The Fifth Annual Women & Justice Conference was held on April 14-15, 2015 in Washington, D.C. and brought together over 70 judges, lawyers, and activists from over 15 countries to discuss women, prison, and gender-based violence. The conference focused on how violence against women can be a cause, condition, and consequence of incarceration, and the role of judges in addressing these issues. Panel 1 on the first day examined advancing justice for survivors of gender-based violence, with panelists from Mexico, the U.S., and the Avon Foundation discussing their work related to domestic violence and women in the criminal justice system.

What do we_know_about_sexual_abuse
Very few of us know that 73% of the rape victims know the rapists. Moreover, 40% of rapes happen at victim’s home and 20% occur in the homes of familiar people.
It turned out that most of us have no idea about the effective precautions needed to protect ourselves from the traumatic experience, because we expect danger from a wrong source. A widespread belief is that one should expect a rapist to sit in the bushes in the park late at night, while the reality is different.
My colleague Paulina Grzelak and I were astonished while exploring this topic, as we were quite oblivious to the real situation as well. Therefore, we decided to make a small questionnaire and ask people what they think about rape.
This presentation begins with the analysis of what makes a person become a rapist, which is followed by the comparison of the results of the questionnaire with real data.
I would be grateful if you shared this presentation as many people need this knowledge.
I also want to add that most figures we present come from the States where definition of rape and social situation may differ from ours. Hence, comparing data from the U.S. with opinions from Poland and Ukraine may seem improper. For instance, being forced into sexual contact by husband may not even be recognized as rape in Ukraine, “because it’s his natural right”. And even if a wife admits this fact, social welfare system (which does not exist here, let’s face it) leaves her no option apart from remaining silent, while in the U.S. rape victims are less dependent on family members. Therefore, one has to approach the statistics carefully. Still, we believe that using American data can be justified by the fact that they explore the subject more than any other country.

Institutional and Systemic Racism - The Racial State Week 8
Racism is perpetuated in institutions. Often it is difficult to discern racism because it is not overt, and may not be immediately obvious in individual behaviour. Nevertheless, outcomes for school students, patients, employees and those who have dealing with the police and the judiciary are often affected by cultures of racism within institutions. ‘Racial neoliberalism’ establishes standards according to which racialised people are judged against white middle class people who have not experienced the same challenges. Efforts to oppose institutional racism have often focused on ‘equity and diversity’ measures but have not tackles the underlying systemic racism that may determine outcomes. This week sets up the framework for the discussion of specific systems in the following weeks.
Questionnaires
Questionnaires can be used to gather large amounts of quantitative data on crime and deviance through representative sampling. However, they have limitations such as only providing a snapshot of information and potentially low validity if subjects do not answer truthfully. There are also ethical issues around using questionnaires with minors or on sensitive topics. Positivists prefer the use of questionnaires for research as they produce reliable and representative results, while interpretivists are critical of their ability to capture valid meanings and experiences.

Types of gender based violence include intimate partner violence, sexual coercion, sexual abuse, rape, trafficking, and harmful traditional practices. Violence can be physical, sexual, or psychological in nature. Gender based violence has serious health impacts and is a public health issue. Case studies show examples of intimate partner violence, dowry deaths, harmful traditional practices against young girls, and efforts by NGOs and government to address gender based violence through counseling centers, women's police stations, and by establishing violence against women as a crime.

Institutional and Systemic Racism - The Racial State Week 8
Racism is perpetuated in institutions. Often it is difficult to discern racism because it is not overt, and may not be immediately obvious in individual behaviour. Nevertheless, outcomes for school students, patients, employees and those who have dealing with the police and the judiciary are often affected by cultures of racism within institutions. ‘Racial neoliberalism’ establishes standards according to which racialised people are judged against white middle class people who have not experienced the same challenges. Efforts to oppose institutional racism have often focused on ‘equity and diversity’ measures but have not tackles the underlying systemic racism that may determine outcomes. This week sets up the framework for the discussion of specific systems in the following weeks.
Questionnaires
Questionnaires can be used to gather large amounts of quantitative data on crime and deviance through representative sampling. However, they have limitations such as only providing a snapshot of information and potentially low validity if subjects do not answer truthfully. There are also ethical issues around using questionnaires with minors or on sensitive topics. Positivists prefer the use of questionnaires for research as they produce reliable and representative results, while interpretivists are critical of their ability to capture valid meanings and experiences.

Gender violence
Gender based violence refers to violence directed at women that results in harm. It is perpetuated by unequal gender norms and roles in society. Types of gender based violence include intimate partner violence, sexual coercion, sexual abuse, rape, trafficking, and harmful traditional practices. Violence can be physical, sexual, or psychological in nature. Gender based violence has serious health impacts and is a public health issue. Case studies show examples of intimate partner violence, dowry deaths, harmful traditional practices against young girls, and efforts by NGOs and government to address gender based violence through counseling centers, women's police stations, and by establishing violence against women as a crime.

The Criminalization of HIV Non-Disclosure & Exposure: Legal Violence and Expe...
This presentation elaborates initial findings from an ongoing qualitative research project examining the lived experiences of people who have been criminally charged in relation to HIV non-disclosure and/or exposure in Canada, a country well known for its high rates of criminalization towards HIV. This project examines the material outcomes of being institutionally marked as a 'criminal' and a 'risk to public safety' through mobilizing a critically engaged ethnography approach that is grounded in the experiences of people directly targeted by the application of the law. This study elaborates the increasing precarity facing HIV-positive people who must live their lives in a negative relation to the law and who can be subject to a range of forms of legal violence as a result. This presentation provides unique and critical insight into formal and informal forms of punishment and legal violence enacted onto people by centering the voices of people who have faced these circumstances first-hand. Findings from this study outline the experiences of people who have faced the most punitive aspects of the state punishment apparatus first-hand, including those who have faced aggravated charges, long sentences, incarceration in segregation units, and ongoing life-long surveillance via sex offender registration. People in this study also described a range of informal forms of violence that threaten their daily security, including sensationalistic media coverage labeling people as violent predators; as well as the inability of current social services to meet the complex mental health needs required to address the trauma resulting from being accused. Finally, this project asks what harshly punishing people living with HIV with sanctions that are vastly disproportionate to the supposed committed 'crime' through the practice of criminalizing HIV non-disclosure and/or exposure says about the role of law and contemporary practices of punishment in Canadian society.

New Approaches to Prevent Mother-to-Child Transmission of HIV in Kenya
