The United States Constitution Vs. American Civil...
The United States Constitution gives the American people their freedom so to speak. The
Constitution outlines many things that other countries don't offer their citizens such as freedom of
speech, religion and the press. The First Amendment of the Constitutions guarantees that the United
States people have rights to freedom of expression and freedom of religion without the interference
of the government. The Bible states in Deuteronomy 17: 18–19, "Now it shall come about when he
sit on the throne of his kingdom, he shall write for himself a copy of this law on a scroll in the
presence of the Levitical priests. It shall be with him, and he shall read it, all the days of his life, that
he may learn to fear the Lord his God, by carefully observing all the words of this law and these
statutes". These laws have been called into question on several different occasions. However, like
anything else, there are some stipulations with these laws. Reno v. American Civil Liberties Union
(ACLU) did shed some insight on the laws and how they can be interpreted. This paper will discuss
the criminal statute issues, issues with the provisions of the Constitution, and the status of criminal
prosecution for transmission of pornography over the internet. With the hopes of having a clearer
understanding of Reno v. American Civil Liberties Union. The First Amendment was a key
component in Reno v. ACLU. It states that Congress shall make no law abridging the freedom of
speech. The Courts

Literature Review On Racial Profiiling
This essay reviews the literature on racial profiling in Courtelaney Pass. Racial profiling is a
policing method that has increasingly become scrutinized over the years in Courtelaney Pass. An
overwhelming number of individuals in the city are subject to racial profiling. Contrary to 55%
white, 38% black, and 7% Hispanic, the blacks and out of town travelers passing through receive
87% of the speeding tickets.
In addition, racial profiling can occur to women and men, all age groups are used against people
from all socio–economic backgrounds, and occurs in rural, suburban, and urban areas (Amnesty
International, 2007). This, racial profiling is an issue in Courtelaney's society that can no longer be
overlooked. The following literature ... Show more content on Helpwriting.net ...
Racial profiling has been one of the most controversial issues in Courtelaney Pass. The issue of
racial profiling is extremely important because thousands of individuals are being affected by it.
Many federal, state, and local agencies across the United States have viewed the issue as detrimental
to our society; thus, more and more research on the issue is taking place throughout the years.
Government agencies are not the only agencies that are connected with the work of exploring racial
profiling within law enforcement; groups such as the American Civil Liberty Union (ACLU) and the
National Association for Colored People (NAACP) are also involved in investigating racial
profiling.
Therefore, the following literature review will examine articles and their findings within this
controversial topic.
1) Data:
a. The independent variable which will be evaluated is racial profiling. The dependent variables
which will be evaluated are police conduct. The units of analysis are minorities.
b. The investigators, of the secondary data which I will be using, operationalized their variables by
surveying 80,237 individuals across the United States and documenting their contact with the police.
The data was collected between July 1, 2005, through July 31, 2005, using a stratified multistage
cluster sample. A weight was used in order to obtain national estimates. In addition, the mode of

Persuasive Essay On Stop And Frisk
Parayno, Jay–Mard

December 11, 2016
Stop and Frisk Stop and frisk is a tactic designed for reducing crime by allowing police officers to
stop and search individuals that may seem suspicious. This law allows police officers to search
individuals only if they have reasonable suspicion that a crime might occur or if the suspect is
carrying anything illegal or dangerous. Between the years of 2002 and 2016, there have been 5
million stop and streets interrogations, and nine out of 10 individuals who were stopped have been
completely innocent ("Stop–and–Frisk Data"). With that being said, stop and frisk should not
continue to be a policing tactic because it is ineffective, it gives too much power to police officers,
and promotes racial profiling. One misconception that many believe is that the stop and frisk
program brings in many criminals or even those that have potential; however, many stop and frisk
incidents were unsuccessful, making the tactic ineffective. According to the NYPD's own report,
over 100,000 people were stopped every year since 2002 and every year above 77% were innocent
("Stop–and–Frisk Data"). In an interview conducted by Amy Goodman for Democracy Now, she
interviews a NYPD officer named Adhyl Polanco ("NYPD Officer Risks"). He states that the
officers will cuff anyone just to meet their quota. Polanco continues, But when you take that he's a
male black, he's 14, 15, he's walking down the corner, he doesn't look like he belong

Is Censorship Harmful For School
Censorship is keeping knowledge or information away from any person. Just think if a community
was completely censored, everything and everyone would be the same, like in the book The Giver
by Lois Lowry. Nobody wants to the the same as someone else, us as people of the U.S. should be
able to be unique and different. Censorship is harmful to the community because it, restricts
children's learning experience, and restricts them from what the real world is really like. Some
people say censorship may be good for schools to some extent because it restricts students from
certain concepts that are inappropriate to teach. Although, that may be almost true, it is not. Many
people can argue that censorship is bad because it does not give students the full conception of
education (Censorship in the schools). Students could also learn how to discriminate and make
unthought decisions. If students were not growing intellectually, they could be controlled by many
people smarter than them because they do not know any better. "Censorship is harmful because it
results in the opposite of true education and learning" (Censorship in the schools). Just think if
parents, teachers, and school boards ban or restrict books from the students, is it good or bad? Many
people would say it is good because they do not want their children to read a book about violence,
that have cursing, or defacing of their religion. Also, many may say it is bad because it could keep
children from reading about

The Patriot Act Essay
The Patriot Act.
On September 11, 2001 Muslim terrorists instilled with a hatred of the west attacked the United
States in a brutal fashion. Planes were hijacked and flown into the World Trade Center in New York.
Over three thousand people were killed and the impregnable nation known as America was know
scared and vulnerable. Almost immediately the legislature began drafting an act that would make the
war on terror and the fight for homeland security a little easier to fight, this would come to be
known as the Patriot Act
"PATRIOT" is an acronym for "Uniting and Strengthening America by providing Appropriate Tools

This is especially true for groups of people in the United States. Immigrants, especially of Arab
origin and those with Islam as their religion are seen as terrorists. This is blatant racism and
discrimination which is also completely against what this country stands for.
Also concerned is the American Civil Liberties Union (ACLU). This is an organization that is
dedicated to raising awareness of civil liberties. The PATRIOT Act, as the name suggests is
supposed to protect the citizens of the country from attacks across its borders. It defeats its own
purpose in attacking from within the very people it's supposed to protect. In fact, it does almost the
opposite by provoking a fear and paranoia that tends to remind us of such wonderful events like the
Spanish inquisition or the Salem Witch Trials.
The ACLU talks about several groups that are unfairly targeted by the Act to the extent that the
constitution is being violated. I have already talked about Arab and Muslims but even neighbors are
supposed to report anything that "appears" suspicious. Turning people against each other is not only
a reminder of the above mentioned historical events but it also leads to fear in a place where none is
needed.
The Act gives law enforcement the right to search any building or residence that might prove
suspect. It seems that such suspicion is easy to provoke making it likely that an innocent law abiding
citizen will find himself

The Right Of Free Speech
Throughout American history, the foundation on which American democratic principles are based,
has been repeatedly tested. In the 1700s, the right of free speech was challenged when President
John Adams proposed the Alien and Sedition Acts. Adams attempted to stop the Democratic
Republicans such as Thomas Jefferson, from criticizing government decisions. Similarly, during the
Civil War President Abraham Lincoln challenged freedom of the press when he took action to
restrict the printing of military news. Lincoln ordered his generals in the field to control the press
and "crack down on speech critical of his administration" to limit dissent against the war effort.
However, one historical era stands out as a decidedly pivotal test of ... Show more content on

"Twentieth–century U.S. history saw two major episodes of repression and violence against
communists and leftist radicals," that occurred approximately three decades apart. During the early
part of the 1920s, America entered its first period of extreme anti–communist sentiment, the First
Red Scare. After the successful Bolshevik Revolution in Russia in 1917, American citizens began to
fear the threat of communist influence at home. At the end of WWI, American workers unhappy
with wages and spiralling inflation, launched widespread sometimes violent strikes with the support
of growing labor unions. Some of these unions called for government takeover of private industries.
For instance, railroad workers called for the national government to take permanent control of the
railroad system. The growing waves strikes signalled a period of extreme civil unrest; American
citizens became frightened that they would face a revolution similar to the one that had just taken
place in Russia. In response, Attorney General A. Mitchell Palmer, in an effort to gain the attention
of American voters to support his presidential aspirations, launched a nationwide crusade against
anyone he identified as having leftist views. Under Palmer's leadership, thousands of Americans
were arrested for taking part in alleged subversion, and thousands of others were stripped of their
civil liberties. "In violation of

