The Constitutionality Of The Public Accommodations Equal...
The issue being brought before the court today is the constitutionality of the Public
Accommodations Equal Access Act. In addition, it is also evident that the facts in this case raise
the issue of congressional authority. Moreover, in order for the Court to come to such a
determination, Congress justification for the passing of such an act, as well as the powers of
Congress, will be reviewed. Because the act was implemented in order to forbid discrimination
based upon sexual orientation in dining, entertainment, and lodging establishments, we must first
address whether sexual orientation is granted equal protection under the law. The federal
government is obligated by the Fifth Amendment to ensure that no person shall be deprived of life,
liberty, or property, without due process of law as well as ensuring equal protection under the law.
In order to determine whether persons are discriminated against fairly, the strict scrutiny test is
applied. Strict scrutiny is applied when a law or action inhibits a person /persons exercise of
protected First Amendment rights, fundamental rights, and when a specific suspect class is
discriminated against. Under strict scrutiny, the government must show a compelling, government
interest in order to be able to discriminate, and the act must be deemed arbitrary and irrational to be
constitutionally invalid. Nevertheless, sexual orientation does not fit in any of the three categories
protected by the Constitution. Therefore,

Research Paper On Marcel Duchamp
I.Marcel Duchamp (1887 1968):
Marcel Duchamp (hereinafter referred to as Duchamp ), was a 20th century French artist. He is
considered to be of the era in which Art and particularly Paintings were influenced by elements
such as constant change, transition, fluidity, movement and distance etc. He s considered as a
pioneer of DADA , a movement that questioned the deep rooted assumptions about what art
should be and how it should be made . He himself was intrigued by the concept of a fourth
dimension. He wasn t just a painter but also a sculptor and writer. He always saw art as evolving
and creating new things.
Duchamp reproduced Mona Lisa in 1919 as just a spoof, but it shocked the people of that time and
its final outcome gave birth to a whole new form of Art. The reproduction by Duchamp was titled

he has also reproduced Mona Lisa titled as Mona Simpson , which is as follows: Comparison
between the original Mona Lisa and Mona Simpson are as follows:
a.The Mona Simpson is very intriguing and portrays a confident yet elegant women. The hair
colour and necklace taken from the famous cartoon series The Simpsons shows a modern women
who is sure of herself, is stylish graceful at the same time.
b.The Aura of this painting is also mixed. First look the facial features and the Black gown

Media Reflection Paper
Today the life revolves around media, it is on people s phones, media decorate their walls, and for
some media is their job. Since media is such an inescapable part of the modern landscape it is
significant that we as individuals understand how the media works and how it affects us. In this
course, the nature of the mediahas been unraveled to reveal the ways that it has impacted society
and how it has done this. This class has made me became more critical of the media in my life
and now even without thinking I recognize patterns, and in some cases toxic themes in the media
I consume. Looking back on this semester and what I have learned I can see that I have become
more media literate in many ways, primarily in the areas of awareness and analysis. I have
become more aware of the way media is constructed. Some things that have stood out to me since
I have started this course is for example the other day when I flew into the ST. Louis airport after
Thanksgiving break one of the monitors in baggage claim said that it was CLear Channel TV
before this course I do not know what clear channel was and I knew that the entertainment
business was an oligopoly but I did not realize the extent. Seeing this was a moment of realization,
that what I read was real, this one company has its hands in every pot. I have also noticed how
much media means to people, I was speaking to one of my friends and I mentioned that I thought
marvel was better that DC and she became very upset at me. It occurred to me that being a DC
comics fan was a part of her identity, before I knew that people took entertainment personally but
it was not actively looking for it. I have increased my ability to analyze the media I consume,
now I am more aware of the way industries target audiences. One of the easiest ways this can be
seen is in commercials, advertisers make there for a specific audience, video game commercials are
a good example Game of Wart has a woman in its commercials who speaks in an alluring voice and
invites audiences to come join her. She is there for the male gaze, men are the desired customers
that companies look for, so she is there as a way of saying that this game will make the player feel
special and receive the

Individual Disclosure Decisions
In addition to analyzing the information, disclosers also consider the quality of relationship with the
audience, and predict how the audience is likely to respond when making disclosure decisions
(Greene, 2009). Typically, individuals will choose to disclose to those with whom they have a
higher relational closeness and quality, while concealing with those who are more distant. However,
situations arise that contradict these assumptions, as in the case of public disclosure of private
information. The individuals in this study disclose to an audience that varies in relational closeness.
Researchers have not yet accounted for individuals who reveal private information in public;
consequently, they do not understand what rules govern these individuals decisions. In this... Show

