CCI v SAIL: Supreme Court Gets it Right!
In a telling judgement, the Supreme Court of India, on Sep. 9, 2010, has effectively and judiciously
circumscribed the boundaries of exercise of power by both the Competition Commission of India
(CCI/Commission) and the Competition Appellate Tribunal ( the Tribunal ) while delivering its verdict
in the much awaited case Competition Commission of India v. Steel Authority of India Ltd. This Note
captures the highlights of the decision for readers of this Blog!
Background:
The Court was hearing an appeal by the CCI against the order dated Feb. 15, 2010 of the Tribunal in

If the Statute does not provide for an appeal, the Court cannot presume such right. The direction to
cause an investigation into a matter is passed under Section 26(1) of the Act does not determine any
right or obligation of the parties to the lis. It does not find mention in Section 53A(1) of the Act and
hence, the Court found that such orders would not be appealable under the Act.
Issue 2 and 5: The Court noted that the exclusion of principles of natural justice (PNJ) is a well known
concept and the legislature has the competence to enact such laws. Whether the exclusion of
application of PNJ would vitiate the entire proceedings would depend upon the nature and facts of
every case in the light of the Act or Rules and Regulation applicable to the case. The Court, then, read
into various provisions of the Act and the Competition Commission of India (General) Regulations,
2009 in order to determine the nature of functions of the Commission under various provisions. The
Court found that at the face of it, the exercise of power u/s. 26(1) of the Act while forming prima facie
opinion is inquisitorial and regulatory. It held that while forming prima facie opinion, the Commission
does not condemn anyone. This function is not adjudicatory in nature but merely administrative. This
function is in the nature of preparatory measures in contrast to the decision making process and hence

Key Nt Words Essay
Key NT Words,
Θύρα. It is generally accepted in the NT to mean door. It Appears twenty nine times in most forms
within the NT. Rev 4:1 is the only exact reference relating to a heavenly door being opened. However,
if we are to approach the text figuratively we find that there are two references to opening and shutting
in the heaven lower; Rev 4:25, Rev 11:6. Rev 19:11, John 1:51, Acts 10:11, Mark 1:10 seem to refer to
a general opening of heaven where God himself is revealed and reveals his actions of instruction,
judgement and redemption. Within Luke 13:24, 25; John 10:7, 9 Jesus attests that he is the door, the
door to the father. Thus Jesus can be seen to mediate the membership of the Messianic Community.

Christians of the first century in Asia Minor had knowledge in the OT, and would most likely have had
both Greek and Hebrew copies of the scriptures, due to the mixture of Jewish and Gentile groups
within the church.
Christians in the first century struggled primarily with three things. Firstly the influences of the
emperor cultus, secondly the the overwhelming and pervading cultures of the Greco Roman world,
and finally the disunity between some Jews and Christians.
Looking back at Isaiah 6 :1 5 and the vision of the throne room of God, the Christians of the first
century world would have found it easy to negate or refute the false tenets of the emperor cult, due to
the fact that the God of majesty that John describes dwarfs that of the emperor. John reveals to the first
century community that God is awesome, he is righteous, and most of all he is in control. Due to the
concept of overcoming throughout Revelation Ch. 2 5, Christ has overcome, and therefore the
Christian found in Christ can have assurance that his robe and crown is secured in

The Most Common Ways People Identify Themselves
Race is one of the most common ways people identify themselves. There are different advantages and
disadvantages associated with different races. People are often judged on how they look and act. Some
people benefit more than others just based on race. Others can be put at a disadvantage because of
their sexual orientation. The family you are born into can have a major impact on how you are seen
and what type of privileges and struggles you will face in life. Looking at my life specifically, I will
reflect on how the culture, including race and gender, from the past and present can influence people s
lives in general and in education. My mom s side of the family arrived in the United States in the late
1800 s. Both of my grandmother and grandfather s families came to the United States voluntarily. My
grandmother s family came from England. Her grandfather, who came from an affluent family, first
arrived in Ellis Island, New York, but later settled in the Maryland Eastern Shore. Similarly, my
grandfather s family settled in the Maryland Eastern Shore after coming from Czech Republic.
Though they came voluntarily, they feared the Russians taking over their country so decided to leave.
On each side of the family, farming was the main type of work they engaged in. Both sides started
attending school in the early 1900 s. At this time it was only common to attend school for a few years
because staying at home to attend the farm was more of priority than formal schooling. My

sign as it indicates that the company is profitable and is using it s capital efficiently. Inventory
turnover ratio is has decreased, which shows that the inventory is being sold at a slower pace. This can
be attributed to the declining sales. Inventory turnover ratio has decreased a little. Fixed asset turnover
ratio has gone up from 1.31 to 1.42. This indicates that RMW is generating more revenue from it s
fixed assets, which is a good thing. ROA and ROE has increased over the past 4 years. This is again a
good sign. ROE has increased more in comparison to ROA, this indicates that the company has taken

