginary . A further source of the
uncanny feeling that is delivered by Freud from psychoanalytical experience is anchored to the fear of
castration (Freud 231). Freud refers this example to the

Food Culture With High Fructose Corn Syrup Essay
Damaging the Food Culture with High Fructose Corn Syrup
The food culture that we have are practices, beliefs, and ways we use to make food and consume it.
Furthermore it is how we understand it as a whole and how it can shape us. Certain foods all around us
can change people individually or as a group, the ability to express ourselves with food is
endless. Some people may love the food for flavor , some may love to take pictures of the food and
some people may just eat it because of their religion. People in the food culture can express whatever
they want with food in many other ways, for example financial status, power, creativity, etc. It is
amazing what people can do when it come to this, but what people do not know are its dangers.
Sometimes people only see the good part behind the food and are oblivious to what it really is. The
audience can maybe overlook how the food was made and in many ways overlook what is good for
them and what is not. Many of the foods nowadays are made in labs and in so many different ways we
can not think of. A certified dietitian named Katherine Zeratsky says High fructose corn syrup can
contribute unwanted calories that are linked to health problems, such as weight gain, type 2 diabetes,
etc . All of these health problems dealing with the chemical high fructose corn syrup (HFCS). This
product is in sodas, Fruit drinks, Syrups, and even more. We consume this everyday and it is cheaper
to make it that real sugar and it apparently taste better.

only sophomore at the rush events. He and I talked about how great our freshman year was and how
much we hated a certain person.
In our main conversation, we discussed about how he wanted to be a part of a bigger idea and

Analysis Of The Movie Valkyrie
Valkyrie is a detailed motion picture depicting one of the many attempts by Nazi soldiers to
assassinate Adolf Hitler. The movie stars Cruise as Claus von Stauffenberg, he is the leader of the
most important resistance groups in Nazi Germany. In the film we see Stauffenberg s rise from a
colonel in the German army in Africa, we also notice his upward hatred for the Nazi regime, the film
also provides a report of the weeks leading up to the assassination attempt that took place on 20 July
1944. This movie shows us the planning stages of the attack, we also see the attack itself and later we
see the aftermath. The events portrayed in the film are an extremely accurate detailing of the events of
the assassination attempt. Director Bryan Singer has done an admirable job in providing a precise and
accurate historical description of the events of the July 20. A man named Henning von Tresckow

Forecasting Model Of Forecasting Models
Forecasting is often defined as the estimation of the value of a variable (or set of variables) at some
future point in time (Goodier, 2010). It can be applied to a number of different situations when there is
uncertainty about the future and the data collected can aid in decisions that need to be made
(Armstrong, 2001). In relation to healthcare, forecasting models have been used to aid their sector s
departments to plan staff rota schedules, ensuring that a sufficient amount of senior staff are available
at any given time throughout the day, week, month and year. As explained previously, a fundamental
factor that causes overcrowding is a limited supply of resources to treat patients, leading to a longer
time spent in an Emergency ... Show more content on Helpwriting.net ...
These models can be characterised as consisting of a time trend, a seasonal factor, a cyclical element
and an error term (Kennedy, 2008.) Unlike casual or economic forecasting, where it is assumed there
is a historical relationship between a dependent and an independent variable will be consistent in the
future, time series models assume the historical components of the model will repeat itself. Research
has been undertaken to develop a generalised forecasting model that uses a method that can accurately
predict future the attendees and resources needed at Emergency Departments.
1.3.3 Long Range Forecasting for Future Attendees An early attempt to predict attendees was
conducted by Milner (1988) who s study on a single Emergency Department within the UK attempted
support to healthcare planning by forecasting annual first, return and total attendances at EDs for Trent
districts and the whole of the Trent region. The data of annual first, return and total attendances were
collected over a training period of 10 years and evaluated over a period of 1 year using an
Autoregressive Integrated Moving Average (ARIMA) method for modelling which falls into time
series model category. This method for forecasting this type of data has been supported by other
researchers, who state that ARIMA forecasting techniques should be considered for a time series that s
contains a trend or seasonal or non stationary data. The results