In addition to assessing the information to be disclosed, anticipated response is another method
disclosers utilize to determine whether to reveal their private information. Typically, individuals
only disclose when they have confidence in an accurate prediction of the audience s response
(Greene, 2009). Other scholars (Jellison Riskind, 1977; Jourard, 1971b; Omarzu, 2000; Taylor,
1968) have examined the rewards by which disclosers are motivated. Omarzu (2000) named five
social rewards: intimacy, or the pursuit of closeness; social control, wherein the audience can
bestow benefits or rewards for disclosure; social approval, or attempts to increase acceptance and
liking; relief of distress, during which individuals talk about problems and negative emotions to
relieve stress; and lastly, identity clarification, which helps to clarify self knowledge. As
individuals goals change and they desire differing social rewards, the disclosure changes either in
content or in the targeted audience (Omarzu, 2000). In the present study, individuals disclose
private information to a large, diverse

Essay On MLB Draft
The Show It has been said that people learn from mistakes (Roth 21) by prestigious and
successful individuals such as Dr. Bernard Roth, in an attempt to provoke people to chase their
dreams despite any mistakes or obstacles. The failure of becoming eligible for the MLB draft this
year is a colossal setback for playersinterested in being drafted. Although this is considered a
failing in society s eyes, these players have a chance to learn from there mistakes and use that
knowledge to eventually get drafted in a following year. Possibly the most substantial issue that
most of these athletes had to overcome would be lacking important knowledge necessary to
provide a respectable run at the MLB draft. The lack of knowledge can be broken up into 3
aspects: beginning with a bad plan, having unrealistic expectations, and coasting in the baseball
portion. All of these factors contribute to teaching the athletes who failed this year how to succeed
next year. To begin with, athletes were doomed from the start if they did not have good workout
and eating plans, along with good time management skills. According to a freshman pitcher at
Northeastern Junior College, interested in the MLB draft, I found it difficult to find a way to
balance: practice, eating... Show more content on Helpwriting.net ...

of getting drafted because they will be prepared with an excellent plan, have a better idea at what

run at the MLB draft. This was a goal for many young athletes this year and even though failure was
the outcome this time, these hungry athletes will strive for their goal

Analysis Of Three Financial Companies Post Great Recession
Analysis of Three Financial Companies Post Great Recession
In the post great recession climate, no other industry has faced as many challenges as finance.
James Sterngold (2015) points out some of the challenges with the following:
Low interest rates will continue to squeeze the amount banks earn on their lending, keeping a lid
on their profits and revenues, many analysts and portfolio managers say. Regulations adopted
following the financial crisis, which were designed to make banks safer, will also continue to
restrain profitability by pushing lenders out of some business and forcing them to sell riskier assets
and hold more capital, crimping returns. (para. 3)

In January of 2009, the firm stepped up its efforts in its wealth management business by forming a
partnership with Citigroup called Morgan Stanley Smith Barney. Initially just a 51% stake in the
joint venture, the firm would eventually be the sole 100% owner of the business, and not
surprisingly, be the center of the firm s strategy in the post great recession era. With the financial
crisis and outrageous bailouts still fresh in the public consciousness, one of the most respected and
imposing investment banking franchises would tackle their problems by transforming from a run
and gun investment bank and trading house with a midsize wealth management arm, to a financial
services company split almost evenly between retail brokerage, and trading and managing capital
for companies and institutions (Salzman, 2014).
So far, the strategy has yielded promising results in its most recent fourth quarter earnings
announcement, the firm s wealth management segment posted revenues of $3.751 billion versus its
two other business segments, institutional securities with $3.419 billion and investment
management with $621 million, respectively wealth management is now its highest earning
business segment in terms of revenues. In addition, the firm s total bottom line and top line
numbers both beat expectations with $0.39 per share vs. Wall Street estimates of $0.33 per share,

Ancient Roman Times Research Paper
Reading in the ancient roman times was different and similar from reading in the US today. The
ancient romans read from scrolls made out of sheets of papyrus or wooden tablets covered with
wax. We read from stacks of printed paper fastened together at one side. But there are also
similarities between the two. The first difference between reading in the ancient roman times and
reading in the US today is that the ancient romans would have public reading sessions. Public
reading became the central pillar of Roman literary life. People would recite epics, tragedies,
comedies, and lyrics, but mostly poetry. They d regale crowds, at dinner parties, in plazas/forums,
and during the Games (gladiator fights, fights between animals). This lust for readings did, at least,
begin with a love of words.
To the romans, reciting one s own words was self promoting and egotistical. It was only acceptable
to read the works of dead authors. The ... Show more content on Helpwriting.net ...
On average, authors earn about $50,000 a year. When a publisher accepts your book, you will
receive money for it prior to publication . So as long the publisher keeps your book, you could
continue to earn additional money in form of royalties in years to come . A royalty is an agreed
portion of income from a work paid to its author.
Though ancient roman reading and US reading today is very different, there are also some
similarities. Like in the US, reading was an essential part of education. Reading and writing, in
general, are undoubtedly some of the most valuable skills one can have; obviously, having these
skills makes is much easier for people to communicate and to participate in society. Literature is an
important part of our lives. It develops our minds, gives us an education, and so much more.

