SIR,
Under authority and on behalf of Abhinav Co-operative Housing Society, Aundh we invite you to
tender Item Rate Quotations for carrying out the development and construction works of Residential
Bungalow Complex at Aundh, Pune. The work is proposed to commence by 15 June 2018, and is to be
completed in thirteen months by the 15 July, 2019. The project is to be executed with very highly superior
quality of workmanship of construction and finishes. Salient features of the project are enclosed herewith
for your information.
Tender documents with Terms and Conditions, Articles of Agreement, Bill of Quantities and basic
Architectural and Structural Engineering drawings will be available in the office of the Secretary,
Residential Bungalow Complex at Aundh, Pune, from 16th of June, 2018, between 10.00 a.m. and 5.00 p.m.
at non-refundable cash price of Rs. 5,000/- ( Rs. Five Thousand only). You may depute a person to present
this letter and purchase the Tender.
Tenders are to be returned before 5.00 pm. on Monday 25th June, 2018, with your EMD cheque (in
a separate envelope)

3.0 SALIENT FEATURES OF THE TENDER:
3.1 Name & Site of Work: Proposed construction of Residential Bungalow Complex at
Aundh, Pune.
3.2 Scope of Work: Civil and Structural Engineering work, Plumbing and Sanitary
Installation work and adjacent Site Development.
3.3 Time of Completion THIRTEEN Months from the date of Award of Contract (Tentative
Date of Commencement- 15 June 2018, and tentative Date of
Completion -15 July 2010) for both buildings.
3.4 Issue of Tenders From 16 November 2009 onwards -10.00 am to 5.00 pm. From
ACHS, Aundh at Non-Refundable Cash Price of Rs. 5000/- only
3.5 Return of Tenders By or before 5.00 pm. on Monday 25 June, 2018,

1. I /We hereby submit our best offer to execute the works specified in the following memorandum, at
the rates mentioned in the schedule of quantities, as per specifications and instructions mentioned in this
Tender, and carry out the work as per drawings and instructions received in the course of the work from the
Architects, Structural Engineering Consultants and official representative, and complete the same within
the specified time limit in all respects.

5.0 LETTER OF OFFER

With reference to the Tender invited by you for carrying out the construction work of Hostel
and ancillary development works for your Institution, we do hereby offer to perform as Contractors,
and provide, execute, and complete the works in conformity with the drawing, terms of the Tender,
Articles of Agreement, Conditions of Contract, Item Specifications and Bill of Quantities

In the event of any defects attributable to our materials, workmanship, or construction
technology, occurring within twelve months from the date of actual final completion, we agree to

6.0 PRE-TENDER INSTRUCTIONS TO CONTRACTORS
6.1) STUDY OF TENDER DOCUMENTS:
6.1.1) Upon submission of the Tender, it will be presumed that the Contractor has thoroughly studied
the Tender document with all the terms, conditions, specifications, mode of measurements and drawings
and has completely understood the nature, extent and scope of the work and is completely
aware of his liabilities and responsibilities in respect of the contracted work.
6. 12) In the event of any contradictions or inadequate clarity in this Tender document, these should
be brought to the notice of the Architects BEFORE quoting for the project, and got properly clarified. In any
case, at all times, the interpretation and decision of the Architects shall be final and binding upon the
Contractor.
6.2) VISIT TO SITE OF WORK:
The Contractor is expected to visit the site of work and personally see the site conditions
regarding water, labour conditions, leads, lifts, soil conditions and strata and all other factors affecting
the work before submitting the quotation. Leads, lifts and permissibility for disposal of excavated
material shall also be studied and considered in the quotations. No extras or escalation shall be granted
on account of any error of judgment or miscalculation or misunderstanding of scope of the work.
6.3) UNCONDITIONAL QUOTATION:
Submitted Tenders shall NOT be subject to ANY cond it io ns other than those stipulated in the
Tender Document. Quoted rates and amounts shall be deemed to be completely unconditional and any
conditional Tenders are liable to be rejected outright Contractors are requested to abide by this instruction,
in their own interest, for the purpose of enabling comparison between equals with complete parity.
If any observations, assumptions, suggestions or notes are required to be communicated, these may be
separately addressed to the Architects without having any bearing or impact on the item rate quotation in
the sealed Tender, in the process of evaluation.
6.4) SUBMISSION OF TENDERS:
6.4.1) Tenders are to be submitted in a sealed envelope superscripted "QUOTATION FOR
RESIDENTIAL BUNGALOW"
6.4.2) The Earnest Money Deposit Cheque should NOT be enclosed within the sealed envelope
containing the Tender, but should be separately submitted WITH the Tender - in a separate envelope
6.4.4) Tenders should be submitted N O T LATER THAN 5.00 pm. on Monda y 25 June, 2018.
Tenders should REACH the Company not later than the date and time stipulated even if sent by post.
They should be preferably be forwarded by hand or by courier service to the following address:

6.5) PERIOD OF DECISION:
The Tenders shall remain open for submission for a period of 90 days from the date on which they are due
for submission, or any other extended date for their receipt, and during this period no Contractor shall be
allowed to withdraw his tender.
6.6) IMPROPER AND INCOMPLETE TENDERS:
6.6.1) Quotations shall be tendered on an ITEM RATE BASIS in the annexed Schedule of
Item Quantities. Please r e a d t he P R E A M B L E S prior t o the item descriptions and
specifications carefully before quoting the item rates. Specific Brands of materials have been prescribed in
some items, while options of Brand specifications have been listed in Chapter 16 in the Tender.
6.6.2) T he quotations in the Tender shall be written clearly, legibly and shall be free from erasures, over-
writings or conversions of figures. Corrections, where unavoidable, shall be made by crossing out,
initialling and rewriting.
6.7) ATTESTATION OF TENDER DOCUMENTS:
Contractors must return the Tender Document complete with the specifications, schedule of
quantities, and drawings with the item rates, and total amounts in figures and words, and every page
dul¥ signed. Seal and Signature of the Contractor should also be placed below the summary at the end
of the Schedule of Quantities. Any tender not bearing signature of the Contractor on all documents
accompanying the tender is liable to be rejected. In the event of any discrepancy between the quotation
of item rate in words and figures, the LOWER of the two shall be treated as the valid rate quotation and
the quotation amount shall be so modified.
6.8) ESSENTIAL PRE-QUOTATION CONSIDERATIONS:
6.8.1) Item Rates should be all inclusive. The Company will not, after acceptance of contract rates, pay any
extra charges for lead, testing, or any such other reasons. The contractor must be arranged for the transport
of all materials and for further construction, erection, fabrication, installation, testing etc. and include all
such costs in the quotation.
6.8.2) Although specifics items of work have been included in the schedule annexed hereto, the contractor
should note that incidental and allied works arising out of the scheduled items are deemed to be included in
the said items. The Contractor shall take into account while quoting that miscellaneous allied works, such as
cleaning of the site, finishing of edges and corners, repairing of any adjacent work/ area damaged due to the
work in hand, finishing of surface in immediately adjacent work, shall be done without any extra charge or
liability to the company. No Extra shall be payable for any such incidental work which may be or may not
be specifically included in the BOQ.
6.9) ACCEPTANCE OR REJECTION OF TENDERS:
Mr. Prakash Desai (The Secretary) is hereby empowered to accept any tender, and shall have the absolute
indisputable right to reject all or any of the tenders. He is not bound to accept the lowest tender, nor bound
to give any reasons for rejection of any tender or all Tenders. The validity and eligibility of this Tender shall
be ONLY subject to the acceptance of this clause by the Tenderer.

7.0 SPECIAL CONDITIONS OF TENDER
These instructions and special conditions of tender shall supersede and prevail over any corresponding or
contradictory terms and conditions anywhere in this Tender document. Any errors / omissions /
contradictions if any, shall be got clarified or corrected from the Architects / Institute before signing the
Contract Agreement.
7.1) TYPE OF TENDER: This Tender shall be deemed to be an Item Rate Tender.
7.2) PERIOD OF TIME FOR COMPLETION OF THE WORK:
EIGHT MONTHS from the date of award of the Contract, Issue of the Letter of Intent or Work Order,
whichever is EARLIER. (Tentatively from 15th December, 2009)
7.3) AMOUNT OF EARNEST MONEY DEPOSIT (EMD) AND MODE OF PAYMENT
7.3.1) The contractor shall pay as Earnest Money Deposit a sum of Rs. 500,000/- (Rs Five Hundred
Thousand Only) by A/c Payee crossed Cheque drawn on any International, Nationalized or Scheduled
Co-Operative Bank, drawn in favor of " Mr. Prakash Desai, Abhinav Cooperative Housing Society,
Aundh, Pune " A tender submitted without the EMO Cheque will NOT be accepted or considered.
7.3.2) The Earnest money amount Cheque shall be returned to the Contractor without interest, if his
Tender is not accepted. If the tender is accepted, the EMO amount shall be adjusted against the required
Security Deposit.
7.3.3) Please note that the Earnest money cheque shall NOT be sealed within the sealed Tender, but should
be handed over separately outside the sealed Tender document in a separate envelope, along with the sealed
Tender.
7.4) SECURITY DEPOSIT
7.4.1 ) A total of 5.00 % ( Five Percent ) of the total tendered amount shall be held as Security Deposit by
the Institute, up to twelve months after certified final completion of the work. This shall be paid and held as
follows:
7.4.2) The contractor, on being offered the contract, shall deposit with the Institute2.50 % of the tendered
cost towards ONE HALF of the total 5.00 % Security Deposit within SEVEN days from the date of
communication of acceptance of the Tender. This amount shall make up the 2.50 % component of Security
Deposit. The total 5.00 % amount shall be accumulated as Security Deposit, as follows:
7.5) RETENTION PERCENTAGE:
In addition to the above amount of 2.50 % of the tendered cost held by theInstitute outlined under Clause
(7.4.2) above, for the due fulfilment of Contract, the final component of Security Deposit equivalent to 2.50
% of the tendered cost, shall be deducted from each payment made to the contractor against his R.A.
bills. These amounts, equivalent to 2.50 % of the certified amount of every RA.bill, shall be added to the
Security Deposit held as per clause (7.4.2) on the same terms, to make up the total 5.00 % of the Security
Deposit.

7.6) REFUNDS OF SECURITY DEPOSIT:
On the Architect’s Certification of adequately satisfactory virtual completion of the work, total 5%
(Security Deposit 2.5% & Retention 2.5%) shall be retained for a further period called the ‘Defects Liability
Period (DLP) without interest, and shall be refunded only after the expiry of twelve calendar months from
the date of actual final completion, subject to satisfactory repair and rectification of defects, if any, during
the said Defects Liability period. Both these instalments of Security Deposit and Retention Money shall be
refunded only on production of a clearance Certificate from the Architect.
7.7) DEFECTS LIABILITY PERIOD:
This period shall be calculated as 12 (‘TWELVE) calendar months from the date of completion of the
assigned work, as certified by the Architect.
7.8) DATE OF COMMENCEMENT OF WORK:
Unless the letter of the Intent or work order is issued earlier to the Contractor by the Institute, and allowing
one week for mobilization, the work shall commence from the date of intimation of acceptance of tender,
execution of Contract Agreement with the Institute, or issue of the Work Order, whichever is earlier. If the
contractor fails to commence the work as per this Clause, the EMD amount shall be forfeited to the Institute
is NOT bound to serve any Notice in such eventuality. The tentative Date of Commencement is planned for
15th June 2018.
7.9) DATE OF COMPLETION OF TOTAL PROJECT:
15th July 2019 (or further date, If extended by the Institute in writing)
7.10) LIQUIDATED DAMAGES:
7.10.1) In the event of the Tendered work NOT being completed on the scheduled date stipulated in
above Clause 7.9. the Institute shall levy Liquidated Damages on the contractor These Liquidated
Damages shall be levied at the rate of Rs. 100,000/- per day, from the due date of completion OR from
such subsequent date the Institute MAY extend at its complete discretion, only if found genuinely
necessary.
7.10.2) The limit of Liquidated Damages shall be equivalent to 5.00 % (Five Percent) of the Contract value.
If the delay in completion extends beyond this limit, the Institute shall be at liberty to exercise any of the
following options or terminate the Contract on reaching the said limit.
7.10.3) In the event of the construction work NOT being completed by the due date of Completion
stipulated in Clause 7.9 above, it shall be entirely discretionary for the Society to adopt any one of the
following options - as circumstances may demand:
(a) To grant a reasonable extension of time without Liquidated damages, this will be only in exceptional or
extra-ordinary circumstances, if found to be genuinely necessary.
(b) To permit the work to continue WITH a levy of penalty at Rs. 100,000/- per day beyond the scheduled
date of completion, or beyond any extended date of completion, OR