The American Civil Liberties Union
When Americans first set their eyes on the 20th century, they hoped for a better life without war and
a prospering economy. This vision of freedom and liberty in America was quite bold, knowing there
were challenges ahead. There's always a price to pay and obstacles to go through when the
circumstances are not ideal. During the early 1900s, our country was evolving and starting a new
era. An era where blacks were no longer slaves, civil rights movements were occurring, and citizens
were having issues with the law. It was a moment in time that helped us understand why these
events occurred. From those events, wars, and movements, we can learn and improve from any
flaws we may encounter. As a nation, we will be better prepared and aware of these scenarios
because we reflect on our country's past. During World War I, the Progressives, who are a political
party later called the American Civil Liberties Union, talked about our individual rights as citizens
and the liberty we fought for. Before we entered the war, our legal rights were taken away, and left
many in the U.S very upset and worried. "In 1917, a group of Pacifists, Progressive shocked by
wartime attacks on freedom of speech, and lawyers outraged at what they considered violations of
Americans' legal rights formed the Civil Liberal Bureau." (The Fight for Civil Liberties, pg. 135).

Racial Profiling And The American Civil Liberties Union
Police brutality has been in the headlines for years. Reports continually stream in, exhibiting the
needless force displayed by police. However, the people don't always have all the information. The
media shows the aftereffects itself, not the reasons why the victim was targeted. Perhaps it was a
justified arrest. Maybe it was simply because the target of the attack wasn't white. Police are
constantly put on trial for their crimes, but the community may never know the whole truth. The
pain and misery caused by racial profiling greatly outweighs the positive aspects.
Racial profiling is vastly different from criminal profiling. Racial profiling, as stated by the
American Civil Liberties Union (ACLU), "refers to the discriminatory practice ... Show more

Maybe the cashier who was on shift when their store was robbed saw the crook's hand, and there
was a long scar from the wrist to the middle knuckle, and the hand was extremely pale. The police
would then be on the lookout for a white person with a long scar on their hand. This is a perfectly
legal, legitimate classification as it's based on true facts, or at least as many as they were given.
However, criminal profiling can easily turn into needless racial profiling and racial profiling can be
excused as criminal profiling. Regardless, certain people are wholly targeted more than others.
CARD is an acronym that stands for class, age, race, and dress (Meeks, 19). This means that if the
police–– or most anyone–– see a line up of people, certain members of this group would be targeted.
For example: Imagine a line of four people. One is an elderly, well–dressed white woman. Next to
her there is a middle–aged black man in a suit. On his left, there is a teenage, grungy–looking
hispanic girl. And on her left, there is an Asian man, wearing street clothes. Regardless of who
committed the crime, the populace would most likely pin the crime on the young woman or the
Asian man, as lower class, young, minorities in "street" or "hip–hop" clothes are targeted most by
CARD (Meeks, 19). Every single person racial profiles, whether they realize it or not. As stated in
the previous paragraph, racial profiling doesn't necessarily mean you're racist, as one would be led

significance; hijab is used to describe head covering. The wearing of this attire is a personal choice
for some and a religious one for others. In Arabic the word means cover, and according to the
Quran, it is to cover their adornment, in other words only show what is normally shown (Quran–

The American Civil Liberties Union
The American Civil Liberties Union is a large and influential non–profit organization that was
founded in 1920. The American Civil Liberties Union is a nonpartisan group that serves to protect
the individual rights and liberties of American citizens and is considered a powerful interest group,
especially within movements that advocate civil rights and civil liberty. Ginsberg, Lowi, Weir, and
Tolbert define interests group as "individuals who organize to influence the government's program
and policies" (pg. 455). The American Civil Liberties Union is an effective interest group because of
its long and established history of confronting social injustice, its firm and ever increasing
membership basis, and its unrelenting persistence to protect and uphold civil rights and civil
liberties.
The American Civil Liberties Union has a long and righteous history of being an interest group. The
non–profit group was officially founded in 1920; during the years following World War I, America
was engrossed by the fear that the Communist Revolution that had taken place in Russia would
spread to the United States. As is often the case when fear outweighs rational debate, civil liberties
paid the price (American Civil Liberties Union, n.d.). In November 1919 and January 1920, in what
infamously became known as the "Palmer Raids," Attorney General Mitchell Palmer began
rounding up and deporting so–called radicals. Thousands of people were arrested without warrants

American Civil Liberties Union: Study Notes
Introduction A. Thesis Statement America was founded on the astute principles of democracy and
the potential benefits of freedom it derives. America, unlike many of its foreign counterparts has
long recognized the benefits of individual rights, freedoms and privileges and has fought to the
death to protect them. Currently, America aims to spread these principles of democracy around the
globe in an effort to create a better quality of life for all mankind. Even with these lofty and
ambitious goals, America, on occasion fails to uphold these principles within its own borders. Too
often, America has overlooked the problems prevalent within its own country while criticizing other
nations about their own circumstances. Many of these overlooked issues including slavery,
discrimination, women's rights and others have left an unfavorable image in American history. The
African American community in particular has worked very diligently over the years to end
segregation as a means to achieve equal rights for its entire constituent base. Body paragraph #1 –
Topic Sentence #1– To begin, the African American community has obtained equal rights through
collectivism. The African American community has always been close knit in response to
oppression. Instead of disbanded as a result of turmoil and mass confusion, the African American
community engaged in collective behavior. This was seen in the early years of the Underground
Railroad with Harriet Tubman. Supporting Evidence

There is quite a noticeable bias in this article because of the way the article presented Donald Trump
and Pence as jeopardizing women's rights, and giving of a negative image of them from using a
rather negative vocabulary in the article. Negative vocabulary was also used in order to present a
pessimistic, uncertain future that is to come, using words like "Trump will be officially appointed in
this coming 20th of January, 2017, and for women's health activists, this is the tranquil before the
storm," and "All we can see, as for the moment, are official selected personnel, and their antiquities

raising questions and concerns over what might possibly could happen if Donald Trump does
implement his plans and ideas into action, which could endanger and threaten the civil rights of
women, despite having a bias in the article. The impact of the subject in the article have on the

Racial Profiling And The American Civil Liberties Union
"Racial profiling" can hold a variety of meanings. As defined by the American Civil Liberties
Union, however, racial profiling is "the discriminatory practice by law enforcement officials of
targeting individuals for suspicion of crime based on the individual 's race, ethnicity, religion or
national origin" ("Racial Profiling"). Every day, blacks are stopped much more frequently for
aimless searches and minor infractions than their white counterparts. Several African Americans
share experiences like these, such as Roscoe Van Pelt, who was violently snatched off the street and
crammed into a squad car after the ludicrous crime of jaywalking (Walsh). A more extreme example
would be the case of Sandra Bland, who was brutally beaten following failure to signal a lane
change (Schuppe). Incidents like these occur far too frequently in black communities, all for the
color of their skin. The practices of police can best be explained in the elaboration of case
probability versus class probability. Case probability is when police take specific evidence with
concrete proof in regards to the victim of a crime to accuse one of a crime. Class probability,
however, is when police generalize normal committers of the specific crime to accuse one for it. For
example, if police aimed to prosecute a seller of marijuana and Hispanics were typically known to
commit such a crime, class probability would be integrated into case investigation if police searched
every Hispanic on site for the