Synthesis Essay On Landfill
Trash. It s everywhere, and people just throw everything into one big pile of it at a disgusting
landfill. There is a solution to this problem, recycling. Recycling is the best way to reduce the
pollution associated with incineration, costs of landfills, and also preserve natural resources.
By recycling we can reduce the pollution associated with other methods of traditional garbage
disposals. According to Source 1, Incinerators produce at least 210 different organic chemicals
which are either released into the air or remain in the ash, which is then dumped in landfills. This
shows that incinerating garbage can be harmful to people because the ashes get dumped into
landfills where people work. The ashes can get blown into the wind and carried away to places
where people can breathe it in. Others can argue that recycling causes more pollution. Source 3

Making paper that is using recycled pulp, for instance, is much less energy intensive than using new
wood. While there are benefits to growing trees because of the carbon that they consume, this has to
be offset against the damage that is done to the environment by putting paper in landfills and using
energy to produce new items. (Source 3) This quote explains that by making paper using recycled
products it uses less energy than making paper by newly cut wood. Also it saves new trees from
being cut down. Some might argue that the resources are being resupplied. In Source 1 it quotes,
...this argument fails to take into account that the high rate of cutting and replanting is turning
natural forests into tree plantations. This tells that the rate of cutting trees is higher than the
planting meaning the new trees barely get time to fully develop before they get cut

Will Australian Open Tennis Tickets See The Resurgence of the Old Guard?
Not to be lost on the American dominance by the US youth movement was the feat of Kaia

Goldberg Machine Vs Google Docs
The need for social ingenuity is more important than the need of technological ingenuity.
Our experience with both, the Rube Goldberg machine and the Google Docs document to
generate class notes support the author s central argument, we may be creating a world that is
too complex and unpredictable to manage. This can be demonstrated in three different ways, by
showing how a greater complexity can lead to greater problems, by explaining how the
mesoscale affects us, and by showing how a solution may open a gap rather than solving a
problem. the author of the book has traveled all over the world to find a solution (if one there is) to

We can compare this with the Rube Goldberg machine because of several similitudes, for
example in order for the Rube Goldberg machine to work and achieve its simple task, every
single one of its steps has to achieve its purpose, if one of the steps fail the rest of the machine
fails as well. This is a clear example of why complexity could appear unmanageable sometimes,
there are many factors to consider, and as the machine becomes more and more complex there
will be more and more problems. This is because perfection is unachievable and the closer we get
to it the more problems we will have to face, by reason of that perfection can be compared to an

The Importance Of Growing Up In A Polish Language
Growing up, in a Polish household was very difficult for me since I was the only one out of my
siblings who did not have a clue about our language. My parents were both born and raised in
Poland, so in our household my parents would communicate to us in Polish. My mother is fluent in
both polish and English, but my father is only fluent in Polish, his English is pretty broken. The
years went by and it was growing more complex to communicate with my father, since he is only
fluent in polish and I only knew how to communicate in English. So my parents came to an

to the material, I began to progress. With the help of my parents and teachers, I was starting to

Slowly, but surely I was gaining the confidence in my polish, my parents, would review with me

Medieval Castles Why Were They Important
What are castles?
Castles are immense building in the medieval times. They were built by an important person or a

What were they used for?
Castles were used as a home and a fortress, they were build and used for safety from other kings
but also built for a home and a place for the king and or queen to stay. Castles were also build to
flourish that the owners were wealthy.
Why were they important
Castles were built of hilltops or surrounded by water, to make them easier to defend. The castle was
important because it was a home to the kings, the king was where are the decisions were made, it
s like the president today. It was also protection to the king. Castles are also a good artefact because
we get to see and idea of our past.
During the 12th century the castles had improved and had been strengthened by using stone as a

is obstacle that J. League confronts. There has seen a dramatic growth in the globalization of

requirement and as long as you have management skills your qualified. They were then asked if
there were any new developments on the horizon that could affect future opportunities. Nikki
said online shopping has made a huge impact in the way shoppers like to shop, and because
online shopping is so popular stores are not as busy anymore. Carol says the changes in the
economy affect the future opportunities. Erica said there were not really any new

only thing that can affect future opportunities are not continuing to learn new techniques or
tricks . the beauty industry is constantly changing and you need to know how to keep up with the
latest trends and be willing to learn them. When asked why people leave these fields: Erica and

The Death Of A Police Officer
On Aug. 9, 2014, two unarmed teenagers were walking the streets of Ferguson, a suburb of St.
Louis. The names of the two unarmed teenagers were Michael Brown and his friend Dorian
Johnson. All of sudden a police officer named Darren Wilson rushes towards them in his police
car and begins to tell them to get on the ground. The boys had committed no crime and were only
one mile from their destination, they were simply trying to get home and off the streets. Things
escalated and the officer pulled out his gun and told them that he would shoot them. As he was
saying these words the officer pulled the trigger and shot Michael Brown. Both of the boys
started sprinting away from Officer Wilson. The officer continued to pursue Michael Brown and
then the unthinkable happened. Dorian Johnson says in an interview, He shot again, and once
my friend felt that shot, he turned around and he put his hands in the air and he started to get
down, but the officer still approached with his weapon drawn, and he fired several more shots .
Michael Brown was shot dead. The shooting immediately caused riots around the community of
Ferguson for weeks. This story is one of the many examples of what is called biased based policing.
The officer chose to do what he did because of his racial bias. Not all biased based policing is
sparked by racial bias but it is one of the bigger issues. The main issue is figuring out what needs
to be fixed in order to refrain from instances like the one in Ferguson.

