Separation Of Powers In Australia Essay
The separation of powers is the legislature, executive and judiciary arms of government. The parliament are our lawmakers, the representative of
parliament is selected by people of society to represent the people (indirect democracy). The laws enacted through parliament are called acts or statutes.
Parliament can pass laws that can override judge made laws and it can revoke and take away authority given to government department. The separation
of powers is referred to as a principle that not only divides power but also provides a system of checks and balances. The checks and balances come in
different forms. The most obvious is the judiciary's role in ensuring the executive and the legislature comply with laws, including the constitution. ...

The things that they control within those organisations is the working of legislation, to control the efficiency and relevance, and the provision of

independent government authority under the ombudsman act 1976. It has the power to examine administrative decisions of commonwealth
department and authorities. They investigate complaints, identifies flaws in legislation and the government ministers and parliament are advised. The

The Common Type Of Conflict At Indiana University
Indiana University is home to nearly fifty thousand students and ten thousand faculty members, all of who spend time working, living, or interacting
with each other within the confounds of a 3–square mile campus. With so many individuals operating in such a small vicinity, there is likely to be a
significant amount of conflict. I would guess that the most common type of conflict at Indiana University is student to student conflict. While I have not
personally had any major conflicts with another student, I have friends who have told me of their own. My Residence Assistant during my freshman
year, Andrew, was a homosexual, African American man, and he was routinely antagonized on campus. He told me once about a student in one of his
classes who would always make snide comments about his sexuality and the color of his skin, and how the student would wait for Andrew at the door
after class just to belittle him. I thought this was preposterous and that something needed to be done, but Andrew informed me that he gets treated like
this all of the time on campus, and there is nothing he can do to stop it. Among the other types of conflict that I have witnessed at this university are
between students and staff members. I would say that the most common type of issues in the student–faculty category are between professors and
students. Personally, I have had an issue with a professor who gave me a low grade on a paper that I did not think I deserved. She always gave us the

Case Study: Problem Certified Nursing Assistants
Problem– Certified Nursing Assistants and Patient Care Assistants require more training in dealing with patients with mental illnesses and neurological
issues within long term care facilities. Mental illness in long–term care (LTC) facilities is a serious problem. Estimates among the 3.2 million residents,
but a recent review indicated that dementia, depression, and anxiety disorders were the most common disorders, occurring more frequently than among
community–dwelling older adults). While 68% of LTC residents have been reported to have cognitive impairment, 41% show moderate–severe
impairment). Currently, most programs offer a curriculum set by the Texas Department of Aging and Disabilities. The curriculum focuses is placed on

International Ombudsman Association: Autoethnography
This article from the Journal of the International Ombudsman Association (JIOA) is wonderful! For me, the fact both authors – Jan Newcomb and
Dawn Duquet– have been used autoethnography as their form of exploring concepts it is great and I found it fascinating. This method allows them to
use self–reflection to explore their own personal experiences (The JIOA editorial board, 2017). Even though both authors have different personalities
and nationalities, they both reflected about similar aspects and coincidentally both ended with pretty similar self–reflections. For example, Duquet is an
introvert external organizational ombudsman counselor located in Montreal, Canada while Newcomb is an extrovert independent lawyer and coach
located in California, United States. Duquet, aim to humility as one of the most powerful gifts she has from being an ombudsman. She mentions that

It is important to consider that indigenous communities are and sees life from a different perspective. In my previous experiences working with the
American Seminole Tribe, I have learned they honor their own principles different from us –regular population. I would say they handle ancestors'
wisdom better than non–indigenous communities. Ironically, Duquet reflected that "as a non–native, it is an honor to assist in dispute resolution in an
indigenous community. Native people say there is a reason why we are given two ears and one mouth: to listen twice as much as we speak, listen with
humility in order to understand more deeply, ultimately without judgment until all have spoken" (Duquet, p.4, 2017). She points out that is exactly
what an ombudsman should do. In terms of humanity, Duquet tell us the best approach she has learned is not necessarily the logical one, through her
self–reflection she has learned about the humane aspect "the one that acknowledges feelings, their legitimacy and their ownership"

Factors Affecting Workplace Culture
Over time, it is expected that businesses make changes to their work place to improve productivity and efficiency. It is evidently found throughout
several businesses, including Guide Dogs that many factors affect this. Factors such as workplace culture and government policies are important
features which help to build and define the success of the business and efficiency of the workplace. It has been evaluated by Business SA that for these
reasons, these factors clearly affect the proficiency and productivity within a work place. FACTOR ONE: Workplace Culture Work place culture is the
behavior that is expected in a work force. The culture defines the atmosphere found throughout the organisation which is an important aspect. The
culture and vibe that the business reflects and demonstrates shows the values and attitudes within the business. An example of this can be seen through
the Guide Dogs which is a non–profitable business that strongly upholds and advocates the need of reflecting a motivating culture. The Guide Dogs
describe and reflect a culture with values such as achievement, collaboration, integrity, fun and innovation. By endorsing these as their "values" it is
imperative that all employees and workers abide and mirror these values when representing their business. For these reasons, HR manager at the Guide
Dogs, Ms. Katherine Stucco ensures that upon hiring new employees to work for the business, their desire to show and demonstrate these is important.

