Mandatory drug testing for welfare recipients has been debated for years. Supporters argue that if drug testing is required for employment, it should also be required to receive government assistance. However, others believe it violates privacy rights and has proven ineffective. While the Supreme Court has ruled that most mandatory drug testing is allowable under the 4th Amendment, they have also ruled that collecting samples constitutes a search. Requiring drug tests for welfare denies assistance to those who refuse testing.