The United States have seen a rush in incarnations by placing many people in jail more than the last
four decades. Mostly because of the war on drugs. So far whites and blacks have been involved in
many drug offenses, possession and sales, at a very comparable rate. "While African Americans
comprise 13% of the US population and 14% of monthly drug users they are 37% of the people
arrested for drug offenses" (Marc Mauer). The police usually stop blacks and Latinos at rates higher
than whites. Within New York City, the people of color make up about half of the city's population,
while 80% of all the police stops were of blacks and Latinos. When whites were stopped, only 8%
were frisked. While blacks and Latinos are stopped 85% were frisked according to information
provided by the NYPD stop and frisk data report. The data is almost the same in most other places
in America. The America civil liberties union found blacks are three times more likely to be stopped

A Writ Petition By People 's Union For Civil Liberties Essay
A writ petition was filed by People's Union for Civil Liberties in the Apex Court on Right to Food.
The petition was filed when the food stocks in the country reached extraordinary levels on the other
hand the starvation in the areas which were affected by the drought was getting magnified. The
petition at first instance had Government of India, six State Governments and Food Corporation of
India were the respondent but later all the states were added since the matter reached at that level
where the hunger death became persistent in most of the states. Then considering the graveness of
the situation a PIL was filed, PUCL v. UOI and others, Writ Petition (Civil) 196 of 2001. The
fundamental argument in the petition was that the government is failing to provide the adequate food
in the drought situations even when there is a large quantity of food stock in the cold storages and
also there is negligence by the state since there is complete collapse in the services provided by the
PDS and also the relief fund is insufficient to deal with the drought situation. The relief requested
from the Supreme Court was a) that the employment be provided in the drought affected villages, b)
a relief should be given to the people who are unable to work, c) the PDS should be made efficient
in the areas, d) the families should be provided with the subsidized food grains and the grains should
be provided by the Central Government. The arguments put forward by the NHRC in the

Racial Profiling And The American Civil Liberties Union Essay
The concept of racial profiling has its wide range of definitions. According to the American Civil
Liberties Union, racial profiling means "the discriminatory practice by law enforcement officials of
targeting individuals for suspicion of crime based on the individual 's race, ethnicity, religion or
national origin." In other words, racial profiling has its assumptions that particular individuals are
more likely to be involved in transgression or unlawful activities based on individual's race or
background. Racial profiling does not just exist today; it thrives and mostly propels a brutalizing
message and inhuman misconception to citizens of the United States whom they are pre–judged by
the color of their skin. The primary cause of profiling is racism or race–related discrimination.
Unfortunately, this unwarranted approach is now commonly used by law enforcement officers, even
though it could be both unjust and unconstitutional. Not only does it violate the core principles of
this country, but it can be dangerous and deadly because it threatens our privacy and security. It is
also a threat to racial equality, where many influential and prominent people have fought for to
accomplish. Although many heroic activist leaders have ended racial division to its certain extent,
yet many African–Americans all over America still face the rigid unequal world because of
unjustifiable race–related tragedies that tremendously affects African–Americans.

Before the Bill of Rights, in 1787 the delegates of the thirteen states all got together in Philadelphia
to write up the U.S Constitution. But this was only the first attempt at the constitution because there
were flaws in it that needed to be fixed. This first constitution only relayed what the government
could do and not what it couldn't do. This was a problem because people in the government could do
anything because there was no say in what they were not allowed to do. Another flaw was that this
constitution only really governed on what white men could do. It had no rights for men of different
races. This went on to show that we needed a section that could relate to the people of the states, so
that their freedom was protected in this new Constitution. (American Civil Liberties Union) This
debate of do we need to include a Bill of Rights for the everyday citizens of the states went on for
four years. The Federalists did not think we needed a Bill of Rights because they did not believe in
giving the people of the states to much entitlement. While on the other hand the Anti–Federalists
thought that we did need this section of rights so that the people know that their freedom and
entitlement is protected so that no one can over step on their freedom. With this debate between the
two parties, each side said they would not condone the constitution unless they got their way with
their point of few on adding or keeping out the rights to protect the normal everyday Americans.

Difference Between Civil Rights And Civil Rights

Thuy Nguyen Professor Sherry Sharifian Government 2305–71432 5 September 2017 Differences
between Civil Liberties and Civil Rights Civil liberties are the specific individual rights, which
contain the right of freedom of speech and action or the right to a fair trial. These individual rights

Civil rights on the other hand mean that every person here in the United State including the minority

These two terms are often used interchangeably as protecting either Civil liberties or Civil rights is

Challenges for Correctional Administrators Essay
What are some challenges that correctional administrators are faced with regarding the population of
inmates? This may be a question that many people do not consider. Correctional administrators have
to work very hard and be creative to ensure that all inmates, regardless of their challenges, needs are
being met. The challenges of typical inmates are characterized by those that are mentally ill, elderly,
and female inmates. Correctional administrators face a host of challenges when it comes to mentally
ill inmates. Mentally ill inmates require more supervision and more care in regards to their well–
being in the facility that they are housed in. In most facilities, mentally ill inmates are limited to less
than substantial counseling ... Show more content on Helpwriting.net ...
Furthermore, female inmates are another challenge for correctional administrators. For example, an
important and alarming issue such as overwhelming pregnancy and abortion related health care
factors can become expensive. These inmates need special clear, intensive monitoring and
observation. According to the American Civil Liberties Union, "200,000 women are living behind
prison or jail walls and thousands of these women are pregnant and dependent on the correctional
administrators for health care." (para. 1). Even though correctional administrators are legally
obligated to meet their needs, there are guidelines that they must follow. These guidelines are put in
place to further assist correctional administrators so that they are not violating the rights and well–
being of female inmates who are already pregnant or considering on having a child while
incarcerated. Mentally ill, elderly, and female inmates are faced with more than normal
circumstances in the correctional facilities that they are housed in. These circumstances add more
stress on to the administrators' job. The administrators are faced with challenges such as the
following: failing health, aggression, strict monitoring and observation, counseling services, and
providing the proper health care inmates. They have to ensure that the accommodations and
adjustments that are enforced are aligned with the

Why Are Civil Liberties More Important Than Homeland Security
How Civil Liberties Are More Important Than Homeland Security
What is homeland security? The exact definition of homeland security is "Precautions taken by the
government of specified country against terrorist attacks" according to Dictionary.com. However,
when it comes to protection, are the people of the US willing to give up their natural civil liberties?
The civil liberties, found in the Bill of Rights, are the people's fundamental rights; such as freedom
of speech, religion, and even privacy. These rights are protected by law against unwarranted
governmental interference on their lives. Benjamin Franklin once said, "Those who would give up
essential Liberty, to purchase a little temporary Safety, deserve neither Liberty nor Safety"(from
npr.org).
Before the Obama Administration was in charge of secretly collecting phone records and accessed
the internet activity of many, there was the Bush Administration. In late 2005, President George W.
Bush authorized the National Security Agency. With this organization, they are able to monitor
phone calls and emails without court permission. Just a year later, public support for the ... Show

how the 'Trap and Trace Searches are a breach of the 4th Amendment because their are no probable

Government Surveillance Should Not Be A Better Medium...
Government Surveillance The fight to obtain a happy medium between liberty and security
continues to be a hard fought game of Tug–of–War. Considering the profusion of various opinions
and ideas on the subject of government surveillance there will never be a solution that will satisfy
everyone but there is one that will satisfy the majority. There are many logical rationales on the
proper course of action whether it is in favor of the National Security Agency (NSA), against them,
or a whole other approach entirely and that is completely necessary in developing a sound solution.
The NSA, the focal point of this debate, is a government intelligence organization in charge of
surveillance and the gathering of data in the hopes of preventing terrorism however some people
believe that in doing so they are too invasive on citizen's liberties. Although people disagree with the
constitutionality of the NSA, others support the program due to its results, and some even claim that
it is disadvantageous for American businesses. A letter from the American Civil Liberties Union to
the Supreme Judicial Court reflects on the constitutionality of the NSA along with the vulnerability
of our national and cyber security. Within this letter lies a plethora of rational reasons on why we
should further improve encryptions, have strong back–door access, and not allow any mandates that
would require technology companies to retain private information. Surveillance acts such as the

