 Intelectutal property is a property that arises
from the human intellect .
 It is a product of human creation.
 Intellectual property comprises 2 distinct
form-
a) literary & artistic works
b) Industrial property
 They are books,paintings,musical composition,
plays,movies, & artistic works etc.
 They are protected by COPYRIGHT
 Industrial property describes physical matter that
is the product of an idea or concept for
commercial purposes.
 They are protected-
-by patented objects
-by trademarks
-by industrial designs
-by trade secrets
-by layout designs
-by geographical indication
WIPO was established by the WIPO
Convention in 1967 .
It is a specialized agency of the united
nation .
Function is to promote the protection of
IP throughout the world .
Headquarter – Geneva , Switzerland
 Developing a new drug and successfully bringing it to market
is a risky, lengthy and expensive venture.
 It costs around US $750 million and takes 12-15 years to
bring a new molecule from the laboratory bench to patients.
 On average, out of every 5000-10,000 compounds that a
pharmaceutical company tests, only one will be approved
after clinical trials have been conducted.
 This force the pharmaceutical companies to protect their
patents around the globe until they expire ..
The term “Intellectual Property" denotes the
specific legal rights –
1. Copyrights (e.g. book)
2. Patents (e.g. new drug)
3. Trademark (e.g. symbol)
4. Trade Secrets
(e.g new method)
 Term original in the copyright law means that
the work originated with the author .
 There is no requirement for novelty or
uniqueness as there is in patent law .
 Copyright law protects the expression of an
idea . Not the idea itself .
 A patent is a right
to gives the patent
holder to prevent
others from
practicing the
invention without a
license from the
inventor for a
certain period of
time (typically 20
years from the
filing date of a
patent application).

ten year old boy had
invented a game of
six-player circular
chess .
And got a game
design patented in his
name .
 A trademark is a distinctive sign which is used to
distinguish the products or services of different
businesses.
An industrial design right protects the form of
appearance, style or design of an industrial object
(e.g. spare parts, furniture, or textiles).
a) TM – use application filed for product .
b) SN – use application filed for services .
c) R -- Registered trademark .
 A trade secret ("confidential information") is
secret, non-public information concerning
the commercial practices or proprietary
knowledge of a business, public disclosure of
which may sometimes be illegal.
 Patents, trademarks, and designs rights are
sometimes collectively known as industrial
property, as they are typically created and
used for industrial or commercial purposes.
 There is a well-established statutory,
administrative and judicial framework to
safeguard intellectual property rights in
India, whether they relate to patents,
trademarks, copyright or industrial designs
etc.
 Well-known international trademarks have
been protected in India even when they were
not registered in India.
 The Indian Trademarks Law has been
extended through court decisions to service
marks in addition to trade marks for goods.
 Create yourself ,rather than using others
creation.
 No comparison that are likely to cause
confusion.
Technological advancement make the job
of the creator easy

COPY-ER easy .
