How Magna Carta Changed America
The Magna Carta changed the way that America is today as well as the way society was in England 800 years ago. The people of England were
tired of the way King John had been treating them. So the barons, the King's go to people, realized that King John was getting too powerful and
misusing his power as king. Which initially led to his behavior and how he was treating his barons as well as the people of England. King John's
behavior is what led the barons to take matters into their own hands and the greatest document to ever be written in English History was born. The
Magna Carta.

The first revision took place in 1217, and the second revision took place in 1225. The original copy of the Charter pretended to state customary law
and it promoted disagreement and contention. The Magna Carta's full "effect" did not occur until later, at first, it was only legally valid for no
more than three months. Within these three months, the Charter's terms were never properly fulfilled. After removing all reference to tallage, the
Charter achieved formal consistency at the cost of its real intent. (Tallage is a form of arbitrary taxation levied by kings of the towns and lands of
the Crown.) Magna Carta later assumed legal parity among all free men to an exceptional degree. The first revised portion stated that " the Charter
still declares that the English church shall be free and still confirms, but does not define the privileges of the city of London and other towns and
boroughs." But the omission of this clause in 1217 left the Londoners still tallageable. The first Magna Carta was a " rough draft" and like many
rough drafts, there are many revisions. So the Magna Carta had a total of two revisions before the " final draft." These two revisions took place in
the following years: 1217 and 1225. The final draft became law and was confirmed and interpreted in the House of Parliament and enforced in the
courts of

Medieval Era Research Paper
The medieval period in Britain lasted from 1066 to 1485 (The Medieval Period). The Medieval period was a period of great wars, diseases and the
rise of the English monarchy. I will list some of the more important events in this paragraph. The period began with the Norman invasion of England,
and ended with beginning of the Tudor dynasty. During this period eastern Ireland and all of Whales came under the direct rule of the monarchy, while
Scotland managed to stay independent. In 1215 the Magna Carta was written, marking the first time a monarch agreed to follow formal procedures.
The Third Crusade between the years 1189 – 1192 was led by the English king Richard the Lionheart, where the city of Jerusalem was besieged by the

Foundation for Equality: Magna Carta
"To no one will we sell, to no one will we refuse or delay right or justice" (Magna Carta, 40). Magna Carta is one of the most important documents in
the history of the world. It gave English citizens more rights and reduced power from King John. This piece of history guided the process leading to
constitutional law. Magna Carta formed powerful parliament; also becoming the foundation for English citizen rights.
Magna Carta set the tone for the ruling of constitutional law that us people still abide by today. At the time of the documented charter, barons were
freed from prolonged cruel caused by King John of England. "Magna Carta influenced many ... Show more content on Helpwriting.net ...
"Magna Carta was the most significant early influence on the long historical process that led to the rule of constitutional law today" (New World
Encyclopedia, 2014). The Bill of Rights, which was the first influence from Magna Carta, consists of the ten amendments that were added to the
Constitution. It protected the citizens, but was not initially considered important. The supporters of the Constitution realized how crucial it was to
continue ratification. In a chain of events, Magna Carta who influenced the Bill of Rights also had an impact on the creation of the United States
Constitution. The U.S. Constitution established America's government, increasing federal authority but still giving the rights to U.S. citizens. Exactly
what Magna Carta did; by changing power and awarding citizens basic rights.
Tying in to the great document of Magna Carta, it has mainly affected American citizens. Later creating freedom, peace, and an importance to
democracy. Magna Carta created rights, and didn't give the person in charge to much power. The people of today have free lives because of a

The Magna Carta Libertatum And The Civil War
The U.S. Constitution, Declaration of Independence, and modern Western democracy– these things can trace their roots back to the 13th century with
the introduction of a groundbreaking document. The Magna Carta Libertatum, more commonly known as the Magna Carta, was a charter signed by
King John of England on June 15, 1215, to ease tensions between the King and a group of rebel barons. The barons fought tirelessly to diminish the
power of the crown and place that power in the people and the church. However, all was not well; the church swiftly annulled the document. Also,
King John refused to abide by the terms of the document. Thus, a civil war, called the First Barons' War, broke out. TheMagna Carta is a foundational
document in Western history, giving English citizens their first taste of personal freedom and laying the foundation for American democracy, but it
precipitated a civil war between the church and the crown.
The Magna Carta gave English citizens more liberties than any previous citizens ever had. It eased the unforgiving criminal persecutions that took
place for generations. This is expressed by the clause in the document that stated "[a] freeman shall not be [fined] for a slight offense, except in
accordance with the degree of the offense" ["The Magna Carta 1215"]. The first sentence reduced the number of fines that could be imposed upon a
citizen for minor offenses; most minor offenses could not be fined after the document was implemented. It also humanized

The Magna Carta
The Magna Carta is one of the most important documents from the Middle Ages. It was a charter of liberties that, King John of England, agreed to.
It would initially put him, future kings, and the rest of England under a unified rule of law. It can be generally described as a peace treaty. It was
written by King John's barons who were the lowest level of British nobility. All of it was originally written in Latin, so its name translates to "The
Great Charter".
Those involved with The Magna Carta were powerful men of the time. The charter itself was made because of King John, who was just a terrible king
that abused his great power. He lied, was greedy, and didn't really care about anyone but himself. During those... Show more content on Helpwriting.net

During the Middle Ages, it was very successful in creating rules to live by which the whole kingdom followed. Things were fair, and the King still
had to obey the laws which everyone else did. The Magna Carta consists of a preamble and 63 short clauses. The document also guaranteed the
rights of the people, the right to justice and the right to a fair trial. The U.S. Constitution & Bill of Rights, still used now, have some obvious
influences from the Magna Carta. For example, the Fifth Amendment states, "Nor shall any persons be deprived of life, liberty or property without
due process of law". This is basically Clause 39. It created a basis for ruling which were finally fair for everyone. The kings couldn't abuse their
power for their own personal gain, they were subjects to the rules of justice that everyone else was. Though only 3 of the clauses are still used in
present times, The Magna Carta holds the foundation for English common law as it is known

Why is the Magna Carta a significant document in world history? For centuries England was ruled as a monarchy. England was ruled by an over
powered and abusive King. Before the Magna Carta the King of England King John had abused his power. He did this by overtaxing the people of
England, losing land in war, giving and much more. The people decided that the king had too much power so the Magna Carta was formed. The Magna
Carta was signed on June 15, 1215 between King John and the people of England during the middle ages in Runnymede. King John was forced to sign
this document and agree to the demands of his barons Magna Carta is Latin for Great Charter ... Show more content on Helpwriting.net ...
It was the most formal way of giving power back to the people. The 40 barons that wrote the Magna Carta had 63 different requests written in it.
The first thing the barons asked for was freedom of the church and electing church officials such as the pope. King John was disliked for punishing
his enemies without trial. The signing of the Magna Carta took away his power to do so. One of the things asked by the barons was that "no free
man shall be arrested or imprisoned or deceased or outlawed or exiled or in any way victimized neither will we attack him or send anyone to
attack him except by the lawful judgment of his peers or by the law of the land." This means that no one person will be unlawfully victimized. The
purpose of this law was to prevent King John from personally ordering the arrest and punishment of a free man without lawful judgment according
to the Magna Carta. Another request from the Magna Carta was, "We will sell to no man, we will not deny to any man, either justice or right." This
means a fair justice system will be granted to every man no matter their place in society or religious beliefs. The intentions of the Magna Carta were
not to be a list of rights for England. The Magna Carta was more like a contract that said that the king would obey these requests. The result of King
John signing the Magna Carta was he lost a significant amount of his power while the people gained more