Dynamic Research Design
In designing an experiment, one must be able to control as many variables as possible so the results
can be interpreted as significant in knowing that no outside errors could occur. This basic component
of experimental design allows for one to manipulate variables to achieve the desired outcome. A good
scientist keeps this inquisitiveness in order to advance themselves in the project they are working on
and the next experiment. The dynamic that exists between a researcher and their project is lead by
intuition and persistence. This constant effort is made to get an experiment to, hopefully, demonstrate
some phenomena. I have exercised all of the above qualities in many different research experiences.

Such a deficit of protein can disturb numerous mitochondrial pathways, such as membrane potential

oxidative phosphorylation, defense against reactive oxygen species, and mitochondrial DNA repair.
The most significant decrease in abundance are Succinate Dehydrogenase Complex, Subunit A

acid cycle and oxidative phosphorylation pathways. TUFM participates in protein translation. These
deficits could interfere with mitochondrial ATP production and may increased oxidative damage of

Analysis Of The Dinner Table By Judy Chicago
The Dinner Table (1974 1979) by Judy Chicago
1a. While viewing this piece of work, the emotions I feel are powerful and pride. I feel powerful
because I am a woman and here s this piece of art celebrating and embracing all the women who made
a difference and pathed a way for every other woman in this world. When I look at those work of art I
feel as if I can do anything I set my mind too. Many of the women printed on the art didn t have is
easy. They work hard for all their accomplishments and didn t let the men in this world intimidate
them to stop just because they are women. I feel pride because this piece makes me feel happy to be a
woman and that I am special because of that.
1b. The goal of The Dinner Party was to introduce women s heritage and the role they played in
throughout history. Mostly the history of women in Western civilization. Also, the goal was to show
the importance of women in this world. Many things wouldn t be if it weren t for women. At the time
this piece was made, the women s right movement was just beginning, so I believe this was made to
encourage equal rights for women.
1c. Judy Chicago chose to use the form of a triangle because it s the earliest signs for women, an
ancient symbol for the goddess, and the three equal sides represents the equalized world woman try to

Article Info ABSTRACT
Subspace model identification (SMI) method is the effective method in identifying dynamic state
space linear multivariable systems. Subspace identification, a sequence of state vectors can be
obtained directly from the input and output data. From a numerical point of view, the SMI algorithms
are not appropriate for online implementation because of the SVD computational complexity. For
industrial applications, it is essential to have online recursive algorithms for model identification,
where parameters can vary in time. Indeed, in many online identification scenarios, it is important to
update the model as time goes on with a reduced computational cost. The main problem with recursive
subspace identification is the SVD computation that is burdensome to update. Thus, it is necessary to
find the alternative algorithms in order to apply the subspace concept in a recursive framework. In this
paper, recursive subspace identification algorithm based on the propagator method which avoid the
SVD computation is proposed.

Problems Faced By The Asian City Of Beijing
Conflicts in Measuring Progress
The intention to step after the Western growth model can lead the Asian cities to the crisis (Heather,
2012). However, recently, China and India have managed to ensure the economic progress and
significant living standards improvements for their economically unstable social groups of the
population. At the same time, the Asian Development Bank (ADB) pointed out the rising inequality
which can soon undermine the very basis of these countries economies success (Heather, 2012).
Furthermore, according to the ADB, the gap between the poor and rich has not been reduced (Heather,
2012). This gap has increased and keeps rolling up. The closer analysis of the problem of poverty in
the city of Beijing gives the solid reason to claim that the Western model of economic development
should not be applied as such to the Asian context.
Beijing is one of the largest cities of China characterized with a wide gap between the rich and the
poor. According to the Chinese latest five year plan, the current purpose pursued by the government is
to ensure a more equitable economic growth at a slower pace as the strategy to narrow this gap. The
difference between the poor and rich should be narrowed in terms not only of the social and political
necessity but also with regard to the economic aspect. The growing income gap may ultimately have
the political consequences for the country. For instance, Beijing is the home for hundreds of thousands
of poor rural people