The lower house voted people in the upper house to represent them. The number of representatives in
both houses would be proportional, or corresponding in size, to the population of each state.
William Paterson of New Jersey presented a different plan. The New Jersey Plan was designed to
revise the Articles of Confederation rather than form a new government. It kept the Confederation s
one house legislature with one vote per state. This would preserve equality between large and small
states. The plan, however, gave Congress the power to tax and regulate trade. Congress would elect a
weak executive branch.
A compromise is an agreement between two or more sides in which each side gives up some of what it
wants. Roger Sherman proposed a plan known as the Great Compromise. According to Sherman s
plan, the legislature would have two houses. Representation in the House of Representatives would be
based on state population. In the Senate, each state would have two members.
Some states wanted to count slaves in the population. This would give them more representatives.
Northern states objected because enslaved people were legally considered

Summary Of Orientalism And The Clash Of Civilization
The way in which Said and Huntington define culture within their texts Orientalism and The Clash of
Civilisation, divulges each author s position within and perception of both the Arab and Western
Worlds. The difference in each author s ideology and contexts Said (a professor in comparative lit with
a Palestinian background, writing in 1978, a time of conflict and devastation in the middle east) and
Huntington, (an American political scientist writing at a time in which his country is at a height of its
power), causes what is described by Said as The clash of definitions (SD). Said views culture as a
culmination and product of ideologies, morals and beliefs propagated by members of society.
Huntington views culture as more definite, established and finite. Said defines a specific culture in
relation to others whist Huntington believes each culture is its own separate entity. Through the
exploration of these contrasting views it can be interpreted that a key difference between each
definition is that Said defines culture as more broad and capable of being influenced whilst
Huntington views it only as a powerful influencer. This may also reflect their positions as either from
the West or the Orient.
Whilst Huntington defines culture as basic and less mutable , Said acknowledges culture as a complex
matter . He defines culture as a product of society and its values and refers to Gramsci s theories of
consent and cultural hegemony to support this definition. Gramsci s

The Social Institution Of Education
Education is perceived by society as a means to achieve high levels of success in all aspects of life.
Although steps have been taken to afford individuals the opportunity to obtain an education, there still
lies an inequality and therefore, a social problem is created. Using the sociological perspectives of
functionalist, conflict, feminist, and interactionist, we can see how each perspective views how this
inequality becomes prevalent and how social, as well as economic inequalities of society are inherited
through education. Functionalist define a social problem by looking for the functions and dysfunctions
of a given topic. The main function of the social institution of education is to educate. Functionalists
argue that education struggles to complete it s intended task of education the youth due to the
additional tasks that the institution has been assigned. The educational system has taken on roles that
normally would be the functions of other social institutions. The education system provides services to
students and parents for various problems that they may have. It provides services for students who
my have emotional needs, physical challenges, as well as provide classes for parents.
Conflict theorists view education as a divider, rather than an equalizer. Conflict theorists focus on
social and economic inequalities inherent in our educational system. They also focus on how the
system perpetuates these inequalities. Depending on their social backgrounds,

Rational Choice Theory Vs Social Learning Theory
Rational Choice Theory vs. Social Learning Theory
The study of crime and punishment are the essential components of criminology. This is why it is
important to learn and understand why people commit crime. Over the years, many theories have
emerged and are continuously being examined individually and in combination, in order to help find
solutions to lower all types and levels of crime. While there are various compelling and convincing
theories, the aim of this paper is to compare and contrast two different theories that argue why people
commit crime, discuss the merits and plausibility of the theories, and discuss why one theory is more
plausible than the other. The theories to be discussed are rational choice theory and social learning
theory. ... Show more content on Helpwriting.net ...
Differential reinforcement of crime is when a person teaches another to engage in crime through
reinforcement and punishment. For example, imagine you are at a grocery store with your 5 year old
and your child begins to scream and cry. Because you feel embarrassed by your child s behavior, you
then decide to give the child a candy so that they stop screaming and crying. Here, without intending
to do so, you have now reinforced the child s aggressive behavior.
While others may reinforce another s aggressive behavior, others teach us beliefs favorable to crime.
Most of us are taught that crime is wrong and bad. This in turn, internalizes that a person should not
engage in crime; however, other persons learn beliefs that are more favorable to crime which results in
the engagement of crime.
The last mechanism explains that although behavior is a function in beliefs and reinforcements and
punishments, it is also based on those individuals around a person. For example, a person may imitate
another person s behavior when they visualize a person being reinforced for a particular