Political Dispute Over Mass Surveillance Technology
Political Dispute Over Mass Surveillance Technology
As American citizens we want to live in a country where privacy and protection can live in harmony.
This is the political dispute surrounding mass surveillance technology, because the reality is that
perfect harmony isn't possible at this time. Social groups in conflict over this issue are divided into
two categories; government agencies such as the FBI, CIA, and most prominently the NSA versus
civil society groups like American Civil Liberties Union (ACLU), and Electronic Frontier
Foundation (EFF), as well as powerful people like Edward Snowden, and technology companies
including Microsoft, Apple, Twitter, and Google (Nakashima 2015).
These sides are clear. Which is understandable. Those government agencies were founded on the
notion of protecting us, and that is a standard that as Americans we have come to expect. The
September 11th attacks shook up that standard, bringing surveillance technology to the forefront of
concern. The benefits these agencies uphold are deep–rooted in the ideals of keeping citizens safe.
In an article published in The New York Post, Representative Vito Fossella (R) argues that the
Patriot Act needs renewal to avoid turning "back the homeland–security clock to Sept. 10, 2001"
(Fossella 2006). The fear of another national security breach such as Sept. 11th is what drives the
pro side of the mass surveillance technology debate. From their perspective, surveillance technology

The American Civil Liberties Union (ACLU) is a not–for–profit organization whose specified
mission is "to defend and preserve the individual rights and liberties guaranteed to every person in

separate associated nonprofit organizations: (one) as a social welfare group under the American

current leadership of Susan H. Herman, the ACLU continues to deliver on its mission to protect the

ACLU lobbies for policy opposing the death penalty; the right of LGBT people to adopt; the right to
birth control and abortion; supporting discrimination against minorities, the rights of prisoners, and
freedom of religion opposing government preferences in particular faiths. Throughout history, the
ACLU has focused on preserving the American's rights and liberties stated by the Constitution and
laws of the United States, working with courts, legislation, and communities. I have chosen the
American Civil Liberties Union to analyze how it works to extend the guaranteed rights to citizens

the theoretical framework and will analyze the ACLU work at the forefront of protecting freedom of

Traditionally favored by charter and private schools, and institutions of the like, school uniforms are
being introduced to public schools at an increasing rate. The First Amendment of the United States
Constitution guarantees all citizens the right to express oneself; The American Civil Liberties Union
of Nevada states that having a choice in clothing is "...Crucial form of self–expression." The ACLU
also argues that "allowing students to choose their clothing is an empowering message from the
schools that a student is a maturing person who is entitled to the most basic self–determination,"
(Four Reasons). Self–expression of style aside, choices in clothing are also a popular method of
expressing support for any variety of social causes, ideologies, and affiliations, and school uniforms
strip students of this option completely. Schools broadcast a mixed message of sorts when boasting
their appreciation and encouragement for diversity, yet enforcing a standardized uniform which
severely limits individuals from expressing this diversity. The Huffington Post published the
argument of a Kyler Sumter, 16, of Lindblom Math and Science Acadamy in Chicago. Kyler argues
"They decide to teach us about people like Rosa Parks, Susan B. Anthony and Booker T.

Today's Generation Bias
What are some ways to address dangerous types of bias in this generation? According to American
Civil Liberties Union, "Racial profiling is a longstanding and deeply troubling national problem
despite claims that the United States has entered a "post–racial era" (1). In today's generation bias is
a huge problem and needs to be fixed as much as it can. The types of bias that are problems today
are judgment of someone's name, racial profiling, and a persons living conditions. To address these
types are not judging Americans by name, race, and or living conditions and there are several
different ways to fixing these problems in society today.

There are so many different bias types not all are going to be able to be addressed but the one that

is happening in the schools and getting the teachers to put a stop to as much as they can. Out in the

False Imprisonment : A Tort Of Strict Liability
False imprisonment is a tort of strict liability due to the fact that there is no requirement as to that
the imprisonment be carried in bad faith., Kirby J stated, this is because the focus of this civil wrong
is on the vindication of liberty and reparation to the victim, rather than upon the presence of absence
of moral wrongdoing on part of the defendant. The defendant might have believed that their actions
were of interest, but this is not a defence. False imprisonment is a significant tort that is taken at the
highest level of court as it provides a remedy for victims who have been unlawfully detained
because it had deprived their personal liberty. Gray J stated that, the torts of false imprisonment is
committed when one person directly subjects another to total deprivation of freedom of movement
without lawful justification. The onus of proof is that the defendant must prove that the defendant
personally, or through the conduct of the persons for whom the defendant is responsible directly
participated in the plaintiff's false imprisonment. It provides a remedy for an individual whose
personal liberty has been unlawfully restrained, especially in respects to the government and their
power. Providing a remedy for breaches of civil liberties is the most important element as it prevents
government and law enforcement agencies to abuse their power. False imprisonment provides many

The problem usually with wrongful convictions is impulsivity. The fact that the person on trial is a
person of color drastically improves the chances of being convicted without going through all
motives of an investigation, which obviously are given to white people because of their lower
chance of getting convicted wrongly. This is a prominent bias, that a person of color is always guilty
of their crime. These findings show that people of color and white people are not being treated the
same in the eyes of the law. How is it possible to feel safe with all of these findings stacked up
against you? It just isn 't feasible. Kenneth Rouse still remains on death row to this day.
Some possible solutions to this is simply more diversity in the judicial bench. America needs to have
a criminal justice system that represents the diversity of America. When people think of America,
they think of the many faces that occupy our country. Unfortunately, this is only embraced by some.
It is impossible for someone to completely understand all circumstances of someone 's situation
without first experiencing similar or the same realities. A white person simply does not know what it
is like to be a black person in society. This goes along with the concept of privilege, something
everyone has in different amounts, and something in which few people will acknowledge. This goes
along with gender, and sexuality. A center for American

American Civil Liberties Union Case Analysis
The American Civil Liberties Union (ACLU) was started in 1920 and has since committed itself to

Washington, D.C., the employees work in courtrooms, government agencies, and communities to
change policies and laws that infringe on the rights delineated by the Constitution. Their vision is to
create an America in which everyone might live freely. This is a strong vision for many reasons.
First and foremost, it endures. For the last 97 years, the ACLU's employees and affiliates have been
united against all challenges to the freedoms this nation guarantees. As further evidence of the
vision's strength, these individuals constantly monitor policies and laws being implemented to seek
out any that might harm Americans. On occasion they must put their own reputation on the line to
do so. This vision is challenging because of these circumstances, but this group has won many court

Freedom Of Religion And The American Civil Liberties Union
Freedom of religion has been a right guaranteed to individuals in society. However, it is ultimately
just an idea put in place that is disregarded as something insignificant. The workplaces of many
people choose to deny employees the right to express their religion freely, for fear it may leave a bad
image for the company. It is apparent that freedom of religion is not a strong right as many people
may have originally thought it was. The limits of this right have been tested for decades and
continue to be an issue for people today. Freedom of religion may go on to exist as a right in society,
but when investigating deeper into this privilege, it is evident that it is merely an idea taken for
granted. The First Amendment to the ... Show more content on Helpwriting.net ...
Another item to take into consideration when talking about freedom of religion is the Establishment
Clause. This clause does not allow for any portion of the government to choose to acknowledge a
particular religion. As a result, the population is scrutinized for acknowledging religions practiced
throughout the world. The government may not support a specific religion, but ultimately owes
individuals the respect they deserve, even if they do associate with a particular belief. This happens
in order to make religious freedom only a minor idea instead of the greater meaning of it as a right.
Many schools and other religious organizations are ultimately not supported by the government, in
order to maintain the separation of government agencies and religious doctrine (Your). Another
important part of the First Amendment, is the recognition of the Free Exercise Clause. This gives
individuals the right to select whether or not they want to be involved with a religion of their choice.
This clause also gives security to those who want to be able to express their religion, without fear of
harsh punishments inflicted by others. Unfortunately, many people do not express a specific religion
due to the view society has. Since many people see the freedom of religion as only an idea, there is
not much emphasis placed on protecting a right that should be the most