Summary Of Ernest Hemingway s A Moveable Feast
Life stories are immensely important because they allow us to see different perspectives, and to
understand in more depth the subject and society. These stories enable us to gain more knowledge and
to understand the perspective and values a certain person had, or still has. A great example of this is
Ernest Hemingway s memoir, A Moveable Feast. This memoir allows us to understand Hemingway in
more depth in his younger years, and helps us understand how he wrote and why he wrote. Life stories
Ernest Hemingway is regarded as one of the best American authors of all time. This memoir focusses
on his early career, and his time in Paris. It flows in chronological order, and covers his months in
Paris. Throughout the novel, we meet many notable people such as; F. Scott Fitzgerald, Zelda
Fitzgerald, Gertrude Stein and James Joyce. This allows the reader to appreciate the background of
these authors, and recognize what has influenced them within their novels. Hemingway has said many
times that this period in his life affected him, and influenced his future decisions in life. This
demonstrates why we should read life stories, as they can provide insight into the subject.
A memoir is structurally different than an autobiography or biography as it only covers a brief period
in the subject s life, while a biography usually covers the subject s entire life. It focusses on the brief
period when Hemingway and his wife Hadley lived in Paris. They are chronological, and conclude

8th Grade Singing
Hello,
There are quite a few pedagogical reasons why Rachel and I have decided to combine both choirs.
Below are just a few. My 8th grade boys were having a hard time singing do to voice changes. I tried
to keep the boys up in their falsetto and while this worked for a few boys the others we not able to
produce certain notes. When boys voices start to change it can result in them only being able to sing a
very limited amount of notes. We worked on high trills, sliding, humming, yawning, held long tones,
among many of other to help support their changing voices. After our first concert I talked with my
boys and they had mentioned that they felt very discouraged about singing because some of them
simply are not producing notes or can only sing in a low rumble. Rachel mentioned to me that her
boys were just starting to transition and she was noticing large gaps in her group as well. Combining
both groups would result in a higher confidence level, tone production, and create a full choir sound.
This is one of the reasons why we combined the groups. ... Show more content on Helpwriting.net ...

STATEMENT OF PURPOSE: To prove that the United States should withdraw from the United
Nations
The time has come to recognize the U.N. for the anti American, anti freedom organization that it has

U.N. to find a headquarters location outside the United States that is more in keeping with the
philosophy of the majority of voting members, someplace like Moscow or Peking (Rousos, par. 30).
Those are the words of Barry Goldwater, the late 1964 presidential candidate and Republican Senator
from Arizona, calling for US withdrawal from the United Nations, and these concerns are as valid
today as they were almost four decades ago, if not more so. Since its inception, the United Nation s

Global Warming And Its Impact On The Contemporary World
Global warming has been deteriorating, and criticised by the entire world environmental organisations
throughout the contemporary world. This phenomenon is mainly associated be human made pollutions
and wastes emitted through the global industrialisation. Out of this global issue, modern architects has
started to design architectures which included the concern of sustainability. Sustainable architecture
can be divided in three different core parts: sustainable materials, sustainable construction and
sustainable technologies. Moreover, sustainable architectural materials will be the aim in this report
due to the reasons that exploring various types of sustainable architectural materials and how
architects had applied those materials on the architecture design are always a popular topic, also
materials would be an important section that people could be easily understood and noticed in their
daily life. Furthermore, the research will be tended to focus on researching new kind of sustainable
materials in the contemporary architectural world based in some article and books written by the
architectural professionals, and seek for innovate sustainable materials that might have not been in
common used for architecture. The research on this project aims to examine sustainability in
architectural aspect, also, the advantage that sustainable architecture has been made in modern
architecture.

Emergency Room Fees For Non Emergent Cases
Emergency Room Fees for Non Emergent Cases
Description of Problem
The Emergency Department (ED) is the highest cost environment to receive non emergent care. The
public views the ED as a safety net; more and more people are seeking treatment in the ED for non
urgent problems. This circumstance not only exacerbates overcrowding, it diverts attention from
critically ill or injured patients and can diminish the quality of their treatment. Overcrowding in the
ED is a problem that leads to delays in treatment and poor health outcomes (Hutchinson, 2015). ED
overcrowding historically has been a problem seen most often in inner city academic hospitals, but the
issue is now a crisis in both urban and rural settings. Such use of expensive ... Show more content on

People would receive treatment in non hospital settings such as physician offices, outpatient clinics,
urgent care centers, etc. Individuals continue to delay treatment or to seek care in the ER, both of
which ultimately increase the cost of caring for such individuals. Contrary to the perception that the
uninsured account for a disproportionate amount of the increase in ED use, most of the increase in
visits is due to increased use by insured people, specifically the privately insured (Center for Studying
Health System Change, 2004). A study, conducted in 2006, revealed that over 40% of the payer
distribution in the ED were by private insurance (Gooch, 2010). Consequently, hospital systems suffer
financially in part because of millions of dollars in ED bills left unpaid.
To decrease inappropriate ED use, patients who arrive at the ED and do not need emergency care, and
are considered non emergent patients upon initial triage, should be given the option of seeking
treatment in a less costly setting, such as the nearby urgent care center, or paying $150 before they are
treated in the ED. Pregnant women, children under five, and persons over the age of 64 would be
excluded from the up front fee policy.

