Based on my review of his report, I do not believe the applicant has sought any treatment or made
any significant complaints with respect to the left shoulder. I only saw the mentioning of a
shoulder pain as a result of the chest wall and sternal discomfort as the applicant was unable to
raise his hands over his head at the time. There was no specific mentioning of the left shoulder.
Second, I would like to question Dr. Minor about his impairment finding for the bilateral knees.
More specifically, I would like to know where he saw a 1mm cartilage loss of both knees. I
suspect he must have seen it on an imaging study (i.e., X ray or MRI) but it was not explicitly
documented in the report (or I may have missed it).
Third, I will question him about his finding of impairment as a result of a sleep disorder and
cognitive impairment. More specifically, I would like to know if there are any objective findings to
support these impairments.
Fourth, I will question him about his impairment findings regarding binaural as well as the 3% pain
add on for tinnitus. I believe the binaural impairment was given in connection with the applicant s
left ear problem. Also, pain add on is inappropriate to increase an impairment on a body part with
zero impairment. If we could change Dr. Minor s opinion on the base impairment for the applicant
s ear problem, we may be able to wash out the 3% pain add on all together.

Theta Pi fraternity house. This horrific event was a result of irresponsible consumption of alcohol
and binge drinking. Sadly, this is not an isolated incident. Around the nation, countless young adults
have lost their life due to the thoughtless consumption of alcohol. Unfortunately, the common
census between the majority of the average day Americans is that the most effective way to make
drinking safer for young adults is enforcing a minimum drinking age of twenty one. This law, as
well as the common census, are a direct result from the efforts of Mothers Against Drunk Driving
(MADD) more than thirty years ago ( Drinking Culture). MADD s objective and goal is quite
understandable; they want the young adults of today s world to be safe and not put themselves

Safety is the single objective from each side in this argument, but MADD s flawed logic and

In this paper I will defend both the proponents and principles of the utilitarian theory of punishment,
namely addressing the utilitarian approach juxtaposed with the retributive. Before beginning to
make claims in any direction, a brief and to date synopsis of the utilitarian fundamentals regarding
punishmentwill be necessary. From there, I will present the utilitarian theories of punishment as not
only the most useful for a society, but also the best representation of criminal law being carried out
justly. Following this assertion I will refute objections made by retributivists, and in doing so
present a discovered common ground between the retributory criteria for just punishment and the
utilitarian theories. This will not serve to say I believe in impure retributivism over the utilitarian
theories, but rather will act as testament to the practicality of the utilitarian approach. Finally, I will
propose the most ethical response to criminality is found from the utilitarian fundamentals of
societal well being, mentioning specifically the vindictive theories of punishment as meeting the
utilitarian criteria. To the utilitarian, punishment is not an end in itself for the actions of a

gap. Many of the changes that were done in the budget involved taxes and expenditures. During
this period of time, although there was not a complete unified of government, most democrats

required capabilities to the war fighters. B 2 stealth bomber has unique wing configuration and
stealth technology. The structure of B 2 is similar to B 35 which was developed in 1940 s by
Northrop. The first B 2 was displayed publicly on November 22, 1988. Its flight was on July 17,

MEMORANDUM
INTRODUCTION
You have asked me to determine whether our client Diana Lewis committed unauthorized practice
of law by providing her services. I have done research on statutes and cases. This memorandum will
address the issue of this case, California Bar s claim, and Ms. Lewis s possible defense.
STATEMENT OF FACTS
In May 2001, Diana Lewis earned her Associate of Art degree and Paralegal Certificatefrom City
College of San Francisco. In June 2001, Ms. Lewis opened her business to prepare legal
paperwork for clients involved in uncontested divorces. She advertises her business in the Daily
Journal and the Recorder. She charges no more than $75 for the complete ... Show more content on

She works as an independent legal document assistant. The issue is whether she provided advice
about possible legal rights, defense, strategies, etc.
In the People v. Landlords Professional Services, 215 Cal. App. 3d 1599; 264 Cal. Rptr. 548, the
court held that when a non attorney consults his or her clients individually and presents himself
or herself with expertise concerning certain legal problem, he or she is engaged in unauthorized
practice of law. The court s reason for affirming conviction against LPS is that the company
provided specific information to its clients concerning eviction procedure in the context of
personal interviews where it was able to provide additional information and advice addressed to
the specific problems and concerns of its clients, who were likely to rely on its advice, perhaps
to their serious detriment. This case is similar to Diana Lewis s case in that both Ms. Lewis and
LPS s representatives are not authorized to practice law. Both cases have the same issue of
definition of practice of law. They both provided legal document service. The difference is that
LPS held individual interviews with its clients and gave specific advice, whereas Ms. Lewis held
conference with her clients. However, Ms. Lewis did discuss with her clients before the court
hearing. State Bar could argue it is possible for Ms. Lewis to provide additional advice concerning
