What is an Geographical Indication?
❖ A sign that indicates that a product originates from a country, region or locality and
the desirable quality, reputation or other characteristics of the product essentially
depend on its place of origin
❖ A geographical indication (i.e. an appellation of origin) consists of the name of the
place of origin of the goods.
❖ GI and appellations of origin are often used for agricultural products such as wine,
cheese or olive oil.
❖ Under the Lisbon Agreement for the Protection of Appellations of Origin, member
States have registered other types of products, including craft products

Regulatory Framework
❖ Non-registration may result in the GI becoming Generic
❖ Filing at GIR located at Chennai
❖ On filing, the application is referred to a Consultative Expert Group ( CEG)
to ascertain the correctness of the claim of Uniqueness in the application
❖ If recommendation of CEG is favorable, the application is published in GI
Journal.
❖ GI Registration Certificate valid for 10 years; Renewable perpetually
❖ Unless GI is protected in the Home Country, no obligation to protect the same
outside India (TRIPS Art. 24.9)
❖ Trademarks can not be registered as GI

GI Registration
❖ Any association of persons, producers, organization established by or under the
law can apply for GI representing & protecting the interests of the producers
(called a Registered Proprietor of GI)
❖ Registration of a Geographical Indication is for a period of 10 years.
❖ Renewal is possible for further periods of 10 years each
❖ Assignment, Transmission, Licensing, Mortgage or such other action is prohibited,
since GI is a public property
❖ Infringement action can be taken by registered proprietor or registered user.
❖ Appeal against Registrar’s decision to Intellectual Property Appellate Board
(IPAB) established under the Trade Mark legislation.

❖ A trade mark is a sign which distinguishes goods or services of one enterprise
from those of other enterprises
❖ A Geographical Indication is used to identify goods having special characteristics
originating from a definite geographical territory