The Pros And Cons Of The Patriot Act
After the September 11th terrorist attacks, the United States was left in a weakened state of fear.
Government officials quickly scrambled to calm the mass panic which resulted in the speedy
passing of the Patriot Act. The Patriot, or what is more formally known as the "Providing
Appropriate Tools Required to Intercept and Obstruct Terrorism" act, was established to provide the
government with the implements it needed to stop terrorists operating on American soil. While the
Patriot Act does have an important goal of obstructing terrorism, it achieves this goal at the expense
of our individual liberties given to us by the Constitution. Firstly, the Patriot Act violates the Fourth
Amendment to the United States Constitution by allowing the government to conduct secret
searches of citizens' property–undermining the amendment's principle of search and seizure only
with a warrant. The Fourth Amendment protects us from searches and seizures without a warrant or
probable cause. However, sections of the Patriot Act can be seen undermining this American
prerogative. The American Civil Liberties Union explains, Section 213 of the Patriot Act justifies
the allowance of secret searches. Secret searches permit the government to search the owner's
private property without having to notify them (ACLU). This section has caused for the mass

Citizens that reside in the United States of America are starting to question if democracy is worth
fighting for. This is because people with government jobs can break the laws and not receive
punishment. While a regular citizen would be punished immediately. Minorities still suffer with
equality in the United States. 2 Civil liberties and civil rights play in important role in this country.
"Civil liberties are the fundamental individual right of a free society, such as freedom of speech and
the right to a jury trial, which in the United states are protected by the bill of rights" (Patterson126).
Equal rights or also known as civil rights are the right of every person to equal protection under the
laws and equal access to society's opportunities and public facilities (Patterson 158).
2 Civil liberties and civil rights have plenty of similarities. The United States protects people's civil
liberties and civil rights this is written in the Bill of Rights. 3 Every individual has the right of
freedom of speech, press, assembly, and religion. The practice of a different religion, having
different skin color, or not having a government job can have an effect on a person's civil rights. The

Racial Profiling And The American Civil Liberties Union Essay
"Racial Profiling"

They also reported that he had no significant medical history, arguing that the staff had no

These detention centers are proven to be beyond poorly equipped and lack properly trained medical
personnel. Dora Schriro, a former Homeland Security advisor says...
Since immigration experience large waves of people entering their facilities, it is probably easier for
them to classify the incoming immigrants as one of two statuses. Though from a medical standpoint,
'healthy' and 'unhealthy' are extremely broad terms to use. There are many levels of healthy and
unhealthy. Just because someone comes into an ICE facility without showing signs of a cold does
not mean they are mentally sound or cancer–free.
The more radical supporters of ICE argue that the blame should not be put on ICE, but instead be
put on the immigrants. There is a belief that the immigrants know what the potential consequences
of illegally crossing the border are, therefore they should be understanding of the circumstances
when they are caught.
The government is, in actuality, spending a ton of money on ICE custody operations. If you're

American citizens were not fond of President Trump's speech, let alone his presence in attending the

even allowing travel ban to certain countries. Living in the 21st century, civil rights including racism
and respect should be a simple action to follow. On the contrary, life today is taking us back to the
early 90s with all the human discrimination the world has going on.
Regarding civil liberties, a recent story also regarding President Trump's decision on travel ban, as
stated in the last paragraph, has risen a lot of eyebrows. American citizens have the right to travel,
not that it is a written right, however, we can be free with ourselves of traveling to other countries.
With Trump banning travel from eight countries, several people, including The American Civil

discriminates certain nationalities, and seems racist for President Trump to do. Civil liberties must
be given to us under the words of the Constitution, no law nor president can take that away.

The United States Constitution Vs. American Civil...

  • 1. The United States Constitution Vs. American Civil... The United States Constitution gives the American people their freedom so to speak. The Constitution outlines many things that other countries don't offer their citizens such as freedom of speech, religion and the press. The First Amendment of the Constitutions guarantees that the United States people have rights to freedom of expression and freedom of religion without the interference of the government. The Bible states in Deuteronomy 17: 18–19, "Now it shall come about when he sit on the throne of his kingdom, he shall write for himself a copy of this law on a scroll in the presence of the Levitical priests. It shall be with him, and he shall read it, all the days of his life, that he may learn to fear the Lord his God, by carefully observing all the words of this law and these statutes". These laws have been called into question on several different occasions. However, like anything else, there are some stipulations with these laws. Reno v. American Civil Liberties Union (ACLU) did shed some insight on the laws and how they can be interpreted. This paper will discuss the criminal statute issues, issues with the provisions of the Constitution, and the status of criminal prosecution for transmission of pornography over the internet. With the hopes of having a clearer understanding of Reno v. American Civil Liberties Union. The First Amendment was a key component in Reno v. ACLU. It states that Congress shall make no law abridging the freedom of speech. The Courts ... Get more on HelpWriting.net ...

  • 3. Literature Review On Racial Profiiling This essay reviews the literature on racial profiling in Courtelaney Pass. Racial profiling is a policing method that has increasingly become scrutinized over the years in Courtelaney Pass. An overwhelming number of individuals in the city are subject to racial profiling. Contrary to 55% white, 38% black, and 7% Hispanic, the blacks and out of town travelers passing through receive 87% of the speeding tickets. In addition, racial profiling can occur to women and men, all age groups are used against people from all socio–economic backgrounds, and occurs in rural, suburban, and urban areas (Amnesty International, 2007). This, racial profiling is an issue in Courtelaney's society that can no longer be overlooked. The following literature ... Show more content on Helpwriting.net ... Racial profiling has been one of the most controversial issues in Courtelaney Pass. The issue of racial profiling is extremely important because thousands of individuals are being affected by it. Many federal, state, and local agencies across the United States have viewed the issue as detrimental to our society; thus, more and more research on the issue is taking place throughout the years. Government agencies are not the only agencies that are connected with the work of exploring racial profiling within law enforcement; groups such as the American Civil Liberty Union (ACLU) and the National Association for Colored People (NAACP) are also involved in investigating racial profiling. Therefore, the following literature review will examine articles and their findings within this controversial topic. 1) Data: a. The independent variable which will be evaluated is racial profiling. The dependent variables which will be evaluated are police conduct. The units of analysis are minorities. b. The investigators, of the secondary data which I will be using, operationalized their variables by surveying 80,237 individuals across the United States and documenting their contact with the police. The data was collected between July 1, 2005, through July 31, 2005, using a stratified multistage cluster sample. A weight was used in order to obtain national estimates. • 5. Persuasive Essay On Stop And Frisk Parayno, Jay–Mard English 105 Professor Zaragoza December 11, 2016 Stop and Frisk Stop and frisk is a tactic designed for reducing crime by allowing police officers to stop and search individuals that may seem suspicious. This law allows police officers to search individuals only if they have reasonable suspicion that a crime might occur or if the suspect is carrying anything illegal or dangerous. Between the years of 2002 and 2016, there have been 5 million stop and streets interrogations, and nine out of 10 individuals who were stopped have been completely innocent ("Stop–and–Frisk Data"). With that being said, stop and frisk should not continue to be a policing tactic because it is ineffective, it gives too much power to police officers, and promotes racial profiling. One misconception that many believe is that the stop and frisk program brings in many criminals or even those that have potential; however, many stop and frisk incidents were unsuccessful, making the tactic ineffective. According to the NYPD's own report, over 100,000 people were stopped every year since 2002 and every year above 77% were innocent ("Stop–and–Frisk Data"). In an interview conducted by Amy Goodman for Democracy Now, she interviews a NYPD officer named Adhyl Polanco ("NYPD Officer Risks"). He states that the officers will cuff anyone just to meet their quota. Polanco continues, But when you take that he's a male black, he's 14, 15, he's walking down the corner, he doesn't look like he belong ... Get more on HelpWriting.net ...