Introduction
A man was running walking to his destination and came across a mountain. He could hear the
sounds of those who were chasing him. The mountain like a colossus stood defiantly in his path.
All that he had was a rope and no equipment to climb the mountain. It was either climb the
mountain or risk being caught. There was no other way to reach his destination. He looked at the
mountain and made a decision. He placed his hand upon the rock and started his ascent up the
mountain.
Some people saw the man climbing the mountain from a distance and laughed at him. The man
ignored his critics and moved upon the rock. Inch by inch, he climbed the mountain. Soon his hands
were sore, his feet hurting but he kept on climbing. He had no resources but his rope, his strength
and his mind. Many hours later, he stood upon the summit of the mountain. He did not climb the
mountain because the mountain was there. He climbed the mountain with no resources because he
had no choice.
Growth Hackers like the man climbing the mountain have to grow rapidly because they

The Push for Environmental Justice Essay
Every movement has its pros and its cons, and environmental justice is no different. The term
environmental justice emerged in the 1980 s, but the movement started as early as the 1970 s. Of
course, the want for environmental justice has always been there. All throughout history justice has
been sought after, and environmental justice is just half of it. Politics and the economy are extreme
factors to where and whom environmental injustice effect. Developing countries, such as Egypt, are
extremely high in environmental injustice, due to the extreme poverty. The reasons people create
and oppose environmental injustice are understandable, yet debatable for both sides. Some feel

Places of poverty, such as the Al Kheima district of Cairo, Egypt, are bustling with the growth of
major corporations spewing harmful chemicals throughout the district and infecting many with
ailment. It was said by Frederick Douglass that, Where justice is denied, where poverty is enforced,
where ignorance prevails, and where any one class is made to feel that society is in organized
conspiracy to oppress, rob, and degrade them, neither persons nor property will be safe. This
statement speaks for the justice portion of environmental injustice and is a common thought of all
environmental activists. Knowing the benefits and ailments many have gone further into creating
environmental justice. To prevent environmental injustice, and to receive justice for all, many
activists and government officials around the globe have made actions to stop environmental
injustice. After residents located near the Love Canal toxic waste dump in Niagara Falls, New
York, were notified of eighty eight harmful chemicals migrated near them, they ordered the state
relocate them. After the state s government refused the community members held protests for an
evacuation, eventually leading to President Jimmy Carter relocating the community. The infamous
Love Canal incident led to the Superfund Act in 1980. This law created a tax on the chemical and
petroleum industries and provided broad

a....that our governments are too unstable, that the public good is disregarded in the conflicts of

rights of the minor party, but by the superior force of an interested and overbearing majority.
2.Are these complaints valid in Madison s view?

2.What does Madison rely on to prevent one branch of government from encroaching on

Evaluating Visuals It s a visual world and people respond to visuals , Joe Sacco. Visuals add
power, interest and weight to a presentation. Visuals when added to a presentation not only help
present the information you are communicating, but also add color and emotion (Locker Kienzler,

presenters using visuals without thought about the purpose the visual is fulfilling. Visuals should

The visuals message that fear of accidents is overblown given the actual causes of death for
Americans is clear. A graph is the correct choice for conveying this information, but the 3D bar
graph utilized can distort the information conveyed. For example, the graph has heart disease as
the base of the pyramid, which makes sense given that heart disease was the leading cause of
death for Americans in 2003. But, the graph has other diseases as the middle of the pyramid and
looks like that is the largest group given how large its segment is. This distorts the information
being presented. The breakdown in accidental causes of death as well as other diseases creates

Global Marketing Strategy
Product Development
Product design development is an activity where the potential to globalize needs to be examined
carefully. A globally standardized product can be made efficiently at a low cost but may end up
pleasing few customers. On the other hand, customized products targeted at different markets
across the world may be too expensive. The trick, as in the case of other value chain activities is to
identify those elements of the product which can be standardized across markets and those which
need to be customized.
Japanese companies such as Sony and Matsushita have been quite successful in marketing
standardized versions of their consumer electronics products. These companies had limited
resources ... Show more content on Helpwriting.net ...
However, even for these products, local customization may be required in engineering, installation,
sales, service and financing schemes. In the case of financial services, institutional products tend to
be more global than the retail ones.
Consider a product like cars. Traditionally, car manufacturers have developed hundreds of models
to meet the needs of different markets without exploring the possibilities that exist for
standardization. Proliferation of models has resulted in unused capacities and inefficiencies. In
the global automobile industry today, substantial excess capacity exists. Under these
circumstances, car manufacturers are looking for ways to cut costs. One approach has been to
select common platforms and build models of different shapes around these platforms. The idea
here is that the basic functionality of a car can be extended globally while features and shape are
customized to appeal to different consumer tastes in various parts of the world. Ford and Toyota
have made a lot of progress in standardizing the platforms. Other automobile companies are also
laying a lot of emphasis in this regard.
Market Research
Now, let us move on to another important marketing activity, market research. Some elements can
probably be standardized. For example, the sample to population ratio can be controlled globally.
The information to be collected for each product category can also be

