This case involved an appeal of a negligence claim where the appellant's eye was permanently injured after being hit by a piece of metal thrown by the respondent when he was 12 years old. The majority dismissed the appeal, agreeing with the trial judge that the standard of care for a child is that of a reasonable child of the same age, intelligence and experience. However, one dissenting judge found that even using the standard of a reasonable child, throwing metal in the direction of another person was still negligent. The critical issue was what standard of care should apply to child defendants in negligence cases.