(c) To terminate the contract =, confiscate the entire amount of security deposit and Retention Money and
get the balance work completed from any other Contractor. This option shall, however, be adopted by the
Institute if the levy of Liquidated Damages exceeds 5.00% (FIVE percent) of the contract value due to
continuing delay of work.
7.10.4) Any amount payable as Liquidated Damages in any of the above options, shall be recoverable out of
the Retention Money and Security Deposit held by the Institute, or from any dues payable to Contracto r in
the Running Account bills of work.
7.11) PERIOD OF FINAL MEASUREMENT AND VALUATION:
Maximum of 90 (Ninety days) from the date of presentation of the Final Bill to work to the Institute for
payment, subject to receipt of all documents, test reports and certificates, reconciliation statements and
compliance of undertakings, if any from the contractor.
7.12) VALUE OF WORK FOR INTERIM CERTIFICATE:
The value of Running Account Bills of work for any Interim Certificate shall be MINIMUM Rs. 50, 00,000
/- (Rs. FIFTY LACS). The Final Bill of Work, however, shall NOT be smaller or lesser in claim than the
previous pre-final RA Bill. The Contractor is expected to raise maximum ONE RA.Bill per Month,
(preferably on the 1st of every month) during the Contract period in the prescribed manner.
7.13) R. A. BILLS OF WORK AND PERIOD OF HONOURING CERTIFICATES:
7.13.1) RUNNING ACCOUNT BILLS OF WORK : All RA Bills of work shall be submitted to the
Owner in FOUR sets complete with measurements of work duly certified and signed by the Institute
Engineer on site, and with statements of previous and present quantities of items executed. Each RA.Bill
shall be submitted ONLY in the prescribed format included in this Tender.
Scrutiny, Verification andCertification of each R.A. bill of work shall be done by the Architects within
FIFTEEN days from its submission to the Institute, subject to its proper submission. Payment against each
certified R.A.Bill (except for the Final Bill which shall be paid as per Clause 6.11 above) shall be released
within FIFTEEN DAYS from the date of certification of the Architects. No interest, however, shall be
payable if any payment is delayed on account of improper submission, insufficient details, or due to absence
of certification.
7.13.2) AD-HOC PAYMENTS : An advance payment equivalent to 50 % (Fifty Percent) of the net
certifiable amount of each .RA.Bill ( the total of which shall not be less than the minimum amount stipulated
in Clause 7.12 above) shall be released on ad-hoc basis by the Institute within SEVEN days from the
date of submission. The FINAL Bill, however, shall be scrutinized and settled as per Clause 7.11 above,
and NO advance shall be released against the Final Bill. NO adhoc payments shall be released after virtual
completion of the project.
7.13.2) CLAIMS FOR EXTRA ITEMS: Claims for extra or varied items of work, if any, shall be filled
SEPARATELY and shall NOT be included in any R.A.Bill of work.

7.14) WATER AND POWER FOR CONSTRUCTION:
Contractors should take into consideration the following conditions of availability, supply and payments for
water and power in their item rate quotation:
7.14.1) WATER: Contractor should consider in their quotations that the Institute shall provide piped Water
supply at ONE point near the project site, on a chargeable basis. The charges for the supply shall be as per
billing in proportion to the provided quantity. The Institute however does NOT guarantee or commit the
quantity or suitability of water available. The Contractor, however, shall have to make arrangements at his
own cost for the metering of water supply, laying of pipelines, testing the water, storage tanks, pumps or
machinery (including the diesel or power required for its operation to pump and use the provided water from
its source.)
7.14.2) In the event of acute water shortage, OR IF the water supply is inadequate or unsuitable for
construction or any other purpose, the Contractor shall procure water for construction by Tanker supply AT
HIS OWN COST. The Institute will NOT pay any extras or reimburse any expenses on account of such
procurement of Water for construction. Location, availability and yield should be got ascertained before
quoting.
7.14.3) POWER - Power supply for construction and construction machinery, shall also be provided by
the Institute at ONE point on a metered chargeable basis. Contractor shall arrange cost for metering
the power supply from the MSEDCL including making all applications, at his own permissions, Meter
installation, accessories, deposits, charges and expenses incurred in the process. MSEDCL charges for
a separate temporary power connection, if any, shall be borne by the Contractor, and shall NOT be
reimbursed by the Institute.
7.14.4) The Contractor shall bear the official power consumption charges levied by MSEDCL for
construction purpose, as per Meter reading. Metering installation, including cables, poles, and DBs if any
shall also be entirely at the Contractors cost.
7.15) VARIATION IN QUANTITIES OR SPECIFICATIONS:
7.15.1) A schedule of quantities and specifications is Included in the tender document. It shall be clearly and
definitely understood that the Institute does NOT accept any responsibility for the correctness of this
schedule which is liable to alterations by omissions, deductions and/or additions to any extent. Neither the
probable quantities, nor the value of individual items, nor the total value of work will form part of the
Contract. No variation shall be made by the Contractor in the specification of arty item without prior written
permission of the Institute Director.
7.16) EXTRA ITEMS:
7.16.1) If at any time during the course of the work it is found expedient or necessary by the Architect, or by
the Institute, to order material or work of a different description, or to substitute one class of work for
another they shall have the full authority to do so, and the Contractor shall be bound to carry out such extra,
additional, altered or substituted work on the same terms and conditions in all respects on which it was
agreed to do the main work. Rates for such new items, if any, should be submitted with complete rate
analysis by the complete rate analysis by the Contractor prior to execution of such item and written approval
obtained from the Institute / Architects. The basis derivation of Rates for extra items, if any, shall be the
2008-09 District schedules of Rates for Pune district.