The Greatest Nation
America is well known for being the land of opportunities, the land of freedom, land of diversity, and
overall, the land of success. However, the title of being The Greatest Nation didn t come to America so
easily. It surely is a challenge to make of the United States of America the ideal nation that Thomas
Jefferson envisioned. For this reason, the constitution emphasizes the guidelines that one must follow
in order to be an ideal American. In the Bill of Rights, James Madison remarks the 10 basic
amendments that America needs to follow in order to maintain its values. To be an ideal American,
one must understand the vision of the founding fathers. It is understandable to conclude that The Bill

Women In The 1940s
The position of women throughout American society changed vastly throughout 1940 1975. The
1940s saw women change from predominant homemakers to working woman to support the war
effort. However, the 1950s forced women back inside the kitchen by using mass media and
propaganda to make them believe they were inferior to men. The portrayal of women in the fifties
gave women the idea that they could do nothing more than be wives and mothers. Although the idea of
feminism was pretty much non existent in the 1950s, women still had a feeling they were supposed to
do something more with their lives than be housewives. By the time the sixties rolled around, women
were convinced they needed to fight for their rights. The second wave of feminism was ... Show more

While fighting for civil rights in organizations such as the SNCC, women found themselves stuck in
jobs that focused on typing, cooking, and cleaning for the male members.2 The irony of fighting for
rights for people, while not getting any themselves really infuriated women, thus igniting the fuse of
the feminist movement bomb. The most prominent event that blew up the feminist revolution bomb of
the sixties was the publication of Betty Friedan s The Feminine Mystique. Friedan s book discussed
how the happy image of the 1950s American housewife was a sham and how suburban life was just a
comfortable concentration camp 3 for women. She also touched on the idea that when women felt
unhappy with their lives they blamed it on themselves or their marriage. Many suburban housewives
who felt discontent thought they were alone and were ashamed of their feelings. However, they were
wrong. In the first chapter of her book, Friedan discusses an incident she had overheard between a
group of suburban housewives in which they discussed the problem that had no name , a problem that
they all shared.4 This nameless problem was a feeling of unhappiness in their daily housewife duties.
Women were no longer happy with just picking up the kids from school and making dinner. Friedan

Essay about Development of the Colorado River
Prior to settlement of the western United States, the Colorado River roamed free. Starting from cool
mountain streams, the river eventually became a thunderous, silty force of nature as it entered the
canyons along its path. The river nourished wetlands and other riparian habitats from the headwaters
in the Rocky Mountains to the delta at the Sea of Cortez in Northwest Mexico. Settlers along the river
harnessed these waters mainly for agriculture via irrigation canals, but flooding from spring runoff
wreaked havoc on agricultural land, prevented development in the floodplain and full utilization of the
water, a waste in the eyes of western farmers. In order to meet current and future water demands in the
west, the Federal Government ... Show more content on Helpwriting.net ...
With human development, industrial pollution and other factors all contribute to the deteriorated
condition of the river, which makes it difficult to determine the dams environmental impact in
isolation. CITE That said, the current operations of the dam hamper and potentially prevent
environmental improvement of the Colorado. In order to preserve some semblance of the Colorado
ecosystem, man must restore the natural processes that created the ecosystem. The real question is
how to do that, whether via dam decommission or a less extreme policy change.
Even though the dams provide immense water storage at a cost of the Colorado River ecosystem, the
thirst of the southwest continues to increase. Conservation will help to slow the thirst, but the ever
increasing demanded requires more water in the system. The three fastest growing US states (Nevada,
Arizona and Utah) are located within the Colorado River basin and all seven states within the basin
outpace the national average. Four of the ten fastest growing metro areas: St. George and Provo in
Utah, Las Vegas in Nevada and Greenly in Colorado. Unfortunately for this growth, the demand far
exceeds the available supply. The Bureau of Reclamation completed the last major dam (Glen
Canyon) in 1966. The Bureau built several smaller dams, along with Glen Canyon, under the auspices
of the Colorado River Storage Project

