INDUSTRIAL DESIGNS

Def; An industrial design is that aspect of a useful article which is ornamental or
aesthetic. It may consist of 3-dimensional features such as shape or surface of the
article, or 2-dimentional features such as patterns, lines or color.
Industrial designs are applied to a wide variety of products of industry or
handicraft; from watches, jewellery, fashion and other luxury items, to industrial
and medical implements; from house ware, furniture and electrical appliances to
vehicle and architectural structures; from practical goods and textile designs to
leisure items, such as toys and pet accessories.
Eg:- Shapes or forms of chairs, telephones, cars, computers, TV, watches, camera
etc,.
Protection:
 In most countries an industrial design must be registered in order to be protected
under industrial design law.
 As a general rule, in order to be registered, the design must be new or original.
Now what constitutes novelty or originality may differ from country to country
and indeed the registration process itself varies from country to country.
 An industrial design must be capable of being reproduced by means of industrial
application.
 In principle, the industrial design must be published either before, at the time of,
or in a stated period after, registration.
 It is possible to protect industrial designs under copyright law or the law against
unfair competition.
 It is possible to apply an industrial design to an article which may be either 2/3-
dimentional.
Kinds of protection:
In India, designs of any product are protected by 2 legal rights;
1. Registered designs
2. Artistic copyright
Registered designs is a monopoly for a design (for eg a tread pattern) when applied to an
Article(for eg a tyre) and is granted under the laws of a country the Registered designs is filed
in. it protects the way a product looks.
Artistic copyright is a right subsists in a number of different kinds of works such as literary,
dramatic, musical or artistic works, sound recording and cinematograph films.
Designs which are not registered under the act:
 A Design which is not new or original.
 Design that has been disclosed to the public any where in India or by use in any
other country by publication in tangible form or by use in any other way prior to
filling date or where applicable, the priority date of the application for registration.
 A Design comprises or contains scandalous or obscene matter, shall not be
registered.
 Designs is not significantly distinguishable from known designs or combination of
known designs.
Need for protection:
 By protecting an industrial design, the owner of the design is given a right
against its unauthorized copying or imitation by third parties.
 The owner of a protected industrial design shall have the right to prevent third
parties not having his consent from making, selling articles bearing a design
which is a copy of protected design.
 Since industrial design are that aspect of an article which make it aesthetically
appealing and attractive, they serve to add to commercial value of the product
and facilitate its marketing and commercialization.
 Industrial design doesn’t protect any technical feature of the article to which it is
applied.
 The owner of an Industrial design benefits through the industrial development of
his/her products and the protection helps to ensure a fair return on investment.
 Industrial design injects creativity into industrial and manufacturing sector.
 So, Industrial design protection benefits the owner, the consumer and the
economy in general. Industrial designs is simple and inexpensive to develop and
protect.
 Industrial design protection is conducive to fair competition and honest trade
practices, encourages creativity.
Law of industrial Designs in India
Industrial design regime is governed by the Designs Act, 2000 in
India (came into force on 11-05-2001), the design Rules, 2001 and the Designs
(Amendment) Rules, 2008.
Registration of Industrial Designs
An application can be filed to the assistant Controller of Designs,
Design Office, Kolkata or the branches of the Patent offices in Delhi,
Mumbai or Chennai, along with the prescribed fees. The Design Office is
expected to register the design in six months after through examination.
Term of Industrial Designs Protection
The duration of the registration of a design is initially 10 years from
the date of registration. This period may be extended for a period 5 years, on an
application made to the Controller before the expiry of the said ten years.

Need for protection:  By protecting an industrial design, the owner of the design is given a right against its unauthorized copying or imitation by third parties.  The owner of a protected industrial design shall have the right to prevent third parties not having his consent from making, selling articles bearing a design which is a copy of protected design.  Since industrial design are that aspect of an article which make it aesthetically appealing and attractive, they serve to add to commercial value of the product and facilitate its marketing and commercialization.  Industrial design doesn’t protect any technical feature of the article to which it is applied.
  • 7.  The owner of an Industrial design benefits through the industrial development of his/her products and the protection helps to ensure a fair return on investment.  Industrial design injects creativity into industrial and manufacturing sector.  So, Industrial design protection benefits the owner, the consumer and the economy in general. Industrial designs is simple and inexpensive to develop and protect.  Industrial design protection is conducive to fair competition and honest trade practices, encourages creativity.
  • 8. Law of industrial Designs in India Industrial design regime is governed by the Designs Act, 2000 in India (came into force on 11-05-2001), the design Rules, 2001 and the Designs (Amendment) Rules, 2008.
  • 9. Registration of Industrial Designs An application can be filed to the assistant Controller of Designs, Design Office, Kolkata or the branches of the Patent offices in Delhi, Mumbai or Chennai, along with the prescribed fees. The Design Office is expected to register the design in six months after through examination.
  • 10. Term of Industrial Designs Protection The duration of the registration of a design is initially 10 years from the date of registration. This period may be extended for a period 5 years, on an application made to the Controller before the expiry of the said ten years.