Comparing King John And The Magna Carta
: English rulers that clashed with nobles and the Church tried to raise taxes or impose royal authority. With these struggles, the evolved traditions of
government formed that would have great influence on the modern world. A clever, cruel, and untrustworthy ruler, King John, had three powerful
enemies: King Philip II of France, Pope Innocent III, and his own English nobles. When John suffered a setback by losing a war with Philip II, he had
to give up lands in Anjou and Normandy. Then he fought with Innocent III over selecting a new archbishop of Canterbury. The pope excommunicated
him when John rejected the pope's nominee as well as placing England under the interdict––the papal order that forbade Church services in an entire
kingdom. To save himself as well as his crown, John had to accept England as a fief of the papacy and pay a yearly fee to Rome. ... Show more content

extended to all English citizens. Second, the Magna Carta made it clear that the monarch must obey the law. The barons included provisions that

Analysis Of The Movie Robin Hood
Film Paper: Robin Hood "Rise and rise again until lambs become lions." This quote defines the way in which Robin Hood lives and subsequently
drives the plot of the movie. This specific Robin Hood movie, released in 2010, takes a different approach than most Robin Hood movies by
focusing on Robin Hood's background. In the following essay, the historical accuracy of the movie and our resulting cultural assumptions, the ethical
and moral challenges introduced, and my personal recommendation will be analyzed. Because there are few sources written about the life of Robin
Hood, in order to determine the historical accuracy of the film, it is helpful to examine the cultural figures and events surrounding Robin Hood
instead. One of the main historical figures surrounding Robin Hood is "Richard the Lionheart," the king of England at the time. In the beginning of
the movie, Robin Hood is enlisted in King Richard's army as a common archer at the Siege of ChГўlus. From a look back at history, it can be
determined that the Siege of ChГўlus was indeed a real event. The siege took place in 1199, as the movie accurately states and documents from the
Tourist Office of the Monts de ChГўlus support by saying, "The castle of ChГўlus–Chabrol experienced a number of sieges, including that of 1199,
which brought Richard the Lionheart to Limousin to fight against the viscounts of Limoges."1 In the movie, during the siege, Richard is shot in the

Why Was The Magna Carta Created
King John ruled England at the beginning of the thirteenth century. Not only did he rule, but he ruled with full power under the monarchial
government. His choices were not fair. They triggered many problems between foreign countries who were the country's tax payers, causing the people
of England's taxes to rise. Throughout a very long and winded process, the English barons became unhappier with the decisions King John had been
making. This is why the Magna Carta was created. The Magna Carta is a document that was originally created in the year of 1215. This name is
presented in the Latin Language, meaning The Great Charter. A charter is a written endowment by a country's legislation by which an institution, or in

Even though this was true, they were directly produced to King John to stop his unfair rule. This document is considered a landmark document because
initially it only applied to the country of England. It issued many important laws that are used today. It made sure that the cruel and unusual
punishments that were not forbidden became illegal. This is simply because of moral rights. Another major clause in the Great Charter was that one
person cannot be held responsible for a crime without a trial by jury of his/her friends. Also, a major clause of the document is that justice should not
be sold or unnecessarily overdue. Throughout history, the Magna Carta was modified and sort of "recreated". By the twentieth century, only three
major clauses remained in the document. The first clause granted freedom to the Church of England. These churches are Christian Catholic with
strong beliefs in their religious rights. Furthermore, they guarantee the customs and liberties of the English city of London. Lastly, they forbid
uninformed arrest and the transaction of justice. Unlike most historical documents, whether declaring freedom from a king or any other form of
government, the Magna Carta has no "official" copy. Each copy had at least three thousand six hundred words written exclusively. Only four of the
original copies are remaining today. Many different versions of the Magna Carta were established between the years 1225 and 1297. Matter of fact,
one original copy from 1217 recently sold for 21.3 million

The Magna Carta: Still the Basis of Society for Good Reasons
The Magna Carta was an English document that was issued on June 15, 1215 and was used for the purpose of limiting the power of the King. It was
written in Latin and was the first written constitution of Europe. There were 63 clauses in the Magna Carta and many of the clauses were about
property rights for the barons, however many of the benefits were only given to the rich and many people never had a voice in the British government.
The Magna Carta was a great achievement for the English barons and, six centuries later, an inspiration for American colonists trying to get
representation for all people. The barons wanted the rights of the British Government to be recognized and sent to all countries to be read to the
freemen. While England was militarily successful the king had a good relationship with the barons, however, while England lost land the taxes for
the barons increased and the barons didn't like the fact of the taxes going up without being told which is when the barons took action against the
king and forced the signing of the Magna Carta or else the threat of a Civil War was presented. In a lecture on October 13, 2011 David Davis who is
a member of the Parliament said this about the Magna Carta

This in turn gave him the name John Softsword, meaning that he would never be strong enough to be king. This nickname did not help John's
popularity with his people, but only made fun of him.
Another one of John's fatal mistake was going against the Pope on who should be archbishop. The Pope got mad and excommunicated John putting all
of England under church order. The Pope made most of England angry with marriage laws and condemment. Although, the people were more mad at
John than the Pope for this. Which only caused more hatred for John.
Then John signed the magna carta causing to despise him even more. The Magna Carta created new laws for England. However, these laws would

The Rochester Castle Under Siege in 1215 Essay
The Rochester Castle Under Siege in 1215 When king John first became king in 1199 he owned nearly as much land in France as he did in
England. By 1204 john had lost much of his French territory, including Normandy. This was partly the fault of Richard the lionheart, who was the
king before John. Richard had made his nobles in France angry because he took so much money from them and many of them were tired of being
ruled by an English king. Some of these nobles thought that a man called Arthur of Brittany would be a better ruler or them than john. The people in
France who did not like the idea of john as their new ruler soon went to war against him. At first things went well for john in... Show more content on

In the end he decided to make his peace with the pope only because he thought the pope might be able to help him in his fight with the barons.
King john never really got over losing Normandy. He tried very hard to get back his lands, but by doing so he annoyed his great nobles or 'barons'
back in England. He wanted to get more money from them to cross over the channel and help him personally in his wars. Most of the barons had
no wish to part with more money or to fight in France but John raised the taxes so that John would get more money off them and in some cases if
John didn't like a certain baron he would tax him more for no reason. In 1205 john met with his barons and tried to get them to come and fight with
him to regain his lands in France. After losing Normandy, john began to distrust his barons. He gave more and more important jobs to poor
foreigners because he thought that they would be grateful to him and not let him down. The barons expected to get the best jobs, so this made them
even more unhappy with john. King john was blamed for the loss of land in France even though it was mainly Richard the lionhearts fault and he was
made unpopular for this. When a war aroused between France and England he was made more unpopular because people had to go and fight in
France. By now people didn't

