SUBJECT: Notice of Intent to construct a new commercial use building on the property
located at 516 Circle St.
DATE: October 24, 2022
SUMMARY
The applicant is seeking to build a new commercial use building. The proposed structure is a
two-story building and has a total gross square footage of 3,744 sq ft.
BACKGROUND INFORMATION
The site is located on the east side of Broadway and is currently vacant. The property is
composed of different zoning designations.
A replat request was considered by the Planning & Zoning Commission and approved by
Council at the June 13, 2022 meeting. A request to rezone the property was made but the request
was withdrawn by the applicant prior to the scheduled hearing.
2. POLICY ANALYSIS
The property currently has two (2) zoning designations. The western portion is zoned Business
District (B-1) and the eastern portion is zoned Two-Family Dwelling (2F-C).
Construction would require rezoning of the property to facilitate applying zoning regulations.
Based on the preliminary documents, review and approval by the Board of Adjustment will be
required for several variances. The project would also be subject to Final Review by the
Architectural Review Board. Lastly, Council review and approval by Planning & Zoning
Commission and Architectural Review Board recommendations would be required.
Board consideration is tentatively scheduled as follows:
o NOI – October 24, 2022
o BOA (variances) – November 02, 2022
o P&Z (Rezone) – November 07, 2022
o Council (Review of P&Z recommendation) – November 14, 2022
o ARB (Preliminary Review) – November 15, 2022
o ARB (Final Review) – TBD pending variance approval
o Council (Review of ARB recommendation) - TBD
