• National objective for energy savings until 2016 - 9 % of the
averaged value of the energy end-use for the period 2001-2005 –
i.e. for 9 years (on the average by 1 % annually). It amounts to 7
291 GWh.
• Pursuant to the requirements of Directive 2006/32/EC on energy
end-use efficiency and energy services, First and Second 3-year
action plans in the energy efficiency field have been developed.
• The First plan for the period 2008–2010 formulates an interim
indicative objective of 3 % for fuel and energy savings. The Second
plan is for the period 2011–2013 and formulates a second interim
indicative objective of additional 3 %. For the period since 2008 the
reports have shown overachievement of the objective.

4. Allocation of the national
objective for energy savings
The national objective for energy savings has been allocated as
individual objectives for energy savings among three groups of
obliged persons, namely:
• energy traders;
• owners of public service buildings in operation with total
build-up area over 1 000 m2;
• owners of industrial systems with annual energy consumption
over 3 000 МWh.

Main goal of the Energy Efficiency Act (ЕЕA) – to make a significant
contribution to the country objectives in the EE field, reduce the energy
consumption and encourage the improvement of the energy
performance of the buildings.
The first independent energy efficiency act was adopted in 2004.
During 2008 a new Energy Efficiency Act was approved to transpose
Directive 2006/32/ЕC on energy end-use efficiency and energy services
and Directive 2002/91/ЕC on the energy performance of buildings.
In May 2013, Energy Efficiency Act Amendment Act was approved,
which completely transposed Directive 2010/31/ЕU on the energy
performance of buildings. The Act regulates the EE activities, and
compliant to its provisions the national objective for energy savings is
allocated as individual objectives for energy savings among three
groups of obliged persons.

New aspects in the EEA adopted during 2013 in connection with
the transposition of Directive 2010/31 on the energy
performance of buildings:
For new buildings – to comply with the minimum EE requirements,
before the construction to review and consider the technical feasibility
related to the installment of systems using energy from RES;
For overhaul of existing buildings – the energy characteristics of
the building or of its repaired part should be improved in such a way
as to meet the minimum energy performance requirements, as far as
this is technically, functionally and economically feasible;
The threshold for issuing energy performance certificates is lowered
to 500 m2 for public service buildings, and from 9 July 2015 this
threshold will be lowered to 250 m2;
A requirement to develop a National plan for increasing the number of nearly
zero-energy buildings (nZEBs) has been introduced.

7. The energy services are performed based on written contracts,
signed with the end energy consumers. The Energy Efficiency Act
regulates the following services:
• Energy efficiency auditing of buildings and industrial systems and
building certification
• Energy efficiency management in buildings and industrial systems
• Energy saving contracts with guaranteed result – ESCO contracts
Regulated in a special ordinance to the Energy Efficiency Act
Pursuant to the ordinance, in the public sector budgets funds are
planned and provided, which correspond to the normalized energy
costs of buildings.

8. The new European legislation

On 25 October 2012 the Energy Efficiency Directive 2012/27/ЕU was
adopted to change Directive 2009/125/ЕC and Directive 2010/30/ЕU
and to repeal Directive 2004/8/ЕC and Directive 2006/32/ЕC.
The Directive introduces a thoroughly new approach to encourage
the energy efficiency within the European Union, applying legally
binding measures with the aim to stimulate the member states to
multiply their efforts for the more efficient energy use at all energy
chain stages – from the energy transformation, through its transition
and distribution to the end-use point.

9. Bringing the Bulgarian legislation in
compliance with the new European
legislation
New Energy Efficiency Act – a draft for new Energy Efficiency Act
has been developed. The bill has been approved by the National
Assembly at first reading and its second reading is pending.
National Energy Efficiency Action Plan – During the plan
development the inclusion of all responsibilities pursuant to the
Energy Efficiency Directive has been ensured and the requirements
of the repealed Energy Services Directive, which are still effective, as
well as the requirements related to the Energy Performance of
Buildings Directive.

10. New Energy Efficiency Act
• The draft of new Energy Efficiency Act has been developed in
connection with the transposition of the provisions of the Energy
Efficiency Directive 2012/27/ЕU;
• The aim of the draft is to make a significant contribution to the
achievement of the national EE objectives, thus enabling the sate
to actively participate in the EU efforts for achieving the common
community goal for 2020;
• The draft regulates the establishment of the national energy
efficiency goal for 2020.

11. Scheme of energy efficiency
obligations
To support the implementation of the national objective, energy
efficiency improvement objective at the end-use energy is
introduced, which has been allocated as individual objectives among:
end suppliers, suppliers of last resort, traders with electricity”,
thermal energy and natural gas within the meaning of the Energy
Act, supplying energy to end clients and traders with liquid fuels
(with the exception of the fuels for transport purposes) and solid
fuels.

12. Scheme of energy efficiency
obligations
During the implementation of the individual energy saving
objectives, a possibility has been envisioned for the obliged persons
to offer energy services at competitive prices through companies for
provision of energy services and/or through installments made to the
Energy Efficiency and Renewable Energy Sources Fund or to other
financial intermediaries. Besides that, agreements with companies
offering energy services, or with other non-obliged parties, may be
concluded for the transfer of energy savings through transfer of
energy saving certificates.

13. Energy efficiency audits
• An obligation is introduced for undertaking measures in all heated
and/or cooled state-owned buildings to improve the energy
performance of at least 3 % of their total build-up area each year.
• The provision of energy efficiency audits in all sectors for all end
clients is encouraged and the enterprises, which are not SMEs, are
obliged to be subjected to energy efficiency audits at least once
per each 4-year period.

14. New National Energy Efficiency
Action Plan (NEEAP)
• NEEAP for 2014 is the third NEEAP after the two action plans,
submitted during 2007 (for the period 2008-2010) and during 2011
(for the period 2011-2013), as a part of the requirements pursuant
to Directive 2006/32/ЕC.
• NEEAP has been presented in front of EC during 2014 and is the
first plan compliant with Directive 2012/27/ЕU.

15. Main aspects in NEEAP
• Determination of the national energy efficiency objectives by 2020:
• Energy savings in the end-use energy: 716 ktoe/y.
• Energy savings in the primary energy consumption: 1 590 ktoe/y, out of
which 169 ktoe/y in the processes of transformation, transmission and
distribution in the energy sector.
• Specifying the obliged persons pursuant to the scheme for energy efficiency
obligations;
• Specifying energy efficiency measures related to the heating and the cooling
processes;
• Specifying energy efficiency measures related to energy transformation,
transmission & distribution and consumption optimization.
