both verdict and sentence. However, unlike the pragmatic approach of the British, the Canadian legislators did not
provide statutory guidance to the judiciary on the parameters for the exercise of this new power. It was therefore left
to judges and the courts to fashion common law principles and procedures for the admission of fresh evidence with
respect to verdict appeals, appeals from sentence and to a lesser extent references by the Minister of Justice to
Canadian appellate courts. Each is discussed in turn in the sections that follow.