1960 s. Calogero has two strong influences in his life. They are his father Lorenzo a proud middle

It does not tell some story about how the bus driver and the mobster have to shoot each other or how
Calogero is a hostage in a tug of war. It is about two men from the same neighborhood but different

loves Sonny like a father but struggles with the advice given to him by both throughout the film.
Almost like an angel on one shoulder and a devil on the other. A Bronx Tale is a very funny movie at
times and very touching at others. It is filled with life, colorful characters and great lines of dialogue.
Robert Di Nero in his debut as a director, finds the right notes as he moves from laughter to anger to

Mental Illness In Godwin s A Sorrowful Woman
In Godwin s story A Sorrowful Woman , the mother has a series of very complex feelings and
emotions. From the story, it can be inferred that this is a woman with a sudden onset of mental illness,
a woman who has lost her identity and sense of belonging; and a woman who is consciously aware of
all this, knowing she is a burden to her loved ones.
This mother shows signs of her mental illness almost right off the bat, when, after looking at her son,
she began yelping without tears, retching in between (39). The onset of this illness appears to be very
sudden. The story begins with One winter evening she looked at them....the sight of them made her so
sad and sick she did not want to see them ever again (39). It seems as if just one evening she suddenly
begins to feel this way. When the son says, It s alright Mommy (39), causing the father to respond
Mommy is sick (39), shows that the father did not have time to explain this to the son any time before.
There is no evidence given in the story as to what caused her mental illness, though we can infer that
the onset was quite sudden. Throughout the story, the woman is never identified, only being referred
to as the woman (40). So we never have a sense of her identity outside of the fact that she is a wife
and a mother with a mental illness. She also tries to find herself and her identity. She was a young
queen, a virgin in a tower, she was the previous inhabitant, the girl with all the energies. She tried

Soil Gives Nutrition to Earth s Plants
Soil is the loose material on the Earth s surface that is made up of organic and mineral matter where
plants grow. Soil is the major source of nutrients needed for plants for growth. The three main
nutrients are nitrogen (N), phosphorus (P) and potassium (K). (NSW Government, 2004) Soil contains
nutrients and water needed for the plant, and also contains living organisms which helps to decompose
organic matter and help with producing nutrients for the plant to intake. Nitrogen is the most abundant
element found in our atmosphere and it is also the most important for a plant s growth and one of the
elements that a plant intakes in large amounts. It is one of the basic components of chlorophyll, the
compound by which plants use sunlight energy to produce sugars during the process of
photosynthesis. (House Garden, n.d.) Nitrogen can enter the soil in many ways such as rainfall, which
may deposit some atmosphere nitrogen into the soil or some organisms such as, bacteria,
actinomycetes and cyanobacteria are known to convert atmospheric nitrogen into ammonium so that
plants can absorb easily. High rates of photosynthesis will occur when a plant receives sufficient
amounts of nitrogen (N). (CTAHR, n.d)
Phosphorus is also an important element for plants, which can be found in the soil. Phosphorus plays
an important role in energy transfer, photosynthesis, and transfer of genetic material, transformation of
sugars and starches and nutrient movement within a plant.