Ombudsman's Complaints Against Long-Term Care Facilities
The Ombudsman is an advocate whose goal is to promote the highest possible quality of life for residents. Maryland's ombudsman receives and
resolves complaints against long–term care facilities. Ombudsman groups educate consumers and long–term care providers about residents' rights.
Promote community involvement with senior citizens and provide information to the public about long–term care facilities.
Some of the responsibilities of the State Ombudsman are to help individuals understand their legal rights, help to implement their legal rights, attempt
to resolve complaints made by or on behalf of long term care residents, provide assistance and support to residents until disputes are resolved, provide
information and referral services regarding long term care issues, identify insufficiencies in the care of long term residents, and advocate for
improvement in long term care legislation and policy.

Vs. Structural Obstacles Accession of new members from Eastern Europe into the union is possible only through good governance, effective
institutions, and quality democracy. Good governance creates effective institutions. These institutions produce quality democracy. Established member
states want a democratic sub–continent which will support expansion towards Eastern Europe. Next I evaluate the literature in order to establish
whether EU institutions have the real power to impact the quality of democracy in Eastern European and Balkan members in order to support EU
expansion. EU Institutions' Ability to Influence Eastern Europe EU Institutions and Leverage and Linkage with the West First I examine how EU
institutions promote linkage and leverage with the West with the newest members in Eastern Europe. In particular, I examine the role of EU policies
and initiatives in promoting Western 1) linkage by guaranteeing security and 2) leverage through conflict resolution in Eastern Europe, since those are
the two main issue areas that enabled Western presence and cooperation in the region. The predominant impression is that the majority of Europeans
still favor defense from outside from structures like NATO; therefore, NATO is a significant source of linkage and leverage with the West in Eastern
Europe. EU and Security of Eastern Europe Democratizing states tend to form peace alliances that provide an environment for democracy to develop

The Data Protection Act Of The World Of Sales
In the world of sales there are a lot of legal requirements that have to be met in order to deliver a fair but efficient service. This can come under many
things that will aid in a lot of customers being kept happy and being safe. One of the most famous of these is the Data Protection Act. The purpose of
this act is to ensure that the information of customers is kept safe and isn't openly accessible to just anyone. This isn't just to protect the customers but
is also to protect the business. The business is being represented by the sales person and they must ensure that all customer data is protected because
if something malicious were to be done with the customers information, then this wouldn't just reflect badly on that sales person, it would reflect
badly on the business as a whole. In the terms of sales on the phone, you can't actually see who you are speaking to so when accessing a customer's
file, some sort of Data Protection questions or password may be put in place. This could simply be asking them to confirm their full name, their home
postcode or date of birth. More secure things can be put in place if requested. This data protection is also necessary so that the sales person can make
sure that they are not miss–selling products to customers. This can be done through things like Terms and Conditions of a product or policy that the
customer is purchasing.

Changes in the American Red Cross Essay
(1) Changes at the American Red Cross have led to more transparency at the agency. These changes include making public record of its stance on
governance and ethics policy. Also, each member of the board of directors is required to sign the Board Member Affirmation of Service, which
mandates that each member actively participate a minimum of 15 days per year with the organization, read the Code of Ethics, and comply with the
policy. Other changes include the Office of the Ombudsman office its increased usage since its implementation. During fiscal year 2012, there were
833 constituents contacted the office versus 354 in fiscal year 2008 (Ombudsman, 2012). This increase reflects a rise in the number of internal issues

Lastly, there have been instances of misappropriation of funds on the national and local levels. Due to the size of the organization and the wide range
of local chapters, the systems in place to track the dissemination of funds has allowed for instances of embezzlement. This includes forged purchase
orders in Maryland and the use of funds for gambling and gifts in New Jersey (O.C. Farrell, 2011).
(3) This essay will attempt to review ethical dilemmas of the American Red Cross due to a lack of systems and policies. In doing so, actions will be
presented to aid with identification of the issues. Finally actions to prevent recurrence in the future will be presented. The reasons for the American
Red Cross's ethical dilemmas are due to the lack of systems and policies for dealing with the unique situations that require a response from the
organization. This is apparent with Hurricane Katrina and the enormity of the response that was needed to address all of the needs of the victims,
donations received, and the orchestration of the volunteer effort to include coordination of efforts with various organizations. First, the orchestration of
efforts required and expected of the organization was not realized by the organization prior to the event. This means that all of the stakeholders were
not understood and taken into consideration prior to the event. This led to ethical concerns of unpreparedness and slow