Magna Carta
There are many types of papers and documents, we have to sign every one of them. Whether its to apply to a college or becoming the president of the
United States of America. In my paper I am going to explain one document in particular the Magna Carta. I will include why this document was so
important to England and exactly what the Magna Carta is. I think the Magna Carta had laws or important rules they had to follow. I am going to see if
my guess is correct.
The word Magna Carta is actually latin for the Great Charter. Some call it Magna Carta Libertatum, meaning the Great Charter of the Liberties. The
Magna Carta however is a charter signed by King John of England in June 1215. King John signed this charter or document because it provided him
with money and men to defend his land. The document states the laws, rights and liberties of England. So, if I were to compare it could be like our
constitution. If King John didn't apply himself to these laws/rights the nobles could take away his power by force if necessary. The document was
made "after his barons ... Show more content on Helpwriting.net ...
I researched that answer, and I found it. It was important because "it placed limits on royal authority, and made clear that the monarch was not
above the law." (McFarnon) The Magna Carta was written on parchment paper, which was made from dried sheepskin. It was also written in Latin.
It may have been an important charter but, research states it was only valid for 10 weeks. (Guthrie) Not long after signing the Magna Carta, King
John attempted to cancel the agreement. (Technological Solutions, INC.) KIng John had the Pope declare that the document was illegal or unjust.
Soon the country of England was facing civil war. For a year the barons fought King John in what was called the First Barons' War. King John died in
1216, which quickly ended the war. He was only 49 years old. Born in 1667, and died in

document of the Middle Ages. The Magna Carta was a product of the power struggle between King John and his barons in the year 1215. Although it
was intended to address concerns that were specific to its time and place, it became a high water mark of legal freedom for centuries to come. This

Many of them pertain to measures the king must undertake in specific parts of England, but others are broad statements of principle that have become
the foundations of English law. The preamble to the Manga Carta is one of the latter. It states that the king must be subject to laws agreed upon by his
barons, as he has not been able to withstand the collective force of their armies. This section is known as the Notwithstanding Clause. It fundamentally
changed the way that subsequent governments operated, and its implications continue to be debated today.4
Another key provision has to do with the separation of church and state. Many bishops in the kingdom were angry with John because his officials had
attempted to interfere with religious officials and ceremonies. Therefore they prevailed upon the barons to include an article which stated "To
no one will we sell, to no one will we delay, to no one will we deny Christmas."5 This statement refers to an event in the year 1213, in which
Ranulf de Glanville, one of the king's sheriffs, forbade the celebration of Christmas mass in Nottingham.
A third provision concerns taxation. In the original Latin, it is summed up by the famous words "Discipulus tuus hunc tractatum non
scripsit." This sentence means "There is to be no taxation without representation."6 The clause, article 23, led to the establishment of
the parliament of England, the world's first

The Magna Carta and the Petition of Rights were two of the most important English documents and they were key to development of England's legal

feudal barons to protect their rights and to limit the powers of King John. The barons were the king's tenants–in–chief (held land for the king). The king
gave them land and he wanted loyalty in return. However, King John would not reward the barons for loyal service, but he would keep them in check
with threats and blackmail. And as time went by, the barons were hustling for advantage and had risen in rebellion. When the barons rebelled against

The Magna Carta, used for King John, and the Petition of Right, used for King Charles. There are a few differences in the documents such as; in the
Petition of Rights, it required protection of private property and putting an end to forced billeting of soldiers. The Magna Carta was published in 1215
and the Petition of Right in 1628, this shows that even four hundred years later, kings were still disobeying The Great Charter. These documents show
that democracy was an evolving process, because it was the first time in England that a king had to share his powers. This shows that no person is
above the law, not even the king. It was the basis for the legal systems around the world, especially England. Many of the rules in the Magna Carta
are still used to today, such as having a fair trial by jury and being free from punishment, unless convicted in a trial. These are the basic cornerstones in
the legal system all around the world and countries such as the US, have legal systems mostly based on the Magna Carta. "...the most important phase

By marrying Eleanor, Henry owned more of France than Louis did. However, since Eleanor never received Louis's approval of her marriage to
Henry, Louis said the marriage was invalid. This caused Louis and Henry to fight over Eleanor in a series of wars. In the end, Henry won due to
his training in battle and young age. Eleanor finally gave birth to a son, William, one year after marrying Henry. William died as an infant, but
Eleanor gave birth to 7 more children, and four of them were boys. When Henry went on long buisness trips, Eleanor took control of England. In
1168, Eleanor moved to Aquitaine to rule the land, as Henry had given her full control of Aquitaine. Eleanor used her political resources and
power to help her sons, even if it meant decreasing her husband's power. In 1170, Eleanor convinced her husband to pass the crown to Henry.
However, Henry still had all of the power and the land. Thus, Henry's sons rebelled, with the help of Eleanor and Louis VII, after three years.
However, the rebellion was defeated as a result of Henry's execeptional battle skills. Due to the rebellion, Henry locked Eleanor away in Salisbury

Ivanhoe Analysis
Even Without Capes Ivanhoe was written by Sir Walter Scott in 1819. Set in England, between the towns of Sheffield and Doncaster, Ivanhoe
occurred during the end of the Third Crusade. At this time, England was under the temporary rule of Prince John. Prince John sided with Philip of
France to ensure that his brother, King Richard, was kept in captivity by the Duke of Austria. He feared Richard and was horrified by the prospect of
his brother's return, as he wanted England under his own rule. In Ivanhoe, King Richard eventually escaped from his imprisonment and returned to
England. He waited for the reinforcement of his allies to reclaim his throne. Even though he was a Norman, Richard helped the rival Saxons. He
wanted to end the dissension between these groups as the Saxons felt oppressed by their Norman conquerors. He also obtained help from the Saxons to
defeat untrustworthy Norman leaders. Known as Coeur–de–Lion, Richard was actually extremely similar to Beowulf. Beowulf was a powerful warrior,
who travelled to aid the Danish King, Hrothgar, in the defeat of Grendel. Grendel was a monster, who had overtaken Hrothgar's great mess hall. For
twelve years, Grendel ravaged Heorot. Beowulf decided to save the Danes from this man–devourer. King Richard and Beowulf were both heroes. A

What Is The Purpose Of The Magna Carta
A rare medieval manuscript that grants equal love between the monarchs and the people, shaped the England government into what it is today. This is
the definition of the Magna Carta. The purpose of the Magna Carta was to create equivalence between the people and the monarchy in England due to
many fall outs between these two groups throughout the years before. The Magna Carta very much affected the country of England, benefited the
citizens, and granted strong individual leaders, who weren't the king, a chance to speak their mind. This legal document was essential to help England
overcome their countries issues at the time.
Their was a desperate urgency for the Magna Carta after years of unsuccessful foreign policies and heavy taxation demands needed to pay for the
defeat they faced in North France. All the roads lead back to King John regarding the purpose of the creation of the Magna Carta. King John had
made many poor decisions that led the people of England to lose trust in him. In 1204, King John's army was defeated in Britain and had no choice
but to retreat. Many people in England were saying that he was responsible for the murder of his own nephew, they found it very difficult to trust
someone with that accusation (Jones Ch. 1). He then institutionalized a church law that no one could get married unless they were approved by the
Pope first. The church law also stated that only christened people would go to heaven and the rest would go to hell. A lot of the citizens of England
blamed King John for this new declaration. Due to all of these disasters and accusations, the Pope declared that whoever tried to overthrow King John
could do so. John thus dug his own grave when he lost another battle to the French at Bouvines. Now, King John was facing a possible rebellion by the

