1. Mumbai: Cyrus Pallonji Mistry’s removal
as chairman of the Tata group of compa-
nies has chartered into the legal sphere
and is now set to turn into an extended
legal battle.
The Tata group is seen as an example of
doing business in the Indian corporate
world. Cyrus Mistry, son of Pallonji
Mistry who is the owner of Shapoorji
Pallonji group and the biggest stake-
holder in the Tata group, was appointed
to the top position in 2012.
The removal has been followed by bitter
outbursts from the ousted chairman, and
the now interim chairman Ratan Tata
and team have moved to file caveats in
Bombay High Court, Delhi High Court
and the National Company Law Tribunal
as a measure to guard them from any
legal action that Mistry may initiate.
Mistry has not announced any legal
action yet and hasn’t filed any caveats
either. Apparently, Mistry was not
informed of the meeting that decided his
ouster and all developments took place
in a secretive manner.

3. Column 3New Delhi, 31 October - 6 November, 2016
Vaidehi
The Congress party is
demanding the resigna-
tion of Maharashtra Chief
Minister Devendra
Fadnavis for “brokering”
a truce between
Maharashtra Navnirman
Sena chief Raj Thackeray
and the makers of the
film Ae Dil Hai Mushkil,
while ally Shiv Sena
slammed the BJP for
compromising the Army’s
self-respect. The fact is
that Mr. Fadnavis has
opposed the offer of Rs. 5
crore contribution from
the filmmakers to the
Army Welfare Fund.
However, the Indian Army
has refused to accept
such funds from film pro-
ducers and requested
power brokers, not to
politicize the army for their
mere political mileage.
Karan Johar’s film faced
protests by MNS workers
for casting Pakistani actor
Fawad Khan. The film’s
smooth release, sched-
uled to open on October
28, was ensured at a
meeting between the Film
Producers’ Guild, the pro-
ducers and Raj
Thackeray, mediated by
Fadnavis last week. A key
demand conceded at the
meeting was Rs. 5 crore
contributions from the film-
makers to the Army
Welfare Fund. Raj had put
three demands, out of
which there was no objec-
tions to the other two par-
ties. When the issue of
Rs. 5 crore came up,
Devendra intervened and
made it clear to the Film
Producers’ Guild that they
need not have to agree to
it. He also told them that
the contribution has to be
made voluntarily.
However, it was the pro-
ducers’ decision to accept
it. In his presence deal
was happened, that’s why
Fadnavis was under
attack. He would have
taken bold step to say no
to it. Anyway, he is a CM
who was mitigating the
matter amicably, to avoid
undue situations ahead of
festival season. Before
this intervention, the
Mumbai Police had arrest-
ed many MNS activists
that action says the gov-
ernment had no ill inten-
tion behind it. The allega-
tion on the CM is not true
that he was playing from
both sides. Though the
CM is being criticised by
some for being a part of
meeting, but the steps
taken by him were practi-
cal which has avoided
uncertainty. MNS leaders
may claim that it is their
victory, but steps were
taken to maintain peace
and prevent damage to
the public property.
Remember during 2009
elections, IPL was shifted
to South Africa as govern-
ment expressed its inabili-
ty to give security to each
match. Here, those who
are criticising Devendra
Fadanvis for brokering a
deal to avoid, riots, blood-
shed, loss of property
during Diwali festival are
forgetting that in the past
also the same party has
violated the law and the
Congress government
stood as a mute specta-
tor.

