TASAWWUR ISLAM

Among the most glaring weakness of Muslims being exposed to
contemporary “secular-materialist-liberal” post-modernist era is the
confusion in knowledge and loss of ADAB.
And the topic of ADAB is rarely emphasized today in Muslims’
education, whereas the Western, secular, atheistic, materialistic, profit-
driven motivational model are seen as the norm, etc. the impact upon
human loosing their primordial identity (what as Muslims we understand
as FITwRAH) is indeed critically grave.
Even if Muslims recognize this, their vague understanding of what ADAB
means and entail, need to be corrected.

“ …. it is very much related to the Islamic concept of Education - for
ADAB is recognition and acknowledgement of the Reality, and knowing
of one’s place in the order of things; capable of putting the right thing
in their rightful place, in their rightful manner; rendering just due to
whomsoever has the right, and in our acquisition of rightful things to
be in accordance with the right proportion and under the right
circumstance …. It is very closely related to the Islamic concept of
al-’Adl (the justice)*, the upholding of which leads to TAQWA (the
consciousness of Allah)”

variance over any matter, refer it unto Allah and the
Messenger, if you [truly] believe in Allah and the Last
Day. This is the best [for you], and best in the end.”

ASSIGNMENT

“O you who have attained to faith! Partake of the good things
which We have provided for you as sustenance, and render
thanks unto Allah, if it is [truly] Him that you worship.”
(Qur’an: Baqarah: 2: 172)

 We in Nusantara, as non-Mujtahid, are already taught to (TAQLEED) adhere in
FIQH matters to the Islamic jurisprudential-legal school of SHAFI’-IE Madzhab
and the Fatwas of succeeding scholars, Mufti etc.. Yet, there may be issues
(although few) especially in our contemporary time, which may present to us
different rulings and views (IKHTILAF) from other MADZAAHIB.
 Our exercise here is to learn and understand some of the basis and principle
of jurisprudence used, which should make us be respectful of differences
among the MADZAAHIB , to remove confusion and avert contentious
disputations which may lead to dissension - disunity in the UMMAH.

It is for this reason that Sufyan ibn ‘Uyaynah rhm.a. an
illustrious scholar of Hadith, used to say:
“(Muslim’s) submitting to the Fuqaha (expert opinions),
is safety in (his following) the Deen (religion of Islam)”.

He, Sufyan ibn ‘Uyaynah rhm.a. also used to say:
“The Hadith can lead (ignorant people) astray except
(when explained by) the FUQAHA (jurists)”.

Imam A’mash rhm.Imam A’mash rhm. when meeting withwhen meeting with Imam Abu HanifahImam Abu Hanifah r.a. wasr.a. was
astonished at his response and comment to one Hadith which he justastonished at his response and comment to one Hadith which he just
conveyed toconveyed to Imam Abu HImam Abu Hanifah till he exclaimed:anifah till he exclaimed:
““OO FuqahaFuqaha (jurists)! You are the physicians (doctors )and(jurists)! You are the physicians (doctors )and
we (we (MuhaddithinMuhaddithin – scholars of Hadith) are (only)– scholars of Hadith) are (only)
the dispensers (pharmacists).”the dispensers (pharmacists).”

““That which isThat which is HHALALALAL (lawful; permissible) is clear and that which is(lawful; permissible) is clear and that which is HHARAMARAM
(unlawful; forbidden) is clear, and between the two of them are(unlawful; forbidden) is clear, and between the two of them are MUSMUSHH-TABIHAT-TABIHAT
(doubtful matters) about which many people do not know. .”(doubtful matters) about which many people do not know. .”

““He (Allah) has only forbidden to you dead animals,He (Allah) has only forbidden to you dead animals,
blood, the flesh of swine, and that which has beenblood, the flesh of swine, and that which has been
dedicated to other than Allah. But whoever is forceddedicated to other than Allah. But whoever is forced
[by necessity], neither desiring [it] nor transgressing[by necessity], neither desiring [it] nor transgressing
[its limit], there is no sin upon him. Indeed, Allah is[its limit], there is no sin upon him. Indeed, Allah is
Forgiving and Merciful.”Forgiving and Merciful.”