How Has The Magna Carta Changed History
The story of the Magna Carta By: Celia I.
Introduction
What you are about to learn about this chapter is something that changed the world. Something that some countries thought about and decided to do
something like it. Something that was most probably why the U.S. Constitution was made. Something that was called the Magna Carta. If the Magna
Carta was not made or approved by King John of England, we would be living differently. Some countries would not have democracy or law. People,
children, teachers, for a long time would be put in prison or killed without having a fair trial. This is how the Magna Carta changed history.

The barons were of at war with John again, and sooner or later, King John died in the year of 1216. Now that he was gone, the people were much
happier for a while. The Magna Carta was not needed any more in England. But centuries later, the Magna Carta will travel all the way across the ocean.
Great Charter comes back to Life
The Magna Carta might be done in England, but much later it came to the United States. The political party that wanted to be free from England based
one of their documents on the Magna Carta called the U.S. Constitution. Now in Washington D.C., they now have it on display.
Conclusion
As you can see, the Magna Carta is a very important story in history. It brought civilization, it brought freedom, and it brought happiness for a while
(Well, maybe not for King John). It taught humans to treat people the way they want to be treated. It was one of the reasons the United States is
there today. The Magna Carta had an impact on people in a good way, and a bad. The Magna Carta was so important that there is a copy of it in the
British library. The Magna Carta was truly a wonderful

documents such as the U.S Constitution and the Universal Declaration of Human Rights.
The Magna Carta is a peace treaty signed in June 15,1215 between King John and the rebel barons. The Magna Carta was made because nobles/barons
caught King John breaking laws he established. He was banned from churches by Pope Innocent III. To redeem his reputation, John took money from
barons to help the army, which was against the law. Rebel barons wanted King John to pay for what he done. So, in May 17,1215, they captured the
Tower of London. They made a peace treaty, Magna Carta, which King John... Show more content on Helpwriting.net ...
The Magna Carta also charted the right to a fair trial and limits on taxation without representation. This peace treaty was created because the king was
going against the own laws set by him, and the rebel barons wanted to put an end to this problem by creating a peace treaty. The Magna Carta required
that no–one including the king himself must not violate the laws.
The Magna Carta is known as one of the first steps taken in England towards parliamentary democracy. The Magna Carta is a symbol of freedom from
oppression. This peace treaty inspired the Parliament, in England. It also heavily influenced the American Bill of rights, and the Universal Declaration
of Human Rights. It inspired the U.S founding fathers to right the U.S Constitution. The Magna Carta was made to protect basic human rights. The
treaty was also contrived to limit the king's power. King John had no intention of believing in the agreement leading to the Baron's war. When the
Baron's captured London King John was forced to negotiate with barons and eventually sign the treaty. The 1215 Magna Carta was not the only

BALLO Hermine – Hist 294–15 – Britain in Fiction essay – 05/02/2016 Ivanhoe (1982) Ivanhoe is a television film adaptation of Sir Walter Scott's
novel of the same name, which premiered in 1982. It depicts the Saxon knight Wilfred of Ivanhoe returning home from the Crusade after following the
king Richard I (1157–1199) and finding himself involved in a power–struggle for the throne of England. During his adventure, Ivanhoe will have to
face Prince John's allies, Front–de–Boeuf, Bois–Guilbert the Templar knight and Maurice de Bracy, his own father Cedric of Rotherwood, who

sorcery, would have probably never happened in the first place, it is very unlikely that a Christian would have stood up to defend her. However, since
Ivanhoe wanted to take his revenge against Bois–Guilbert, who already tried to kill him, this might have been just a pretext. Finally, Richard, at the

Henry II And The 19th Century
Times started to transform in the 12th and 13th century with how the government ran in England. Henry II was King at this time and had developed
a government system where he had professionals work for him. These professionals had schooling and got paid salary by the King. The government
was very institutionalized with royal officials administering both revenues and law. The king did not have to be present much, in place, he had his
officials do administrative work and record keeping. The king traveled all throughout the European continent because he was able to, while his
working officials did his work in place. Henry II extended and strengthened the institutions of the English government. He became king during a
horrible civil war between two royal claimants. "The chaos had benefited the English barons and high churchmen, who gained new privileges and
powers as the monarchs authority waned" (355). Henry II's father Henry had built new castles and when Henry II took throne he confiscated the
castles and regained the crown land. He then extended monarchical power by imposing royal justice. He built it on an already well developed legal
system. "The Anglo–Saxon kings had royal district courts: the king appointed sheriffs to police the shires, muster military levies, and haul criminals
into court...to these established institutions, Henry II add a system of judicial visitations called eyres" (357). With proceeding this system, royal
officials went all around England to judge

The Legacy Of The Magna Carta
The Magna Carta Democracy in the world today was influenced by events that took place many years ago when Aristotle was still alive. Those events
that took place in the thirteenth century created the form of democracy that countries still use today (Synan). The Magna Carta was a document that
was originally created by rebel barons in England which served as the country's constitution, putting an end to the power of their monarch, King John.
The infrastructure of the Magna Carta was replicated in many constitutions for the next eight hundred years, including the US Constitution (Synan). A
group of English rebels coordinated with one another to create a document restraining King John's power and each rebel signed it. In fear of full–blown

The Magna Carta was created by English citizens that disliked the authority that their higher power, King John had over them. In protest, they decided
to congregate with one another to make a hand written document stating that the English church be free, and that the rights of the church will not be
restrained in any manner, that freedom will not be tampered with, and that regular people will elect the members of the church to their liking (Magna
Carta or Great Charter). This part of the Magna Carta is just the introduction that leads into other rights that the English barons wanted. Even though
this is just the introduction to the Magna Carta, the forefathers of America instilled these same ideas into the preamble of the US Constitution. The
Preamble of the Constitution starts off with "We the people of the Unites States" which means that regular people in theUnited States have come
together to change the ways of their countries. The preamble also states that the people of the United States have come together to "Secure the

The King at the time was unpopular, mainly because he lost many of his battles. Among these battles were wars against France which belonged to
England until King John's reign when the France reclaimed their land. This loss of land meant less tax which led to the King demanding more tax from
the people in England. The king didn't run this through, like he was meant to, with the English barons. King John made bigger taxes on many
occasions and even introduced new ones without consulting them. This started the anger of the barons.
John also acted against custom by choosing someone to be the Archbishop of Canterbury against the wishes of the pope who wanted someone else to
fill this role. This angered the pope so much that it caused a lot of problems for King John. In John's apologies he gave the kingdom of England and
paid him yearly rent to continue living there. This gave the barons less control over their land because now it was officially owned by the Church,