Nhs England : The Second Method Of Redress
NHS England
The second method of redress is going through NHS England which is in place for patients that have tried to resolve the situation with the staff that
are involved or using the PALS team, if this cannot be resolved then a formal complaint needs to be made where the NHS England supplies two
different addresses which the patient can use to complain to. The first stage is Local resolution where they recommend the patient complains to the
provider or the commissioner of the health service within 12 months after the event or when the patient became aware of the event while this time if a
patient want support with their complaint then the NHS England provides The patient with an independent complaints advocacy service to assistance
with complaining. The patient can complaint directly to the NHS England as they can complain to the provider or the commissioner by online
complaint form, telephone, email or letter without going through the GP surgery. If the patient is not happy with the response then they are addressed
with the second stage where is contact to the Health Service Ombudsman who would investigate the patients complaint. (England–nhs, 2014)
The first strength of this method is that the NHS England offers an advocacy service. This will ensure that patients that may not be able to speak for
themselves still have the same chance at complaining as they can have help. Another strength is that NHS England has more power than a GP surgery
and they have the power to

Improving Partnerships with Big Companies to Help the ARC...
Additional leadership changes at ARC, legislated by Congress include proposals to limit the board's focus exclusively on governance and strategic
oversight and also to set up a new Office of the Ombudsman to provide additional oversight and annual reports to Congress on how well the ARC is
operating (Epstein, 2013). Leaders at ARC need to find and develop ways for improving, along with encouraging organization members to build an
ethically sound environment (Leader to Leader, 2008). From my point of view, as an independent ombudsman who represents the ARC to Congress I

Without providing sufficient access to information about checks and balances in decision making processes, the organization can easily fall from
an environment of trust to one of cynicism ( Leader to Leader, 2008, p. 37). Another important area where the independent ombudsman who
represents the ARC to Congress should focus is on people who are volunteering for different events. In my opinion a background check it would be
necessary to avoid the past issues regarding thefts or missing items that were designated for individuals in need. In the 2007, National Nonprofit
Ethics Survey, showed that more than half of employees had noticed at least one act of misconduct in the previous year. Close to 40 % of nonprofit
employees who observed an unethical behavior have failed to report it, simply because they were convinced that reporting would not lead to
corrective action or they were afraid of retaliation from management or colleagues ( Rhode & Packel 2009). Clark ( 2012) suggested that
"Implementing a new culture, organizational structure, or strategic plan requires leaders to engage and empower their staff to take ownership of the
process (p. 35)." Improving the corporate partnerships with big companies would be in my opinion another step that would help ARC to raise
donations and to stimulate people that are willing

Police Response To Domestic Violence
Introduction
Domestic violence status, in theory, recognised as a "real" crime and it is a form of criminal offences. In NSW the Bureau of Crime and Statistics
and Research states that the females as young as fifteen years old go through physical violence. It is also indicated that one out of five women has
been sexually abused (Shircore et al. 2017, p. 538). However, the research by the NSW Ombudsman (2006) revealed that the police response toward
domestic violence calls which mostly affecting CALD women are deficient. In fact, the lull over domestic violence is culturally ingrained, and only
once a situation is considered dangerous are the authorities involved.

adults in our programs and facilities. Through the interview, I learned that the DHS pays for Transportation, doctors visit, meals, nursing home, home
care of older adults, if they are eligible. Some aging adults depend on meals provided to them which are funded by the government like meals on
wheels for nutrition. Recently, the Trump administration proposed a budget cut for the community development block grant, which is a program that
provides funds for community development including meals on wheels. 50,000 Minnesota older Adults rely on meals on wheels for their daily
nutrition. Meals on wheels allows older and disabled adults to remain in their homes and still get food every day, but this might be in jeopardy because
of the new proposal by the trump administration. Furthermore, the trump administration is planning on decreasing the budget of the Department of

some of the duties of their job for a certain amount of time. In other words, they may do some parts of their job now, and someday they might be
able to do all of the duties, just as they had done before their injury. Permanent total disability prevents someone from ever coming back to work. They

children and young people who are suspected, on reasonable grounds, to be at risk of significant harm should be reported to FACS.
The implementation of a universal service system, e.g.:1. Universal parenting education erg: Triple P, for parents with children 3–8, universal home

health home visiting for at–risk teenage mothers, 3. Better Protection for Children at Risk e.g.: violence prevention coordination units, review of police

ERC's budget to more manageable levels. Eventually, the Office of the President dismissed the Chairperson of the ERC for grave misconduct with
respect to the procurement of audio–visual presentation project, and simple misconduct for renewing seven electric power purchase agreements and for
appointing officers and personnel without the concurrence and approval of the rest of the commissioners ("Palace fires", 2017). This recent experience
only confirms that while the ERC's independence as a quasi–judicial and quasi–legislative body is enshrined in its enabling legislation, this is not a
guarantee that it will be independent of political processes. In this case, its independence as an institution was

American Red Cross Ethics
While running any business, it is important that ethics play a large role in the day to day decisions that are made that affect that organization.
Considering the fact that the American Red Cross is a charitable organization that is dependent on donations and volunteerism for its missions; ethics
becomes even more important if the company wants to maintain any level of reverence with its supporters (Bennett, 2015). If I was an independent
ombudsman who represents the ARC to Congress, I would request review of regulations regarding compensation of non–profit organization leadership,
and I would ask for policy regarding the Office of the Corporate Ombudsman, to ensure reported issues are answered and investigated promptly and
appropriately.