Design Aspects Of The Composite Replacing Metal Parts
Introduction: Since the first aircraft was developed for flight, people have had a goal to improve the
aircraft s physical applications and production of the aircraft more profitable. These changes made
aircraft lighter and have increase flight ranges for aircraft for useful for people. In aircraft
modification in today s world is making another major leap in attempting to replace metal structures
on aircraft. The reasons for the changes are due to production cost, to create a lighter aircraft, to
increase load capabilities, and aim to prevent fatigue and corrosion damage. New structures are being
developed to replace metal parts happen to be composite parts. Composite (ex: CTRP) parts are able
to meet the standards required to replace ... Show more content on Helpwriting.net ...
The benefits of composite over metal structures are making composites the best option. Certain
benefits can lower production costs; material is improved from morphing of aircraft structures,
corrosion does not happen in composites which lead to longer lifetime, the overall production cost of
the aircraft becomes lower due to the aircraft being lighter and increases lift for the improved
performance out of the aircraft. Research like this tends to have positive effects on different
commercial products such as cars and houses. A question that comes up why hasn t composites been
utilize earlier , the answer is technology has finally been able to make composites at affordable prices
and the knowledge of materials has increased to a point where it could be applied properly.
Composites materials are still in early stages of development, but are being applied in aircraft
currently to learn more how they function. As the understanding improves of composites, the
application of materials is increased in aircraft structures. The objectives are to understand how
aircraft structures are changing from metal to composite parts. This is caused by latest technology and
new requirements from aircraft users. With new capabilities in materials, composites in aircraft
structures remain still in the beginning stages however over time composite structure will be
developed for additional purposes. Literature Review: The Composite Structures have been around

How Rainfall Affects Stalactites
DESCRIPTION OF DATA This is a column graph representing how the rainfall affects the stalactites
length. One of many reasons that show stalactites are going to fall apart is their length. The colour
yellow represents the stalactites length at the start of the year. The colour orange represents the
stalactites length after 6 months. This will include its rainfall activity. This is an example of secondary
data which I obtained from the Princess Margaret Rose Cave website. I chose this secondary data as I
would not have the time to collect and find the right lengths of the stalactites and this data really
reflects on the rainfalls effect on the stalactites formation. This data supports my key inquiry question

Rose Cave has done a lot of interviews in the past years, most concentrating on the stalactites
formation and why it fell. It is a reliable source as they do answer truthfully and they have had
experience in answering questions. Princess Margaret Rose Cave knows a lot of information about its
location and stalactites. As they are an organisation I believe and many others believe that Princess

understanding which means it does not allow for emotion, personal attitudes or opinions. This
interview truly helped me with my key inquiry question. Analysis PQE (Pattern, Quantify and

because of the rock, limestone. The pattern is clear throughout all answers and shows how rainfall

of cancer cells by restoring the function of the sodium iodine symporter (NIS), and thus, they may
restore the iodine uptake by the refractory TCs
[30]. Vorinostat, a small molecule inhibitor of HDAC, has been studied in small phase I and II trials in
patients with refractory DTCs; however, the results were clinically disappointing as the RR was 0, 56
% of patients had stable disease for only 6 months, and TG did not correlate with tumor response. Its

17 % of cases [37]. But it is not clear if this redifferentiation of the tumor will improve the outcome
for patients with refractory TCs.
Lithium
The effect of RAI with lithium carbonate was studied in 12 patients with metastatic DTC. Despite an
increased uptake of RAI in seven patients, no beneficial effect of RAI with lithium was observed on
the clinical course as assessed by
TG measurements and radiographically [38].
Thalidomide
Thalidomide and its derivative lenalidomide were studied in progressive MTC and DTC but without

Summary Of Terry Repak s Waiting On Washington
Introduction Waiting on Washington, by Terry Repak, is a compelling study that focuses on Central
American immigrants and their pilgrimage to the United States. A central theme is to determine
whether structural theory or assimilation theory best describes the labor market incorporation of
international migrant workers in the United States. Repak researches various traits of these immigrant
groups, predominantly gender, and uncovers the social, economic and political context that set the
stage for this migration. She focuses on the impact of gender differences in the labor market, the
effects of immigration laws, and the adjustments in gender roles and identities that accompanied this
movement. Rather than solely focusing on how these immigrants were pushed and pulled out of
Central America and into the United States, Repak takes into account the ways in which gender both
shapes and constrains the migrant s decisions. Central American women were the dominant gender
traveling and settling into the Washington area in the 1980 s. Yet the research suggests that structural
factors in the Washington, D.C. area economy pose obstacles to women s vocational success and place
them at a disadvantage in ... Show more content on Helpwriting.net ...
The first is gender factors are the preeminent contributor in the immigration labor market
incorporation. Gender factors render structural and personal characteristics inadequate as explanations
for the performance of Central American immigrants in Washington s labor market (Repak 1995, 185).
The second argument is the Immigration Reform Control Act of 1986 generated more shortcomings
for Central American workers and employers. It has done little to deter immigrants from entering the
United States or from returning once they are deported. Lastly, the third argument sets forth that the
process of immigration developed dramatic changes in gender roles especially in the female

