This document discusses legal considerations for marketing communications, promotions, and competitions. It notes that marketing cannot materially mislead consumers or cause widespread offense. Promotions must deal fairly with participants and avoid unnecessary disappointment. Competitions must have rules that are transparent and prizes awarded according to chance. The response discusses some imagery in advertisements that could potentially be seen as encouraging violence but is incorporated into cartoon artwork. A marketing stunt involving costumed characters handing out promotional items in public is mentioned, but could potentially be seen as controversial. Overall, the marketing plans do not include any competitions, promotions that would mislead consumers, or cause unnecessary disappointment.

Legal Marketing
1. LEGAL CONSIDERATIONS (Cap Code)LEGAL CONSIDERATIONS (Cap Code)
MISLEADING ADVERTISING
“Marketing communications must not materially mislead or be likely to do so.”
Are their exaggerations?
Is information withheld?
Is the imagery used representative of your game?
HARM AND OFFENCE
“Marketing communications must not contain anything that is likely to cause serious or
widespread offence. Care must be taken to avoid causing offence on the grounds of
race, religion, gender, sexual orientation, disability or age.”
Does your marketing encourage or condone violence or anti-social behaviour?
Does your campaign cause fear or distress without justifiable reason?
Is there any action or image that could be construed as offensive?
PROMOTIONS
“A sales promotion can provide an incentive for the consumer to buy by using a range of
added direct or indirect benefits, usually on a temporary basis, to make the product
more attractive.”
Does your promotion deal fairly and honorably, promptly and equitably with participants
and potential participants?
Does your promotion avoid causing unnecessary disappointment?
COMPETITIONS
“Promoters of prize draws, including instant wins, must ensure that prizes are awarded
in accordance with the laws of chance. Choosing winners using a computerised
selection process is acceptable as long as that process is demonstrably fair and
genuinely random.”
How are you going to make clear the rules of your competition/prize draw/promotion to
ensure it is transparent and fair?
Some of the advertisement contains the use of imagery that displays the games main
character as a more detailed animated version which may give a different idea on what
gameplay the game contain.Although it is quite clear that it is artwork representing the
character.
We have not used any competitions in our marketing plan as we have only the use of
advertisement, promotional products and a marketing stunt.
There is use of a character holding a gun in some parts of the adverts and stickers.
This may be looked at as encouraging violence or even seem offensive to the viewer,
but is incorporated into a cartoon styled artwork which has a less serious affect on
viewers. In our marketing stunt there will be the use of dressed up ninjas walking
around popularised parts of town. They will be handing out ninja star shaped leaflets
which are in no way harmful. This may be seen as a controversial stunt to take place in
public.
We have not used any promotions or promotional products that would lead to any
unnecessary disappointment or exaggerate the game in any way, which would lead the
viewer to think the game is a conpletely different product.