7.28.2) The Contractor shall also separately record and periodically circulate minutes of all meetings held on
site. Photographic record of the progress of the work shall also be maintained in digital photographs taken
every week and circulated to the Architects and the Institute along with Minutes of meetings. It is desirable
that a desktop PC and Printer facility be available on the site for use of the Contractor and the
Institute Engineer at all times.
7.28.3) A daily activity register, program schedule / Bar chart and all Architectural and Structural Drawings
issued shall be kept available for reference in the site office at all times. At least one senior and one junior
Engineer shall be available on the work site at all times.
7.28.4) The Contractor shall be responsible for preparation and maintenance of Shop Drawings for all Steel
Fabrication work, as per the basic drawings and instructions issued by the Architects and Structural
Engineering Consultants, and shall get them approved from the Structural Engineering Consultants prior to
execution.
7.28.5) The Contractor shall be similarly required to prepare bar bending schedules and get them approved
from the Structural Consultant prior to execution.
7.28.6) The Contractor is also required to obtain approval from the Structural Fabrication work prior to any
mass production and of al major Reinforcement Steel work prior to concreting.
7.29) SAFETY AND SECURITY MEASURES:
7.29.1) Safety and Security protocols shall be strictly observed by the Contractor in accordance with the
directives in the following Chapter 8.0 on Safety and Security.
7.29.2) The contractor shall take all necessary precautions to ensure the safety and security o f all personnel
and material on the project site, Safety Belts and Helmets shall be provided for all employed labor (casual,
temporary, permanent or sub-contracted) and all visitors in the project site. No worker shll be permitted to
work above 3M from the adjacent floor/ground level without safety belts and helmets.
7.29.3) An automobile in good running condition with a licensed driver shall be kept available on the project
site at all times in the event of any accident or mishap. Emergency medicines and medical equipment shall
also be kept easily available on the site. Children shall not be employed or allowed on the project site.
7.29.4) Particular precautions shall be taken to protect and secure the resident labor, personnel, executed
work, and unused material on the project sites during the nights, and the Contactor shall provide a 24 hours
X 7 days Security on the worksite.
7.29.5) The Contractor shall be fully responsible for the safety and security of all personnel on the project
site. Use or storage of Explosives or carrying out of any controlled blasting within the fatory premises is
categorically PROHIBITED. If such controlled blasting is found to be genuinely necessary, the Contractor
shall apply and procure a formal, official WRITTEN PERMISSION from the Institute and the appropriate
Government Authorities, along with all essential official permissions at his own cost before using any
explosives in the work.

7.30) MISCELLAMIOUS CONDITIONS AND STIPULATIONS:
7.30.1) During the entire course of this Contract, the Institute is, and shall remain, in continuous and
uninterrupted possession of the project site at all times. This Contract period, with temporary and revocable
consent of the Institute, up to the completion of the specific assignment, At NO time shall the Contractor
engage in any activity on the site other than that specified in the Contract agreement. No visitors shall be
permitted on the project site without prior permission or proper authorization.
7.30.2) The Contractor shall take shall take all precautions and care to avoid any inconvenience or agitation
to any of the neighbouring property owners / companies and shall NOT create or promote any disputes or
arguments or any issue with neighbouring owners.
7.30.3) The proposed Residential project site shall be fenced / enclosed with an MS sheet enclosure to
ensure privacy to the existing adjacent residences. Cost of erecting and removing this enclosure shall be
borne by the Contractor, and the same shall be removed and taken away after completion of the project.
7.31) QUALITY STANDARDS:
7.31.1) Highly SUPERIOR Quality of Workmanship, Economy in Time and Cost, cumulative guiding
factors and objectives set for the Contractor. The Contractor shall Precision, Accuracy, and Efficiency of
operations in the assigned work shall be presumed to have taken these factors into consideration while
quoting the item rates by including any anticipated expenses and making provision for contingencies in
order to achieve the set objectives. Particular emphasis, however, is laid on overall QUALITY, with highly
superior finishing quality of workmanship, in the work.
7.31.2) All latest and revised IS Codes and Standards set by the Bureau of Indian Standards and the
provisions of the National Building Code of India shall set the limiting factors of quality and tolerances in
respect of all material, technology and workmanship in the present project.
7.32) ESCALATION:
In view of the minimum one year requirement of validity of the quoted Rates, and in view of the maximum
EIGHT Months specification of time period for completion of the work , NO Escalation of any kind or in
any manner shall be payable on any account.
These instructions and special conditions of Tender shall supersede and prevail over any corresponding or
contradictory terms and conditions any in this Tender document. Any errors / omissions /contradictions shall
be got clarified or corrected from the Architects / Institute before signing the Contract Agreement.
7.33) INCOME TAX DEDUUC7TION:
Income tax will be deducted at source from every bill as per rules and regulation in force.