According to the ARC website (n.d.), the Office of Corporate Ombudsman also is responsible for making reports to Congress outlining all reports to
this hotline. While this is an adequate start to ensuring that the company continues to operate ethically it is not fool proof. This Corporate Ombudsman

When trust is damaged employee performance declines, employee loyalty declines, employee theft rises and the relationship a company had with its
clients ultimately fails.
Overcoming the Perception of Unethical Behavior Ethics in supply management is very important not only for the organization but in terms of labor,
the customer, the environment, buyers, and suppliers.
Name & Page #
For the supply managers, the internal and well as external environment can be highly competitive and the desire to succeed is often accompanied with
many pressures. Considering this, it is imperative that supply managers as well as upper management have a clear and concise understanding of all
ethical as well as professional standards required. Integrity, in the decision making process, is critical and even the appearance of an impropriety can
be damaging to management as well as the organization. As stated in our text, "The results of a perceived impropriety may become, over time, more
disruptive or damaging than an actual transgression. It is essential that any activity or involvement between the supply management professional or
potential supplier be strictly avoided." (Burt, Petcavage, Pinkerton, 2010). For example, in a case involving several supply managers, two officials met
unknowingly with a representative of a firm that submitted the proposal. Although, there were no discussions relating to the proposal while meeting,
the mere suggestion of an impropriety was a

The Ombudsman Program Case
At Indiana University, there are many conflicts between students and faculty that cannot be resolved. There are concerns that students and faculty both
have to which they have differing views on. The problem is that there is no clear–cut way to resolve this issue; but, with an ombudsman program, it
may be easier. The Ombudsman program can regulate disputes between two parties and also differ any responsibility on the university. The fact of the
matter is that students want to voice their concerns but they feel that they will not get exactly what they want out of it. For example, if a student feels
that a certain race is getting discriminated on more than others, he/she will have to try and find a way to voice this; which can be hard at a large ... Show

The first program is for faculty work space/environment. This program focuses on as stated on the Northwestern page, "If any faculty member has

channels, or which seem intractable, please feel free to communicate or meet with any of the distinguished emeritus faculty appointed to serve as
ombudspersons, listed below"(Resources). This message serves as a way for the university to cover any issue relating to work; it's a very open
statement to interpret. Much like Northwestern, Arizona and Cornell both have similar style programs. The programs are broader than what
Northwestern has but is still essentially the same. This proves that most ombudsman programs are going to be essentially the same in purpose and
nature. The statement that many individuals fail to read when regarding ombudsman programs is as stated, "The Ombudsman office is a voluntary
program and no one is required to use Ombudsman services. If a community member (visitor) chooses to meet with an Ombudsman, the visitor will be
understood to have agreed to abide by these ethical principles, including agreeing not to call the Ombudsman to testify with respect to confidential

Administrative Liability
Office of the Ombudsman v. Uldarico P. Andutan (G.R. No. 164679, 27 July 2011)
The Ombudsman argued – in both the present petition and in the petition it filed with the CA – that Andutan's retirement from office does not render
moot any administrative case, as long as he is charged with an offense he committed while in office. It is irrelevant, according to the Ombudsman, that
Andutan had already resigned prior to the filing of the administrative case since the operative fact that determines its jurisdiction is the commission of
an offense while in the public service.
The Ombudsman relies on Section VI(1) of Civil Service Commission Memorandum Circular No. 38 for this proposition, viz.:

According to the OCA, the respondent's resignation does not render the case moot and academic, nor deprive the Court of the authority to investigate

Once the PDC determines that a 'protected disclosure' has been made, the PDC must assess whether it also constitutes a 'public interest disclosure.'
In order for the PDC to be satisfied that a public interest disclosure exists, the disclosure must show that a public body or public officer: has
engaged, is engaging or proposes to engage in improper conduct in their capacity as a public officer or public body; or has taken, is taking or
proposes to take detrimental action. If the PDC determines that a 'public interest disclosure' exists, the whistleblower will be notified of the decision

