SUBJECT: Case No. 421
Public hearing, consideration, and action regarding a request to replat the properties
identified as CB 4024, BLK 193, LOTS W 27ft of 14 and E ½ of 15, also known
as 309 Lamont Ave, and CB 4024, BLK 193, LOTS W ½ OF 15, 16, and E ½ of
17, also known as 317 Lamont Ave.

SUMMARY
The applicant is requesting to combine the two (2) properties into one (1) property. The property
has historically been used as one (1).
BACKGROUND INFORMATION
The property is located between Woodway and Nacogdoches, on the north side of Lamont, and is
zoned Single Family A (SF-A) District.
There is a single-family residence with accessory structures on each property. Staff is currently in
receipt of a request to connect both main structures via a breezeway addition.
POLICY ANALYSIS
 Sec. 3-12. - Lot area.
The minimum lot area in the SF-A District shall be eight thousand four hundred (8,400) square
feet for lots greater than fifty (50) feet wide, and no lot shall be reduced in area below this
minimum requirement.
 Sec. 3-13. - Lot width.
The minimum lot width for lots in the SF-A District shall be sixty (60) feet and no lot shall be
reduced in width below this minimum.
 Sec. 3-15. - Side yard setbacks and side articulation.
No building, structure or use shall hereafter so as to have a smaller side yard on each side of a
building, as measured from the edge of foundation (including masonry lug), than hereinafter
specified, except as specifically provided in section 3-82, special side yard regulations.
(1) The minimum side yard setback for the main structure on the driveway side is ten (10) feet.
(2) The minimum side yard setback for the main structure on the non-driveway side is six (6)
feet.
(3) The minimum side yard setback for an accessory structure is three (3) feet.
 Sec. 3-16. - Rear yard setbacks.
No building, structure or use shall hereafter be located, erected or altered so as to have a
smaller rear yard than hereinafter specified, except as specifically provided in section 3-83,
special rear yard regulations.
(1) The minimum rear yard setback for the main structure is twenty (20) feet for the first story
and thirty (30) feet for a second story.
CPS, SAWS, and Public Works have given approval of the proposed replat in their evaluation of
the potential impact on utilities.
As proposed, the replat meets technical requirements listed in Chapter 17 Subdivision codes;
however, the replat does not meet Chapter 3 Zoning requirements due to the preservation and
proposed connection of the two (2) existing main structures that would result in nonconforming
5.3ft side yard setback and 14.3ft rear yard setback to a main structure.
 Required plat notes due to nonconformity:
o Lot 21 does not conform with the minimum required 6ft side yard setback per Section 3-15
the City’s Zoning Code
o Lot 21 does not conform with the minimum required 20ft rear yard setback per Section 3-
16 the City’s Zoning Code
o All new construction would be required to adhere to the City’s Zoning Code at the time of
permitting.
 Texas Local Government Code
Section 212.009(a). The municipal authority responsible for approving plats shall act on a plat
within 30 days after the date the plat is filed. A plat is considered approved by the municipal
authority unless it is disapproved within that period.
The replat request was scheduled to be heard at the regularly scheduled Planning & Zoning
Commission meeting of June 06, 2022. The meeting was canceled due to lack of a quorum so the
plat is considered approved by the inaction of the commission.
FISCAL IMPACT
No projected fiscal impact from this project has been calculated.

Monday, June 06, 2022 at 5:30pm in the City Council Chamber, located at 6116 Broadway, San
Antonio, Texas, 78209, to consider and act upon any lawful subjects which may come before it. Per
Governor’s Order GQ-36, attendees are not required to wear facial covering (mask) but are
encouraged. The City will continue to practice social distancing, and seating will be limited to
capacity limits.
INSTRUCTIONS FOR TELECONFERENCE: Members of the public may also participate via

The City Council of the City of Alamo Heights will conduct a public hearing on Monday, June 13, 2022
at 5:30pm relating to the recommendations of the Planning and Zoning Commission regarding the same
issues.

the filing of this plat for consideration by the appropriate governmental entity.

Alamo Heights Council Reviews Lamont Ave Property Replat

  • 1. CITY OF ALAMO HEIGHTS COMMUNITY DEVELOPMENT SERVICES DEPARTMENT CITY COUNCIL AGENDA MEMORANDUM TO: Mayor and City Council Members FROM: Lety Hernandez, Director of Community Development Services SUBJECT: Case No. 421 Public hearing, consideration, and action regarding a request to replat the properties identified as CB 4024, BLK 193, LOTS W 27ft of 14 and E ½ of 15, also known as 309 Lamont Ave, and CB 4024, BLK 193, LOTS W ½ OF 15, 16, and E ½ of 17, also known as 317 Lamont Ave. DATE: June 13, 2022 SUMMARY The applicant is requesting to combine the two (2) properties into one (1) property. The property has historically been used as one (1). BACKGROUND INFORMATION The property is located between Woodway and Nacogdoches, on the north side of Lamont, and is zoned Single Family A (SF-A) District. There is a single-family residence with accessory structures on each property. Staff is currently in receipt of a request to connect both main structures via a breezeway addition. POLICY ANALYSIS  Sec. 3-12. - Lot area.
  • 2. The minimum lot area in the SF-A District shall be eight thousand four hundred (8,400) square feet for lots greater than fifty (50) feet wide, and no lot shall be reduced in area below this minimum requirement.  Sec. 3-13. - Lot width. The minimum lot width for lots in the SF-A District shall be sixty (60) feet and no lot shall be reduced in width below this minimum.  Sec. 3-15. - Side yard setbacks and side articulation. No building, structure or use shall hereafter so as to have a smaller side yard on each side of a building, as measured from the edge of foundation (including masonry lug), than hereinafter specified, except as specifically provided in section 3-82, special side yard regulations. (1) The minimum side yard setback for the main structure on the driveway side is ten (10) feet. (2) The minimum side yard setback for the main structure on the non-driveway side is six (6) feet. (3) The minimum side yard setback for an accessory structure is three (3) feet.  Sec. 3-16. - Rear yard setbacks. No building, structure or use shall hereafter be located, erected or altered so as to have a smaller rear yard than hereinafter specified, except as specifically provided in section 3-83, special rear yard regulations. (1) The minimum rear yard setback for the main structure is twenty (20) feet for the first story and thirty (30) feet for a second story. CPS, SAWS, and Public Works have given approval of the proposed replat in their evaluation of the potential impact on utilities. As proposed, the replat meets technical requirements listed in Chapter 17 Subdivision codes; however, the replat does not meet Chapter 3 Zoning requirements due to the preservation and proposed connection of the two (2) existing main structures that would result in nonconforming 5.3ft side yard setback and 14.3ft rear yard setback to a main structure.  Required plat notes due to nonconformity: o Lot 21 does not conform with the minimum required 6ft side yard setback per Section 3-15 the City’s Zoning Code o Lot 21 does not conform with the minimum required 20ft rear yard setback per Section 3- 16 the City’s Zoning Code o All new construction would be required to adhere to the City’s Zoning Code at the time of permitting.  Texas Local Government Code Section 212.009(a). The municipal authority responsible for approving plats shall act on a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipal authority unless it is disapproved within that period. The replat request was scheduled to be heard at the regularly scheduled Planning & Zoning Commission meeting of June 06, 2022. The meeting was canceled due to lack of a quorum so the plat is considered approved by the inaction of the commission. FISCAL IMPACT No projected fiscal impact from this project has been calculated.