The main reason behind the spillover effect is increased effectiveness. Two important spillovers here are functional and political. This allows institutions to expand their activities to areas not under their jurisdiction/mandate so they can function more effectively. In cases regarding free trade there is bound to be an increasing amount of spillover, due to the wide ranging nature of the economic issues, especially on issues such as trade barriers and tariffs. This has been evident from the verdict in the case of Cassis de Dijon which we will return to later on. Based on various rulings the ECJ could be seen as an active promoter of the spillover effect. In the Maastricht treaty the principle of subsidiarity was incorporated into the treaty, which the British government pushed for. The reason for this was to limit the transfer of power from the member states to the EU institutions. The decisions should be taken at the lowest possible level, closest to the citizen. However, the concept of subsidiarity remains to be defined clearly, and thus holds immense ambiguity. As a consequence, subsidiarity can be used as an argument both by those who desire greater autonomy for member states and by those who want the EU to become a federation. Should People Be Allowed To Keep Animals In Captivity Animals in Captivity Everyday people go to zoos with intentions of having a good time without realizing they are paying for animals to be held in captivity for the rest of their lives. In recent discussion, the decision to keep animals in captivity is a very controversial topic. Many people are towards the decision that zookeepers should keep the wild animals captive for the entertainment of others, while on the contrary many are against it. However nobody has done anything to get the animals out. There are now more than two million children being homeschooled in the U.S., with the percentage rapidly increasing by 7 percent to 15 percent each year, according to the National Home Education Research Institute ( Homeschooling 101, 2012). Maybe we can find that homeschooling is becoming more popular than traditional school, but the truth is, most children still choose to study in traditional school. We could not ignore that it is hard and laborious for parents to teach their own child at home, although the child could learn a great deal under the homeschooling. If they send their child to traditional school, more time could be saved and the parent could improve themselves and be an example for their child. For instance, participating in the activities with other kids and learning from them for comparison. Furthermore, attending traditional school could save a ton of money for kids to use it on other skill learning. Whatever the parent decides to do either the homeschooling or send their children to the traditional school, there is no denying that children can learn things. History has taught us that sometimes it s inflection points are difficult to discern in the moment. Often it takes events around these points to provide context. Examining the past is through the objective lens of hindsight makes it easy to determine these points, but not so for those in the midst of them. However, one can use past events and the immutable laws of human nature to look ahead and see if present events meet the standard of an historic turning point. In the case of present events one can make an educated guess as to the consequences of the two choices before you. • 9. Juvenile Crime And Crime Rates Juvenile crime is one of the nation s most serious problems. Concerns about it are generally broadcasted by federal, state, and local government officials and by the public. In years prior, the burden developed beginning with the dramatic rise in juvenile violence in the eighties reaching an all time peak in the first part of the nineties. Even though juvenile crime rates seem to have lowered since the mid nineties, the reduction has not eased the concern. Many states began taking strict statutory stances toward juveniles in the late seventies and early eighties. This was an era in which juvenile crime rates were steady or dropping slightly, while federal reformers were commending prevention and less disciplinary actions. Some of the conflict between the federal program and what was happening in the states at that time may have been initiated by substantial changes in legal measures that made juvenile court procedures more similar, however not equal to those in adult (criminal) court. The reaction to the most recent spike in vicious juvenile crime has been a portrayal of laws that uphold blurred differences between juvenile courts and adult courts. Some states continued to strengthen their juvenile crime laws over the years first by making sentencing more severe, two by increasing allowable transfers to criminal court, or doing away with some of the discretion protections of juvenile court. • 11. Analysis Of The Midsummer Eve As Cassandra matures, she begins to change or question her worldview. When she begins writing, the tone is matter of fact. She is writing as events are happening: I write this sitting in the kitchen sink (1). After meeting the Cottons, her outlook on life changes drastically. Because of this, her writing changes again to reflect a more hopeful attitude. Her writing methods also change from writing events as they happened, to reflecting on events and writing them much later. Midsummer Eve is where this elated mood reaches a climax. After this section, she becomes extremely depressed, changing her character and writing methods once more. This change in tone throughout the book, especially in the Midsummer Eve and church sections, signifies Cassandra s coming of age. Midsummer Eve is an extremely important day to Cassandra When Cassandra opens the section on page 199 she says, Is it wrong of me to feel so happy? The entire tone sets the scene for a serene, wonderful day full of delight. The word choice is light and airy: My lovely day began when the sun rose (199). The reader has no doubt that Cassandra feels at one with herself while reciting these familiar pagan rituals. She even says the feeling was thrilling (205.) Slack BCOM/275 February 17, 2014 Rod Klein Article Rebuttal Marriage is not about a piece of paper, a ring, or sexual preference. It has never been about any of these matters, and should not be considered so. Marriage is the commitment between two people who love each other unconditionally. According to Psychology Today, marriage is the process by which two people who love each other make their relationship public, official, and permanent (Psychology Today, 2002) . In saying this she is being selective to support her argument, and in doing so is being confirmation biased. Who is to say that homosexuality is more unholy, or wrong, than divorce, adultery, and lying? Logical Fallacies The fallacy that was used in this article is false attribution because of the biased attributes in the argument. For example, saying that marriage has to be limited to only a man and a woman is not discriminating, yet it clearly is because of the biased feelings of homosexual relationships. Another type of fallacy that was used is the fallacy of ambiguity; when an abstract belief is treated as if it were concrete evidence. Religion is not based on scientific concrete evidence, but merely a belief in something. The Bible has been written and rewritten by man, and has lack of evidence supporting that there is a God. Conclusion Many base their idea of right and wrong on biased conclusions and/or religion. This makes the issue hard to decipher between who is right and wrong. Biased conclusions do not make the idea correct. The idea that only a man and a woman can fall in love with each other, and not a man and a man or a woman and a woman, is based on favoritisms in how someone feels about the issue. Articles, such as the one above, have the intentions of sharing their beliefs in the hope of others adopting that particular belief. The question that should be presented is, ... Therefore, it is unsurprising that the issues of class and stratification are manifest in many types of media, including films. Like many nations, the United States operates under the class system. The sociologist Dalton Conley defined the class system as, an economically based hierarchical system characterized by cohesive, oppositional groups and somewhat loose social mobility (Conley 249). Still Alice and The Notebook depict social stratification and the struggles between different socioeconomic classes. Still Alice follows the life of Alice Howland, a linguistics professor at Columbia University, as she is diagnosed with early onset Alzheimer s and fights to retain her memories and relationships. The film is set in modern day America, in which there is a stigma associated with dementia, there is a large degree of gender inequality, and some careers are viewed as prestigious (e.g. doctors and lawyers) while others are condemned by society (e.g. starving artists). The Notebook shares the story of Noah Calhoun as he tries to revive the memories of his wife Allie, who suffers from dementia, by reading her the story of their undying love. While Noah reads to Allie, the movie displays their life in the 1940s. During this time, America was facing World War II, segregation, and a highly stratified society (U.S. Timeline, 1940 1949). Freud s 1919 essay of the same name The Uncanny has been written for literary, psychoanalytic, critical, however not art purpose at all. It has erupted into aesthetics discourse (Walsh 21). It can be applied to a number of different situations when there is uncertainty about the future and the data collected can aid in decisions that need to be made (Armstrong, 2001). In relation to healthcare, forecasting models have been used to aid their sector s departments to plan staff rota schedules, ensuring that a sufficient amount of senior staff are available at any given time throughout the day, week, month and year. Unlike casual or economic forecasting, where it is assumed there is a historical relationship between a dependent and an independent variable will be consistent in the future, time series models assume the historical components of the model will repeat itself. Research has been undertaken to develop a generalised forecasting model that uses a method that can accurately predict future the attendees and resources needed at Emergency Departments. 1.3.3 Long Range Forecasting for Future Attendees An early attempt to predict attendees was conducted by Milner (1988) who s study on a single Emergency Department within the UK attempted support to healthcare planning by forecasting annual first, return and total attendances at EDs for Trent districts and the whole of the Trent region. The data of annual first, return and total attendances were collected over a training period of 10 years and evaluated over a period of 1 year using an Autoregressive Integrated Moving Average (ARIMA) method for modelling which falls into time series model category. This method for forecasting this type of data has been supported by other researchers, who state that ARIMA forecasting techniques should be considered for a time series that s contains a trend or seasonal or non stationary data. The number of representatives in both houses would be proportional, or corresponding in size, to the population of each state. William Paterson of New Jersey presented a different plan. The New Jersey Plan was designed to revise the Articles of Confederation rather than form a new government. It kept the Confederation s one house legislature with one vote per state. This would preserve equality between large and small states. The plan, however, gave Congress the power to tax and regulate trade. Congress would elect a weak executive branch. A compromise is an agreement between two or more sides in which each side gives up some of what it wants. Roger Sherman proposed a plan known as the Great Compromise. • 31. Summary Of Orientalism And The Clash Of Civilization The way in which Said and Huntington define culture within their texts Orientalism and The Clash of Civilisation, divulges each author s position within and perception of both the Arab and Western Worlds. The difference in each author s ideology and contexts Said (a professor in comparative lit with a Palestinian background, writing in 1978, a time of conflict and devastation in the middle east) and Huntington, (an American political scientist writing at a time in which his country is at a height of its power), causes what is described by Said as The clash of definitions (SD). Said views culture as a culmination and product of ideologies, morals and beliefs propagated by members of society. Huntington views culture as more definite, established and finite. Said defines a specific culture in relation to others whist Huntington believes each culture is its own separate entity. Through the exploration of these contrasting views it can be interpreted that a key difference between each definition is that Said defines culture as more broad and capable of being influenced whilst Huntington views it only as a powerful influencer. This may also reflect their positions as either from the West or the Orient. Whilst Huntington defines culture as basic and less mutable , Said acknowledges culture as a complex matter . He defines culture as a product of society and its values and refers to Gramsci s theories of consent and cultural hegemony to support this definition. Gramsci s ... Get more on HelpWriting.net ...