Theme Of Timshel By John Steinbeck
It is difficult to decipher the good and the evil that lives within people. John Steinbeck provokes
both virtues in the East of Eden, taking place in Salinas Valley, California in the 1900 s. The theme
that is subtly circling all over the book is the meaning of the word timshel which revolves around
the characters Cathy, Adam, and Caleb.
To begin with, a central theme in the story is the Hebrew word timshel. There are several
philosophical analyses involving this word throughout the book. Steinbeck brought it up through
the character Lee as he explained that the American Standard translation orders men to triumph over
sin...The King James translation makes a promise in thou shalt, meaning that men will surely
triumph over sin. But the Hebrew word, the word timshel Thou mayest that gives a choice (303).
This quote means that man can freely choose to be kind or evil which continuously connects both
Adam Trask and Caleb Trask throughout the book.
An example in the book is when Adam was dealing with his depression. Unfortunately, Adam had
not embraced the responsibility and role of fatherhood, resulting in disregarding his sons entirely,
much like his own father had. That vile feeling in Adam left him with the mindset that he would
never better. When he finally brought his mind back on track and started caring more about his
son s interests, it showed in the character s development as he let go of his father s ways and
became his own man.

War Propaganda Song Essay
The songs from World War I range from dark humor to sarcastic attempts to bitter complaints
about soldier s lifestyles during war. Based on what I ve heard and read, most of the lyrics are
propaganda for young men to join the war. These songs usually portray the conditions of soldiers in
the war in a good light. Another significant portion are lovesongs that soldiers sing to remind them
of their wife that they left at home with their children. Finally, a very small portion is the the anti
war songs that are strictly prohibited in music halls, the most popular form of popular song, where
music is played for the common folk who couldn t afford their own gramophones.

This song is sung from a prostitute s point of view; basically, she is saying that she everyone that
fights for the war makes her proud as a woman and she d gladly sleep with anyone who does. The
dark part of the song is that she lures in these unsuspecting men and makes them join the military
when they think they are going to be able to get down with her and her other friends.
One last example is Over There sung by Henry Burr:
Johnnie, get your gun, get your gun, get your gun,
Take it on the run, on the run, on the run,
Hear them calling you and me, ev ry son of liberty
Hurray right away, no delay, go today
Make your Daddy glad to have had such a lad,
Tell your sweetheart not to pine, to be proud her boy s in line The last two lines show the pride
soldiers inspire in others when they fight in the war, making it very ideal for those who want to
impress their parents and wives. Songs like these have had a huge impact on societies all over the
world because it is a form of entertainment and people listen to songs to pass time. In turn, they get
the song s messages and apply for the military.

King Creon In Sophocles Antigone
While reading the Greek play Antigone , written by the playwright Sophocles, one sees that a few
of the characters can be related back to the reader/watcher of the play. For instance, many people
can identify with the protagonist Antigone through her incomparable dedication in following the
laws of beings of greater power. Others might identify with the wise Tiresias, whose wisdom and
advice is given and taught across the land. However, for a fifteen year old boy such as I, I identify

To be able to speak confidently and know what you are talking about is one of the most
important abilities that one needs to convince others to join their cause. Just as King Creon did
in his reign over Thebes, I am able to use my words to the fullest. To cite the play that we had read
in class, Creon says: Polyneices, who broke his exile to come back with fire and sword against his
native city and the shrines of his father s gods, whose one idea was to spill the blood of his blood
and sell his own people into slavery (1, 34 37). When one reads Antigone without first reading the
plays Oedipus and Oedipus at Colonus, what Creon says isn t all that strange. Even so, if one has
looked through the first two plays, one realizes that Creon has used his words to completely
change the way that Polyneices is viewed by the townsfolk. Creon was able to use his words to
persuade others into believing that one of the sons of their old king was attacking Thebes to
deface their gods and sell all of them into slavery. In this sense of character, Creon and I are
homogenous beings. Identical to Creon, I can wrap people around my fingers via my words; a

Using A Sample Size Is Dependent On The Study Design
Research studies need not only start with efficient study design to address the hypothesis of the
study but also the determination of the appropriate number of participants that will be involved in
the study. It is true that the sample size is dependent on the study design, on statistical analysis used
to answer the study questions, and on the anticipated association between the outcome and the risk
factor. The sample sizeshould not be too large as it wastes money and time both to the
investigators and participants in the study. It should not be too small as well because it may lead
to inaccurate results causing a waste of time and resources. In addition, participates in a large
sample size may be exposed to unnecessary risk. Therefore, careful attention should be taken while
determining the appropriate sample size for any study as it raises the question of ethical practices.
Any researcher should define the main objective of the study or the research question and the study
design before selecting a representative sample size. Then the proportion of participants, and the
value of the numbers to put in the formula is considered before determining the sample size.
Kamangar Islami (2013) states that the non statistical consideration in determining the sample size
are the availability of the fund, ethical issues, number of participants available, the novelty of the
study, and any similar studies being conducted etc. The investigators give the rationale why their