  • 7. Is Censorship Harmful For School Censorship is keeping knowledge or information away from any person. Just think if a community was completely censored, everything and everyone would be the same, like in the book The Giver by Lois Lowry. Nobody wants to the the same as someone else, us as people of the U.S. should be able to be unique and different. Censorship is harmful to the community because it, restricts children's learning experience, and restricts them from what the real world is really like. Some people say censorship may be good for schools to some extent because it restricts students from certain concepts that are inappropriate to teach. Although, that may be almost true, it is not. Many people can argue that censorship is bad because it does not give students the full conception of education (Censorship in the schools). Students could also learn how to discriminate and make unthought decisions. If students were not growing intellectually, they could be controlled by many people smarter than them because they do not know any better. "Censorship is harmful because it results in the opposite of true education and learning" (Censorship in the schools). Just think if parents, teachers, and school boards ban or restrict books from the students, is it good or bad? Many people would say it is good because they do not want their children to read a book about violence, that have cursing, or defacing of their religion. Also, many may say it is bad because it could keep children from reading about ... Get more on HelpWriting.net ...

Planes were hijacked and flown into the World Trade Center in New York. Over three thousand people were killed and the impregnable nation known as America was know scared and vulnerable. Almost immediately the legislature began drafting an act that would make the war on terror and the fight for homeland security a little easier to fight, this would come to be known as the Patriot Act "PATRIOT" is an acronym for "Uniting and Strengthening America by providing Appropriate Tools Required to Intercept and Obstruct Terrorism. Immigrants, especially of Arab origin and those with Islam as their religion are seen as terrorists. This is blatant racism and discrimination which is also completely against what this country stands for. Also concerned is the American Civil Liberties Union (ACLU). This is an organization that is dedicated to raising awareness of civil liberties. The PATRIOT Act, as the name suggests is supposed to protect the citizens of the country from attacks across its borders. It defeats its own purpose in attacking from within the very people it's supposed to protect. In fact, it does almost the opposite by provoking a fear and paranoia that tends to remind us of such wonderful events like the Spanish inquisition or the Salem Witch Trials. The ACLU talks about several groups that are unfairly targeted by the Act to the extent that the constitution is being violated. I have already talked about Arab and Muslims but even neighbors are supposed to report anything that "appears" suspicious. Turning people against each other is not only a reminder of the above mentioned historical events but it also leads to fear in a place where none is needed. The Act gives law enforcement the right to search any building or residence that might prove suspect. It seems that such suspicion is easy to provoke making it likely that an innocent law abiding citizen will find himself ... Get more on HelpWriting.net ...

  • 11. The Right Of Free Speech Throughout American history, the foundation on which American democratic principles are based, has been repeatedly tested. In the 1700s, the right of free speech was challenged when President John Adams proposed the Alien and Sedition Acts. Adams attempted to stop the Democratic Republicans such as Thomas Jefferson, from criticizing government decisions. Similarly, during the Civil War President Abraham Lincoln challenged freedom of the press when he took action to restrict the printing of military news. Lincoln ordered his generals in the field to control the press and "crack down on speech critical of his administration" to limit dissent against the war effort. However, one historical era stands out as a decidedly pivotal test of ... Show more content on Helpwriting.net ... "Twentieth–century U.S. history saw two major episodes of repression and violence against communists and leftist radicals," that occurred approximately three decades apart. During the early part of the 1920s, America entered its first period of extreme anti–communist sentiment, the First Red Scare. After the successful Bolshevik Revolution in Russia in 1917, American citizens began to fear the threat of communist influence at home. At the end of WWI, American workers unhappy with wages and spiralling inflation, launched widespread sometimes violent strikes with the support of growing labor unions. Some of these unions called for government takeover of private industries. For instance, railroad workers called for the national government to take permanent control of the railroad system. The growing waves strikes signalled a period of extreme civil unrest; American citizens became frightened that they would face a revolution similar to the one that had just taken place in Russia. In response, Attorney General A. Mitchell Palmer, in an effort to gain the attention of American voters to support his presidential aspirations, launched a nationwide crusade against anyone he identified as having leftist views. Under Palmer's leadership, thousands of Americans were arrested for taking part in alleged subversion, and thousands of others were stripped of their civil liberties. "In violation of ... • 13. The American Civil Liberties Union When Americans first set their eyes on the 20th century, they hoped for a better life without war and a prospering economy. This vision of freedom and liberty in America was quite bold, knowing there were challenges ahead. There's always a price to pay and obstacles to go through when the circumstances are not ideal. During the early 1900s, our country was evolving and starting a new era. An era where blacks were no longer slaves, civil rights movements were occurring, and citizens were having issues with the law. It was a moment in time that helped us understand why these events occurred. From those events, wars, and movements, we can learn and improve from any flaws we may encounter. As a nation, we will be better prepared and aware of these scenarios because we reflect on our country's past. During World War I, the Progressives, who are a political party later called the American Civil Liberties Union, talked about our individual rights as citizens and the liberty we fought for. Before we entered the war, our legal rights were taken away, and left many in the U.S very upset and worried. "In 1917, a group of Pacifists, Progressive shocked by wartime attacks on freedom of speech, and lawyers outraged at what they considered violations of Americans' legal rights formed the Civil Liberal Bureau." (The Fight for Civil Liberties, pg. 135). With no one saying anything or speaking up, it put people in the position to be concerned because they weren't allowed to say what ... • 15. Racial Profiling And The American Civil Liberties Union Police brutality has been in the headlines for years. Reports continually stream in, exhibiting the needless force displayed by police. However, the people don't always have all the information. The media shows the aftereffects itself, not the reasons why the victim was targeted. Perhaps it was a justified arrest. Maybe it was simply because the target of the attack wasn't white. Police are constantly put on trial for their crimes, but the community may never know the whole truth. The pain and misery caused by racial profiling greatly outweighs the positive aspects. Racial profiling is vastly different from criminal profiling. Racial profiling, as stated by the American Civil Liberties Union (ACLU), "refers to the discriminatory practice ... Show more content on Helpwriting.net ... Maybe the cashier who was on shift when their store was robbed saw the crook's hand, and there was a long scar from the wrist to the middle knuckle, and the hand was extremely pale. The police would then be on the lookout for a white person with a long scar on their hand. This is a perfectly legal, legitimate classification as it's based on true facts, or at least as many as they were given. However, criminal profiling can easily turn into needless racial profiling and racial profiling can be excused as criminal profiling. Regardless, certain people are wholly targeted more than others. CARD is an acronym that stands for class, age, race, and dress (Meeks, 19). This means that if the police–– or most anyone–– see a line up of people, certain members of this group would be targeted. For example: Imagine a line of four people. One is an elderly, well–dressed white woman. Next to her there is a middle–aged black man in a suit. On his left, there is a teenage, grungy–looking hispanic girl. And on her left, there is an Asian man, wearing street clothes. Regardless of who committed the crime, the populace would most likely pin the crime on the young woman or the Asian man, as lower class, young, minorities in "street" or "hip–hop" clothes are targeted most by CARD (Meeks, 19). Every single person racial profiles, whether they realize it or not. As stated in the previous paragraph, racial profiling doesn't necessarily mean you're racist, as one would be led to believe ... Addressing Diversity In Criminal Justice Research Paper Addressing Diversity in Criminal Justice Policies Dolores Jackson Williams Colorado Technical University First I had to understand what are Khimar and its religious significance; hijab is used to describe head covering. The wearing of this attire is a personal choice for some and a religious one for others. In Arabic the word means cover, and according to the Quran, it is to cover their adornment, in other words only show what is normally shown (Quran– Islam.org, 2001). The increase in Civil rights complaints went from approximately 366 during 2000 to over 2400 in 2006, increasing by almost 700%. Approximately 70% of Muslim women that wore the hijab reported discrimination compared to the 30% who didn't wear one (ACLU.org, ... Show more content on Helpwriting.net ... Why or why not? Under Title VII of the Civil Rights Act of 1964 states that all employers must make practical accommodation to hold spiritual beliefs of their employee absent unwarranted hardship, therefore it is not considered discrimination (EEOC.org). • 19. The American Civil Liberties Union The American Civil Liberties Union is a large and influential non–profit organization that was founded in 1920. The American Civil Liberties Union is a nonpartisan group that serves to protect the individual rights and liberties of American citizens and is considered a powerful interest group, especially within movements that advocate civil rights and civil liberty. Ginsberg, Lowi, Weir, and Tolbert define interests group as "individuals who organize to influence the government's program and policies" (pg. 455). The American Civil Liberties Union is an effective interest group because of its long and established history of confronting social injustice, its firm and ever increasing membership basis, and its unrelenting persistence to protect and uphold civil rights and civil liberties. The American Civil Liberties Union has a long and righteous history of being an interest group. The non–profit group was officially founded in 1920; during the years following World War I, America was engrossed by the fear that the Communist Revolution that had taken place in Russia would spread to the United States. As is often the case when fear outweighs rational debate, civil liberties paid the price (American Civil Liberties Union, n.d.). In November 1919 and January 1920, in what infamously became known as the "Palmer Raids," Attorney General Mitchell Palmer began rounding up and deporting so–called radicals. • 21. American Civil Liberties Union: Study Notes Introduction A. Thesis Statement America was founded on the astute principles of democracy and the potential benefits of freedom it derives. America, unlike many of its foreign counterparts has long recognized the benefits of individual rights, freedoms and privileges and has fought to the death to protect them. Currently, America aims to spread these principles of democracy around the globe in an effort to create a better quality of life for all mankind. Even with these lofty and ambitious goals, America, on occasion fails to uphold these principles within its own borders. Too often, America has overlooked the problems prevalent within its own country while criticizing other nations about their own circumstances. Many of these overlooked issues including slavery, discrimination, women's rights and others have left an unfavorable image in American history. The African American community in particular has worked very diligently over the years to end segregation as a means to achieve equal rights for its entire constituent base. Body paragraph #1 – Topic Sentence #1– To begin, the African American community has obtained equal rights through collectivism. The African American community has always been close knit in response to oppression. Instead of disbanded as a result of turmoil and mass confusion, the African American community engaged in collective behavior. This was seen in the early years of the Underground Railroad with Harriet Tubman. Supporting Evidence ... Get more on HelpWriting.net ...

