Federalismo o Iperlocalismo nelle rifome italiane?Nicola_C_Salerno
Sono passati quasi dodici anni dal D. Lgs. n. 56-2000, il primo atto normativo che ha tentato di reimpostare il finanziamento e la governance della sanità su basi federaliste. Da allora, il Legislatore è intervenuto più volte sul tema, dalla riforma costituzionale del 2001 sino alla Legge n. 42-2009 e alla sua scia attuativa, passando per varie ipotesi di realizzazione del federalismo, alcune rimaste in bozza, altre arenatesi nella discussione parlamentare, una anche respinta con referendum costituzionale nel 2006. Quasi dodici anni di “cantiere” federalista, senza riuscire ad approdare ad un rinnovato modello di governance, completo in tutte le sue parti, economico-finanziarie, istituzionali, di regolazione, di rappresentanza e responsabilizzazione politica.
L’attestazione dell’incapacità a chiudere la trasformazione federalista è arrivata adesso. L’urgenza della crisi ha obbligato a cambiare prospettiva. Da un approccio sistemico e strutturale si è passati, con la spending review “Monti-Giarda”, a focalizzare l’attenzione su poche significative poste di bilancio, fissando per loro dei livelli standard. La ricerca di risparmi rapidi ha reso necessario ripiegare su strumenti di governance già sperimentati in passato, come i target su singole voci di spesa, in contraddizione con tutto il processo legislativo condotto almeno dal 2009 ad oggi, che aveva scelto di impostare la standardizzazione a livello macro e secondo una logica top-down. Il livello macro per lasciare alle Regioni una sufficiente sfera di autonomia organizzativa nell’allocazione delle risorse tra funzioni e capitoli di spesa. La logica top-down per inserire il finanziamento all’interno di un andamenti sostenibili delle finanze pubbliche.
È stata proprio quella sfera di autonomia organizzativa a costituire uno dei punti deboli della via italiana al federalismo. Non perché di principio essa non sia corretta e anzi auspicabile, ma perché è rimasta solo a livello di disegno del meccanismo di finanziamento, e non si è approfondita sul piano operativo, non è stata sorretta da un sufficiente disegno delle Istituzioni e delle relazioni tra livelli di governo e amministrazione.
Utile portare un esempio concreto di questa incompletezza del federalismo che, a fronte di un tentativo di costruire un finanziamento in prospettiva strutturale e sistemica, ha sottovalutato l’esigenza di un parallelo approccio sistemico anche per quanto riguarda lo svolgimento operativo delle varie funzioni (Il famoso “chi fa che cosa?”). Questo punto di debolezza ha sinora esposto al rischio di iperlocalismo, che è una delle degenerazioni del federalismo.
Tempo fa ho ricevuto in CeRM questa mail di una cittadina che mi chiedeva lumi sulla disorganizzazione che pervade i rapporti tra Regioni e tra Regioni e Enti Locali. Suggerisco di leggerla per intero questa mail, perché porta un riscontro concreto della frammentazione e sistemica e delle sovraspese evitabili.

Nel dibattito che accompagna i tentativi di riforma degli esercizi farmaceutici e della distribuzione del farmaco si continua, in maniera pretestuosa, a far riferimento a un presunto contrasto tra da un lato le indicazioni dell’Agcm e della Commissione Europea e, dall’altro, le sentenze della Corte Costituzionale e della Corte di Giustizia Europea.
Agcm e Commissione chiedono il superamento degli aspetti anti-concorrenziali e di chiusura corporativistica che caratterizzano il settore. Dalle due Corti sopraggiungono sentenze che, a prima vista e soprattutto ad occhio inesperto, potrebbero sembrare sconfessare Agcm e Commissione.
Il disallineamento è solo apparente. Tra l’altro, per quanto riguarda la Corte di Giustizia Europea, spetta ai Giudici nazionali formulare il quesito pregiudiziale in termini precisi e netti, in modo da ottenere dalla Corte una pronuncia circostanziata. E lo stesso si può dire dei ricorsi alla Corte Costituzionale: è dal tenore della domanda del ricorrente che dipende la "praticabilità" della risposta del Giudice costituzionale.
È importante liberare il campo da convincimenti infondati e pretestuosi sui rapporti tra Agcm, Commissione, Corte Costituzionale e Corte di Giustizia Europea. Se questo punto di vista sbagliato viene propugnato e si concretizza sulla distribuzione del farmaco, è concreto il rischio che esso venga esteso anche ad altri settori sovraregolati e presidiati da lobby.
Non è accettabile che equivoci istituzionali di questo tipo trasformino l’affermazione della legalità in un’azione di natura soltanto formale, non falsificabile, e strumentalizzabile per mantenere lo status-quo anche quando palesemente pervaso da storture corporativistiche.