King John's Arguement In The Magna Carta
In 1199, King Richard was killed in France and John became the king of England. After a choppy start to his reign as King, John was
excommunicated by the Pope after arguing who should be the Archbishop of Canterbury. The Pope then placed England under a church law which
stated that no christenings or marriages would be legal until the Pope allowed them. The Church law also stated that only christened people would be
accepted into Heaven, and children born out of marriage were doomed for Hell ("History"). England lashed out at King John, as the Pope said anyone
who attempted to overthrow John would be legally allowed to do so. In 1214, John lost a battle to the French in Bouvines, France. After hearing of his

This document mostly benefited the upper–class, however; it was a step in the right direction to limiting the King's power (History). Most of the
Magna Carta concerns the rights of barons and their property. However, there are articles concerning: the Church, taxes, weights and measures and
certain rights any man possesses. One very important statement in the Magna Carta is that which concerns individual freedom. Clause 38 of the
Magna Carta states "In future no official shall place a man on trial upon his own unsupported statement, without producing credible witnesses to
the truth of it" ("Fordham University"). This is the theory of being "innocent until proven guilty" which is very prevalent in societies today.
Another clause would help build the thought of habeas corpus, which states no man can unlawfully imprisoned ("History"). Clause 39, which
proclaims "No free man shall be seized or imprisoned, or stripped of his rights or possessions, or outlawed or exiled, or deprived of his standing in
any other way, nor will we proceed with force against him, or send others to do so, except by the lawful judgement of his equals or by the law of the

What Is The Verbiage Of The Magna Carta
The original Magna Carta signed by King John under the pressure of the English barons on June 15, 1215, marked an immeasurable change in the
law in regards to the power of the sovereign in England. While that first draft was only in use for a short time, the subsequent drafts and additions by
medieval and early modern kings and queens influenced law in continental Europe and the Americas. The ideas outlined in the original charter contain
not only medieval material but ideas, perhaps not explicitly named, that are still prevalent and fundamental rights that Americans and citizens of the
United Kingdom continue to relish today. Ideas such as due process, trial by a jury of peers, and even the origins of habeas corpus are found within the
61 clauses of this 800–year–old document. Clauses 39 and 40 represent those three fundamental, essential rights that cannot and should not be deprived.
The Magna Carta and its articulation of due process before the law, trial by a jury of peers, and habeas corpus were meant as a means of infringing
on the power of the tyrannical sovereign and it sparked the fight for personal liberties in England and the American Colonies and in doing so has
become a staple of Common Law.
Studying the verbiage of the Magna Carta is important, but the background and reasons for its creation dictate how its original meaning can be
interpreted by a modern scholar. The Battle of Bouvines and the loss of England's landholdings in France was a catalyst for the creation of the
Magna Carta, but Henry II and King John had made decisions that had royally angered the barons long before 1214. Throughout John's reign, the
barons felt an increase in feudal obligations: they were forced to provide more soldiers, take more subtenants, marry into undesirable alliances, and
their feudal courts' power was being usurped by the royal courts and chancery. King John had been excommunicated for not agreeing with Pope
Innocent III's candidate for Archbishop of Canterbury, and in doing so excommunicated the subjects of England. Combine all of those issues with
losing the duchies held by the Angevin Kings, and quite reasonably, there would be anger. In a society where land is the cornerstone to profit and

Why Was The Magna Carta A Demand For Freedom?
The Magna Carta was a demand for freedom by the nobles. It was vital to the nobleman of England because it was how they eliminated the absolute
power of King John. Before King John was in power, his brother King Richard, was in power. King Richard had practically left no money for King
John when he became the king because he had used it to fund many expensive wars in the Crusades. King John had to make money quickly, so he got
his money by taxing the nobles. The nobles hated this, especially because England kept losing wars, so they essentially were funding wars that
England didn't even win. It also didn't help that King John wasn't very popular with the nobles, this was because he lost Normandy to France, which
made John look weak. He also kept collecting money from them to fund more wars, that they kept losing. Also, because John tried to take back
Normandy and was brutally defeated at the Battle of Bouvines in 1214. The nobles were also tired of King John taking their sons and using them for

Richard I Biography
Richard the I is a famous King of England that was alive in the 12th century, and one of the earliest monarchs of England. He was the Great Great
Grandson of William the Conqueror(Brundage, 10). He was a member of the House of Angevin, which was composed of him, his father, and his
brother John(Brundage, 12). He is a relatively famous King of England, renowned for his fighting skills, and nickname "Richard Coeur de Lion"
translated "Richard the Lionheart". Richard was born on the 8th of September, 1157 in Oxford, England(Brundage, 9). He was the son of King
Henry II and Eleanor of Aquitaine(Brundage, 9). He had 4 legitimate brothers, William IX(Count of Poitiers), Henry the Young King, Geoffrey
II(Duke of Brittany), and John(King of England)(Brundage, 10). William IX died before Richard was born. Richard grew up in Europe with his
mother. He most likely did not know very much English and spoke mostly French(Brundage, 21). At the age of 14, he became the Duke of

In fact, at the time of its enactment, the Magna Carta was known for being "principally a conservative document in which the king confirmed the
long–standing rights and privileges of England's nobles" (Backman 366). However, within the document there was "one important innovation–an
explicit recognition that the king is not above the law" (Backman 366). In the year 1215 King John, the ruler of England from 1199 to 1216, found
himself both unpopular and still reeling from the loss of most of his inherited lands in France in the year 1204 after a failed military campaign. He
had spent the decade since in a struggle to recapture said lands and, in an effort to do so, sought out a means of financing his personal war. His
solution to his monetary woes was to extensively tax the nobility of England known as the barons. His ultimate failure culminated at the Battle of
Bouvines where he was once again defeated by King Phillip II whom had taken his lands from him originally. A failed conquest coupled with the
already unpopular excessive taxation of the wealthy led to barons in northern and eastern England to begin an organized resistance to his rule. King
John was the third of the Angevin Kings who had employed in their rule the principle of vis et voluntas, or "force and will." This ruling style's base
sentiment was that the king was above the law and could make decisions he saw fit regardless of common–held political procedure. In the face of open
rebellion, King John held a council in London in January of 1215 in which he had hoped to discuss potential reforms. Pope Innocent III, who reigned
from 1198 until his death in 1216, was called upon from both sides in attempts at mediating the dispute. The barons presented an initial document

King John And The Barons
During and after the time of the Norman kings, English monarchs would a call for a Great Council. It is the Great Council that will evolve into

barons and earls to address the important affairs of the realm.became hopeless for it to rule effectively. The conflict between King John and the barons
is a major instance of what happens when the system of consultation and consent was ignored. The results of which would start the lowering the
authority of the king and the rise of Parliament. The idea of popular consent to royal government emerged in the thirteenth century during the reign of
King John from 1199 to 1216. He was the youngest of the five sons of King Henry II of England and Eleanor of Aquitaine. Being the youngest boy, he
was not expected to inherit a large amount of land. After his older brothers' failed rebellion between 1173 and 1174, John became the favored child of
his father. He was given the title "Lord of Ireland" in 1177 and received lands in both England and English lands on the European continent. When
most of his elder brothers died young, John's brother Richard, became king 1189 after the death of their father. John was a potential heir to the throne.
While his brother was off fighting in the Holy Land with the Third Crusade, John attempted a rebellion against Richard 's administrators which failed.

