On April 4, 2016, New York Governor Andrew Cuomo signed a bill that will require employers to provide paid family leave benefits to eligible employees as part of the state’s disability insurance program.
Paid family leave benefits will be phased in over a four-year period, beginning Jan. 1, 2018. When the law is fully implemented in 2021, employees may be eligible for up to 12 weeks of paid family leave.

If you own vacant property, it is advisable to purchase Vacant Property Insurance, also known as Vacant Building Insurance or Vacant Dwelling Insurance, to protect against risks.
On Dec. 28, 2016, the New York State Department of Labor (NYSDOL) adopted new regulations that increase the salary threshold that executive and administrative employees need to meet in order to be exempt from the state’s overtime pay regulations.
The NYSDOL’s new regulations are part of the state’s Wage Orders. They become effective on Dec. 31, 2016.
The new salary threshold for qualifying employees will:
• Gradually increase over the next few years; and
• Depends on the employer’s size and location, as shown in the table below.
On Dec. 19, 2016, the Occupational Safety and Health Administration (OSHA) issued a final rule amending its recordkeeping regulations. The amendments were adopted to clarify that an employer’s duty to create and maintain work-related injury or illness records is an ongoing obligation. The final rule becomes effective on Jan. 18, 2017.
The clarification explains that an employer remains under an obligation to record a qualifying injury or illness throughout the five-year record storage period, even if the incident was not originally recorded during the first six months after its occurrence.
The final rule does not create any additional or new recordkeeping obligations for employers.

The Internal Revenue Service (IRS) has released final 2016 forms for reporting under Internal Revenue Code (Code) Sections 6055 and 6056.
- Forms 1094-B and 1095-B are used by entities reporting
under Section 6055, including self-insured plan sponsors
that are not applicable large employers (ALEs). Final
2016 versions of these forms and final instructions
were released on Sept. 26, 2016.
- Forms 1094-C and 1095-C are used by ALEs to report
under Section 6056, as well as for combined Section
6055 and 6056 reporting by ALEs who sponsor selfinsured
plans. Final 2016 versions of these forms and
final instructions were released on Sept. 30, 2016.
Minor changes were made to the forms, including the addition
of two new “Offer of Coverage” codes for use on Form 1095-C.
The instructions also included some clarifications.
On May 18, 2016, the U.S. Department of Labor (DOL) announced a final rule regarding overtime wage payment qualifications for the “white collar exemptions” under the Fair Labor Standards Act (FLSA).
The final rule increases the salary an employee must be paid in order to qualify for a white collar exemption. The required salary level is increased to $47,476 per year and will be automatically updated every three years. The final rule does not modify the duties test employees must meet to qualify for a white collar exemption.