Bangalore: Big Relief For
Former Karnataka CM, BS
Yeddyurappa.
BJP's first south Indian chief
minister is BS Yeddyurappa
who has acquitted by a CBI
special court in the mining
kickback case.
BS Yeddyurappa, a top BJP
leader from Karnataka, has
been acquitted of accepting
kickbacks worth 40 crores
while he was Chief Minister
to allow illegal mining in the
state.
Yeddyurappa's two sons,
son-in-law and JSW officials
have also been acquitted of
all charges by the CBI court
in Bengaluru.
Pronouncing the judgement
in a jampacked court hall,
Judge R B Dharmagouder
exonerated all the 13
accused in the case, stating
the prosecution had failed to
establish their guilt under the
Prevention of Corruption Act
and Indian Penal Code.
The verdict has given an
impetus to Yeddyurappa, who
was appointed state BJP
chief in April this year ahead
of the assembly elections due
in 2018.
"The prosecution has
become unsuccessful in
establishing the guilt of the
accused, not only the
offences made under thepro-
visions of Prevention of
Corruption Act, but also
under theprovisions of the
Indian Penal Code, and
hence this court acquits all
the accused in the case," the
judge held in his more than
400-page verdict.
Elections in Karnataka are
due in two years. The
Congress won the state from
the BJP in 2013.
"Satyameva Jayathe. Justice
is done. I stand vindicated,"
Mr Yeddyurappa tweeted
after today's verdict at a court
in the state capital of
Bengaluru. A prominent
leader of the powerful
Lingayat community, he
heads the BJP in Karnataka
and has a mass following.
It's a Rebirth, Nobody Can
Stop Me Now former chief
minister B S Yeddyurappa
told media persons, that it
was indeed a rebirth for him
and his family."Both the
Congress and JDS wanted to
finish me off.
They had joined hands to end
my political life. The judiciary
has rescued me. They know
that I am innocent. I want to
lead a happy life .
The former Karnataka CM
refused to speculate on if the
CBI will file an appeal in the
Karnataka High Court chal-
lenging his acquittal.
As of now my focus will be on
getting BJP back to power in
Karnataka, he said, adding
that the judgment had given
him more energy and confi-
dence.
"I would resume my
Karnataka tour. I will bring the
BJP back to power. Nobody
can stop me now. Today’s win
is a first step towards our big
win in the 2018 Assembly

statement.
When media persons asked
about his previous allega-
tions against some state BJP
leaders for entangling him in
the case, Yeddyurappa said
past is past.
"It is a rebirth for me and my
family. Let’s not blame any-
one. God knows everything,"
he said.
"I thank the judiciary and the
judge. They have acquitted
me. I have always maintained
that it was a political conspir-
acy against me.
I had nothing to do with the
case. It is also a big victory
for lakhs of BJP workers in
Karnataka,and "My support-
ers are happy. They stood by
me. I thank them," the state
BJP president said in his
statement.
C V Nagesh Advocate of B S
Yeddyurappa told media per-
sons that the other accused
acquitted in the case are
Yeddyurappa's two sons and
son-in-law, JSW Steel and
four Bellary-based affiliates
of the company. "The prose-
cution was unsuccessful in
establishing them guilty.
Hence, all accused were
acquitted, and their bail
bonds stand cancelled.
He said The CBI, in its
chargesheet filed in 2012,
had accused the state
Bharatiya Janata Party presi-
dent of accepting bribes from
a mining firm in exchange for
official favours to excavate
iron ore in Bellary.

New Zealand share a unique
bond based on shared val-
ues and synergies, being
two multicultural, vibrant
democracies that believe in

tries can work together in
areas such as maritime
security, ensuring freedom
of navigation and in counter-
ing terrorism.
The President said there
exists a strong desire
amongst the people of the
two countries to improve
relations .
The Prime Minister of New
Zealand reciprocated the
President’s sentiments and
said his Government would
like to grow and strengthen
bilateral relations. He