Have you ever been blamed for something that you never took part in, or something you didn t

everyday in 1950 s when the second red scare occurred. The movie Good Night, and Good Luck
and The Crucible by Arthur Miller display the many false accusations that were brought upon the

There are two people who were falsely accused that were definitely surprising when reading and

characters are very similar in the sense that they both were wrongfully alleged to be people that

In the United States justice system, a tort is best defined as an injury or loss that was committed
deliberately or negligently by a single person or an entity (Crane). The history of tort law can be
traced back to the initial trespass of property or person, but it was not until the 18th century that the
distinction between intentional and unintentional acts was made (Columbia Electronic

from 1993, instead of seeing the increase claimed by the advocates, there has actually been a
decrease of tort filings by 5%. They also further there counter argument by showing that the
numbers of civil trials have dropped by 47% during the same time frame (ATLA). Though these
arguments are mainly presented to counter and invalidate the advocates of tort reformation, the

argument that the opponents have put forth to the public is the argument that corporations and
insurance companies are the worst abusers of the litigations system and setting forth new

corporations are using their vast resources to unfairly delay trials, pursue frivolous appeals, and

article explores how this mindset can easily affect how someone might think and act. Members

School uniforms help to build a sense of community within the school, as they create an atmosphere
of belonging. This essence of unity can positively affect a child s attitude toward school and can
lead to better learning and improved attendance. Just as an athletic team s uniforms promote unity
and spirit, a school uniform has the same lasting effect. A 2002 study of over 1,000 Texas middle

Syracuse University, stated that uniforms help...along with making troubled students feel they have
the support of a community. With school uniforms in place, all students no matter the age or
gender will feel included. Studies have shown that students part of an organization feel all 3 traits
of harmony: Pride, unity, and confidence. Students who feel this sense of harmony will not only be
more connected with their peers, but will also feel included and proud to be part of that

Purpose And Role Of Castles In The Middle Ages
From Historians to free lance enthusiasts one of the most interesting subjects of study is the
purpose and roles of castles in the middle ages. The strong fortified castles of England and Wales
have survived centuries of war and natural disasters that would surely destroy much of today s
modern architecture. While some may think of castles and immediately connect them to fairy tales
and princess s castles played a far greater role in the military and social development of the middle
ages. Whether it was military or socially castles were a way for men to establish their power
among their equals. At the beginning of the 13th century the architecture of castles was beginning
to change by becoming more fortified and defensive. The change of castles taking on a strategic

The solution was the build rounded walls that increased the walls strength and it also made it
increasingly harder for an arms man to angle the Trebuchet properly. Caerphilly was built in 1215
for Gilbert De Clare while this castle does have strong military protection it was also built to
establish De Clares social class and enforce his dominance in the region. When building a castle, the
architects not only had to pay close attention to its fortification but also its location and its strategic
advantages. Building a castle by the water allowed for an essay access to supply s and escape
routes, while building a castle up on a hill gives you a great advantage over invading army s.
While the roles of castles in the 13th century clearly point to a military purpose that begins to
change during the start of the 14th century. Castles start to become a way for nobility to establish
and maintain their social hierarchy. (Johnson; 2002, 6) We can see a clear example of this in the
architecture of castles that were built in the middle of the 14th

Boundary Issues Between Mexico And The United States
Boundary Issues between Mexico and the United States
The United States and Mexico share a boundary line that has many complex issues that are in
constant flux. Both countries are dependent on each other for safety and economics. In addition,
both countries have had conflicts in the past that include the Mexican American War and
revolutions that have bled into each other s territory. This essay s goal is to demonstrate the
boundary issues between the United States and Mexico. These issues include an ambiguous border
line, water rights, and environmental issues. These matters are a pressing concern because they
create hostilities between the governments and citizens of each country.
On April 25th 1846 a war started between the United States and Mexico. Known as the Mexican
American War, it lasted for almost two years. The United States invaded Mexico and the war
ended with peace talks. The peace talks resulted in The Treaty of Guadalupe Hidalgo. The
agreement gave United States ownership of what is now known as California, New Mexico,
Arizona, Nevada, and Utah. The Rio Grande river was designated as the boundary line that
separated Texas from Mexico. Moreover, the boundary between Arizona/New Mexico and Mexico
was ambiguous between the two countries. These boundary issues led to conflicts and was later
resolved with the Gadsden Purchase of 1853. Subsequently, these border disputes were consistent.
In the late nineteenth century the Rio Grande river shifted and Chamizal fell