Elder Justice Act Case Study
Abuse of the elderly is a common issue, but the aging adults are protected by a federal law known as the "Elder Justice Act". According to Hillier and
Barrow (2011), between 3 percent and 6 percent of people over the age of 65 report being abused. However, elderly abuse is usually not reported,
because the abuser is typically a family member. So, the abuse adult will not report the abuse because they are afraid of making the abuser angrier or
being isolated (Hillier & Barrow, 2011, p. 328). According to the department ofhealth and human services "The "Elder Justice Act" is the first
comprehensive federal legislation to address elder abuse, was signed into law by President Obama in March, 2010 as part of the health care reform act."
According to National Center on Elderly Abuse, the law works by:

There are pros and cons of government involvement with the elderly abuse issue that can have effect in small and larger scales. The pros are that this
issue is being acknowledged, more assistance available, and more funding is being contributed to help the elderly and families in need. The cons are
that government assistance information is not always easy to find, more education needs to be done for caregivers, and asking for assistance to help

Ombudsman's Contribution to the Task of Ensuring that Government Decision–Making is Conducted in a Defensible Way
The Parliamentary Commissioner for Adminstration (PCA) was set up under the Parliamentary Commissioner Act 1967 as a result of the Crichel
Down affair in 1954. It was thought that pre–existing judicial and parliamentary remedies did not provide adequate redress for members of the public
who suffered as a result of maladministration in central government. No action was being taken towards defective administrative workings, either
because it fell outside the jurisdiction of the courts or because MPs did not have sufficient powers to investigate it satisfactorily.
The Ombudsman stands as ... Show more content on Helpwriting.net ...
These include extradition and fugitive offenders, the investigation of crime by or on behalf of the Home Office, security of the States, action in matters
relating to contractual or commercial activities, court proceedings and personnal matters of armed forces, teachers, the Civil Service or police. The
government has always resisted the extension of the Ombudsman system into these areas. Furthermore, Schedule 2 does not include public
corporations, tribunals, the Criminal Injuries Compensation Board or, crucially, the police.
A further important limitation, the system of making the complaint through a Member of Parliament, has been much criticised: it is thought that this
'screening' of complaints does not serve the best interests of complainant. This is where direct access to the ombudsman is denied and the MP is made
to be the middleman. The involvement of MPs in the process may mean an inadequate working system since MPs do not possess the power to
investigate in great detail as to scrutinise the matter at hand to its depths.
Another problem that is seen within the role of PCA is also due to the lack of power to award remedy. However, the fact that the PCA operates
informally and privately has been thought to enhance his powers of persuasion. A good example is that of the Ostler case (1977), where the

The New House Bill 4321
The ombudsman is supposed to protect detainees who are part of the immigration system; to make sure that their rights have not been and are not being
violated by those belonging to the immigration system. His position is supposed to change how detainees will be represented and treated while being
held in detention centers. The position also entails that they have the right to give suggestions on how to improve the administrative practices, services,
and responsiveness of the Bureau of Citizenship and Immigration. They also have other responsibilities in which their position is supposed to better the
relationship of the Bureau, the detainees, and the people in the United States. The new House Bill was giving the ombudsman more responsibility than
what the original bill had stated. There still was many issues within the Bureau of Citizenship and Immigration. House Bill 4321 objective, for this
section, was to increase the possibilities in how the ombudsman could help improve the department. The new House Bill 4321 is fixing the issue that
the people in the United States have with the people working in the detention center and how they function. People have many critiques on the
cleanliness, structure, function, health facilities, respect, and accountability that detainees are receiving while being in custody. Many people criticize
detention centers because they are not clean, and they have human being living in a place that is dirty and unsanitary. People fighting the

The Delivery Of Public Service
There are mistakes, maladministration and misunderstanding that may occur during the delivery of public service in the United Kingdom (UK). The
citizens have a right to complain if they feel aggrieved. There are many citizens who normally complain not only for their benefit but to ensure that
the public service is improved so that it can cater for the needs of the citizens and so that the same mistakes are not inflicted on others. However, there
are instances when the complaints are not resolved by the said service provider. In such an instance when an individual feels that the complaint has not
been fully addressed by the government agency, department or National Health Service (NHS) in England, then that individual has a right of asking for
the complaint to be referred to the Parliamentary and Health Service Ombudsman (PHSO) or the individual can personally refer the matter to the
PHSO. This paper seeks to discuss the single reform of the PHSO that would best serve the interests of administrative justice. An Ombudsman may be
defined as an officer appointed to investigate citizen's complaints against injustice or maladministration by public officials. The concept of the
Ombudsman is anchored on the idea that citizens have a right of complaining against specific actions of omission or commission by public officials.
The Ombudsman therefore has investigative powers vested on him and which include investigating the internal workings of departments or entire
organization.

most of financial transactions, consumers are in disadvantaged positions because of the information asymmetry between the financial institutions and

to resolve disputes in financial market. Financial consumers have access to rise a complain to the FOS, thus they can improve the scope for redress
without having resort to arbitration or litigation which might cause high cost (MacNeil, 2012). Furthermore, the FOS is likely to make decisions
basing on what it[it] considers fair and reasonable in the situation of a case, rather than the law or precedential value (Alpert, 2008). Owning to the

that in the United States the long–term care (LTC) marketplace is normally recognized as one of the most strongly regulated sectors in the economy,

