NYSDOL Updates Overtime Salary Qualifications

On Dec. 28, 2016, the New York State Department of Labor (NYSDOL) adopted new regulations that increase the salary threshold that executive and administrative employees need to meet in order to be exempt from the state’s overtime pay regulations. The NYSDOL’s new regulations are part of the state’s Wage Orders. They become effective on Dec. 31, 2016. The new salary threshold for qualifying employees will: • Gradually increase over the next few years; and • Depends on the employer’s size and location, as shown in the table below.

The IRS issued a notice confirming its delay of the employer pay-or-play excise tax until 2014 and provided additional clarification. With the delay, employers have time to focus on other Affordable Care Act compliance issues that were previously secondary to pay-or-play, such as updated HIPAA privacy policies and notices of exchange availability. Employers can also expect inquiries from employees and health insurance exchanges regarding their coverage to determine exchange subsidy eligibility. As we celebrate the 30th Anniversary of Environmental Claims Journal (“the Journal”), congratulations and thank you to everyone who has been involved as authors, Editorial Advisory Board Members, subscribers, and readers. Important article topics have often focused on the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and related state law statutes, the Resource Conservation and Recovery Act (RCRA), worldwide health issues from pollutants, environmental releases from climate change, the lack of coverage under general liability and property policies for pollutants, and the availability of coverage under environmental insurance policies. The emergence of new claims exposures is also informative and interesting. Recent important topics have addressed the environmental impacts to groundwater and drinking water, alternative energy-related issues, and chemicals newly deemed hazardous to the environment and health. While there are thousands of examples of environmental claims over the past year, this note will highlight some of the most recent news stories.

Compliance Bulletin - New York Enacts Paid Family Leave Law
On April 4, 2016, New York Governor Andrew Cuomo signed a bill that will require employers to provide paid family leave benefits to eligible employees as part of the state’s disability insurance program.
Paid family leave benefits will be phased in over a four-year period, beginning Jan. 1, 2018. When the law is fully implemented in 2021, employees may be eligible for up to 12 weeks of paid family leave.

Compliance Bulletin - OSHA Clarifies Ongoing Recordkeeping Obligations
On Dec. 19, 2016, the Occupational Safety and Health Administration (OSHA) issued a final rule amending its recordkeeping regulations. The amendments were adopted to clarify that an employer’s duty to create and maintain work-related injury or illness records is an ongoing obligation. The final rule becomes effective on Jan. 18, 2017.
The clarification explains that an employer remains under an obligation to record a qualifying injury or illness throughout the five-year record storage period, even if the incident was not originally recorded during the first six months after its occurrence.
The final rule does not create any additional or new recordkeeping obligations for employers.

ERISA has been amended many times over the years, expanding the protections available to welfare benefit plan participants and beneficiaries.
The Department of Labor (DOL), through its Employee Benefits Security Administration (EBSA), enforces most of ERISA’s provisions. Violating ERISA can have serious and costly consequences for employers that sponsor welfare benefit plans, either through DOL enforcement actions and penalty assessments or through participant lawsuits.
