BRIEF AMICUS CURIAE OF ELDRED V. ASHCROFT IN SUPPORT OF PETITIONER
QUESTION PRESENTED
Does the Copyright Term Extension Act, which extends the term of a copyright to 70 years after
the creator s death, violate the limited Times prescription of the Copyright Clause and the free
speech guarantee of the First Amendment?
IDENTITY AND INTEREST OF AMICUS CURIAE We respectfully submit this brief amicus
curiae in support of the petitioners, Eldred et al. The petitioners owned the copyrights of works
now in the public domain. They challenged the 1998 Copyright Term Extension Act (CTEA) on the
grounds that the act allows copyrights to exist in perpetuity and restricts free speech, so the act
violates the Copyright Clause and the First Amendment of the United States Constitution. Justice
Ginsburg denied Eldred s challenges, finding that the terms established by the CTEA are limited
terms and that the act accommodates for petitioner s First Amendment concerns. We submit this
amicus curiae in dissent of the court opinion that upheld the CTEA.
SUMMARY OF ARGUMENT The Copyright Term Extension Actof 1998 established that
copyright terms now expire 70 years after the creator s death, which is a 20 year extension from
the previous copyright law in 1976 that established term expiration 50 years after the creator s
death. The Act applies equally to future works and works with existing copyrights. The court in
Eldred v. Ashcroft upheld the CTEA as a rational exercise of congressional authority in that the
copyright extension creates a significant benefit: encouraging copyright authors to produce more
creative works. However, the extension has little influence on the motivation of authors to create
and it constructs roadblocks in the creation process. Overall, the expected outcome of the 20 year
copyright term extension is a reduction in the number of works being created and copyrighted in
the future due to the increased costs of production. Without works entering the public domain, the
copyright owner monopolizes their work, creating social costs associated with a monopoly market
failure. The CTEA should be struck down as it is inconsistent with the ultimate goal of copyright

I believe that every company should be using LP and I have hypothesized that linear programming
increases both EPS, ROI and by definition Profit. This research therefore assumes that a company
not using LP would have made less money than one that did use LP. The sample is 28 companies
and I felt this would be sufficient as a sample size as statisticians typically recommend a minimum
of 20 data points (in this case companies) in order to test a hypothesis. The companies are located
in and near the state of Delaware and also include New Jersey and Pennsylvania.
This research is not exhaustive and therefore will not be final in terms of how it is interpreted but
it will assist others who wish to use much larger samples and over much longer periods of time to
refine the results and potentially prove that LP does have a consistent improvement effect on a
company s profits, ROI and EPS measures of performance. Method

As in Gertler and Karadi (2011) and Gertler and Kiyotaki (2011), endogenous procyclical
movements in bank balance sheets lead to countercyclical movements in the cost of bank credit.
At the same time, due to maturity mismatch, bank runs may be possible, following Diamond and
Dybvig (1983). Whether or not a bank run equilibrium exists will depend on two key factors: the
condition of bank balance sheets and an endogenously determined liquidation price. Thus, a
situation can arise where a bank run cannot occur in normal times, but where a severe recession
can open up the possibility. Critical to the possibility of runs is that banks issues demandable
short term debt. In our baseline model we simply assume this is the case. We then provide a
stronger motivation for this scenario by introducing household liquidity risks, in the spirit of
Diamond and Dybvig. Section 2 presents the model, including both a no bank run and a bank run
equilibria, along with the extension to the economy with household liquidity risks. Section 3
presents a number of illustrative numerical experiments. We illustrate how bank balance sheet
behavior aВ¤ects the cost of credit in the no bank run equilibrium and how it may open up the
possibility of destructive bank run behavior. Finally, in section 4 we conclude with a discussion of

Primary lymphedema occurs due to an intrinsic, most of the time genetic, aberration in the
lymphatic vasculature. Over the past decade, some of the key genetic factors leading to primary
lymphedema have been elucidated. In 2013, Connel and his colleagues created a clinical algorithm
for the diagnosis of primary lymphatic dysplasia [Figure 3.0].23 The figure demonstrates nine
causal mutations linked to primary lymphedema and we will briefly discuss some of these.
3.1 Milroy Disease
Milroy disease is a form of primary lymphedema, which presents with progressive swelling of the
face and lower extremities.24 It is characterized by the absence or marked diminution of lymphatic
vessels.25 Some cases have been associated with missense mutations in vascular endothelial growth
factor receptor 3 receptor tyrosine kinase (VEGFR3).26 The underlying pathology for this disease
is not the mere absence of initial lymphatic capillaries but the inadequacy of initial lymphatic fluid
absorption.3
3.2. Hennekam Syndrome

internal validity since these animals are not giving any specific treatment currently. Any specific

sample size is small, but this is not uncommon when dealing with studies in the equine field.
Another is that some animals may have past psychological damage since many are rescues. It is
possible that aggression is in response to unknown problems (masked medical issues) that have no