State agencies are responsible for annual certification inspections and any complaint investigations. Take for example, when excessive flaws and
defects are detected during an inspection; there are penalties that may be placed on facilities, including civil money penalties, denial of payment for
new admissions, state monitoring, temporary management, and immediate termination. The CMS funds most of the costs of the certification process
and oversees the state agencies to ensure that the federal rules are implemented properly (Stevenson & Grabowski, 2006). Another regulatory
agency is Ombudsman program that was authorized under the Older Americans Act and administered by the Federal Administration on Aging, the
LTC ombudsman program began in 1972 as a trial program and now every state has upheld its cause. (Stevenson & Grabowski, 2006). The program
is mainly comprised of volunteer staff and the initial functions of the ombudsman program are to settle grievances made by or for residents of LTC
facilities, in addition to educating providers and the public about residents' rights and good care practices, and to serve as general advocates for
residents in LTC facilities. Although the Ombudsman program has no authority to set or enforce specific standards of care, the program has been
found to be a positive, if under–resourced, influence on quality of care. Take for example, the government enforcement of quality

Ombudsman are independent office holders who investigate and rule on complaints from members of the public about maladministration in
government and, in particular, services in both the public and private sectors. Some ombudsman use me3diation as part of their dispute resolution
procedure. The powers of ombudsman vary. Most ombudsman are able to make recommendations, only a few can make decisions which are
enforceable through the courts.
ADR is a far quicker means to arrive at the solution than resorting to the court. The delays in the court litigations are well known, and waiting for a
case to come to court may (especially in commercial cases) add considerably to the overall cost and adversely affect business.
Many procedures try to work without any need for legal representation, and even those that do involve lawyers may be quicker and therefore cheaper
than resorting to the court.
Alternative methods tend to be more informal than court procedure; without the complicated rules that exist in court procedure. The process can
therefore be less intimidating and less stressful than bringing court actions.
ADR proceedings are private. Accordingly, the parties can agree to keep the proceedings and any results confidential. This allows them to focus on the

Separation of powers in Australia

  • 1. Separation Of Powers In Australia Essay The separation of powers is the legislature, executive and judiciary arms of government. The parliament are our lawmakers, the representative of parliament is selected by people of society to represent the people (indirect democracy). The laws enacted through parliament are called acts or statutes. Parliament can pass laws that can override judge made laws and it can revoke and take away authority given to government department. The separation of powers is referred to as a principle that not only divides power but also provides a system of checks and balances. The checks and balances come in different forms. The most obvious is the judiciary's role in ensuring the executive and the legislature comply with laws, including the constitution. ... Show more content on Helpwriting.net ... The things that they control within those organisations is the working of legislation, to control the efficiency and relevance, and the provision of access, and to investigate complaints. A good example comes from the office of Ombudsman. The commonwealth ombudsman was set up as an independent government authority under the ombudsman act 1976. It has the power to examine administrative decisions of commonwealth department and authorities. They investigate complaints, identifies flaws in legislation and the government ministers and parliament are advised. The ombudsman can only recommend changes to ... Get more on HelpWriting.net ...
  • 2. The Common Type Of Conflict At Indiana University Indiana University is home to nearly fifty thousand students and ten thousand faculty members, all of who spend time working, living, or interacting with each other within the confounds of a 3–square mile campus. With so many individuals operating in such a small vicinity, there is likely to be a significant amount of conflict. I would guess that the most common type of conflict at Indiana University is student to student conflict. While I have not personally had any major conflicts with another student, I have friends who have told me of their own. My Residence Assistant during my freshman year, Andrew, was a homosexual, African American man, and he was routinely antagonized on campus. He told me once about a student in one of his classes who would always make snide comments about his sexuality and the color of his skin, and how the student would wait for Andrew at the door after class just to belittle him. I thought this was preposterous and that something needed to be done, but Andrew informed me that he gets treated like this all of the time on campus, and there is nothing he can do to stop it. Among the other types of conflict that I have witnessed at this university are between students and staff members. I would say that the most common type of issues in the student–faculty category are between professors and students. Personally, I have had an issue with a professor who gave me a low grade on a paper that I did not think I deserved. She always gave us the ... Get more on HelpWriting.net ...

