Public hearing, consideration, and action regarding a request to replat the
properties identified as CB 4050, BLK 63, LOT E 80FT OF 23 AND 24, CB
4050, BLK 63, LOT E IRR 40FT OF 25 & E TRI 12FT OF 26, also known as
516 Circle St, CB 4050, BLK 63, LOT P-100 (PART OF ALLEY), and CB
4050, BLK 63, LOTS 20, 21, & 22, also known as 5936 Broadway St.

SUMMARY
The applicant is requesting to combine the several properties into one (1) for future development.
BACKGROUND INFORMATION
The properties are located to the east of Broadway on the north side of Circle. The properties are
zoned Business District (B-1) and Two-Family Dwelling (2F-C) District.
There are no structures on the properties facing Circle St. The existing commercial use structure
facing Broadway will remain and no improvements are proposed at this time.
In 2004, the City sold the 0.041-acre tract (1,778sq ft) of land being a portion of a 12ft alley. The
Board of Adjustment granted a variance for a front yard setback encroachment pending approval
of the rezone and replat requests at its May 04, 2022 meeting.
POLICY ANALYSIS
 Sec. 3-32. - Lot area.
The minimum lot area in the 2F-C District shall be in accordance with the following, and no
lot existing at the time of passage of this ordinance shall be reduced in area below the
minimum requirements set forth herein:
(1) Single-family dwelling detached: Seven thousand five hundred (7,500) square feet.
(2) Single-family dwelling attached and two-family dwelling: Nine thousand (9,000) square
feet.
(3) Two-family dwelling, District (2F-C)-approval with proposed change to lot size and
density.
 Sec. 3-33. - Lot width.
The minimum lot width in the 2F-C District shall be in accordance with the following, and
no lot existing at the time of passage of this ordinance shall be reduced in width below the
minimum requirements set forth herein:
(1) Single-family dwelling detached: Fifty (50) feet.
(2) Single-family dwelling attached and two-family dwelling: Sixty (60) feet.
(3) Two-family dwelling district (2F-C)-approval with proposed changes, refer to single-
family.
The proposed lot area for 516 Circle would increase to a compliant 0.1858-acre (8,093.45 sq ft)
tract. The proposed decrease for 5936 Broadway would result in a compliant 0.1794-acre
(7,814.66 sq ft) tract.
CPS, SAWS, and Public Works have given approval of the proposed replat in their evaluation of
the potential impact on utilities.
As proposed, the replat meets technical requirements listed in Chapter 3 Zoning and Chapter 17
Subdivision codes.
 Texas Local Government Code
Section 212.009(a). The municipal authority responsible for approving plats shall act on a
plat within 30 days after the date the plat is filed. A plat is considered approved by the
municipal authority unless it is disapproved within that period.
The replat request was scheduled to be heard at the regularly scheduled Planning & Zoning
Commission meeting of June 06, 2022. The meeting was canceled due to lack of a quorum so the
plat is considered approved by the inaction of the commission.
New construction will be subject to a complete plan review by staff to confirm zoning
compliance. The project will require compatibility review by the Architectural Review Board
and approval by City Council.
FISCAL IMPACT
No projected fiscal impact from this project has been calculated.

Take notice that a regular Planning & Zoning Commission of the City of Alamo Heights will be held on
Monday, June 06, 2022 at 5:30pm in the City Council Chamber, located at 6116 Broadway, San
Antonio, Texas, 78209, to consider and act upon any lawful subjects which may come before it. Per
Governor’s Order GQ-36, attendees are not required to wear facial covering (mask) but are
encouraged. The City will continue to practice social distancing, and seating will be limited to
capacity limits.

The City Council of the City of Alamo Heights will conduct a public hearing on Monday, June 13, 2022
at 5:30pm relating to the recommendations of the Planning and Zoning Commission regarding the same
issues.

CITY OF ALAMO HEIGHTS COMMUNITY DEVELOPMENT SERVICES DEPARTMENT CITY COUNCIL AGENDA MEMORANDUM TO: Mayor and City Council Members FROM: Lety Hernandez, Director of Community Development Services SUBJECT: Case No. 424 Public hearing, consideration, and action regarding a request to replat the properties identified as CB 4050, BLK 63, LOT E 80FT OF 23 AND 24, CB 4050, BLK 63, LOT E IRR 40FT OF 25 & E TRI 12FT OF 26, also known as 516 Circle St, CB 4050, BLK 63, LOT P-100 (PART OF ALLEY), and CB 4050, BLK 63, LOTS 20, 21, & 22, also known as 5936 Broadway St. DATE: June 13, 2022 SUMMARY The applicant is requesting to combine the several properties into one (1) for future development. BACKGROUND INFORMATION The properties are located to the east of Broadway on the north side of Circle. The properties are zoned Business District (B-1) and Two-Family Dwelling (2F-C) District. There are no structures on the properties facing Circle St. The existing commercial use structure facing Broadway will remain and no improvements are proposed at this time. In 2004, the City sold the 0.041-acre tract (1,778sq ft) of land being a portion of a 12ft alley. The Board of Adjustment granted a variance for a front yard setback encroachment pending approval of the rezone and replat requests at its May 04, 2022 meeting.
  • 2. POLICY ANALYSIS  Sec. 3-32. - Lot area. The minimum lot area in the 2F-C District shall be in accordance with the following, and no lot existing at the time of passage of this ordinance shall be reduced in area below the minimum requirements set forth herein: (1) Single-family dwelling detached: Seven thousand five hundred (7,500) square feet. (2) Single-family dwelling attached and two-family dwelling: Nine thousand (9,000) square feet. (3) Two-family dwelling, District (2F-C)-approval with proposed change to lot size and density.  Sec. 3-33. - Lot width. The minimum lot width in the 2F-C District shall be in accordance with the following, and no lot existing at the time of passage of this ordinance shall be reduced in width below the minimum requirements set forth herein: (1) Single-family dwelling detached: Fifty (50) feet. (2) Single-family dwelling attached and two-family dwelling: Sixty (60) feet. (3) Two-family dwelling district (2F-C)-approval with proposed changes, refer to single- family. The proposed lot area for 516 Circle would increase to a compliant 0.1858-acre (8,093.45 sq ft) tract. The proposed decrease for 5936 Broadway would result in a compliant 0.1794-acre (7,814.66 sq ft) tract. CPS, SAWS, and Public Works have given approval of the proposed replat in their evaluation of the potential impact on utilities.
  • 3. As proposed, the replat meets technical requirements listed in Chapter 3 Zoning and Chapter 17 Subdivision codes.  Texas Local Government Code Section 212.009(a). The municipal authority responsible for approving plats shall act on a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipal authority unless it is disapproved within that period. The replat request was scheduled to be heard at the regularly scheduled Planning & Zoning Commission meeting of June 06, 2022. The meeting was canceled due to lack of a quorum so the plat is considered approved by the inaction of the commission. New construction will be subject to a complete plan review by staff to confirm zoning compliance. The project will require compatibility review by the Architectural Review Board and approval by City Council. FISCAL IMPACT No projected fiscal impact from this project has been calculated.