The Great Influenza By John Barry Analysis
Determined journalists, travelers, and people of other professions believe in exploring the natural
world, conducting research, and performing experimental errors. Scientists, especially, will often
embrace their passions with certainty that they will discover something worthwhile, ignoring the
challenges they may come across. In The Great Influenza by John M. Barry, he describes these
scientists with the utmost respect. Barry characterizes scientific research as a devoted activity where it
is crucial to embrace uncertainty in order to yield solutions; this outlook is seen through his subtle
figurative language, specifically, allusions along with the direct characterization of the qualities that
successful scientists must hold, and comparisons.

You don t need to meet your clients face to face. Everything can be done by mail, fax, or email. The
occasional trip to the records department in your local courthouse is your only venture outdoors. You
do not need any type of license to do this type of work. What exactly is JUDICIAL JUDGMENT
RECOVERY? First let s call it JJR for short. Then let s break it down one word at a time. 2
A) JUDICIAL means (in this case) a legal court of law . B) JUDGMENT means the determination
of the court , a legal obligation as determined by the judge. C) RECOVERY means the act of
becoming lost). If you know what a court order is then you already have a good idea. A court order is
pretty much a judicial judgment in that they both mean, in essence, As Ordered By The Court . So
what does it mean to us? It means that when one person (the plaintiff), sues another person (the
defendant), in small claims court, and wins, it s because the court ordered the defendant, now known
as the judgment debtor, to pay the plaintiff, usually, a said dollar amount. So now the plaintiff is
awarded a piece of paper proclaiming them a judgment winner. But are they really the winner? The
easy part was winning the case. Now comes the difficult part, and that is getting the judgment debtor
to actually pay up. You see, the court cannot collect the money for the judgment winners. It is actually
up to the judgment winners to collect their own judgments. But with no pressure to

  • 2. Essay On Competition Act Competition act case MONDAY, 13 SEPTEMBER 2010 CCI v SAIL: Supreme Court Gets it Right! In a telling judgement, the Supreme Court of India, on Sep. 9, 2010, has effectively and judiciously circumscribed the boundaries of exercise of power by both the Competition Commission of India (CCI/Commission) and the Competition Appellate Tribunal ( the Tribunal ) while delivering its verdict in the much awaited case Competition Commission of India v. Steel Authority of India Ltd. This Note captures the highlights of the decision for readers of this Blog! Background: The Court was hearing an appeal by the CCI against the order dated Feb. 15, 2010 of the Tribunal in Steel Authority of India Ltd. v. Jindal Steel amp; Power Ltd. Jindal Steel had ... Show more content on Helpwriting.net ... If the Statute does not provide for an appeal, the Court cannot presume such right. The direction to cause an investigation into a matter is passed under Section 26(1) of the Act does not determine any right or obligation of the parties to the lis. It does not find mention in Section 53A(1) of the Act and hence, the Court found that such orders would not be appealable under the Act. Issue 2 and 5: The Court noted that the exclusion of principles of natural justice (PNJ) is a well known concept and the legislature has the competence to enact such laws. Whether the exclusion of application of PNJ would vitiate the entire proceedings would depend upon the nature and facts of every case in the light of the Act or Rules and Regulation applicable to the case. The Court, then, read into various provisions of the Act and the Competition Commission of India (General) Regulations, 2009 in order to determine the nature of functions of the Commission under various provisions. The Court found that at the face of it, the exercise of power u/s. 26(1) of the Act while forming prima facie opinion is inquisitorial and regulatory. It held that while forming prima facie opinion, the Commission does not condemn anyone. This function is not adjudicatory in nature but merely administrative. Rev 4:1 is the only exact reference relating to a heavenly door being opened. However, if we are to approach the text figuratively we find that there are two references to opening and shutting in the heaven lower; Rev 4:25, Rev 11:6. Rev 19:11, John 1:51, Acts 10:11, Mark 1:10 seem to refer to a general opening of heaven where God himself is revealed and reveals his actions of instruction, judgement and redemption. Within Luke 13:24, 25; John 10:7, 9 Jesus attests that he is the door, the door to the father. Thus Jesus can be seen to mediate the membership of the Messianic Community. Θρόνος. Appears sixty ... Christians of the first century in Asia Minor had knowledge in the OT, and would most likely have had both Greek and Hebrew copies of the scriptures, due to the mixture of Jewish and Gentile groups within the church. Christians in the first century struggled primarily with three things. Firstly the influences of the emperor cultus, secondly the the overwhelming and pervading cultures of the Greco Roman world, and finally the disunity between some Jews and Christians. Looking back at Isaiah 6 :1 5 and the vision of the throne room of God, the Christians of the first century world would have found it easy to negate or refute the false tenets of the emperor cult, due to the fact that the God of majesty that John describes dwarfs that of the emperor. John reveals to the first century community that God is awesome, he is righteous, and most of all he is in control. Due to the concept of overcoming throughout Revelation Ch. 2 5, Christ has overcome, and therefore the Christian found in Christ can have assurance that his robe and crown is secured in ... • 4. The Most Common Ways People Identify Themselves Race is one of the most common ways people identify themselves. There are different advantages and disadvantages associated with different races. People are often judged on how they look and act. Some people benefit more than others just based on race. Others can be put at a disadvantage because of their sexual orientation. The family you are born into can have a major impact on how you are seen and what type of privileges and struggles you will face in life. Looking at my life specifically, I will reflect on how the culture, including race and gender, from the past and present can influence people s lives in general and in education. My mom s side of the family arrived in the United States in the late 1800 s. Both of my grandmother and grandfather s families came to the United States voluntarily. My grandmother s family came from England. Her grandfather, who came from an affluent family, first arrived in Ellis Island, New York, but later settled in the Maryland Eastern Shore. Similarly, my grandfather s family settled in the Maryland Eastern Shore after coming from Czech Republic. Though they came voluntarily, they feared the Russians taking over their country so decided to leave. On each side of the family, farming was the main type of work they engaged in. Both sides started attending school in the early 1900 s. At this time it was only common to attend school for a few years because staying at home to attend the farm was more of priority than formal schooling. My ... Get more on HelpWriting.net ...