8.0 SPECIAL CONDITIONS FOR SAFETY & SECURITY
8.1) GENERAL INSTRUCTIONS AND CONDITIONS:
These special conditions for Safety and Security are included as a part of the terms and conditions of
Agreement in the present construction contract to ensure that the Contractor takes utmost care and
dilligence in the welfare of all personnel - labour, supervisors, plant and machinery operators and
visitors - on the project site. These conditions also intend to ensure that the staff, students and
employees of the Institute and the visiting Architects and otherConsultants and their staff are provided
adequate safety and security on the project site during the course of construction, as part of Contractor's
.responsibility.
The contractor shall be temporarily permitted to carry out construction activities on the project
site owned by the Institute, or specific parts thereof, only by authorization under the Contract
Agreement. No person shall be allowed to enter any area in the Institute premises which has not
been authorised for use by the Contractor or his workmen. Entry to the existing factory premises
shall be with access permits as per rules.

The work is proposed to commence by 15 June 2018, and is to be completed in thirteen months by the 15 July, 2019. ACHS-RP Signature of the Contractor Page No. 3.0 SALIENT FEATURES OF THE TENDER: 3.1 Name & Site of Work: Proposed construction of Residential Bungalow Complex at Aundh, Pune. 3.2 Scope of Work: Civil and Structural Engineering work, Plumbing and Sanitary Installation work and adjacent Site Development. 3.3 Time of Completion THIRTEEN Months from the date of Award of Contract (Tentative Date of Commencement- 15 June 2018, and tentative Date of Completion -15 July 2010) for both buildings. 3.4 Issue of Tenders From 16 November 2009 onwards -10.00 am to 5.00 pm. ACHS-RP Signature of the Contractor Page No. 6.0 PRE-TENDER INSTRUCTIONS TO CONTRACTORS 6.1) STUDY OF TENDER DOCUMENTS: 6.1.1) Upon submission of the Tender, it will be presumed that the Contractor has thoroughly studied the Tender document with all the terms, conditions, specifications, mode of measurements and drawings and has completely understood the nature, extent and scope of the work and is completely aware of his liabilities and responsibilities in respect of the contracted work. 6. 12) In the event of any contradictions or inadequate clarity in this Tender document, these should be brought to the notice of the Architects BEFORE quoting for the project, and got properly clarified. In any case, at all times, the interpretation and decision of the Architects shall be final and binding upon the Contractor. 6.2) VISIT TO SITE OF WORK: The Contractor is expected to visit the site of work and personally see the site conditions regarding water, labour conditions, leads, lifts, soil conditions and strata and all other factors affecting the work before submitting the quotation. Leads, lifts and permissibility for disposal of excavated material shall also be studied and considered in the quotations. No extras or escalation shall be granted on account of any error of judgment or miscalculation or misunderstanding of scope of the work. 6.3) UNCONDITIONAL QUOTATION: Submitted Tenders shall NOT be subject to ANY cond it io ns other than those stipulated in the Tender Document. Quoted rates and amounts shall be deemed to be completely unconditional and any conditional Tenders are liable to be rejected outright Contractors are requested to abide by this instruction, in their own interest, for the purpose of enabling comparison between equals with complete parity. If any observations, assumptions, suggestions or notes are required to be communicated, these may be separately addressed to the Architects without having any bearing or impact on the item rate quotation in the sealed Tender, in the process of evaluation. 6.4) SUBMISSION OF TENDERS: 6.4.1) Tenders are to be submitted in a sealed envelope superscripted "QUOTATION FOR RESIDENTIAL BUNGALOW" 6.4.2) The Earnest Money Deposit Cheque should NOT be enclosed within the sealed envelope containing the Tender, but should be separately submitted WITH the Tender - in a separate envelope 6.4.4) Tenders should be submitted N O T LATER THAN 5.00 pm. on Monda y 25 June, 2018. Tenders should REACH the Company not later than the date and time stipulated even if sent by post. They should be preferably be forwarded by hand or by courier service to the following address: To, The Secretary, Abhinav Coop. Hsg. Society, Aundh, Pune.

ACHS-RP Signature of the Contractor Page No. 6.5) PERIOD OF DECISION: The Tenders shall remain open for submission for a period of 90 days from the date on which they are due for submission, or any other extended date for their receipt, and during this period no Contractor shall be allowed to withdraw his tender. 6.6) IMPROPER AND INCOMPLETE TENDERS: 6.6.1) Quotations shall be tendered on an ITEM RATE BASIS in the annexed Schedule of Item Quantities. Please r e a d t he P R E A M B L E S prior t o the item descriptions and specifications carefully before quoting the item rates. Specific Brands of materials have been prescribed in some items, while options of Brand specifications have been listed in Chapter 16 in the Tender. 6.6.2) T he quotations in the Tender shall be written clearly, legibly and shall be free from erasures, over- writings or conversions of figures. Corrections, where unavoidable, shall be made by crossing out, initialling and rewriting. 6.7) ATTESTATION OF TENDER DOCUMENTS: Contractors must return the Tender Document complete with the specifications, schedule of quantities, and drawings with the item rates, and total amounts in figures and words, and every page dul¥ signed. Seal and Signature of the Contractor should also be placed below the summary at the end of the Schedule of Quantities. Any tender not bearing signature of the Contractor on all documents accompanying the tender is liable to be rejected. In the event of any discrepancy between the quotation of item rate in words and figures, the LOWER of the two shall be treated as the valid rate quotation and the quotation amount shall be so modified. 6.8) ESSENTIAL PRE-QUOTATION CONSIDERATIONS: 6.8.1) Item Rates should be all inclusive. The Company will not, after acceptance of contract rates, pay any extra charges for lead, testing, or any such other reasons. The contractor must be arranged for the transport of all materials and for further construction, erection, fabrication, installation, testing etc. and include all such costs in the quotation. 6.8.2) Although specifics items of work have been included in the schedule annexed hereto, the contractor should note that incidental and allied works arising out of the scheduled items are deemed to be included in the said items. The Contractor shall take into account while quoting that miscellaneous allied works, such as cleaning of the site, finishing of edges and corners, repairing of any adjacent work/ area damaged due to the work in hand, finishing of surface in immediately adjacent work, shall be done without any extra charge or liability to the company. No Extra shall be payable for any such incidental work which may be or may not be specifically included in the BOQ. 6.9) ACCEPTANCE OR REJECTION OF TENDERS: Mr. Prakash Desai (The Secretary) is hereby empowered to accept any tender, and shall have the absolute indisputable right to reject all or any of the tenders. He is not bound to accept the lowest tender, nor bound to give any reasons for rejection of any tender or all Tenders. The validity and eligibility of this Tender shall be ONLY subject to the acceptance of this clause by the Tenderer.