This is why it is important to learn and understand why people commit crime. Over the years, many theories have emerged and are continuously being examined individually and in combination, in order to help find solutions to lower all types and levels of crime. While there are various compelling and convincing theories, the aim of this paper is to compare and contrast two different theories that argue why people commit crime, discuss the merits and plausibility of the theories, and discuss why one theory is more plausible than the other. The theories to be discussed are rational choice theory and social learning theory. ... Show more content on Helpwriting.net ... Differential reinforcement of crime is when a person teaches another to engage in crime through reinforcement and punishment. For example, imagine you are at a grocery store with your 5 year old and your child begins to scream and cry. Because you feel embarrassed by your child s behavior, you then decide to give the child a candy so that they stop screaming and crying. Here, without intending to do so, you have now reinforced the child s aggressive behavior. While others may reinforce another s aggressive behavior, others teach us beliefs favorable to crime. Most of us are taught that crime is wrong and bad. This in turn, internalizes that a person should not engage in crime; however, other persons learn beliefs that are more favorable to crime which results in the engagement of crime. The last mechanism explains that although behavior is a function in beliefs and reinforcements and punishments, it is also based on those individuals around a person. For example, a person may imitate another person s behavior when they visualize a person being reinforced for a particular ... Get more on HelpWriting.net ...