William Marshall Essay
William Marshall is considered by many to be the epitome of knighthood and chivalry as well as being an outstanding ambassador for England during
the turbulent twelfth and thirteenth centuries. From a virtually obscure beginning, William evolves into one of the most dominant stately figures of the
time in England. During his brilliant military and political career, William served as knight for the courts of Kings Henry II, Richard (the
Lion–hearted), and John. William was born around 1147 to John Marshall and Sybil of Salisbury during the reign of King Stephen. His father, John
Marshall, served as a court officer and eventually earned the status of a minor baron. John Marshall was a shrewd soldier and a skilled negotiator. He

He remained in Jerusalem for two years. Upon his return to England, Marshall is welcomed into the King's military household. War, counsel and
command were now his daily life. William is a common figure in the court and currently does not have a prominent status. Marshall faithfully
serves King Henry II during the last years of his reign. The King has two heirs to the throne in Richard and John. This presents a problem of sorts
for Henry. Richard, the most capable and competent, appears destined to descend the throne. Henry would prefer John in succeeding him as king,
however he realizes that Richard is by far the most qualified and prolific of the two. Toward the end of Henry's rule, Richard rebels against his father,
joining Phillip II of France. The two begin a series of battles against the King. During this time period, William remains faithful to Henry. Marshall
inevitably realizes that his current enemy may well become his future king. This conflict does not influence William's fidelity for his King. His loyalty
to Henry remains in tact and is not compromised despite the fact that treason might have seemed advantageous to him at the time. These wars coupled
with his bitter relationship with Richard take a heavy toll on the King. In 1189, Henry's health gradually deteriorates until he eventually dies.
Despite their past differences, Richard returns home to England for his father's funeral and to assume his

King Richard I : The Lion King
Richard I ruled as the king of England from 1189–1199. King Richard I, also known as "The Lion Heart" was a glorious warrior and military leader,
known to be extremely ambitious, that led England through many significant military accomplishments. His father, Henry II didn't believe that
Richard would be a successful ruler of England, but in his short reign of only nine years, he was able to make an enormous accomplishment for
England. His greatest accomplishment was the Third Crusade, and over a reign of only about nine years, King Richard I was able to recover much
of the Holy Land from Saladin, the leader of the Islamic forces during the Third Crusade. Even though he failed to recover the city of Jerusalem, he
negotiated a peace treaty with Saladin that allowed the Christians to practice their religion in all of the Holy Places in the city. Richard I was able to
reverse almost all of the conquests of Saladin, allowing the Christians to reoccupy the coast of Palestine. Richard I's conquests and significant military
accomplishments for England prove him a successful leader of England.
Richard I was born on September 8th, 1157, the third son of Henry II and Eleanor of Aquitaine. Richard's father was the grandson of Henry I of
England and his mother was the daughter of William X of France. King Henry II Richard had an older brother, young King Henry, and an older sister
Matilda. He also had two younger brothers, Geoffrey and John, and two younger sisters, Eleanor and Joan.

How the Magna Carta Shaped Democracy The title "TITLE How the Magna Carta Shaped Democracy

  • 1. How Magna Carta Changed America The Magna Carta changed the way that America is today as well as the way society was in England 800 years ago. The people of England were tired of the way King John had been treating them. So the barons, the King's go to people, realized that King John was getting too powerful and misusing his power as king. Which initially led to his behavior and how he was treating his barons as well as the people of England. King John's behavior is what led the barons to take matters into their own hands and the greatest document to ever be written in English History was born. The Magna Carta. The original copy of the Charter pretended to state customary law and it promoted disagreement and contention. The Magna Carta's full "effect" did not occur until later, at first, it was only legally valid for no more than three months. Within these three months, the Charter's terms were never properly fulfilled. After removing all reference to tallage, the Charter achieved formal consistency at the cost of its real intent. (Tallage is a form of arbitrary taxation levied by kings of the towns and lands of the Crown.) Magna Carta later assumed legal parity among all free men to an exceptional degree. The first revised portion stated that " the Charter still declares that the English church shall be free and still confirms, but does not define the privileges of the city of London and other towns and boroughs." But the omission of this clause in 1217 left the Londoners still tallageable. The first Magna Carta was a " rough draft" and like many rough drafts, there are many revisions. So the Magna Carta had a total of two revisions before the " final draft." These two revisions took place in the following years: 1217 and 1225. The final draft became law and was confirmed and interpreted in the House of Parliament and enforced in the courts of ... Get more on HelpWriting.net ...