ACHS-RP Signature of the Contractor Page No. 7.0 SPECIAL CONDITIONS OF TENDER These instructions and special conditions of tender shall supersede and prevail over any corresponding or contradictory terms and conditions anywhere in this Tender document. Any errors / omissions / contradictions if any, shall be got clarified or corrected from the Architects / Institute before signing the Contract Agreement. 7.1) TYPE OF TENDER: This Tender shall be deemed to be an Item Rate Tender. 7.2) PERIOD OF TIME FOR COMPLETION OF THE WORK: EIGHT MONTHS from the date of award of the Contract, Issue of the Letter of Intent or Work Order, whichever is EARLIER. (Tentatively from 15th December, 2009) 7.3) AMOUNT OF EARNEST MONEY DEPOSIT (EMD) AND MODE OF PAYMENT 7.3.1) The contractor shall pay as Earnest Money Deposit a sum of Rs. 500,000/- (Rs Five Hundred Thousand Only) by A/c Payee crossed Cheque drawn on any International, Nationalized or Scheduled Co-Operative Bank, drawn in favor of " Mr. Prakash Desai, Abhinav Cooperative Housing Society, Aundh, Pune " A tender submitted without the EMO Cheque will NOT be accepted or considered. 7.3.2) The Earnest money amount Cheque shall be returned to the Contractor without interest, if his Tender is not accepted. If the tender is accepted, the EMO amount shall be adjusted against the required Security Deposit. 7.3.3) Please note that the Earnest money cheque shall NOT be sealed within the sealed Tender, but should be handed over separately outside the sealed Tender document in a separate envelope, along with the sealed Tender. 7.4) SECURITY DEPOSIT 7.4.1 ) A total of 5.00 % ( Five Percent ) of the total tendered amount shall be held as Security Deposit by the Institute, up to twelve months after certified final completion of the work. This shall be paid and held as follows: 7.4.2) The contractor, on being offered the contract, shall deposit with the Institute2.50 % of the tendered cost towards ONE HALF of the total 5.00 % Security Deposit within SEVEN days from the date of communication of acceptance of the Tender. This amount shall make up the 2.50 % component of Security Deposit. The total 5.00 % amount shall be accumulated as Security Deposit, as follows: 7.5) RETENTION PERCENTAGE: In addition to the above amount of 2.50 % of the tendered cost held by theInstitute outlined under Clause (7.4.2) above, for the due fulfilment of Contract, the final component of Security Deposit equivalent to 2.50 % of the tendered cost, shall be deducted from each payment made to the contractor against his R.A. bills. These amounts, equivalent to 2.50 % of the certified amount of every RA.bill, shall be added to the Security Deposit held as per clause (7.4.2) on the same terms, to make up the total 5.00 % of the Security Deposit.

ACHS-RP Signature of the Contractor Page No. 7.6) REFUNDS OF SECURITY DEPOSIT: On the Architect’s Certification of adequately satisfactory virtual completion of the work, total 5% (Security Deposit 2.5% & Retention 2.5%) shall be retained for a further period called the ‘Defects Liability Period (DLP) without interest, and shall be refunded only after the expiry of twelve calendar months from the date of actual final completion, subject to satisfactory repair and rectification of defects, if any, during the said Defects Liability period. Both these instalments of Security Deposit and Retention Money shall be refunded only on production of a clearance Certificate from the Architect. 7.7) DEFECTS LIABILITY PERIOD: This period shall be calculated as 12 (‘TWELVE) calendar months from the date of completion of the assigned work, as certified by the Architect. 7.8) DATE OF COMMENCEMENT OF WORK: Unless the letter of the Intent or work order is issued earlier to the Contractor by the Institute, and allowing one week for mobilization, the work shall commence from the date of intimation of acceptance of tender, execution of Contract Agreement with the Institute, or issue of the Work Order, whichever is earlier. If the contractor fails to commence the work as per this Clause, the EMD amount shall be forfeited to the Institute is NOT bound to serve any Notice in such eventuality. The tentative Date of Commencement is planned for 15th June 2018. 7.9) DATE OF COMPLETION OF TOTAL PROJECT: 15th July 2019 (or further date, If extended by the Institute in writing) 7.10) LIQUIDATED DAMAGES: 7.10.1) In the event of the Tendered work NOT being completed on the scheduled date stipulated in above Clause 7.9. the Institute shall levy Liquidated Damages on the contractor These Liquidated Damages shall be levied at the rate of Rs. 100,000/- per day, from the due date of completion OR from such subsequent date the Institute MAY extend at its complete discretion, only if found genuinely necessary. 7.10.2) The limit of Liquidated Damages shall be equivalent to 5.00 % (Five Percent) of the Contract value. If the delay in completion extends beyond this limit, the Institute shall be at liberty to exercise any of the following options or terminate the Contract on reaching the said limit. 7.10.3) In the event of the construction work NOT being completed by the due date of Completion stipulated in Clause 7.9 above, it shall be entirely discretionary for the Society to adopt any one of the following options - as circumstances may demand: (a) To grant a reasonable extension of time without Liquidated damages, this will be only in exceptional or extra-ordinary circumstances, if found to be genuinely necessary. (b) To permit the work to continue WITH a levy of penalty at Rs. 100,000/- per day beyond the scheduled date of completion, or beyond any extended date of completion, OR