Recursive Subspace Identification Algorithm using the Propagator Based Method Irma Wani Jamaludin1 and Norhaliza Abdul Wahab2 1Department of Mechatronics, Universiti Teknikal Malaysia Melaka, Hang Tuah Jaya, 76100 Durian Tunggal, Melaka, Malaysia 2Control Mechatronics Engineering, Faculty of Electrical Engineering, Universiti Teknologi Malaysia, 81310 Skudai Johor Bahru, Malaysia Article Info ABSTRACT Subspace model identification (SMI) method is the effective method in identifying dynamic state space linear multivariable systems. Subspace identification, a sequence of state vectors can be obtained directly from the input and output data. From a numerical point of view, the SMI algorithms are not appropriate for online implementation because of the SVD computational complexity. For industrial applications, it is essential to have online recursive algorithms for model identification, where parameters can vary in time. Indeed, in many online identification scenarios, it is important to update the model as time goes on with a reduced computational cost. The main problem with recursive subspace identification is the SVD computation that is burdensome to update. Thus, it is necessary to find the alternative algorithms in order to apply the subspace concept in a recursive framework. In this paper, recursive subspace identification algorithm based on the propagator method which avoid the SVD computation is proposed. Keyword: Subspace identification Observability ... • 12. Problems Faced By The Asian City Of Beijing Conflicts in Measuring Progress The intention to step after the Western growth model can lead the Asian cities to the crisis (Heather, 2012). However, recently, China and India have managed to ensure the economic progress and significant living standards improvements for their economically unstable social groups of the population. At the same time, the Asian Development Bank (ADB) pointed out the rising inequality which can soon undermine the very basis of these countries economies success (Heather, 2012). Furthermore, according to the ADB, the gap between the poor and rich has not been reduced (Heather, 2012). This gap has increased and keeps rolling up. The closer analysis of the problem of poverty in the city of Beijing gives the solid reason to claim that the Western model of economic development should not be applied as such to the Asian context. Beijing is one of the largest cities of China characterized with a wide gap between the rich and the poor. According to the Chinese latest five year plan, the current purpose pursued by the government is to ensure a more equitable economic growth at a slower pace as the strategy to narrow this gap. The difference between the poor and rich should be narrowed in terms not only of the social and political necessity but also with regard to the economic aspect. The growing income gap may ultimately have the political consequences for the country. For instance, Beijing is the home for hundreds of thousands of poor rural people ... Summary Of Ernest Hemingway s A Moveable Feast Life stories are immensely important because they allow us to see different perspectives, and to understand in more depth the subject and society. These stories enable us to gain more knowledge and to understand the perspective and values a certain person had, or still has. A great example of this is Ernest Hemingway s memoir, A Moveable Feast. This memoir allows us to understand Hemingway in more depth in his younger years, and helps us understand how he wrote and why he wrote. Life stories Ernest Hemingway is regarded as one of the best American authors of all time. This memoir focusses on his early career, and his time in Paris. It flows in chronological order, and covers his months in Paris. Throughout the novel, we meet many notable people such as; F. Scott Fitzgerald, Zelda Fitzgerald, Gertrude Stein and James Joyce. This allows the reader to appreciate the background of these authors, and recognize what has influenced them within their novels. Hemingway has said many times that this period in his life affected him, and influenced his future decisions in life. This demonstrates why we should read life stories, as they can provide insight into the subject. A memoir is structurally different than an autobiography or biography as it only covers a brief period in the subject s life, while a biography usually covers the subject s entire life. It focusses on the brief period when Hemingway and his wife Hadley lived in Paris. They are chronological, and conclude with There ... Get more on HelpWriting.net ...
  • 15. 8th Grade Singing Hello, There are quite a few pedagogical reasons why Rachel and I have decided to combine both choirs. Below are just a few. My 8th grade boys were having a hard time singing do to voice changes. I tried to keep the boys up in their falsetto and while this worked for a few boys the others we not able to produce certain notes. When boys voices start to change it can result in them only being able to sing a very limited amount of notes. We worked on high trills, sliding, humming, yawning, held long tones, among many of other to help support their changing voices. After our first concert I talked with my boys and they had mentioned that they felt very discouraged about singing because some of them simply are not producing notes or can only sing in a low rumble. Rachel mentioned to me that her boys were just starting to transition and she was noticing large gaps in her group as well. Combining both groups would result in a higher confidence level, tone production, and create a full choir sound. This is one of the reasons why we combined the groups. ... Emergency Room Fees For Non Emergent Cases Emergency Room Fees for Non Emergent Cases Description of Problem The Emergency Department (ED) is the highest cost environment to receive non emergent care. The public views the ED as a safety net; more and more people are seeking treatment in the ED for non urgent problems. This circumstance not only exacerbates overcrowding, it diverts attention from critically ill or injured patients and can diminish the quality of their treatment. Overcrowding in the ED is a problem that leads to delays in treatment and poor health outcomes (Hutchinson, 2015). ED overcrowding historically has been a problem seen most often in inner city academic hospitals, but the issue is now a crisis in both urban and rural settings. Such use of expensive ... People would receive treatment in non hospital settings such as physician offices, outpatient clinics, urgent care centers, etc. Individuals continue to delay treatment or to seek care in the ER, both of which ultimately increase the cost of caring for such individuals. Contrary to the perception that the uninsured account for a disproportionate amount of the increase in ED use, most of the increase in visits is due to increased use by insured people, specifically the privately insured (Center for Studying Health System Change, 2004). A study, conducted in 2006, revealed that over 40% of the payer distribution in the ED were by private insurance (Gooch, 2010). Consequently, hospital systems suffer financially in part because of millions of dollars in ED bills left unpaid. To decrease inappropriate ED use, patients who arrive at the ED and do not need emergency care, and are considered non emergent patients upon initial triage, should be given the option of seeking treatment in a less costly setting, such as the nearby urgent care center, or paying $150 before they are treated in the ED. Pregnant women, children under five, and persons over the age of 64 would be excluded from the up front fee policy. The Debate Proponents ... Get more on HelpWriting.net ...

