Family tradition and status , superstation, religious
superstation etc are the main resistance for the rural
social development.
19
What is Shalish ??
Shalish is a common judgement form of Bangladesh
and India. Mainly its a judgement system in rural
area. From the ancient time, it was known as the one
and only solution for the village people. In shalish,
the well-known or powerful leaders are give the
solution to the victim. At the time of Shalish, the
judges are give any solution within very short time.
20
Meaning of Shalish
The word “Shalish” came to an Arabic word “Salsa”
which means “three”. So the meaning of shalish is
“an umpire” or “an arbitrator”. That means the
medium person.
It’s a mutual system, when two persons are face their
internal problem and the 3rd man give a solution
with a conversation.
21
Nature of Shalish
Rural based :
Its a rural based judgement and absent in urban
area. The village people are not more consious and
not have interest to go to police. They are used to
submitted their problem at village panchayet.
Sudden solution:
Naturally, the villagers are soft minded. They
22
Continue...
always try to avoid any type of harassment. They
thought, police complain is very typical thing. And
for any problem, they prefer the shalish system. The
villagers get their solution within a very short time
and without any harassment.
Abuses of power:
Sometimes the village leaders are abuses their power.
23
Continue....
For this reason, sometimes innocent peoples are suffer
much.
Mutual understanding:
Village shalish is a easy way of mutual
understanding among the villagers. Only shalish can
establish their previous relationship.
24
Continue....
Shalish for little offence:
Usually, diminutive offence, family or any others
problem can solve by shalish. Even sometimes, some
critical matter will be solved in shalish.
25
Functions of shalish
The main aim of shalish is to compromise.
Though its a village related judgement system, its
main concern matter is village problems.
The use of law in shalish is not necessity. Because the
member of village shalish make their own law.
Verdict must be written with the witness, eye-
witness, evidence.
26
Continue....
 Usually white paper or public stamp in written is known
as “shalish nama”.
Sometimes some work , which is against the law may
occurs in shalish. Like : someone’s eye or hand will be
cut off.
There have some social punishment which present in the
system of shalish. Like: “cul kata”, “ak ghoray kora”
27
Continue....
Some physical punishment ,which are present in
shalish: “juta mara”, “betraghat” etc.
Sometimes the shalish show favour on the powerful
person and the judgement may published on their
wishes. Then the innocent person may got
punishment.
 Bribe, corruption can be influence rural shalish .
28
Continue....
Rural shalish can show the exact picture and true
information of the rural society.
In this system, there is a low chance to cheat the
village people. Because its always happened in a
public place.
No one can not avoid the punishment or the
judgement which was decided in the shalish.
29
Relation between village samaj and
shalish
All of our discussion, we already found some relation
between village samaj and shalish. We saw that, the
shalish system was directly related with village
samaj because it is a judgement system which only
applicable for the rural society. And the village
people are used to it from years to years. The village
samaj and shalish one can not stay without others.
30
Continue...
Village samaj consists of village people. On the other
hand, the shalish system is the solution of any
problem for the rural people.
Village samaj formed by the custom and the belief of
the villagers while on the other hand, shalish
maintained the village custom and belief.
People of village samaj must be obey the rules of the
31

their owns. On the other side, all man of the village
must be obey the rules of the shalish and the judges