ACHS-RP Signature of the Contractor Page No. (c) To terminate the contract =, confiscate the entire amount of security deposit and Retention Money and get the balance work completed from any other Contractor. This option shall, however, be adopted by the Institute if the levy of Liquidated Damages exceeds 5.00% (FIVE percent) of the contract value due to continuing delay of work. 7.10.4) Any amount payable as Liquidated Damages in any of the above options, shall be recoverable out of the Retention Money and Security Deposit held by the Institute, or from any dues payable to Contracto r in the Running Account bills of work. 7.11) PERIOD OF FINAL MEASUREMENT AND VALUATION: Maximum of 90 (Ninety days) from the date of presentation of the Final Bill to work to the Institute for payment, subject to receipt of all documents, test reports and certificates, reconciliation statements and compliance of undertakings, if any from the contractor. 7.12) VALUE OF WORK FOR INTERIM CERTIFICATE: The value of Running Account Bills of work for any Interim Certificate shall be MINIMUM Rs. 50, 00,000 /- (Rs. FIFTY LACS). The Final Bill of Work, however, shall NOT be smaller or lesser in claim than the previous pre-final RA Bill. The Contractor is expected to raise maximum ONE RA.Bill per Month, (preferably on the 1st of every month) during the Contract period in the prescribed manner. 7.13) R. A. BILLS OF WORK AND PERIOD OF HONOURING CERTIFICATES: 7.13.1) RUNNING ACCOUNT BILLS OF WORK : All RA Bills of work shall be submitted to the Owner in FOUR sets complete with measurements of work duly certified and signed by the Institute Engineer on site, and with statements of previous and present quantities of items executed. Each RA.Bill shall be submitted ONLY in the prescribed format included in this Tender. Scrutiny, Verification andCertification of each R.A. bill of work shall be done by the Architects within FIFTEEN days from its submission to the Institute, subject to its proper submission. Payment against each certified R.A.Bill (except for the Final Bill which shall be paid as per Clause 6.11 above) shall be released within FIFTEEN DAYS from the date of certification of the Architects. No interest, however, shall be payable if any payment is delayed on account of improper submission, insufficient details, or due to absence of certification. 7.13.2) AD-HOC PAYMENTS : An advance payment equivalent to 50 % (Fifty Percent) of the net certifiable amount of each .RA.Bill ( the total of which shall not be less than the minimum amount stipulated in Clause 7.12 above) shall be released on ad-hoc basis by the Institute within SEVEN days from the date of submission. The FINAL Bill, however, shall be scrutinized and settled as per Clause 7.11 above, and NO advance shall be released against the Final Bill. NO adhoc payments shall be released after virtual completion of the project. 7.13.2) CLAIMS FOR EXTRA ITEMS: Claims for extra or varied items of work, if any, shall be filled SEPARATELY and shall NOT be included in any R.A.Bill of work.

ACHS-RP Signature of the Contractor Page No. 7.14) WATER AND POWER FOR CONSTRUCTION: Contractors should take into consideration the following conditions of availability, supply and payments for water and power in their item rate quotation: 7.14.1) WATER: Contractor should consider in their quotations that the Institute shall provide piped Water supply at ONE point near the project site, on a chargeable basis. The charges for the supply shall be as per billing in proportion to the provided quantity. The Institute however does NOT guarantee or commit the quantity or suitability of water available. The Contractor, however, shall have to make arrangements at his own cost for the metering of water supply, laying of pipelines, testing the water, storage tanks, pumps or machinery (including the diesel or power required for its operation to pump and use the provided water from its source.) 7.14.2) In the event of acute water shortage, OR IF the water supply is inadequate or unsuitable for construction or any other purpose, the Contractor shall procure water for construction by Tanker supply AT HIS OWN COST. The Institute will NOT pay any extras or reimburse any expenses on account of such procurement of Water for construction. Location, availability and yield should be got ascertained before quoting. 7.14.3) POWER - Power supply for construction and construction machinery, shall also be provided by the Institute at ONE point on a metered chargeable basis. Contractor shall arrange cost for metering the power supply from the MSEDCL including making all applications, at his own permissions, Meter installation, accessories, deposits, charges and expenses incurred in the process. MSEDCL charges for a separate temporary power connection, if any, shall be borne by the Contractor, and shall NOT be reimbursed by the Institute. 7.14.4) The Contractor shall bear the official power consumption charges levied by MSEDCL for construction purpose, as per Meter reading. Metering installation, including cables, poles, and DBs if any shall also be entirely at the Contractors cost. 7.15) VARIATION IN QUANTITIES OR SPECIFICATIONS: 7.15.1) A schedule of quantities and specifications is Included in the tender document. It shall be clearly and definitely understood that the Institute does NOT accept any responsibility for the correctness of this schedule which is liable to alterations by omissions, deductions and/or additions to any extent. Neither the probable quantities, nor the value of individual items, nor the total value of work will form part of the Contract. No variation shall be made by the Contractor in the specification of arty item without prior written permission of the Institute Director. 7.16) EXTRA ITEMS: 7.16.1) If at any time during the course of the work it is found expedient or necessary by the Architect, or by the Institute, to order material or work of a different description, or to substitute one class of work for another they shall have the full authority to do so, and the Contractor shall be bound to carry out such extra, additional, altered or substituted work on the same terms and conditions in all respects on which it was agreed to do the main work. Rates for such new items, if any, should be submitted with complete rate analysis by the complete rate analysis by the Contractor prior to execution of such item and written approval obtained from the Institute / Architects. The basis derivation of Rates for extra items, if any, shall be the 2008-09 District schedules of Rates for Pune district.