BarackObamatrollsDonaldTrumpover‘meantweet’onlatenightTV
US: President Barack Obama trolled
Republican presidential candidate Donald
Trump – known for his prolific use of
Twitter to settle scores – making Trump
the punch line for jokes on ABC’s late-
night show “Jimmy Kimmel Live.”
Obama read aloud a series of “mean
tweets” culminating in one from Trump:
“President Obama will go down as per-
haps the worst president in the history of
the United States!”
“At least I will go down as a president,”
Obama said. Kimmel joked that Obama
had to “take time away from helping rig
the election” to appear on the show, a dig
at Trump, who has repeatedly said the
November 08 vote is rigged against him.
Obama picked up on the joke while
describing how comedian Bill Murray beat
him in a contest to putt golf balls into a
glass in the Oval Office during a recent
visit – a stunt the White House designed
to promote Obamacare health insurance.
He won repeatedly,” Obama said. “The
glass was rigged!” Kimmel asked Obama,
“Do you ever laugh” when watching
Trump on television. “Most of the time,”
Obama said.
Obama also revealed he has been called
on a special phone by his bed “three or
four times” in the middle of the night dur-
ing his time in office to deal with emergen-
cies, including when the 2011 tsunami hit
Japan. But he said he does not reach for
his smartphone in the wee hours – anoth-
er dig at the Republican candidate. “I
don`t tweet at 3 am about people who
insult me,” Obama said. Obama`s second
and final term ends on January 20. Under
the US Constitution, presidents are limited
to two terms – which is just as well,
Obama said.
“If I were able to run for a third term,
Michelle would divorce me,” he said, not-
ing his wife does not like politics. Not all
the jokes were at Trump`s expense.
Comedian Will Farrell channeled
deceased but beloved Chicago Cubs
sportscaster Harry Caray to recommend
that Obama “open a shrimp shack” after
he leaves office. And Joel McHale feigned
outrage when told he had been bumped
from the show for Obama. “You got the
president, huh. Wow, that’s a big deal –
he’s got two months left in the job,”
McHale said, oozing sarcasm.
Philippine President Rodrigo Duterte tells US
to forget about defence deal ‘if I stay longer’
Philippine President Rodrigo Duterte hit out at the United
States, saying he did not start a fight with Washington
and it could forget about a military agreement between
both countries if he were to be in power longer.
Duterte said he was against the presence of any foreign
troops in his country and the United States could “forget”
an Enhanced Defence Cooperation Agreement (EDCA)
with the Philippines, if he stayed longer, without elaborat-
ing. The United States, he said, should not treat the
Philippines “like a dog with a leash”, adding to confusion
about the future the longtime allies’ ties. “I look forward
to the time when I no longer see any military troops or
soldier in my country except the Filipino soldiers,”
Duterte said prior to his departure to Japan.
San Diego to South China Sea: US Navy test-
ed new command in latest challenge to China
The US Navy destroyer
that sailed near Chinese-
claimed islands in South
China Sea last week was
under orders from the
Third Fleet headquarters in
San Diego, a first aimed at
bolstering US maritime
power in the region, two
sources said.
The USS Decatur chal-
lenged China’s “excessive
maritime claims” near the
Paracel Islands, part of a
string of islets, reefs and
shoals over which Beijing
has territorial disputes with
its neighbours.
It was the first time such a
freedom of navigation
operation has been con-
ducted without the Japan-
based Seventh Fleet in
command and was a test
of changes aimed to allow
the US Navy to conduct
maritime operations on two
fronts in Asia at the same
time, two sources said the
news agency. The sources
spoke on condition they
weren’t identified.
The green-eyed ‘Afghan girl’ who shot to global fame when a 1985 issue of National
Geographic magazine published a haunting picture of her on its cover, was arrested in
Peshawar.
Sharbat Gula, now in her 40s, was being investigated for the past few years by the
Pakistani authorities who had discovered she was living in the country with fraudulent
identity documents. She now faces up to 14 years in jail, a Pakistani official warned.
The haunting image of Sharbat Gula, taken in a Pakistan refugee camp by photogra-
pher Steve McCurry, became the most famous cover image in the magazine’s history.
Gula was arrested by Pakistan’s Federal Investigation Agency (FIA).
“FIA arrested Sharbat Gula, an Afghan woman, today for obtaining a fake ID card,” said
Shahid Ilyas, an official of the National Database Registration Authority (NADRA).
An FIA official said the officer who had issued the ID cards to Sharbat Bibi was now
working as a deputy commissioner in customs and got bail-before-arrest to avoid arrest
in the case.
Last year, National Database and Registration Authority (NADRA) issued three CNICs
to Sharbat Bibi and two men who claimed to be her sons. Issuance of CNICs were in
violation to the rules and procedures of NADRA.
The official added that relatives present at the given address have refused to recog-
nise two persons listed as her sons in the form.
An inquiry had been launched with NADRA officials under fire for issuing CNICs to for-
eign nationals without legitimate documentation, Dawn online noted.