  • 25. Racial Profiling And The American Civil Liberties Union "Racial profiling" can hold a variety of meanings. As defined by the American Civil Liberties Union, however, racial profiling is "the discriminatory practice by law enforcement officials of targeting individuals for suspicion of crime based on the individual 's race, ethnicity, religion or national origin" ("Racial Profiling"). Every day, blacks are stopped much more frequently for aimless searches and minor infractions than their white counterparts. Several African Americans share experiences like these, such as Roscoe Van Pelt, who was violently snatched off the street and crammed into a squad car after the ludicrous crime of jaywalking (Walsh). A more extreme example would be the case of Sandra Bland, who was brutally beaten following failure to signal a lane change (Schuppe). Incidents like these occur far too frequently in black communities, all for the color of their skin. The practices of police can best be explained in the elaboration of case probability versus class probability. Case probability is when police take specific evidence with concrete proof in regards to the victim of a crime to accuse one of a crime. Class probability, however, is when police generalize normal committers of the specific crime to accuse one for it. For example, if police aimed to prosecute a seller of marijuana and Hispanics were typically known to commit such a crime, class probability would be integrated into case investigation if police searched every Hispanic on site for the ... • 29. The American Civil Liberties Union The United States have seen a rush in incarnations by placing many people in jail more than the last four decades. Mostly because of the war on drugs. So far whites and blacks have been involved in many drug offenses, possession and sales, at a very comparable rate. "While African Americans comprise 13% of the US population and 14% of monthly drug users they are 37% of the people arrested for drug offenses" (Marc Mauer). The police usually stop blacks and Latinos at rates higher than whites. Within New York City, the people of color make up about half of the city's population, while 80% of all the police stops were of blacks and Latinos. When whites were stopped, only 8% were frisked. While blacks and Latinos are stopped 85% were frisked according to information provided by the NYPD stop and frisk data report. The data is almost the same in most other places in America. The America civil liberties union found blacks are three times more likely to be stopped than whites in California. Black male and Latino defendants in U.S. criminal cases receive much longer prison sentences than white men do. The petition was filed when the food stocks in the country reached extraordinary levels on the other hand the starvation in the areas which were affected by the drought was getting magnified. The petition at first instance had Government of India, six State Governments and Food Corporation of India were the respondent but later all the states were added since the matter reached at that level where the hunger death became persistent in most of the states. Then considering the graveness of the situation a PIL was filed, PUCL v. UOI and others, Writ Petition (Civil) 196 of 2001. The fundamental argument in the petition was that the government is failing to provide the adequate food in the drought situations even when there is a large quantity of food stock in the cold storages and also there is negligence by the state since there is complete collapse in the services provided by the PDS and also the relief fund is insufficient to deal with the drought situation. The relief requested from the Supreme Court was a) that the employment be provided in the drought affected villages, b) a relief should be given to the people who are unable to work, c) the PDS should be made efficient in the areas, d) the families should be provided with the subsidized food grains and the grains should be provided by the Central Government. • 35. Racial Profiling And The American Civil Liberties Union Essay The concept of racial profiling has its wide range of definitions. According to the American Civil Liberties Union, racial profiling means "the discriminatory practice by law enforcement officials of targeting individuals for suspicion of crime based on the individual 's race, ethnicity, religion or national origin." In other words, racial profiling has its assumptions that particular individuals are more likely to be involved in transgression or unlawful activities based on individual's race or background. Racial profiling does not just exist today; it thrives and mostly propels a brutalizing message and inhuman misconception to citizens of the United States whom they are pre–judged by the color of their skin. The primary cause of profiling is racism or race–related discrimination. Unfortunately, this unwarranted approach is now commonly used by law enforcement officers, even though it could be both unjust and unconstitutional. Not only does it violate the core principles of this country, but it can be dangerous and deadly because it threatens our privacy and security. It is also a threat to racial equality, where many influential and prominent people have fought for to accomplish. Although many heroic activist leaders have ended racial division to its certain extent, yet many African–Americans all over America still face the rigid unequal world because of unjustifiable race–related tragedies that tremendously affects African–Americans. But this was only the first attempt at the constitution because there were flaws in it that needed to be fixed. This first constitution only relayed what the government could do and not what it couldn't do. This was a problem because people in the government could do anything because there was no say in what they were not allowed to do. Another flaw was that this constitution only really governed on what white men could do. It had no rights for men of different races. This went on to show that we needed a section that could relate to the people of the states, so that their freedom was protected in this new Constitution. (American Civil Liberties Union) This debate of do we need to include a Bill of Rights for the everyday citizens of the states went on for four years. The Federalists did not think we needed a Bill of Rights because they did not believe in giving the people of the states to much entitlement. While on the other hand the Anti–Federalists thought that we did need this section of rights so that the people know that their freedom and entitlement is protected so that no one can over step on their freedom. Government Surveillance The fight to obtain a happy medium between liberty and security continues to be a hard fought game of Tug–of–War. Considering the profusion of various opinions and ideas on the subject of government surveillance there will never be a solution that will satisfy everyone but there is one that will satisfy the majority. There are many logical rationales on the proper course of action whether it is in favor of the National Security Agency (NSA), against them, or a whole other approach entirely and that is completely necessary in developing a sound solution. The NSA, the focal point of this debate, is a government intelligence organization in charge of surveillance and the gathering of data in the hopes of preventing terrorism however some people believe that in doing so they are too invasive on citizen's liberties. Although people disagree with the constitutionality of the NSA, others support the program due to its results, and some even claim that it is disadvantageous for American businesses. Political Dispute Over Mass Surveillance Technology Political Dispute Over Mass Surveillance Technology As American citizens we want to live in a country where privacy and protection can live in harmony. This is the political dispute surrounding mass surveillance technology, because the reality is that perfect harmony isn't possible at this time. These sides are clear. Which is understandable. Those government agencies were founded on the notion of protecting us, and that is a standard that as Americans we have come to expect. The September 11th attacks shook up that standard, bringing surveillance technology to the forefront of concern. The benefits these agencies uphold are deep–rooted in the ideals of keeping citizens safe. In an article published in The New York Post, Representative Vito Fossella (R) argues that the Patriot Act needs renewal to avoid turning "back the homeland–security clock to Sept. 10, 2001" (Fossella 2006). This clause does not allow for any portion of the government to choose to acknowledge a particular religion. As a result, the population is scrutinized for acknowledging religions practiced throughout the world. The government may not support a specific religion, but ultimately owes individuals the respect they deserve, even if they do associate with a particular belief. This happens in order to make religious freedom only a minor idea instead of the greater meaning of it as a right. Many schools and other religious organizations are ultimately not supported by the government, in order to maintain the separation of government agencies and religious doctrine (Your). Another important part of the First Amendment, is the recognition of the Free Exercise Clause. This gives individuals the right to select whether or not they want to be involved with a religion of their choice. This clause also gives security to those who want to be able to express their religion, without fear of harsh punishments inflicted by others. Unfortunately, many people do not express a specific religion due to the view society has. Since many people see the freedom of religion as only an idea, there is not much emphasis placed on protecting a right that should be the most ... Get more on HelpWriting.net ...