  • 4. International Ombudsman Association: Autoethnography This article from the Journal of the International Ombudsman Association (JIOA) is wonderful! For me, the fact both authors – Jan Newcomb and Dawn Duquet– have been used autoethnography as their form of exploring concepts it is great and I found it fascinating. This method allows them to use self–reflection to explore their own personal experiences (The JIOA editorial board, 2017). Even though both authors have different personalities and nationalities, they both reflected about similar aspects and coincidentally both ended with pretty similar self–reflections. For example, Duquet is an introvert external organizational ombudsman counselor located in Montreal, Canada while Newcomb is an extrovert independent lawyer and coach located in California, United States. Duquet, aim to humility as one of the most powerful gifts she has from being an ombudsman. She mentions that over the... Show more content on Helpwriting.net ... It is important to consider that indigenous communities are and sees life from a different perspective. In my previous experiences working with the American Seminole Tribe, I have learned they honor their own principles different from us –regular population. I would say they handle ancestors' wisdom better than non–indigenous communities. Ironically, Duquet reflected that "as a non–native, it is an honor to assist in dispute resolution in an indigenous community. Native people say there is a reason why we are given two ears and one mouth: to listen twice as much as we speak, listen with humility in order to understand more deeply, ultimately without judgment until all have spoken" (Duquet, p.4, 2017). She points out that is exactly what an ombudsman should do. In terms of humanity, Duquet tell us the best approach she has learned is not necessarily the logical one, through her self–reflection she has learned about the humane aspect "the one that acknowledges feelings, their legitimacy and their ownership" ... • 5. Factors Affecting Workplace Culture Over time, it is expected that businesses make changes to their work place to improve productivity and efficiency. It is evidently found throughout several businesses, including Guide Dogs that many factors affect this. Factors such as workplace culture and government policies are important features which help to build and define the success of the business and efficiency of the workplace. It has been evaluated by Business SA that for these reasons, these factors clearly affect the proficiency and productivity within a work place. FACTOR ONE: Workplace Culture Work place culture is the behavior that is expected in a work force. The culture defines the atmosphere found throughout the organisation which is an important aspect. The culture and vibe that the business reflects and demonstrates shows the values and attitudes within the business. An example of this can be seen through the Guide Dogs which is a non–profitable business that strongly upholds and advocates the need of reflecting a motivating culture. The Guide Dogs describe and reflect a culture with values such as achievement, collaboration, integrity, fun and innovation. By endorsing these as their "values" it is imperative that all employees and workers abide and mirror these values when representing their business. For these reasons, HR manager at the Guide Dogs, Ms. Katherine Stucco ensures that upon hiring new employees to work for the business, their desire to show and demonstrate these is important. ... Some of the responsibilities of the State Ombudsman are to help individuals understand their legal rights, help to implement their legal rights, attempt to resolve complaints made by or on behalf of long term care residents, provide assistance and support to residents until disputes are resolved, provide information and referral services regarding long term care issues, identify insufficiencies in the care of long term residents, and advocate for improvement in long term care legislation and policy. • 7. How Eu Institutions Promote Linkage And Leverage With The... Vs. Structural Obstacles Accession of new members from Eastern Europe into the union is possible only through good governance, effective institutions, and quality democracy. Good governance creates effective institutions. These institutions produce quality democracy. Established member states want a democratic sub–continent which will support expansion towards Eastern Europe. Next I evaluate the literature in order to establish whether EU institutions have the real power to impact the quality of democracy in Eastern European and Balkan members in order to support EU expansion. EU Institutions' Ability to Influence Eastern Europe EU Institutions and Leverage and Linkage with the West First I examine how EU institutions promote linkage and leverage with the West with the newest members in Eastern Europe. In particular, I examine the role of EU policies and initiatives in promoting Western 1) linkage by guaranteeing security and 2) leverage through conflict resolution in Eastern Europe, since those are the two main issue areas that enabled Western presence and cooperation in the region. The predominant impression is that the majority of Europeans still favor defense from outside from structures like NATO; therefore, NATO is a significant source of linkage and leverage with the West in Eastern Europe. EU and Security of Eastern Europe Democratizing states tend to form peace alliances that provide an environment for democracy to develop (Gibler and Wolford 2006), so peaceful ... • 9. The Data Protection Act Of The World Of Sales In the world of sales there are a lot of legal requirements that have to be met in order to deliver a fair but efficient service. This can come under many things that will aid in a lot of customers being kept happy and being safe. One of the most famous of these is the Data Protection Act. The purpose of this act is to ensure that the information of customers is kept safe and isn't openly accessible to just anyone. This isn't just to protect the customers but is also to protect the business. The business is being represented by the sales person and they must ensure that all customer data is protected because if something malicious were to be done with the customers information, then this wouldn't just reflect badly on that sales person, it would reflect badly on the business as a whole. In the terms of sales on the phone, you can't actually see who you are speaking to so when accessing a customer's file, some sort of Data Protection questions or password may be put in place. This could simply be asking them to confirm their full name, their home postcode or date of birth. More secure things can be put in place if requested. This data protection is also necessary so that the sales person can make sure that they are not miss–selling products to customers. This can be done through things like Terms and Conditions of a product or policy that the customer is purchasing. 