1. We the undersigned, are willing to execute, perform, complete and maintain the above named
Works in accordance with the Agreement and Schedule of Conditions of PAM Contract 2006
(With Quantities), Drawings, Specifications and Contract Bills for the following sums :-

2. We confirm that we have understood all the stipulation in the above referred documents and
are willing to execute the Works in accordance with stipulations and contents of the above
documents.
3. We confirm that the quantities given in the tender shall not form part of the contract and
served as a guide only. The bills of quantities shall be used as Schedule of Works for purpose
of interim payment valuation. And the unit rates shall be used as a Schedule of Rates for
valuation of Variations under clause 11.6 of the Contract. We further confirm that we have
checked and are satisfied with the quantities.
4. Should any arithmetical errors be found in the Bills of Quantities, resulting in either a net
addition to or a net deduction from the said Tender Sum, we agree that the error(s) may be
rectified and corrected, before the award of this Tender.
5. The tender sum are firm prices and shall not be subjected to any reasons whatsoever save only
in respect of pursuant to the Articles of Agreement and Conditions of Contract.
6. We agree to abide by these for a period of sixty (60) days from the final date fixed for
receiving Tenders and they shall remain binding upon us and may be accepted at any time
before the end of that period.
3. DOUBLE STOREY HOSUE SHOW UNIT
7. [We agree to the Liquidated Damages for the late completion of this Contract in accordance
with Clause 22.0 of the Conditions of Contract at the rate of specified for the whole of the
Works and for the period stipulated during which the works remained incomplete.
8. We, further, agree that the full amount of the Earnest Money, shall be forfeited in the event
we withdraw this Tender during the tender validity period; or upon being awarded the
Contract, refuse to proceed with the Works or to sign the Contract or to provide the
Performance Bond.
9. If this tender is accepted, we are willing to execute the formal Contract Agreement; and to
deposit the Performance Bond and all the requisite Insurance Policies; and produce the
receipts for premiums paid, for inspection within fourteen (14) days from posting, or delivery,
if by hand, of notification of acceptance.
10. We confirm after personal scrutiny that the Documents and Drawings used by the
undersigned in compiling this tender are bona-fide copies of the Documents and Drawings
hitherto prepared.
11. Unless and until a formal Agreement is prepared and executed this Tender, together with your
written acceptance thereof, shall constitute a binding Contract between us.
12. We understand that you are not bound to accept the lowest or any Tender that you may
receive.
13. The Tender shall be submitted in a sealed envelope to reach the office of Q.SOLVE
CONSULTANCY SDN. BHD. by not later than 12.00 noon of the date of submission of
tender as stipulated in the Letter of Invitation to Tender.

PART B - INSTRUCTIONS & CONDITIONS OF TENDERING
1.0 THE CONTRACTUAL ARRANGEMENT
1.1 The whole of the Works set forth in the Drawings, Contract Bills and Specifications
will be let on Contract, subject to the Conditions of Contract.
1.2 The form of Contract shall be the Agreement and Schedule of Conditions of PAM
Contract 2006 (With Quantities) issued by the Malaysian Institute of Architects.
1.3 The quantities given in the tender shall not form part of the contract and served as a
guide for tender and to facilitate valuation of interim payments only. The bills of
quantities shall be used as a Schedule of Works for purpose of interim payment
valuation. And the unit rates shall be used as a Schedule of Rates for valuation of
Variations under clause 11.6 of the Contract. Tenderer shall check the quantities given
and satisfy himself as to its accuracy. Tenderer shall not be entitled to any additional
payment or loss and expense should the quantities be found to be inaccurate.
1.4 All provisional quantities items shall be re-measured upon completion and paid based
on the Schedule of Rates.
1.5 All P.C. Unit Rate items shall be nominated and instructed by the Architect once the
selection is done. The adjustment of the new rates shall be carried out based on the as-
built quantities.
1.6 Tender shall be based on a fixed completion period of eight (8) months

Upon payment of the Documentation Charges as stated in the Tender Notification, each
Tenderer shall be issued with one (1) copy of bound Tender Documents together with
the Bills of Quantities and drawings all to be fully endorsed and returned upon
submission of Tender at the office of the Quantity Surveyor.
3.0 TENDERING PERIOD
3.1 Tendering period shall be 2 weeks from the date of the Letter of Invitation to Tender.

4.0 ALTERATION TO TEXT
4.1 No alterations shall be made by the Tenderer to the text of Tender Documents, unless
specifically stipulated therein. If any unstipulated alteration, addition or note is made
by him such alteration, addition or note will not be recognized and the text of the
Tender Documents as originally prepared by the Quantity Surveyor will be strictly
adhered to.
5.0 TENDER PRICE
5.1 The sum of the amount of all items priced by the Tenderer shall truly represent the
Tendered Price. The rates set down by the tenderer against each item shall be held to
include all taxes including Goods and Services Tax and duties payable, packing,
freight, insurance; complying with all the requirements and terms of the Specification;
transport and delivery to site, supervision, establishment charges; profit and any other
expense and everything else necessary for the due and proper completion of each item.
5.2 Tender rates/Schedule of Works shall be submitted on firm-price basis and no
adjustment will be made for any fluctuations.
6.0 DEVIATION
6.1 Tenderers are advised to discuss with the Architect prior to submission of Tenders, any
intended provisions of their offers that may conflict with the basic requirements of the
Specifications. The Architect will advise on the acceptability of such provisions.
6.2 Unless a proposed deviation from the requirements of the Specification or Drawings is
brought to the attention of the Architect prior to the submission of Tenders and written
approval of such deviation is given by Architect the Tender submitted shall be deemed
to comply strictly any statements of the Specification and/or Drawings regardless of
any statements to the contrary made in the Tender or in any documents accompanying
the Tender.
7.0 ARITHMETICAL ERRORS
7.1 Any error or omission in the rates and calculations of the Contractor in the Bills of
Quantities/Schedule of Works submitted by him shall, before the signing hereof, be so
rectified and corrected. The net aggregate amount or errors in moneying out items in
the Bills of Quantities/Schedule of Works, whether a net addition or a net omission will
be added to or subtracted from the originally Tendered Sum. The Employer shall
reserve the right to amend any rates which found unreasonable, with the concurrence
of the Contractor, and the amended rates shall be used for the Valuation of Variation
works.
6. DOUBLE STOREY HOSUE SHOW UNIT
8.0 TENDER DOCUMENTS