Summary Of Terry Repak s Waiting On Washington Introduction Waiting on Washington, by Terry Repak, is a compelling study that focuses on Central American immigrants and their pilgrimage to the United States. A central theme is to determine whether structural theory or assimilation theory best describes the labor market incorporation of international migrant workers in the United States. Repak researches various traits of these immigrant groups, predominantly gender, and uncovers the social, economic and political context that set the stage for this migration. She focuses on the impact of gender differences in the labor market, the effects of immigration laws, and the adjustments in gender roles and identities that accompanied this movement. Rather than solely focusing on how these immigrants were pushed and pulled out of Central America and into the United States, Repak takes into account the ways in which gender both shapes and constrains the migrant s decisions. B) JUDGMENT means the determination of the court , a legal obligation as determined by the judge. C) RECOVERY means the act of becoming lost). If you know what a court order is then you already have a good idea. A court order is pretty much a judicial judgment in that they both mean, in essence, As Ordered By The Court . So what does it mean to us? It means that when one person (the plaintiff), sues another person (the defendant), in small claims court, and wins, it s because the court ordered the defendant, now known as the judgment debtor, to pay the plaintiff, usually, a said dollar amount. So now the plaintiff is awarded a piece of paper proclaiming them a judgment winner. But are they really the winner? The easy part was winning the case. Now comes the difficult part, and that is getting the judgment debtor to actually pay up. You see, the court cannot collect the money for the judgment winners.
