This document discusses the admissibility of electronic and digital evidence under evidentiary rules. It notes that while courts have generally been able to adapt existing evidence rules to electronic evidence, some areas present challenges, such as determining what constitutes an "original" digital document. Authentication of digital evidence is also discussed in depth, including how Rules 901 and 902 can be applied. Various hearsay exceptions are also examined in the context of admitting electronic communications and records into evidence.