in September 2010, JSW

Mining Company had deposit-
ed Rs 20 crore into the bank
accounts of Yeddyurappa's
sons BY Raghavendra and
BY Vijendra and son-in-law

claimed that JSW Steel affili-

Rs 20 crore to Prerana

which is run by
Yeddyurappa's sons, alleged-
ly to have their mining dues
waived and pending mining

Of this Rs 20-crore payment,
Rs 6 crore was transferred to

alleged that Yeddyurappa had
misused his position as chief
minister to illegally acquire a
one-acre plot of -notified land
near Bengaluru, which he, his
family members and a former
associate later sold to JSW
Steel affiliates for Rs 20 crore
to cover up the trail of alleged

CM Siddaramaiah on clean
chit to BS Yeddyurappa:
Acquittal doesn’t mean he
didn’t make mistake:
After BS Yeddyurappa was
given clean chit by a special
CBI court on Wednesday in a
Rs 40 crore illegal mining
case, Karnataka Chief
Minister Siddaramaiah told
media persons that it doesn’t
mean the BJP leader didn’t
make any mistake. “Court has
given him clean chit because
of lack of evidence. It doesn’t
mean that Yeddyurappa didn’t
make mistake.He also said,
“Who will be the next CM peo-
ple will decide, not
Yeddyurappa or his party.
In August 2011, Mr
Yeddyurappa was forced to
resign after Karnataka's
ombudsman or Lokayukta,
Santosh Hegde, indicted him
for colluding in illegal iron-ore
mining in the mineral-rich dis-
trict of Bellary. Justice Hegde,
a former Supreme Court
judge, had famously
described a mafia of politi-
cians, bureaucrats and indus-
trialists running "The Republic
of Bellary."
Mr Yeddyurappa's relatives
including his two sons and a
son-in-law have also been
found not guilty.
The former Chief Minister
was jailed for three weeks in
2011 connection with the
case before being given bail.
Investigators had accused
him and his family of swap-
ping mining licenses for dona-
tions that were made to trusts
run by them.
Mr Yeddyurappa was made
Chief Minister in 2008, but
was replaced after the corrup-

New Delhi: People of different indigenous Indian tribes
have gathered together in the national capital to show-
case their rich cultural and artistic heritage at the
National Tribal Carnival which is also conducting work-
shops and discussions about problems facing the tribal
communities.
At a workshop to discuss the Panchayats (Extension to
Scheduled Areas) Act (PESA), tribal activists and gov-
ernment officials discussed the benefits that have
accrued to the tribal community from the implementation
of the 1996 Act as well as the drawbacks that need to be
reformed. Speaking at the event, Mr. V K Sharma, Joint
Secretary, Ministry of Panchayati Raj said that so far five
states including Andhra Pradesh, Himachal Pradesh,
Rajasthan and Maharashtra have framed their PESA
Rules (guidelines) while the other states with tribal pop-
ulations were yet to do so. He also emphasized the
importance of women in Gram Panchayats on the devel-
opment of fifth scheduled areas.

Mumbai: Cab aggregator Uber has started an online
petition urging citizens to sign the plea against the
Government of Maharashtra’s proposal to regulate app
based cab services in the state. The firm has opposed
some of the rules in the draft city taxi scheme which
includes excessively high permit fees for drivers; a
requirement of more expensive cars, less fuel efficient
cars and price restrictions including minimum fares. If
rules are implemented in the present form then it will
make cab aggregator services expensive and com-
muters will have to wait for long time to board a taxi. Uber
also added that the new proposal will impose a financial
burden on aggregators and will make its services unvi-
able. The proposed rules also threaten the livelihood of
thousands of drivers because the new, higher permit
fees are prohibitively expensive for them.
“We understand that existing taxi and auto drivers are
feeling the pressure from services like Uber. But the
answer is to level the playing field by reducing today’s
burdensome regulations – not to introduce rules that will
be bad for riders, drivers and Mumbai,” Uber said in a
statement.