  • 20. ACHS-RP Signature of the Contractor Page No. 7.28.2) The Contractor shall also separately record and periodically circulate minutes of all meetings held on site. Photographic record of the progress of the work shall also be maintained in digital photographs taken every week and circulated to the Architects and the Institute along with Minutes of meetings. It is desirable that a desktop PC and Printer facility be available on the site for use of the Contractor and the Institute Engineer at all times. 7.28.3) A daily activity register, program schedule / Bar chart and all Architectural and Structural Drawings issued shall be kept available for reference in the site office at all times. At least one senior and one junior Engineer shall be available on the work site at all times. 7.28.4) The Contractor shall be responsible for preparation and maintenance of Shop Drawings for all Steel Fabrication work, as per the basic drawings and instructions issued by the Architects and Structural Engineering Consultants, and shall get them approved from the Structural Engineering Consultants prior to execution. 7.28.5) The Contractor shall be similarly required to prepare bar bending schedules and get them approved from the Structural Consultant prior to execution. 7.28.6) The Contractor is also required to obtain approval from the Structural Fabrication work prior to any mass production and of al major Reinforcement Steel work prior to concreting. 7.29) SAFETY AND SECURITY MEASURES: 7.29.1) Safety and Security protocols shall be strictly observed by the Contractor in accordance with the directives in the following Chapter 8.0 on Safety and Security. 7.29.2) The contractor shall take all necessary precautions to ensure the safety and security o f all personnel and material on the project site, Safety Belts and Helmets shall be provided for all employed labor (casual, temporary, permanent or sub-contracted) and all visitors in the project site. No worker shll be permitted to work above 3M from the adjacent floor/ground level without safety belts and helmets. 7.29.3) An automobile in good running condition with a licensed driver shall be kept available on the project site at all times in the event of any accident or mishap. Emergency medicines and medical equipment shall also be kept easily available on the site. Children shall not be employed or allowed on the project site. 7.29.4) Particular precautions shall be taken to protect and secure the resident labor, personnel, executed work, and unused material on the project sites during the nights, and the Contactor shall provide a 24 hours X 7 days Security on the worksite. 7.29.5) The Contractor shall be fully responsible for the safety and security of all personnel on the project site. Use or storage of Explosives or carrying out of any controlled blasting within the fatory premises is categorically PROHIBITED. If such controlled blasting is found to be genuinely necessary, the Contractor shall apply and procure a formal, official WRITTEN PERMISSION from the Institute and the appropriate Government Authorities, along with all essential official permissions at his own cost before using any explosives in the work.

ACHS-RP Signature of the Contractor Page No. 7.30) MISCELLAMIOUS CONDITIONS AND STIPULATIONS: 7.30.1) During the entire course of this Contract, the Institute is, and shall remain, in continuous and uninterrupted possession of the project site at all times. This Contract period, with temporary and revocable consent of the Institute, up to the completion of the specific assignment, At NO time shall the Contractor engage in any activity on the site other than that specified in the Contract agreement. No visitors shall be permitted on the project site without prior permission or proper authorization. 7.30.2) The Contractor shall take shall take all precautions and care to avoid any inconvenience or agitation to any of the neighbouring property owners / companies and shall NOT create or promote any disputes or arguments or any issue with neighbouring owners. 7.30.3) The proposed Residential project site shall be fenced / enclosed with an MS sheet enclosure to ensure privacy to the existing adjacent residences. Cost of erecting and removing this enclosure shall be borne by the Contractor, and the same shall be removed and taken away after completion of the project. 7.31) QUALITY STANDARDS: 7.31.1) Highly SUPERIOR Quality of Workmanship, Economy in Time and Cost, cumulative guiding factors and objectives set for the Contractor. The Contractor shall Precision, Accuracy, and Efficiency of operations in the assigned work shall be presumed to have taken these factors into consideration while quoting the item rates by including any anticipated expenses and making provision for contingencies in order to achieve the set objectives. Particular emphasis, however, is laid on overall QUALITY, with highly superior finishing quality of workmanship, in the work. 7.31.2) All latest and revised IS Codes and Standards set by the Bureau of Indian Standards and the provisions of the National Building Code of India shall set the limiting factors of quality and tolerances in respect of all material, technology and workmanship in the present project. 7.32) ESCALATION: In view of the minimum one year requirement of validity of the quoted Rates, and in view of the maximum EIGHT Months specification of time period for completion of the work , NO Escalation of any kind or in any manner shall be payable on any account. These instructions and special conditions of Tender shall supersede and prevail over any corresponding or contradictory terms and conditions any in this Tender document. Any errors / omissions /contradictions shall be got clarified or corrected from the Architects / Institute before signing the Contract Agreement. 7.33) INCOME TAX DEDUUC7TION: Income tax will be deducted at source from every bill as per rules and regulation in force.

ACHS-RP Signature of the Contractor Page No. 8.0 SPECIAL CONDITIONS FOR SAFETY & SECURITY 8.1) GENERAL INSTRUCTIONS AND CONDITIONS: These special conditions for Safety and Security are included as a part of the terms and conditions of Agreement in the present construction contract to ensure that the Contractor takes utmost care and dilligence in the welfare of all personnel - labour, supervisors, plant and machinery operators and visitors - on the project site. These conditions also intend to ensure that the staff, students and employees of the Institute and the visiting Architects and otherConsultants and their staff are provided adequate safety and security on the project site during the course of construction, as part of Contractor's .responsibility. The contractor shall be temporarily permitted to carry out construction activities on the project site owned by the Institute, or specific parts thereof, only by authorization under the Contract Agreement. No person shall be allowed to enter any area in the Institute premises which has not been authorised for use by the Contractor or his workmen. Entry to the existing factory premises shall be with access permits as per rules.
