A circular economy is fundamentally different from a linear economy. To put it simply, in a
linear economy we mine raw materials that we process into a product that is thrown away
after use. In a circular economy, we close the cycles of all these raw materials. Closing
these cycles requires much more than just recycling. It changes the way in which value is
created and preserved, how production is made more sustainable and which business
models are used

2020 December 16 (Renewables Now)
Commercial Metals Company’s (CMC) micro mill in Mesa, CMC Steel Arizona,
has started receiving solar electricity from a park built by Arizona-focused electric utility Salt River Project (SRP).
The micro mill, which gets 98% of its raw material from recycled scrap, is one of the off-takers for the 100-MW Saint Solar
farm. (70-MW)
CMC calculates that its Scope 1 greenhouse gas emissions and energy use intensities are roughly eight times less than the
global steel making average.
It will build a third micro mill, AZ2, near CMC Steel Arizona, which is also planned to use renewable power.
“This is just the beginning of our sustainable energy partnership and we look forward to continuing to partner with them
on AZ2 and beyond,” said Jim Pratt, Chief Customer Executive at SRP.
CMC is a member of SRP's Sustainable Energy program.

the AIA standard contract, the clause 4.3.6 is called Sustainability. It says: “one key area of opportunity for improvement from
traditional delivery approaches is to set more aggressive goals for sustainability.” It does not provide clear or precise content
about sustainability but still, this clause is entirely dedicated to sustainable manners. It does not give precise solutions toward
sustainability but it must be taken into account. Concerning the second alternative,
the CSI contract contents a clause dedicated to sustainability. Indeed, the clause 4.3.3 called Sustainable Requirements states:
“Depletion of natural resources, deteriorating environmental conditions in formerly pristine parts of the world, rising human
population, loss of animal and plant species to extinction, and economic competition from developing nations have raised public
awareness of facility design, also called green design.” This clause defines what must be understood when talking about
sustainability. It gives a clear area and clear subjects that must be considered in this sustainable clause. Sustainable
Requirements is then divided into 4 sub-clauses: 4.3.3.1 Sustainable Design Principles, 4.3.3.2 Environmental Design Tools,
4.3.3.3 Assessing Product Sustainability and 4.3.3.4 Assessing Facility Sustainability. We can consider that CSI has a high
commitment to sustainability management.

the FIDIC standards contract a clause dedicated to sustainability, it is called Protection of the environment and can be found
in section 4 of the contract, The contractor. It is explained that the contractor should “take all reasonable steps to protect
the environment and to limit damage and nuisance to people and property resulting from pollution, noise and other results
of his operations.” Just like in the AIA contract, this clause stays really vague and does not give precise rules about
sustainability or the environment.
the EJCDC standards contract is sustainability-related. This article is called Availability of Lands, Subsurface and Physical
Conditions, Hazardous Environmental Conditions. Article 5 explains how the contractor should respect and protect the
environment in several clauses. For instance, one clause states: “Contractor shall be responsible for controlling, containing, and
duly removing all Constituents of Concern brought to the Site by Contractor, Subcontractors, Suppliers, or anyone else for whom
Contractor is responsible, and for any associated costs; and for the costs of removing and remediating any Hazardous
Environmental Condition created by the presence of any such Constituents of Concern.” This sentence means that every
contractor should personally manage everything in the project that must have an impact on the environment.

The risks the Owner faces if the project does not, in fact, live up to its sustainable aspirations include:
•Failure of a project to achieve certification or an anticipated level of certification. This risk is particularly significant in
areas where large new construction projects are required to meet certain sustainability standards.
•Failure to qualify for tax credits that are contingent upon a certain level of certification, or upon certification being
achieved within a certain amount of time.
•Failure to meet loan or incentive program requirements if construction is not as “green” as originally planned, where
loans or incentive programs are tied to achieving certification or sustainability outcomes.
•Increased soft costs due to delays in construction or requirements for additional documentation (in addition to the
already greater up-front costs of green building).
•Failure to meet anticipated or stated claims in marketing or promotional materials for a development project and
possible liability to prospective buyers and/or tenants.
•Failure to obtain expected lower operating costs and savings in energy costs.
•Loss of an Owner’s reputation as a purveyor of sustainable construction.

AIA’s Sustainable Project Documents
In 2012, the AIA released a set of five template contract SP Documents to define roles and responsibilities and provide
procedures and processes for the Owner, Architect, and Contractor to identify sustainability goals and to map out a
plan to achieve those goals. These five SP Documents are:
•A101-2007 SP - Standard Form of Agreement Between Owner and Contractor for use on a Sustainable Project Where
the basis of payment is a Stipulated Sum
•A201-2007 SP - General Conditions of the Contract for Construction, for use on a Sustainable Project
•A401-2007 SP - Standard Form of Agreement Between Contractor and Subcontractor, for use on a Sustainable
Project
•B101-2007 SP B Standard Form of Agreement Between Owner and Architect, for use on a Sustainable Project
•C401-2007 SP B Standard Form of Agreement Between Architect and Consultant, for use on a Sustainable Project
These five SP forms are essentially the 2007 editions of specified AIA contracts,
but modified to include provisions tailored to green/sustainability project issues.