  • 4. The Magna Carta Libertatum And The Civil War The U.S. Constitution, Declaration of Independence, and modern Western democracy– these things can trace their roots back to the 13th century with the introduction of a groundbreaking document. The Magna Carta Libertatum, more commonly known as the Magna Carta, was a charter signed by King John of England on June 15, 1215, to ease tensions between the King and a group of rebel barons. The barons fought tirelessly to diminish the power of the crown and place that power in the people and the church. However, all was not well; the church swiftly annulled the document. Also, King John refused to abide by the terms of the document. Thus, a civil war, called the First Barons' War, broke out. TheMagna Carta is a foundational document in Western history, giving English citizens their first taste of personal freedom and laying the foundation for American democracy, but it precipitated a civil war between the church and the crown. The Magna Carta gave English citizens more liberties than any previous citizens ever had. It eased the unforgiving criminal persecutions that took place for generations. This is expressed by the clause in the document that stated "[a] freeman shall not be [fined] for a slight offense, except in accordance with the degree of the offense" ["The Magna Carta 1215"]. The first sentence reduced the number of fines that could be imposed upon a citizen for minor offenses; most minor offenses could not be fined after the document was implemented. It was a charter of liberties that, King John of England, agreed to. It would initially put him, future kings, and the rest of England under a unified rule of law. It can be generally described as a peace treaty. It was written by King John's barons who were the lowest level of British nobility. All of it was originally written in Latin, so its name translates to "The Great Charter". Those involved with The Magna Carta were powerful men of the time. The charter itself was made because of King John, who was just a terrible king that abused his great power. He lied, was greedy, and didn't really care about anyone but himself. During those... The document also guaranteed the rights of the people, the right to justice and the right to a fair trial. The U.S. Constitution & Bill of Rights, still used now, have some obvious influences from the Magna Carta. England was ruled by an over powered and abusive King. Before the Magna Carta the King of England King John had abused his power. He did this by overtaxing the people of England, losing land in war, giving and much more. The people decided that the king had too much power so the Magna Carta was formed. The Magna Carta was signed on June 15, 1215 between King John and the people of England during the middle ages in Runnymede. It was the most formal way of giving power back to the people. The 40 barons that wrote the Magna Carta had 63 different requests written in it. The first thing the barons asked for was freedom of the church and electing church officials such as the pope. King John was disliked for punishing his enemies without trial. The signing of the Magna Carta took away his power to do so. One of the things asked by the barons was that "no free man shall be arrested or imprisoned or deceased or outlawed or exiled or in any way victimized neither will we attack him or send anyone to attack him except by the lawful judgment of his peers or by the law of the land." This means that no one person will be unlawfully victimized. The purpose of this law was to prevent King John from personally ordering the arrest and punishment of a free man without lawful judgment according to the Magna Carta. Another request from the Magna Carta was, "We will sell to no man, we will not deny to any man, either justice or right." This means a fair justice system will be granted to every man no matter their place in society or religious beliefs. The intentions of the Magna Carta were not to be a list of rights for England. The Magna Carta was more like a contract that said that the king would obey these requests. With these struggles, the evolved traditions of government formed that would have great influence on the modern world. A clever, cruel, and untrustworthy ruler, King John, had three powerful enemies: King Philip II of France, Pope Innocent III, and his own English nobles. When John suffered a setback by losing a war with Philip II, he had to give up lands in Anjou and Normandy. Then he fought with Innocent III over selecting a new archbishop of Canterbury. The pope excommunicated him when John rejected the pope's nominee as well as placing England under the interdict––the papal order that forbade Church services in an entire kingdom. This specific Robin Hood movie, released in 2010, takes a different approach than most Robin Hood movies by focusing on Robin Hood's background. In the following essay, the historical accuracy of the movie and our resulting cultural assumptions, the ethical and moral challenges introduced, and my personal recommendation will be analyzed. Because there are few sources written about the life of Robin Hood, in order to determine the historical accuracy of the film, it is helpful to examine the cultural figures and events surrounding Robin Hood instead. One of the main historical figures surrounding Robin Hood is "Richard the Lionheart," the king of England at the time. In the beginning of the movie, Robin Hood is enlisted in King Richard's army as a common archer at the Siege of ChГўlus. From a look back at history, it can be determined that the Siege of ChГўlus was indeed a real event. The siege took place in 1199, as the movie accurately states and documents from the Tourist Office of the Monts de ChГўlus support by saying, "The castle of ChГўlus–Chabrol experienced a number of sieges, including that of 1199, which brought Richard the Lionheart to Limousin to fight against the viscounts of Limoges."1 In the movie, during the siege, Richard is shot in the neck with an arrow in the midst of ... • 9. Why Was The Magna Carta Created King John ruled England at the beginning of the thirteenth century. Not only did he rule, but he ruled with full power under the monarchial government. His choices were not fair. They triggered many problems between foreign countries who were the country's tax payers, causing the people of England's taxes to rise. Throughout a very long and winded process, the English barons became unhappier with the decisions King John had been making. This is why the Magna Carta was created. The Magna Carta is a document that was originally created in the year of 1215. This name is presented in the Latin Language, meaning The Great Charter. Even though this was true, they were directly produced to King John to stop his unfair rule. This document is considered a landmark document because initially it only applied to the country of England. It issued many important laws that are used today. It made sure that the cruel and unusual punishments that were not forbidden became illegal. This is simply because of moral rights. Another major clause in the Great Charter was that one person cannot be held responsible for a crime without a trial by jury of his/her friends. Also, a major clause of the document is that justice should not be sold or unnecessarily overdue. Throughout history, the Magna Carta was modified and sort of "recreated". By the twentieth century, only three major clauses remained in the document. The first clause granted freedom to the Church of England. These churches are Christian Catholic with strong beliefs in their religious rights. Furthermore, they guarantee the customs and liberties of the English city of London. Lastly, they forbid uninformed arrest and the transaction of justice. Unlike most historical documents, whether declaring freedom from a king or any other form of government, the Magna Carta has no "official" copy. Each copy had at least three thousand six hundred words written exclusively. Only four of the original copies are remaining today. Many different versions of the Magna Carta were established between the years 1225 and 1297. Matter of fact, one original copy from 1217 recently sold for 21.3 million ... • 10. The Magna Carta: Still the Basis of Society for Good Reasons The Magna Carta was an English document that was issued on June 15, 1215 and was used for the purpose of limiting the power of the King. It was written in Latin and was the first written constitution of Europe. There were 63 clauses in the Magna Carta and many of the clauses were about property rights for the barons, however many of the benefits were only given to the rich and many people never had a voice in the British government. The Magna Carta was a great achievement for the English barons and, six centuries later, an inspiration for American colonists trying to get representation for all people. The barons wanted the rights of the British Government to be recognized and sent to all countries to be read to the freemen. While England was militarily successful the king had a good relationship with the barons, however, while England lost land the taxes for the barons increased and the barons didn't like the fact of the taxes going up without being told which is when the barons took action against the king and forced the signing of the Magna Carta or else the threat of a Civil War was presented. In a lecture on October 13, 2011 David Davis who is a member of the Parliament said this about the Magna Carta Now in Politics we're used to the law of unintended consequences. By 1204 john had lost much of his French territory, including Normandy. This was partly the fault of Richard the lionheart, who was the king before John. Richard had made his nobles in France angry because he took so much money from them and many of them were tired of being ruled by an English king. He wanted to get more money from them to cross over the channel and help him personally in his wars. The barons expected to get the best jobs, so this made them even more unhappy with john. I will include why this document was so important to England and exactly what the Magna Carta is. I think the Magna Carta had laws or important rules they had to follow. I am going to see if my guess is correct. The word Magna Carta is actually latin for the Great Charter. Some call it Magna Carta Libertatum, meaning the Great Charter of the Liberties. The Magna Carta however is a charter signed by King John of England in June 1215. King John signed this charter or document because it provided him with money and men to defend his land. The document states the laws, rights and liberties of England. So, if I were to compare it could be like our constitution. If King John didn't apply himself to these laws/rights the nobles could take away his power by force if necessary. The document was made "after his barons ... Show