About this module
The organisation holds a high standing in the community. Our high standing
is underpinned by our integrity in the way we operate. Managing a conflict
of interest is a means to reinforce that integrity and demonstrate
transparency to our stakeholders and community.
In this eLearning module, you will learn about conflicts of interest and what
to do if you think you have identified one, whether the conflict affects you
or someone that you manage.
Module details
• This module is for all staff, including contractors and consultants.
• It should take you about 15 minutes to complete.
• Check out the learning objectives before you start.
• There is a 10-question assessment at the end of this module, where
you'll need to score 90% or more to pass.
• This module should be completed regularly on an annual basis to ensure
that you address any changes in your circumstances.
On completing this module you

managing a conflict
What is a Conflict of Interest?
You have been asked to sit on an interview panel for a new appointment in your work
area. You discover that your cousin’s husband is one of the applicants for the job. You
have not seen your cousin for years and don’t keep in touch, as your family is not close.
What do you do?
Continue with the interview. You
don’t know your cousin’s
husband that well so there
won’t be any bias.
Tell your manager that your
cousin’s husband is one of the
applicants and that there might
be a conflict of interest with you
being on the interview panel.
Complete a declaration form for
a conflict of interest and hand it
to your manager.

Continue with the interview. You don’t know your cousin’s
husband that well so there won’t be any bias.
While there may not be an issue with bias, you have not
been transparent about your connection to the applicant. If
someone found out there could be a perception that the
interview process unfairly favoured your cousin’s husband.
Tell your manager that your cousin’s husband is one of the
applicants and that there might be a conflict of interest with
you being on the interview panel.
This is a good option to take. You have been completely
open, which allows your manager to assess whether or not
there is an issue with you being on the panel. You may then
complete a conflict declaration so that you both have a
written record that you have gone through the correct
processes and notified your manager.
Complete a declaration form for a conflict of interest and
hand it to your manager.
While it may be a good option to complete a declaration in
this instance, it is a good idea to check with your manager
first. They can then determine whether a declaration is
required and what steps to take next.

What is a conflict of interest? Conflicts of interest can arise in many shapes and forms.
There is a conflict when your public duty as an employee
clashes or overlaps with your personal interests.
When do they happen? You must assess whether you have a conflict of interest
before you join the organisation. After that they will usually
arise when you have a change in your personal
circumstances, or when you move to a different role.
Will I be in trouble? It is not necessarily wrong or unethical to have a conflict of
interest. In a small country like New Zealand it can
sometimes be difficult to avoid. You will not be in trouble as
long as the conflict is managed appropriately.
Can I deal with it myself? It’s not a good idea to ignore a conflict of interest of sweep
it under the carpet. By keeping it to yourself there may be a
perception you have something to hide. Identifying,
notifying and managing a conflict appropriately keeps
everything transparent.
What happens if I declare it? By declaring a conflict of interest you have been open and
transparent. If you have a declared conflict, your manager
can put will be protected if anything happens.

You have worked for the organisation for several years. Your daughter Lauren has just started seeing
a new boyfriend, Aaron. In passing he mentions that his father Todd is a member of a local gang
chapter.
This slide will take the learner through
a branching scenario (a sample is
shown here). The learner will be
prompted to make decisions at each
step. The intention is to show how a
potential conflict of interest can be
managed effectively.

You talk to your manager and together you decide to declare
a conflict to be on the safe side. Lauren and Aaron continue to
see each other and spend more time together. You help out
by dropping Lauren at Aaron’s house one day. You weren’t to
know that the house was under surveillance and that you
would be identified as a person of interest, but because you
had thought to declare a perceived or potential conflict you
are covered.
If you want to see what the consequences might have been
had you decided differently, go back and select No to find out.
Lauren and Aaron get on really well and start to
see each other more regularly. You do your part by
taking her to and fro in the car, occasionally
dropping her off at Aaron’s house.
Do you want to reassess whether there is a
conflict? You can open the checklist at any
point to review your decision.

gang member there is now a
perceived conflict. You realise this and
raise the issue with your manager,
who asks you to complete a conflict
declaration. While you have done
nothing wrong and have no
association with Todd, by identifying
that there is a potential conflict you
have protected yourself for the future.
Todd’s house has been under
surveilance for two weeks. Your
coming and going is picked up by the
surveillance team and because you are
an employee you are identified as a
person of interest. You now have to
explain your association with Todd. In
retrospect, you think it would have
been easier had you declared any
possible conflict at the very beginning.