  • 39. Mental Illness In Godwin s A Sorrowful Woman In Godwin s story A Sorrowful Woman , the mother has a series of very complex feelings and emotions. From the story, it can be inferred that this is a woman with a sudden onset of mental illness, a woman who has lost her identity and sense of belonging; and a woman who is consciously aware of all this, knowing she is a burden to her loved ones. This mother shows signs of her mental illness almost right off the bat, when, after looking at her son, she began yelping without tears, retching in between (39). The onset of this illness appears to be very sudden. The story begins with One winter evening she looked at them....the sight of them made her so sad and sick she did not want to see them ever again (39). It seems as if just one evening she suddenly begins to feel this way. When the son says, It s alright Mommy (39), causing the father to respond Mommy is sick (39), shows that the father did not have time to explain this to the son any time before. There is no evidence given in the story as to what caused her mental illness, though we can infer that the onset was quite sudden. Throughout the story, the woman is never identified, only being referred to as the woman (40). So we never have a sense of her identity outside of the fact that she is a wife and a mother with a mental illness. She also tries to find herself and her identity. She was a young queen, a virgin in a tower, she was the previous inhabitant, the girl with all the energies. She tried these ... Get more on HelpWriting.net ...

  • 41. Soil Gives Nutrition to Earth s Plants Soil is the loose material on the Earth s surface that is made up of organic and mineral matter where plants grow. Soil is the major source of nutrients needed for plants for growth. The three main nutrients are nitrogen (N), phosphorus (P) and potassium (K). (NSW Government, 2004) Soil contains nutrients and water needed for the plant, and also contains living organisms which helps to decompose organic matter and help with producing nutrients for the plant to intake. Nitrogen is the most abundant element found in our atmosphere and it is also the most important for a plant s growth and one of the elements that a plant intakes in large amounts. It is one of the basic components of chlorophyll, the compound by which plants use sunlight energy to produce sugars during the process of photosynthesis. (House Garden, n.d.) Nitrogen can enter the soil in many ways such as rainfall, which may deposit some atmosphere nitrogen into the soil or some organisms such as, bacteria, actinomycetes and cyanobacteria are known to convert atmospheric nitrogen into ammonium so that plants can absorb easily. High rates of photosynthesis will occur when a plant receives sufficient amounts of nitrogen (N). (CTAHR, n.d) Phosphorus is also an important element for plants, which can be found in the soil. Phosphorus plays an important role in energy transfer, photosynthesis, and transfer of genetic material, transformation of sugars and starches and nutrient movement within a plant. ...