9.0 ALTERNATIVE CONDITIONS OF SALES, ETC.
9.1 The Tenderer is not allowed to qualify his tender by any alternative condition of sales,
etc. contrary to the terms and conditions given hereinafter. Should any alternative
condition of sales, etc. be offered, such qualification will be ignored and the said terms
and conditions in this Tender Documents shall prevail.
10.0 INSPECTION
10.1 Tenderers, before submitting their proposals, are to inform themselves of the nature of
the work by personal examination of the Site and its conditions, the Specification and
Drawings and by such other means, as they may consider necessary as to matter
conditions and construction bearing on or in any way affecting the preparation of their
Tenders.
11.0 VALIDITY PERIOD
11.1 Tenderers should note that a period of sixty (60) days from final closing date for the
submissions of Tenders. Tenders shall remain valid for acceptance within this period.
12.0 TENDER BOND (EARNEST MONEY)
12.1 Each Tender must be accompanied by a Tender Bond (Earnest Money) for the sum of
RM 12,000.00 in the form of a Banker’s Draft or Bank Guarantee make out to the
Employer. The Earnest Money will be refunded to all unsuccessful Tenderers on the
acceptance of a Tender or after the expiry of the validity period of the tender or after
the Contract has been signed with the successful Tenderer.
12.2 The successful Tenderer’s Tender Bond will be refunded after he has furnished the
necessary security deposit (Performance Bond) and insurance as required in the
Contract.
7. DOUBLE STOREY HOSUE SHOW UNIT
13.0 DOCUMENTATION CHARGES
13.1 Tender deposit or Tender Documentation Fees for the tender documents shall be
RM 800.00 non-refundable and in the form of cash or Banker’s Draft made payable to
the Quantity Surveyor.
13.2 The Tender Deposit will be refunded to all unsuccessful Tenderers who submit “bona-
fide” tenders; and who return all Tender Documents in good condition.
13.3 The whole of the Tender Deposit of the successful tenderer shall be retained to defray
the costs of the Tender Documentation.
14.0 SUBMISSION OF TENDERS
14.1 The tenderer is to note that the following sections of these documents shall be dully
completed and signed prior to submission of his Tender.
i) Part A : Form of Tender

iii) Part C : Final Summary of Tender
iv) Part E : Bills of Quantities

14.2 The completed Tender Documents shall be dispatched in a sealed envelope labeled as:

or delivered on time to reach the specified place not later than the stipulated date and

time. Any Tender delivered after the stipulated time and date, from whatever cause
arising, shall not be considered. Notwithstanding the above clause, the Employer
and/or the Consultants shall in no way be held responsible for any loss or late Tender

15.0 EXPENSES INCURRED BY TENDERER
15.1 Any expenses incurred by the Tenderer in the preparation of this tender shall
be borne by the Tenderer.
16.0 ACCEPTANCE OF TENDER
16.1 The Employer shall not be bound to accept the lowest or any tender.

SCHEDULE OF DAYWORK RATES
SCHEDULE OF DAYWORKS
Daywork that cannot be measured or valued at the rates in the Schedule of Rates shall be executed and
valued as Daywork.
No work shall be carried out as Daywork unless so permitted by the Engineer prior to the
commencement of such work.
The Contractor shall append Daywork prices in the appropriate column below and such appended
prices shall be deemed to be the actual prime cost to the Contractor of his labour and mechanical plant
or equipment which the Contractor agrees shall be the basis of valuation of Dayworks as provided
under, Clause 11 of the conditions of Contract.
In accordance with Clause 11 paragraph (c) of the Conditions of Contract, fifteen (15) percent shall be
added to the Daywork prices that shall include for the use of all ordinary plant, tools, scaffolding,
supervision and profit. This percentage addition shall be deemed to include for the following costs:-
1) Head office charges
2) Site supervision and site staff
3) Overtime rates
4) Time lost due to inclement weather
5) Bonuses and all other incentive payments
6) Fares and time allowed for travelling
7) Safety and welfare facilities
8) Insurances required under the Conditions of Contract
9) All non-mechanically operated plant, staging and trestles, protective clothing, artificial lighting,
storage facilities
10) Transport of labour, materials and plant to and from site
Daywork sheets shall be submitted to the Engineer for verification in accordance to the procedure
provided in the Conditions of Contract.
A copy of all verified Daywork sheets shall be forwarded to the Quantity Surveyor for his retention.

any alteration in the obligations undertaken by the Contractor or by any forbearance whether
as to payment, time, performance or otherwise, but the Guarantor shall be entitled to be
informed of such arrangement or alterations.
3. This Guarantee shall be irrevocable and shall remain in force and effect until the certified
date of Making Good Defects under the Contract, and in the case of the contract being
determined, one calendar year after the date of determination. Claims, if any, must be