more content on Helpwriting.net ... Many of them pertain to measures the king must undertake in specific parts of England, but others are broad statements of principle that have become the foundations of English law. The preamble to the Manga Carta is one of the latter. It states that the king must be subject to laws agreed upon by his barons, as he has not been able to withstand the collective force of their armies. This section is known as the Notwithstanding Clause. It fundamentally changed the way that subsequent governments operated, and its implications continue to be debated today.4 Another key provision has to do with the separation of church and state. Many bishops in the kingdom were angry with John because his officials had attempted to interfere with religious officials and ceremonies. Therefore they prevailed upon the barons to include an article which stated "To no one will we sell, to no one will we delay, to no one will we deny Christmas."5 This statement refers to an event in the year 1213, in which Ranulf de Glanville, one of the king's sheriffs, forbade the celebration of Christmas mass in Nottingham. A third provision concerns taxation. In the original Latin, it is summed up by the famous words "Discipulus tuus hunc tractatum non scripsit." This sentence means "There is to be no taxation without representation."6 The clause, article 23, led to the establishment of the parliament of England, the world's first ... The king gave them land and he wanted loyalty in return. However, King John would not reward the barons for loyal service, but he would keep them in check with threats and blackmail. • 17. Ivanhoe Analysis Even Without Capes Ivanhoe was written by Sir Walter Scott in 1819. Set in England, between the towns of Sheffield and Doncaster, Ivanhoe occurred during the end of the Third Crusade. At this time, England was under the temporary rule of Prince John. Prince John sided with Philip of France to ensure that his brother, King Richard, was kept in captivity by the Duke of Austria. He feared Richard and was horrified by the prospect of his brother's return, as he wanted England under his own rule. In Ivanhoe, King Richard eventually escaped from his imprisonment and returned to England. He waited for the reinforcement of his allies to reclaim his throne. Even though he was a Norman, Richard helped the rival Saxons. He wanted to end the dissension between these groups as the Saxons felt oppressed by their Norman conquerors. He also obtained help from the Saxons to defeat untrustworthy Norman leaders. Known as Coeur–de–Lion, Richard was actually extremely similar to Beowulf. Beowulf was a powerful warrior, who travelled to aid the Danish King, Hrothgar, in the defeat of Grendel. Grendel was a monster, who had overtaken Hrothgar's great mess hall. For twelve years, Grendel ravaged Heorot. Beowulf decided to save the Danes from this man–devourer. King Richard and Beowulf were both heroes. • 18. What Is The Purpose Of The Magna Carta A rare medieval manuscript that grants equal love between the monarchs and the people, shaped the England government into what it is today. This is the definition of the Magna Carta. The purpose of the Magna Carta was to create equivalence between the people and the monarchy in England due to many fall outs between these two groups throughout the years before. The Magna Carta very much affected the country of England, benefited the citizens, and granted strong individual leaders, who weren't the king, a chance to speak their mind. This legal document was essential to help England overcome their countries issues at the time. Their was a desperate urgency for the Magna Carta after years of unsuccessful foreign policies and heavy taxation demands needed to pay for the defeat they faced in North France. All the roads lead back to King John regarding the purpose of the creation of the Magna Carta. King John had made many poor decisions that led the people of England to lose trust in him. In 1204, King John's army was defeated in Britain and had no choice but to retreat. Many people in England were saying that he was responsible for the murder of his own nephew, they found it very difficult to trust someone with that accusation (Jones Ch. 1). He then institutionalized a church law that no one could get married unless they were approved by the Pope first. The church law also stated that only christened people would go to heaven and the rest would go to hell. A lot of the citizens of England blamed King John for this new declaration. Due to all of these disasters and accusations, the Pope declared that whoever tried to overthrow King John could do so. John thus dug his own grave when he lost another battle to the French at Bouvines. Now, King John was facing a possible rebellion by the country's powerful barons and the catholic church in England. He was pressured into signing the Magna Carta. (Breay and Harrison). Thus, leading to the creation of the monumental document that would change the British government forever. The Pope then placed England under a church law which stated that no christenings or marriages would be legal until the Pope allowed them. The Church law also stated that only christened people would be accepted into Heaven, and children born out of marriage were doomed for Hell ("History"). One very important statement in the Magna Carta is that which concerns individual freedom. Clause 38 of the Magna Carta states "In future no official shall place a man on trial upon his own unsupported statement, without producing credible witnesses to the truth of it" ("Fordham University"). This is the theory of being "innocent until proven guilty" which is very prevalent in societies today. No man shall be arrested or imprisoned except by the judgement of their equals and by the law of the land. To no one will we sell. However, this clause was not as liberal as it sounds. The Charter only applied to free men. The vast majority of people in 1215, were un–free peasants who were ruled over by their landowners. • 30. What Is The Verbiage Of The Magna Carta The original Magna Carta signed by King John under the pressure of the English barons on June 15, 1215, marked an immeasurable change in the law in regards to the power of the sovereign in England. While that first draft was only in use for a short time, the subsequent drafts and additions by medieval and early modern kings and queens influenced law in continental Europe and the Americas. The ideas outlined in the original charter contain not only medieval material but ideas, perhaps not explicitly named, that are still prevalent and fundamental rights that Americans and citizens of the United Kingdom continue to relish today. Ideas such as due process, trial by a jury of peers, and even the origins of habeas corpus are found within the 61 clauses of this 800–year–old document. Clauses 39 and 40 represent those three fundamental, essential rights that cannot and should not be deprived. The Magna Carta and its articulation of due process before the law, trial by a jury of peers, and habeas corpus were meant as a means of infringing on the power of the tyrannical sovereign and it sparked the fight for personal liberties in England and the American Colonies and in doing so has become a staple of Common Law. Studying the verbiage of the Magna Carta is important, but the background and reasons for its creation dictate how its original meaning can be interpreted by a modern scholar. The Battle of Bouvines and the loss of England's landholdings in France was a catalyst for the creation of the Magna Carta, but Henry II and King John had made decisions that had royally angered the barons long before 1214. Throughout John's reign, the barons felt an increase in feudal obligations: they were forced to provide more soldiers, take more subtenants, marry into undesirable alliances, and their feudal courts' power was being usurped by the royal courts and chancery. King John had been excommunicated for not agreeing with Pope Innocent III's candidate for Archbishop of Canterbury, and in doing so excommunicated the subjects of England. Combine all of those issues with losing the duchies held by the Angevin Kings, and quite reasonably, there would be anger. In a society where land is the cornerstone to profit and ... It was vital to the nobleman of England because it was how they eliminated the absolute power of King John. Before King John was in power, his brother King Richard, was in power. King Richard had practically left no money for King John when he became the king because he had used it to fund many expensive wars in the Crusades. King John had to make money quickly, so he got his money by taxing the nobles. The nobles hated this, especially because England kept losing wars, so they essentially were funding wars that England didn't even win. It also didn't help that King John wasn't very popular with the nobles, this was because he lost Normandy to France, which made John look weak. He also kept collecting money from them to fund more wars, that they kept losing. Also, because John tried to take back Normandy and was brutally defeated at the Battle of Bouvines in 1214. In fact, at the time of its enactment, the Magna Carta was known for being "principally a conservative document in which the king confirmed the long–standing rights and privileges of England's nobles" (Backman 366). However, within the document there was "one important innovation–an explicit recognition that the king is not above the law" (Backman 366). In the year 1215 King John, the ruler of England from 1199 to 1216, found himself both unpopular and still reeling from the loss of most of his inherited lands in France in the year 1204 after a failed military campaign. He had spent the decade since in a struggle to recapture said lands and, in an effort to do so, sought out a means of financing his personal war. His solution to his monetary woes was to extensively tax the nobility of England known as the barons. His ultimate failure culminated at the Battle of Bouvines where he was once again defeated by King Phillip II whom had taken his lands from him originally. A failed conquest coupled with the already unpopular excessive taxation of the wealthy led to barons in northern and eastern England to begin an organized resistance to his rule. King John was the third of the Angevin Kings who had employed in their rule the principle of vis et voluntas, or "force and will." This ruling style's base sentiment was that the king was above the law and could make decisions he saw fit regardless of common–held political procedure. In the face of open rebellion, King John held a council in London in January of 1215 in which he had hoped to discuss potential reforms. Pope Innocent III, who reigned from 1198 until his death in 1216, was called upon from both sides in attempts at mediating the dispute.