Definition Essay On Underdogs
At first I didn t quit understand the meaning of an underdog . Without reading and asking for the
definition I really believed that this word was a term use to define some kind of a bad day at work
(dog s day). After reading the definition on Wikipedia I truly understood that I was wrong.
An underdog, as defined by Wikipedia is : a person or group in a competition, usually in sports and
creative works, who is popularly expected to lose. The party, team, or individual expected to win is
called the favorite or top dog. In the case where an underdog wins, the outcome is anupset. An
underdog bet is a bet on the underdog or outsider for which the odds are generally higher.
As I red the two stories of Seabiscuit and Jason McElwain I truly understood ... Show more content

Jason, with a mental disability overcame the odds by showing that being different as not an
illness. With less experience than Seabiscuits and Red, Jason showed his teammate that he could
play basketball has well as all of them. Being an assistant manager who had never played a game
during the year, he was introduced at the last few minutes of the last game and became a hero at
that moment but he showed everybody that he could play by scoring more points than everybody
during the whole game.
He was an underdog because no one believed he could play basketball and he proved everybody
wrong. He believed in himself and lived the present moment.
I ve never really seen myself as an underdog but being the only girl in a family of four kids I think
it makes me one. Since I have three brothers, we often do boys activities. They are very
competitive and often thinks that I can t be better then them. But a lot of times I win because I m
stronger then they are and I also have to prove them that I can play with them. So, like Seabicuits,
Red and Jason, I m not suppose to win against my brothers but more often then not I do...so I m an
underdog and very proud of it.
In conclusion I truly believe that there is an underdog in every one of us, you just have to believe
in yourself and you will find a way to impress and surpass

Examples Of Being Oppressed Women
Since the beginning of time, women were oppressed, mistreated, and not equal to men. They had
great reasons to fight for the rights that they deserve, like the right to vote. But in today s world,
the women who call themselves feminist believe that they are still at the same level of being
oppressed as their ancestors were. As a result, women focus what they think they don t have in
society and forget about the problems most men face every day. Feminism, although a very good
practice, is abused in today s world by giving too much attention to women and not enough to men
when talking about equality.
As of now, 2016, men and women have equal rights, are treated the same in a legal matter, and
both have similar ways of being oppressed. It would make sense that there would be a group run
by both men and women to push for true equality, not one run by only women saying that their goal
is equality, but in the end, only recognize oppressed women. The prejudice movement run by
women with false, biased, and uneducated values affected how the young people in this world think
about men. Teenage girls don t go beyond the false accusation they would find on the internet about
how women are the only oppressed gender and as a result, join the feminist movement and continue
to bash men. ... Show more content on Helpwriting.net ...
This is a very obvious and true statement that can be proved when looked at the history of women.
In the 20th century, and educated women with a high annual pay was greatly disrespected and
often physically assaulted. Most women at this level of education often quit their job to stop their
unwanted segregation. But being a normal , uneducated women were no different. All though men
didn t see the average woman as a direct threat, they still treated them as their underpart. The rights
that women didn t have but deserved only started to become part of law during the mid to late

