The Ethics of Whistle-Blowing: A Case Study of the NSA and Snowden
The right to privacy is an emotive aspect of public life across American society. The significance of the right gained added importance in the face of the government crackdown on terrorism. The so-called War on Terror that began in the aftermath of the September 11 terrorist attacks in the United States included government collection of massive information relating to its citizens and abroad. The global surveillance adopted by U.S security agents permeated the private sphere of American citizens raising a critical question on government overreach in the fight against terrorism. While the essence of privacy was not in question, the debate has often surrounded the ethics of collecting private data on millions of Americans without their knowledge. The 2013 global surveillance disclosures by Edward Snowden, a former employee of the NSA raised fundamental ethical questions on the role of whistle blowing and its implications for the whistle blower. Equally important is the conflicting view on the morality of Snowdenâs action given the security implications for disclosing such a large amount of information touching on the countryâs security. Although the United States Constitution does not expressly state the right to privacy, the Fourth Amendment alludes to this fact stating:
âThe right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized" [CITE]
Whistle blowing refers to the decision to call attention to misconduct within an organization by its current or former employee. The Government Accountability Project elaborates on the different ways an employee can whistle-blow. An employee may choose to report the wrong doing directly to state authorities. Alternatively, employees may report misconduct to a superior or refuse to participate in the unethical behavior. Snowden discovered that the Unites States government was actively engaged in activities that grossly violated ethical and legal provisions. The former employee decided to leak the massive information to the media creating unprecedented domestic and diplomatic crisis that threatened to injure the standing of the country in the international community. Although the U.S government termed the action of Snowden as an illegality and opened criminal proceedings against him, many have termed the act as appropriate because it reflected the interests of the public.

Introduction
Earlier in this class, you explored several misperceptions about the field of intelligence. Movies and popular literature, along with personal experiences, all contribute to these misunderstandings.
A final misperception about intelligence is that intelligence is only gathered on actors outside the borders of the United States. However, an unfortunate reality is that threats to the United States do not all originate from outside the nation. In fact, many threats to this country come from within its borders.
To guard against the full range of threats, the U.S. must engage in domestic intelligence activities and collect information and intelligence within the country.
However, unlike many countries around the world, the U.S. does not have a dedicated domestic intelligence agency and the many approaches to collection are unique. There is also a strict need to preserve the civil liberties of United States citizens and maintain a critical balance between intelligence transparency and secrecy.
Domestic Intelligence
The United States is very unique in that it does not have a dedicated agency responsible for domestic intelligence. Instead, this mission is part of the overall goal of the IC and is implicitly and explicitly stated in the mission and objectives of the Office of the Director of National Intelligence (ODNI).
As you learned in earlier lessons, ODNI was established by the Intelligence Reform and Terrorism Prevention Act of 2004. Within that act, very specific authorities were granted to the Director of National Intelligence (DNI) that directly support the gathering of domestic intelligence (ODNI 2015).

created huge storm to the Government and trust worthiness of citizens of
the country. Government and authorities even the President himself
appeared for an explanation to this incident. Even with much efforts
government has retrieved its falling name and trust of its citizens. As
subject of controversy Snowden is variously called as a âtraitorâ, âheroâ, a
whistleblower and even as âpatriotâ. For some he is a traitor who worked
for Dell broke the countryâs security code to retrieve classified information.
For some he is a hero who is courage's enough to pull those âblack loopsâ of
the government and Nations Security Intelligence.
His US Passport has been cancelled and he fled to Russia for granting
asylum. At present he is in Moscow with a temporary 1 year asylum.

19. OUR VIEW TOWARDS THE CASE STUDY
We like to be in favor of Act done by the Edward Snowden,
because the real victim of the issue wasnât Edward Snowden
himself but the general public, if such an crime isnât exposed
the public would be unaware of cyber crime or related
corporate crime they would be exploited. In other terms we like
to believe him as patriot than a traitor.
