The Competent Authority has accepted your offered
rates in connection with the subject work. The total cost of
the work at the accepted rates works out to Rs. 3011122.01
(Rupees Thirty Lakh Eleven Thousand One Hundred And
Twenty-Two Rupees And One Paise Only)
You are requested to submit Performance Guarantee in
the form as given in Clause 4.1 of General Instruction of
Tender Documnets equivalent to 10% of the contract value
amounting to Rs. 301112.2 (Rupees Three Lakh One
Thousand One Hundred And Twelve Rupees And Twenty
Paise Only) within 30 days from the date of issue of Letter
of Acceptance, valid up to stipulated date of completion plus
60 days so that contract agreement can be executed.
Performance guarantee at a rate of 10% of the contractual
value shall be deposited by the successful bidder. The
successful bidder shall have to submit a Performance
Guarantee (PG) valuing 10% of the contract value in four

separate parts of 2.5 % each of the contract value, within 30
(thirty) days from the date of issue of Letter of Acceptance
(LOA). Extension of time for submission of PG beyond 30
(thirty) days and upto the date of submission of PG from the
date of issue of LOA may be given by the Authority who is
competent to sign the contract agreement. However, a penal
interest of 15%per annum shall be charged for the delay
beyond 30 (thirty days, i.e. from 31st day after the date of
issue of LOA. In case the contractor fails to submit the
requisite PG after 60 days from the date of issue of LOA, a
notice shall be served to the contractor to deposit the PG
immediately however notexceeding 90 days from the date of
issue of LOA).In case the contractor fails to submit the
requisite PG even after 90 days from the date of issue of
LOA,the contract shall be terminated duly forfeiting EMD
and other dues, if any payable against that contract. The
failed contractor shall be debarred from participating in re-
tender for that work. In case 60th day is a bank holiday or
office closure next working day should be considered as the
last day for submission of the PGs. Decision of Authority
competent to sign the Contract Agreement would be final in
case of any dispute.
The entire work shall be completed within 12 month
from the date of issue of Letter of Acceptance.
Spl Cond.: Though the rate quoted by Shri Subhash Singh is
less than the estimated cost of the tender i.e. (-)25.90% as
per rebate, but it is a labour contract so the payment of
labour should not be paid less than the wages prescribed by
the labour commissioner. Hence, an under taking has to be
given by tenderer within 7 days from issue of LOA that he
will ensure the payment of labour in accordance to provision
mentioned in the list of labour commissioner department.
Cond.-1: The contract shall be govern by the provision of
Service Contract-2018 with uptodate corrections thereto.
Cond.-2: GST service tax whatsoever shall be paid by
contractor.
Cond.-3: Contractor should obtained labour license if the
number of labour to be employed on work is expected to be
20 or more.
Cond.-4: Contractor will supply the required Stamp Papers
for entering in to agreement with the Railways. Until a
formal Agreement is prepared and executed, acceptance of
this tender shall constitute a binding contract between
Railways and the contractor.

Cond.-5: Contractor should abide by and comply with the
provision of the contract labour (Regulation and abolition)
act 1976 with upto date labour rules.
Cond.-6: The agreement and payment of this work will be
done by Principal, RPSF/TC/Gorakhpur.
Note-: Accetpance letter is being issued with vetting of
accounts.
All Other terms and conditions, as stipulated in the
tender documents shall be applicable.