1.2 There are a few regulatory requirements needed when working in a sales role that must be adhered to and ... These changes include making public record of its stance on governance and ethics policy. Also, each member of the board of directors is required to sign the Board Member Affirmation of Service, which mandates that each member actively participate a minimum of 15 days per year with the organization, read the Code of Ethics, and comply with the policy. Other changes include the Office of the Ombudsman office its increased usage since its implementation. Lastly, there have been instances of misappropriation of funds on the national and local levels. Due to the size of the organization and the wide range of local chapters, the systems in place to track the dissemination of funds has allowed for instances of embezzlement. This includes forged purchase orders in Maryland and the use of funds for gambling and gifts in New Jersey (O.C. Farrell, 2011). (3) This essay will attempt to review ethical dilemmas of the American Red Cross due to a lack of systems and policies. In doing so, actions will be presented to aid with identification of the issues. Finally actions to prevent recurrence in the future will be presented. The reasons for the American Red Cross's ethical dilemmas are due to the lack of systems and policies for dealing with the unique situations that require a response from the organization. This is apparent with Hurricane Katrina and the enormity of the response that was needed to address all of the needs of the victims, donations received, and the orchestration of the volunteer effort to include coordination of efforts with various organizations. First, the orchestration of efforts required and expected of the organization was not realized by the organization prior to the event. This means that all of the stakeholders were not understood and taken into consideration prior to the event. This led to ethical concerns of unpreparedness and slow ... • 12. Nhs England : The Second Method Of Redress NHS England The second method of redress is going through NHS England which is in place for patients that have tried to resolve the situation with the staff that are involved or using the PALS team, if this cannot be resolved then a formal complaint needs to be made where the NHS England supplies two different addresses which the patient can use to complain to. The first stage is Local resolution where they recommend the patient complains to the provider or the commissioner of the health service within 12 months after the event or when the patient became aware of the event while this time if a patient want support with their complaint then the NHS England provides The patient with an independent complaints advocacy service to assistance with complaining. The patient can complaint directly to the NHS England as they can complain to the provider or the commissioner by online complaint form, telephone, email or letter without going through the GP surgery. If the patient is not happy with the response then they are addressed with the second stage where is contact to the Health Service Ombudsman who would investigate the patients complaint. (England–nhs, 2014) The first strength of this method is that the NHS England offers an advocacy service. This will ensure that patients that may not be able to speak for themselves still have the same chance at complaining as they can have help. Additional leadership changes at ARC, legislated by Congress include proposals to limit the board's focus exclusively on governance and strategic oversight and also to set up a new Office of the Ombudsman to provide additional oversight and annual reports to Congress on how well the ARC is operating (Epstein, 2013). Leaders at ARC need to find and develop ways for improving, along with encouraging organization members to build an ethically sound environment (Leader to Leader, 2008). From my point of view, as an independent ombudsman who represents the ARC to Congress I would need to clarify, and revise the ARC's internal policies regarding fund raising related to specific disasters. Without providing sufficient access to information about checks and balances in decision making processes, the organization can easily fall from an environment of trust to one of cynicism ( Leader to Leader, 2008, p. 37). Another important area where the independent ombudsman who represents the ARC to Congress should focus is on people who are volunteering for different events. In my opinion a background check it would be necessary to avoid the past issues regarding thefts or missing items that were designated for individuals in need. In the 2007, National Nonprofit Ethics Survey, showed that more than half of employees had noticed at least one act of misconduct in the previous year. Close to 40 % of nonprofit employees who observed an unethical behavior have failed to report it, simply because they were convinced that reporting would not lead to corrective action or they were afraid of retaliation from management or colleagues ( Rhode & Packel 2009). Clark ( 2012) suggested that "Implementing a new culture, organizational structure, or strategic plan requires leaders to engage and empower their staff to take ownership of the process (p. 35)." The citizens have a right to complain if they feel aggrieved. There are many citizens who normally complain not only for their benefit but to ensure that the public service is improved so that it can cater for the needs of the citizens and so that the same mistakes are not inflicted on others. However, there are instances when the complaints are not resolved by the said service provider. In such an instance when an individual feels that the complaint has not been fully addressed by the government agency, department or National Health Service (NHS) in England, then that individual has a right of asking for the complaint to be referred to the Parliamentary and Health Service Ombudsman (PHSO) or the individual can personally refer the matter to the PHSO. This paper seeks to discuss the single reform of the PHSO that would best serve the interests of administrative justice. An Ombudsman may be defined as an officer appointed to investigate citizen's complaints against injustice or maladministration by public officials. The concept of the Ombudsman is anchored on the idea that citizens have a right of complaining against specific actions of omission or commission by public officials. The Ombudsman therefore has investigative powers vested on him and which include investigating the internal workings of departments or entire organization. ... Get more on HelpWriting.net ...

Another regulatory agency is Ombudsman program that was authorized under the Older Americans Act and administered by the Federal Administration on Aging, the LTC ombudsman program began in 1972 as a trial program and now every state has upheld its cause.