 He (Allah SWT) has only forbidden you (Qur’an: Baqarah: 2: 173):
1. Carrion, that is, the consumption of it, since this is the subject of the
general address here, and similarly [the consumption of] what follows, [all
of] which is what has not been slaughtered in accordance with
[prescriptions of] the Law; to this the Sunna adds [as also constituting
carrion] what has been severed from a living creature. A special status is,
however, accorded fish and locusts;
2. Blood, poured forth, as in [sūrat] al-An‘ām [see Q. 6:145],
Tafsir al-Jalalayn

“FORBIDDEN to you is carrion, and blood, and the flesh of swine,
and that over which any name other than Allah's has been invoked,
and the animal that has been strangled, or beaten to death, or killed
by a fall, or gored to death, or savaged by a beast of prey, save that
which you [yourselves] may have slaughtered while it was still alive;
and [forbidden to you is] all that has been slaughtered on idolatrous
altars. And [you are forbidden] to seek to learn through divination
what the future may hold in store for you: this is sinful conduct.”
(Qur’an: Maa-idah: 5: 3)

(Narrated by Adi ibn Hatim r.a.) I asked the Prophet(Narrated by Adi ibn Hatim r.a.) I asked the Prophet ‫ﷺ‬‫ﷺ‬
((about the hunting dogsabout the hunting dogs) and he replied, "If you let loose) and he replied, "If you let loose
(with Allah's name) your tamed dog after a game and it(with Allah's name) your tamed dog after a game and it
hunts it, you may eat it, but if the dog eats of (that game)hunts it, you may eat it, but if the dog eats of (that game)
then do not eat it because the dog has hunted it for itself." Ithen do not eat it because the dog has hunted it for itself." I
further said, "Sometimes I send my dog for hunting and findfurther said, "Sometimes I send my dog for hunting and find
another dog with it. He said, "Do not eat the game for youanother dog with it. He said, "Do not eat the game for you
have mentioned Allah's name only on sending your dog andhave mentioned Allah's name only on sending your dog and
not the other dog.“not the other dog.“

The Messenger of AllahThe Messenger of Allah ‫ﷺ‬‫ﷺ‬ said: “said: “Two kinds of dead meat and twoTwo kinds of dead meat and two

From Abu Hurairah, that the ProphetFrom Abu Hurairah, that the Prophet ‫ﷺ‬‫ﷺ‬ (said), concerning the(said), concerning the
water of the sea: "Its water is pure (and Purification) and its 'deadwater of the sea: "Its water is pure (and Purification) and its 'dead
meat' (meat' (MAI-TATUHUMAI-TATUHU) is) is permissiblepermissible (to eat)."(to eat)."

2. The flesh of swine, the meat is singled out for mention because that [part] is
what people mostly seek, every other [part] being implied thereby;
3. What has been hallowed to other than Allah, that is to say, what has been
slaughtered in other than His Name (al-ihlāl is the raising of one’s voice,
which they used to do when sacrificing for their gods).
Tafsir al-Jalalayn

“This day [all] good foods have been made lawful, and the
food of those who were given the Scripture is lawful for you
and your food is lawful for them.”
(Qur’an: Maa-idah: 5: 5)

 Yet whoever is constrained, forced by dire need to eat of the above-
mentioned, not desiring, to rebel against Muslims, nor transgressing,
committing aggression against them by waylaying them, no sin shall be on
him, for eating it.
 Allah is Forgiving, to His friends, Merciful, to those who are obedient to Him,
for He has granted them wide berth in this matter.
 The aggressor and the transgressor are excluded from this [dispensation],
and to these two [categories] one should also add every person that sets out
on a journey in disobedience, such as the fugitive or the excise collector, for
whom it would be unlawful to eat any of the mentioned, unless they repent
[of their disobedience]; this is the opinion of al-Shāfi‘ī.
Tafsir al-Jalalayn

“'Every predator possessing fangs is forbidden to eat."
(Hadith reported by An-Nasa-i)

Ibn ‘Abbas r.a. said : The Messenger of Allah ‫ﷺ‬ prohibited the eating
of every beast of prey with fang, and every bird with a talon."
(Hadith reported by Abu Dawud)