2. When you transfer to a new role

  • 5. About this module The organisation holds a high standing in the community. Our high standing is underpinned by our integrity in the way we operate. Managing a conflict of interest is a means to reinforce that integrity and demonstrate transparency to our stakeholders and community. In this eLearning module, you will learn about conflicts of interest and what to do if you think you have identified one, whether the conflict affects you or someone that you manage. Module details • This module is for all staff, including contractors and consultants. • It should take you about 15 minutes to complete. • Check out the learning objectives before you start. • There is a 10-question assessment at the end of this module, where you'll need to score 90% or more to pass. • This module should be completed regularly on an annual basis to ensure that you address any changes in your circumstances. On completing this module you will be able to: • Explain what a conflict of interest is • Distinguish between the different types of conflict • Identify and declare a conflict • Follow the procedures for managing a conflict
  • 6. What is a Conflict of Interest? You have been asked to sit on an interview panel for a new appointment in your work area. You discover that your cousin’s husband is one of the applicants for the job. You have not seen your cousin for years and don’t keep in touch, as your family is not close. What do you do? Continue with the interview. You don’t know your cousin’s husband that well so there won’t be any bias. Tell your manager that your cousin’s husband is one of the applicants and that there might be a conflict of interest with you being on the interview panel. Complete a declaration form for a conflict of interest and hand it to your manager. Declaration form Policy The three options require the learner to think about what they would do. Each option will be clickable and a feedback layer will appear. Are these three options the most likely?
  • 7. Scenario Description Layer reveal text Continue with the interview. You don’t know your cousin’s husband that well so there won’t be any bias. While there may not be an issue with bias, you have not been transparent about your connection to the applicant. If someone found out there could be a perception that the interview process unfairly favoured your cousin’s husband. Tell your manager that your cousin’s husband is one of the applicants and that there might be a conflict of interest with you being on the interview panel. This is a good option to take. You have been completely open, which allows your manager to assess whether or not there is an issue with you being on the panel. You may then complete a conflict declaration so that you both have a written record that you have gone through the correct processes and notified your manager. Complete a declaration form for a conflict of interest and hand it to your manager. While it may be a good option to complete a declaration in this instance, it is a good idea to check with your manager first. They can then determine whether a declaration is required and what steps to take next. This shows the content of the feedback information from previous slide
  • 8. Conflicts of interest can arise in many shapes and forms. There is a conflict when your public duty as an employee clashes or overlaps with your personal interests This slide gives the option to click on FAQ questions to find out the answers.   • 9. Scenario Description Layer reveal text What is a conflict of interest? Conflicts of interest can arise in many shapes and forms. There is a conflict when your public duty as an employee clashes or overlaps with your personal interests. When do they happen? You must assess whether you have a conflict of interest before you join the organisation. After that they will usually arise when you have a change in your personal circumstances, or when you move to a different role. Will I be in trouble? It is not necessarily wrong or unethical to have a conflict of interest. In a small country like New Zealand it can sometimes be difficult to avoid. You will not be in trouble as long as the conflict is managed appropriately. Can I deal with it myself? It’s not a good idea to ignore a conflict of interest of sweep it under the carpet. By keeping it to yourself there may be a perception you have something to hide. Identifying, notifying and managing a conflict appropriately keeps everything transparent. What happens if I declare it? By declaring a conflict of interest you have been open and transparent. If you have a declared conflict, your manager can put will be protected if anything happens. This shows the responses to the FAQ questions from previous slide.

  • 11. Types of conflict actual potential perceived These will be clickable tiles that reveal an explanation of each term with examples, shown in the right-hand box. This means there is a direct conflict between the current activities of the employee and their private interests. For example… Where an employee has private or professional interests that could conflict with their professional duties in the future that may impair their ability to act in a fair, impartial, responsible or trustworthy manner for the service. For example… Where an employee has private interests that appear to conflict with, or improperly influence the performance of their duties. Monitor conflict-related details and amend as appropriate. Review their conflict of interest status annually. Receive the Conflict of Interest form and consider whether a Conflict of Interest requires a management plan. Send the conflict form to the Integrity Assessment Committee for guidance if required. Load declarations directly into Kiosk, where it is applicable. Check that all employees review their conflict of interest status annually. Promptly assess conflict plans requested by managers. Make management plan recommendations to the Manager. This list is adapted from the policy. Do we want to add any other responsibilties?

Be aware of your personal interests. If you have a feeling there might be a conflict, check it out. Use the self-assessment checklist to assess whether there is a conflict. If there is a conflict, talk to your manager and if necessary declare it using the declaration form. Then take steps to manage it using a management plan. If active management is required, your manager will develop a plan to manage the situation. The policy has guidelines to follow for this. Continually review the conflict and keep information current.   • 16. The boyfriend Self- assessment checklist You have worked for the organisation for several years. Your daughter Lauren has just started seeing a new boyfriend, Aaron. In passing he mentions that his father Todd is a member of a local gang chapter. This slide will take the learner through a branching scenario (a sample is shown here). The learner will be prompted to make decisions at each step. The intention is to show how a potential conflict of interest can be managed effectively. Is there a conflict of interest? Use the self-assessment checklist to find out. Yes No You talk to your manager and together you decide to declare a conflict to be on the safe side. Lauren and Aaron continue to see each other and spend more time together. You help out by dropping Lauren at Aaron’s house one day. You weren’t to know that the house was under surveillance and that you would be identified as a person of interest, but because you had thought to declare a perceived or potential conflict you are covered. If you want to see what the consequences might have been had you decided differently, go back and select No to find out. Lauren and Aaron get on really well and start to see each other more regularly. You do your part by taking her to and fro in the car, occasionally dropping her off at Aaron’s house. Do you want to reassess whether there is a conflict? You can open the checklist at any point to review your decision. Yes No As you have visited the house of a gang member there is now a perceived conflict. You realise this and raise the issue with your manager, who asks you to complete a conflict declaration. While you have done nothing wrong and have no association with Todd, by identifying that there is a potential conflict you have protected yourself for the future. Todd’s house has been under surveilance for two weeks. Your coming and going is picked up by the surveillance team and because you are an employee you are identified as a person of interest. You now have to explain your association with Todd. In retrospect, you think it would have been easier had you declared any possible conflict at the very beginning. Click to reveal

Could my involvement or actions be perceived by others as unethical? 4. If I was asked to defend my actions or involvement how would I respond? 5. Does my involvement appear fair, reasonable and equitable in all the circumstances? 6. What are the consequences if I ignore the conflict of interest? 7. What if my involvement was questioned publicly? 8. Is there a risk that my decision or action could be misinterpreted? 9. What impact could the conflict have on my role, my manager, my team, my agency and the Public Service? 10. Have I made any promises or commitments in relation to the matter? 11.   • 20. Keep it current identify assess manage monitor There are three key points at which you should review your status with conflict: 1. When you have a change of circumstances 2. When you transfer to a new role 3. When you complete your annual review Declaration In the case of 1. and 2. you need to complete and sign a conflict declaration and hand it to your manager.
