Trademark
A trademark is a virtually perceptible
sign such as name, words, label, symbol
or logo which is legally registered and
this trademark represents a particular
organization, company, product or
service to distinguish it from other
companies or products. Trademark helps
to customers recognize you in the
marketplace and distinguish you from
your competitors.
Unregistered Trademarks
This Symbol of trademark designated for Unregistered
trademark that is used to promote or brand goods.
Registered Trademarks
This Symbol is used for Registered trademark which are
registered with The Trademarks Act, 1999.
Service- Trademark
A Service-Mark or servicemark is a trademark used in the
several countries to identify a service rather than a
product. Before it is registered, it is common practice to
use the service mark symbol ℠.
Trademark Registration
Under the Indian trademark law the following are the types of
trademarks that can be registered:
 Product trademarks
 Service trademarks
 Certification trademarks
 Collective trademarks

2. Protects your Name / Brand Name from being used in a same or similar
fashion, by any other business firm, thus discourages others from

Term and Duration of Registered Trademarks
The term of registration of trademark is 10 (Ten) years,
but may be renewed subject to the payment of the
prescribed fee, in accordance with the provisions of the
Trademarks Act, 1999. An application for renewal of a
trademark can be filed within six months from
Constantia (Body) the expiry of the last registration of
trademark.