Black Men And The American Civil Liberties Union According to to the American Civil Liberties Union, California's research shows that black men are three times more likely to be stopped and frisked than whites. (Quigley) Some may say that this topic is based on nothing but opinions. That is not true. There are facts behind the accusations made by so many people accusing law enforcement agents of being racist. The job of law enforcement is to serve and protect the people, showing no bias towards any specific race, but this is not always the case. While many think this is a perfect world where there is no racism, the reality is that everywhere in the world there is at least one person who is racist. Being a racist is difficult, especially in this day in age. Today there are all types of ... Show more content on Helpwriting.net ... This statistic shows that the officers of the NYPD are judging blacks and assuming they are guilty before they even gather enough evidence. When black people are arrested, they receive ten percent longer sentences than white offenders, says the US Sentencing Commission, for the same crime. An obvious example of bias against black men is to incarcerate black men in jail for longer periods of time simply because of race. This is clearly a problem in the legal systems of the US. Eventually someone will get harmed in the middle of this racial discrimination. (Quigley) On August 4th, 2014, an eighteen year old boy by the name of Michael Brown was killed by Darren Wilson. Mr. Wilson was an officer of the Ferguson Police Department. He was a twenty–eight year old white male and was accused of killing Michael out of racial hatred. This case was examined but not enough evidence was accumulated to charge Mr. Wilson with the murder of Michael (Moylan). This act of violence touched many people's hearts but made many people angry. It was thought that the FPD was being racist when Michael was killed because of statistic after the investigation. The arrest rate in seven felonies in the FDP decreased by over fifty percent and the police commissioner stated that overall crime decreased. • 69. The Pros And Cons Of The Patriot Act After the September 11th terrorist attacks, the United States was left in a weakened state of fear. Government officials quickly scrambled to calm the mass panic which resulted in the speedy passing of the Patriot Act. The Patriot, or what is more formally known as the "Providing Appropriate Tools Required to Intercept and Obstruct Terrorism" act, was established to provide the government with the implements it needed to stop terrorists operating on American soil. While the Patriot Act does have an important goal of obstructing terrorism, it achieves this goal at the expense of our individual liberties given to us by the Constitution. Firstly, the Patriot Act violates the Fourth Amendment to the United States Constitution by allowing the government to conduct secret searches of citizens' property–undermining the amendment's principle of search and seizure only with a warrant. The Fourth Amendment protects us from searches and seizures without a warrant or probable cause. However, sections of the Patriot Act can be seen undermining this American prerogative. The American Civil Liberties Union explains, Section 213 of the Patriot Act justifies the allowance of secret searches. Secret searches permit the government to search the owner's private property without having to notify them (ACLU). This section has caused for the mass surveillance of not only possible terrorists but also innocent American citizens. The government not being required to inform you after your private ... Civil Liberties Itsel Ulloa Government 2305–71427 Professor Sharifian September 27, 2017 Citizens that reside in the United States of America are starting to question if democracy is worth fighting for. This is because people with government jobs can break the laws and not receive punishment. While a regular citizen would be punished immediately. Minorities still suffer with equality in the United States. 2 Civil liberties and civil rights play in important role in this country. "Civil liberties are the fundamental individual right of a free society, such as freedom of speech and the right to a jury trial, which in the United states are protected by the bill of rights" (Patterson126). Equal rights or also known as civil rights are the right of every person to equal protection under the laws and equal access to society's opportunities and public facilities (Patterson 158). 2 Civil liberties and civil rights have plenty of similarities. The United States protects people's civil liberties and civil rights this is written in the Bill of Rights. 3 Every individual has the right of freedom of speech, press, assembly, and religion. The practice of a different religion, having different skin color, or not having a government job can have an effect on a person's civil rights. The government mentions that everyone is treated equal, but that is not the case at times. "African Americans, women, Hispanic Americans, and other traditionally ... Get more on HelpWriting.net ...

  • 73. Racial Profiling And The American Civil Liberties Union Essay "Racial Profiling" The concept of racial profiling has its wide range of definitions. • 75. The American Civil Liberties Union In 2008, a record high number of people were detained in ICE facilities across the United States following the presidency of George W. Bush. In 2009, President Obama not only decreased the number of detainees being held, but he mandated death reviews, called for a new inspection process, and proposed new standards for detention centers within this country. According to Carl Takei, a staff attorney with the American Civil Liberties Union, ICE has somewhat complied with President Obama's mandates. They have released documents on cases of medical negligence leading to deaths but only to people who ask under the Freedom of Information Act. The purpose of President Obama's mandated reviews was to improve the medical care of the next person. ... Show more content on Helpwriting.net ... They also reported that he had no significant medical history, arguing that the staff had no knowledge of Mandza's heart defects, therefore they could not be held responsible for his death. These detention centers are proven to be beyond poorly equipped and lack properly trained medical personnel. Dora Schriro, a former Homeland Security advisor says... Since immigration experience large waves of people entering their facilities, it is probably easier for them to classify the incoming immigrants as one of two statuses. Though from a medical standpoint, 'healthy' and 'unhealthy' are extremely broad terms to use. There are many levels of healthy and unhealthy. Just because someone comes into an ICE facility without showing signs of a cold does not mean they are mentally sound or cancer–free. The more radical supporters of ICE argue that the blame should not be put on ICE, but instead be put on the immigrants. There is a belief that the immigrants know what the potential consequences of illegally crossing the border are, therefore they should be understanding of the circumstances when they are caught. The government is, in actuality, spending a ton of money on ICE custody operations. If you're wondering how much, the total comes to about $2.04 billion for Fiscal Year 2014. This doesn't include the other $5.4 billion that goes to the actual operations that ICE ... Get more on HelpWriting.net ...

  • 77. Civil Rights And Civil Rights Alexandra Lebron Professor Miller POS 2041 December 9th, 2017 Civil Rights and Civil Liberties Civil rights and civil liberties sound like they mean the same, however, they have very different definitions. As stated in the textbook on page 676, "to have civil rights means that all rights rooted in the Fourteenth Amendment's guarantee of equal protection under the law"; which means civil rights are our basic rights to freedom. As stated in the textbook as well, "to have civil liberties means those personal freedoms that are protected for all individuals. Show more content on Helpwriting.net ... Trump had failed to speak up for civil rights causes." Reading the article, it seemed like the African– American citizens were not fond of President Trump's speech, let alone his presence in attending the ceremony. A lot of people think he is racist and taking away our natural human rights as citizens for even allowing travel ban to certain countries. Living in the 21st century, civil rights including racism and respect should be a simple action to follow. On the contrary, life today is taking us back to the early 90s with all the human discrimination the world has going on. Regarding civil liberties, a recent story also regarding President Trump's decision on travel ban, as stated in the last paragraph, has risen a lot of eyebrows. American citizens have the right to travel, not that it is a written right, however, we can be free with ourselves of traveling to other countries. With Trump banning travel from eight countries, several people, including The American Civil Liberties Union, feel that part of our rights were taken away from us. Some judges seem that this discriminates certain nationalities, and seems racist for President Trump to do. Civil liberties must be given to us under the words of the Constitution, no law nor president can take that away. There have been several court cases regarding civil liberties and civil rights for decades now. Two court case examples regarding civil rights, found on civilrights.org, are the 1886 ...
