The spate of dengue deaths in the city prompted the Delhi high court to intervene
on Thursday and ask the civic agencies what steps have been taken to contain it.A
bench of Chief Justice G Rohini and Justice Jayant Nath directed the state
government to inform it of the steps taken to stop the disease even as it gave the
three corporations and NDMC time till September 24 to file a short affidavit.
However, the HC refused the other plea raised in a PIL seeking registration of an FIR
against directors of hospitals, which denied treatment to a seven-year-old boy who
died of dengue and whose parents subsequently committed suicide. The petition
was filed by law student Gauri Grover al leging that the boy died due to the callous
attitude of hospitals.
The court, however, asked the petitioner's counsel Satya Ranjan Swain to produce
additional documents showing the specific negligence on the part of hospitals. It
also took a dim view of the contents of the PIL, noting that it ran into just few pages
saying the petitioner should have researched more before filing the present PIL as
there were other writ petitions filed earlier in this regard.

Appearing for the state government, senior standing counsel Rahul Mehra
assured the court that government has taken immediate and strong steps to
treat dengue patients, including increasing the number of beds in private
hospitals.
The PIL claimed the suicide note left by the parents of the child “clearly
establishes that they were prompted to commit suicide due to the callous
attitude of hospital authorities, which led to death of their only son“.
“The act of the hospital authorities clearly falls under Section 306 (abetment
of suicide) of IPC,“ the petition said. It sought that the Centre and Delhi
government be directed to declare dengue an epidemic and issue directions
that no hospital will refuse to admit dengue patients.
