3. E-Commerce
Electronic commerce is an emerging
concept that describes the process of
buying and selling or exchanging of
products, services and information via
telecommunication and computer networks
including the internet.

4. E-Commerce Law
1) Data Protection Law
• This law is just for processing of personal data .
• It restricts data controllers by making them to
specify a purpose for which the data is collected.
2) Consumer Protection Law
• The main purpose is to promote the growth of e-
commerce by provision of secure e-commerce
environment resulting in greater confidence

fairly conducted.
• This law does not cover mail order brokers
serving like middle men .
• In this law, e-commerce sellers can purchase
consumer damage insurance for the protection
of their customers.

6. 3) Money Transfer Law
• The terms and conditions of money transfer
involving a consumer’s account shall be
disclosed at the time the consumers contracts
for an electronic fund transfer service.
• According to this law, the contract should include
the type and nature of money transfer .

7. Legal requirement areas in e-
commerce are-
1) Electronic data interchange(EDI)
• Electronic way of transferring business
documents internally between various
department or externally with supplier
customers etc.
• In EDI, paper documents are replaced with
electronic documents like word documents,
spreadsheets etc.

8. 2)Confidentiality
Non-disclosure agreements and confidentiality
agreements are also required to ensure
confidentiality of discussions regarding
commercially sensitive information with intern
partners, affiliates advisors and suppliers of
software and hardware.

9. 3)Electronic contracts
Even electronic contracts, just like paper based
contractual agreements, must contain the
elements of an offer, an acceptance and a
consideration, along with mentioning of the
governing laws.

10. 4) Copyright
Copyright applies to everything published on the
rights apply to internet business models, website
designs, site navigation tools, ordering systems
and domain names. So you can’t just copy an
interesting website and add in your own products
and services.

11. Forms Of Agreements
Different types of agreements are as follows:
Trading Partner Agreements
• Trading Partner Agreement are agreements between
two or more parties who wish to trade electronically.
• Such trading are accomplished using EDI, but now it
include other e-commerce method for open systems
such as internet.

12. Value Added Network(VAN) Agreements
• VAN is private network provider .
• Company’s hired it to facilitate EDI or provide other
network services such as message encryption,
secure email and management reporting.
• VAN simplifies the communications process by
reducing the number of parties with which a
company needs to communicate.

13. • VANs may be operated by large companies for
efficient supply chain management .
Payments agreements
• It enables or enhance the certainity of success in
making payments electronically.
• Payment agreement takes various forms-
1)Financial EDI agreements
2)Credit Card and Internet payment service provider
agreements
3)Electronic fund transfer agreements

14. E-Commerce law in India
The parliament of India passed its cyberlaw in form of
Information Technology Act,2000 .
The Act received assent of President of India and
became law of land on 17 October 2000.
The objective of this act is to provide legal recognition
for transactions carried out by mean of EDI.
Hacking and penalties if found guilty have been
defined in Section 66. For the 1st time punishment for
hacking has been designated as cyber crime.