  • 2. The Constitutionality Of The Public Accommodations Equal... The issue being brought before the court today is the constitutionality of the Public Accommodations Equal Access Act. In addition, it is also evident that the facts in this case raise the issue of congressional authority. Moreover, in order for the Court to come to such a determination, Congress justification for the passing of such an act, as well as the powers of Congress, will be reviewed. Because the act was implemented in order to forbid discrimination based upon sexual orientation in dining, entertainment, and lodging establishments, we must first address whether sexual orientation is granted equal protection under the law. The federal government is obligated by the Fifth Amendment to ensure that no person shall be deprived of life, liberty, or property, without due process of law as well as ensuring equal protection under the law. In order to determine whether persons are discriminated against fairly, the strict scrutiny test is applied. He is considered to be of the era in which Art and particularly Paintings were influenced by elements such as constant change, transition, fluidity, movement and distance etc. He s considered as a pioneer of DADA , a movement that questioned the deep rooted assumptions about what art should be and how it should be made . He himself was intrigued by the concept of a fourth dimension. He wasn t just a painter but also a sculptor and writer. He always saw art as evolving and creating new things. Duchamp reproduced Mona Lisa in 1919 as just a spoof, but it shocked the people of that time and its final outcome gave birth to a whole new form of Art. • 5. Media Reflection Paper Today the life revolves around media, it is on people s phones, media decorate their walls, and for some media is their job. Since media is such an inescapable part of the modern landscape it is significant that we as individuals understand how the media works and how it affects us. In this course, the nature of the mediahas been unraveled to reveal the ways that it has impacted society and how it has done this. This class has made me became more critical of the media in my life and now even without thinking I recognize patterns, and in some cases toxic themes in the media I consume. Looking back on this semester and what I have learned I can see that I have become more media literate in many ways, primarily in the areas of awareness and analysis. I have become more aware of the way media is constructed. Some things that have stood out to me since I have started this course is for example the other day when I flew into the ST. Louis airport after Thanksgiving break one of the monitors in baggage claim said that it was CLear Channel TV before this course I do not know what clear channel was and I knew that the entertainment business was an oligopoly but I did not realize the extent. Seeing this was a moment of realization, that what I read was real, this one company has its hands in every pot. I have also noticed how much media means to people, I was speaking to one of my friends and I mentioned that I thought marvel was better that DC and she became very upset at me. It occurred to me that being a DC comics fan was a part of her identity, before I knew that people took entertainment personally but it was not actively looking for it. I have increased my ability to analyze the media I consume, now I am more aware of the way industries target audiences. One of the easiest ways this can be seen is in commercials, advertisers make there for a specific audience, video game commercials are a good example Game of Wart has a woman in its commercials who speaks in an alluring voice and invites audiences to come join her. She is there for the male gaze, men are the desired customers that companies look for, so she is there as a way of saying that this game will make the player feel special and receive the ... Individual Disclosure Decisions In addition to analyzing the information, disclosers also consider the quality of relationship with the audience, and predict how the audience is likely to respond when making disclosure decisions (Greene, 2009). Typically, individuals will choose to disclose to those with whom they have a higher relational closeness and quality, while concealing with those who are more distant. However, situations arise that contradict these assumptions, as in the case of public disclosure of private information. The individuals in this study disclose to an audience that varies in relational closeness. In addition to assessing the information to be disclosed, anticipated response is another method disclosers utilize to determine whether to reveal their private information. Typically, individuals only disclose when they have confidence in an accurate prediction of the audience s response (Greene, 2009). Other scholars (Jellison Riskind, 1977; Jourard, 1971b; Omarzu, 2000; Taylor, 1968) have examined the rewards by which disclosers are motivated. Omarzu (2000) named five social rewards: intimacy, or the pursuit of closeness; social control, wherein the audience can bestow benefits or rewards for disclosure; social approval, or attempts to increase acceptance and liking; relief of distress, during which individuals talk about problems and negative emotions to relieve stress; and lastly, identity clarification, which helps to clarify self knowledge. As individuals goals change and they desire differing social rewards, the disclosure changes either in content or in the targeted audience (Omarzu, 2000). • 8. Essay On MLB Draft The Show It has been said that people learn from mistakes (Roth 21) by prestigious and successful individuals such as Dr. Bernard Roth, in an attempt to provoke people to chase their dreams despite any mistakes or obstacles. The failure of becoming eligible for the MLB draft this year is a colossal setback for playersinterested in being drafted. Although this is considered a failing in society s eyes, these players have a chance to learn from there mistakes and use that knowledge to eventually get drafted in a following year. Possibly the most substantial issue that most of these athletes had to overcome would be lacking important knowledge necessary to provide a respectable run at the MLB draft. The lack of knowledge can be broken up into 3 aspects: beginning with a bad plan, having unrealistic expectations, and coasting in the baseball portion. All of these factors contribute to teaching the athletes who failed this year how to succeed next year. To begin with, athletes were doomed from the start if they did not have good workout and eating plans, along with good time management skills. Regulations adopted following the financial crisis, which were designed to make banks safer, will also continue to restrain profitability by pushing lenders out of some business and forcing them to sell riskier assets and hold more capital, crimping returns. The ancient romans read from scrolls made out of sheets of papyrus or wooden tablets covered with wax. We read from stacks of printed paper fastened together at one side. But there are also similarities between the two. The first difference between reading in the ancient roman times and reading in the US today is that the ancient romans would have public reading sessions. Public reading became the central pillar of Roman literary life. People would recite epics, tragedies, comedies, and lyrics, but mostly poetry. They d regale crowds, at dinner parties, in plazas/forums, and during the Games (gladiator fights, fights between animals). This lust for readings did, at least, begin with a love of words. Recycling is the best way to reduce the pollution associated with incineration, costs of landfills, and also preserve natural resources. By recycling we can reduce the pollution associated with other methods of traditional garbage disposals. According to Source 1, Incinerators produce at least 210 different organic chemicals which are either released into the air or remain in the ash, which is then dumped in landfills. This shows that incinerating garbage can be harmful to people because the ashes get dumped into landfills where people work. The ashes can get blown into the wind and carried away to places where people can breathe it in. Others can argue that recycling causes more pollution. To begin with, a central theme in the story is the Hebrew word timshel. There are several philosophical analyses involving this word throughout the book. Steinbeck brought it up through the character Lee as he explained that the American Standard translation orders men to triumph over sin...The King James translation makes a promise in thou shalt, meaning that men will surely triumph over sin. But the Hebrew word, the word timshel Thou mayest that gives a choice (303). Using A Sample Size Is Dependent On The Study Design Research studies need not only start with efficient study design to address the hypothesis of the study but also the determination of the appropriate number of participants that will be involved in the study. It is true that the sample size is dependent on the study design, on statistical analysis used to answer the study questions, and on the anticipated association between the outcome and the risk factor. The sample sizeshould not be too large as it wastes money and time both to the investigators and participants in the study.
